that separates north and south korea. we're trying to get more information on this. don't really know what happened just yet as we begin a new hour here. i'm bill hemmer, dana has the day off today. >> sandra: i'm sandra smith. the diplomatic crisis is unfolding at this hour as we learn brand-new details. north korea apparently taking an american into custody. the u.n. command says the u.s. soldier entered north korea without authorization and is likely being held in detention by the north korean regime. >> bill: former u.n. ambassador nikki haley has analysis. first rich edson has the story from the north lawn as best as we can tell at the moment anyway, good morning. >> the circumstances as to what this soldier was doing crossing into north korea are unclear. here is what we know from united nations command. they tell us a u.s. national on

a jsa orientation tour crossed without authorization the military demarcation line into the democratic people's republic of korea and we believe he is currently in custody and working with the kpa counterparts to resolve this incident. the jsa is the joint security area straddling the border between the two countries. soldiers from both sides are close to one another here. we were there in 2017 with secretary of state rex tillerson. there are several blue huts there that cross the border, half in north and half in south korea designed to hold discussions between the two countries. tour groups from either north and south korea can occupy the huts. when we were there troops were taking pictures of us. in 2019 then president trump became the first current u.s. president to cross into north korea. other top u.s. officials have looked in north korea in that general area.

trump held meetings with kim and then he stopped engaging with the united states. biden administration said it is ready to resume talks. >> we're prepared to sit down and talk without pre-conditions about their nuclear program and we have made clear to china that it is the united states who is ready for diplomacy and north korea who is not. >> north korea, like other authoritarian regime eagerly takes americans into custody to try to extract concessions from the u.s. it is illegal for americans to travel there right now. >> bill: rich edson from the white house. thank you. for rich, thank you on that. smitty. >> sandra: joining us now former u.n. ambassador and republican candidate nikki haley. we are learning more. not a whole lot of detail on what happened here. a u.s. soldier confirmed detained by north korea. what is your reaction to that? >> you know, unfortunately here

we go again. my heart goes out to the warmbier family. don't forget what happened to him when they detained him. kim is a tyrant, a thug, a murderer and we have to remember that. and i negotiated one of the largest sanctions in a generation against north korea when i was on the security council at the united nations. and what i will say to biden, if you go talk to him, i can tell you what kim will want. he will want sanctions lifted. we cannot do it. you cannot lift sanctions. what has kept kim jong unin line is because we put pressure on him. he needs to know there will be hell to pay if he hurts that soldier. it is troubling and concerning. you can't trust kim or north korea and let china know we're watching you. china is the one that can make a difference in this. we'll see what they do in that process. >> bill: beijing pulls all the cards in that country.

does it affect the race? you have qualified for the first debate. how does this indictment affect his candidacy? >> it will keep on going. the rest of this primary election is going to be in reference to trump about lawsuits, it will be about legal fees, it will be about judges and it is going to continue to be a further and further distraction. that's why i am running is because we need a new generational leader. we can't keep dealing with this drama or dealing with the negativity. we can't keep dealing with all of this. we have china that's literally trying to be at war with us. you have iran building a bomb. north korea detaining a soldier and testing ballistic missiles. we need to focus on the debt and the lack of transparency in schools and crime and the craziness on the border. we can't be sitting there focused on lawsuits over and over again. and so when it comes to the debate, what i'll say is we can't complain about biden not debating rfk if trump is not

going to get on the debate stage and stand next to us. i have never known him to be scared of anything. i certainly don't expect him to be scared of the debate stage. so i think he will have to get on there and have to talk about these lawsuits and how to get past them. >> bill: are you suggesting he is not going to be there? >> he said that. i know he is not scared of the debate stage. i would fully expect him to be there. i think the republicans should expect him to be there. >> bill: here he is with marie in with that question. >> are you participating in the upcoming debate? >> well, you know, it's quite an easy question normally. ronald reagan didn't do it. a lot of other people didn't do it. when you have a big lead you don't do it. you lead people by 50 and 60 points and say why would you be doing a debate. it is not fair. why would you let somebody at 0 or 1 or 2 or 3 be popping you with questions? >> bill: what about that? >> well, you do it because you

want to serve the american people. you don't show that you are serving the american people by being absent. you show that you want to serve the american people by showing up. it is the same issue with biden not debating rfk. if you are going to serve the people you have to show up and tell them why you are the person to do it. i look forward to being on that debate stage and talking about how we will make america strong and proud again and i think he should be on that debate stage. again, i have never known him to be scared of anything. i would be shocked if he was scared of the debate stage. we'll see what happens. >> sandra: one follow up. do you believe it helps or hurts you and the other candidates if he does stay off that stage? >> oh, i welcome him on the debate stage. the american people need to see what their options are. they need to see the full slate of options. i want him on the debate stage and the american people do. keep going to nikki haley.com.

the reason we know this is because the former president received what's called a target letter. a standard letter given by a prosecutor to a potential defendant or rather a target of a probe. it typically comes at the end of a probe when a probe is winding down. we know a grand jury has been meeting in washington, d.c. for months over january 6th. we never officially knew that donald trump was the target of the january 6th probe. however, he says he received this letter from special counsel jack smith's office over the weekend on sunday night. in that letter, bill and sandra, he says that jack smith, who you see on your screen, is giving him four days to appear before a grand jury in washington. monday, tuesday, wednesday, thursday. if something would happen friday, we don't know. if something could happen next week, we don't know. it could be a few weeks down the road. typically when you see this kind of communication from a special

counsel, it warns that something is imminent. you have a chance to come before a grand jury, talk to the grand jury, but clearly this is a development and i may just add and we have to add today in fort pierce, florida, there is a hearing related to the classified documents probe. another probe under special counsel jack smith where attorneys from the government and donald trump's team will meet to discuss how they will handle the classified information because there is so much classified information in that case, it's a separate case from january 6th but it will give us an idea what we are looking at as far as a trial is concerned. donald trump wants the trial to be after the 2024 election. we're told that d.o.j. doesn't want that. >> bill: the wheels of justice can turn slowly or not. republicans would argue this is on the rocket docket all of them. tomorrow afternoon we'll have a hearing and we'll have, i believe, david now, two whistleblowers, gary shapley has

identified himself and a mr. x will be a second witness. who is mr. x? >> we'll find out tomorrow. this is in the hunter biden investigation. mr. x worked on that investigation on a granular level. he helped open the hunter biden tax probe nearly half a decade ago. he sat with congressional staff for several hours last month and told his story. it's in a transcript. we read through it, bill. seeing and hearing him it will have people decide if they believe him. he did not personally see david weiss, the u.s. attorney complain he was not in charge of the probe. that claim is made by gary shapley and he will be there also tomorrow. >> we finally have experts that will testify under oath as to whether or not laws were broken. if so, how many, which laws and we're going to see whether or not the government has stepped in to obstruct a formal

>> sandra: portland police detain a person of interest in the murders of four young women. one of the convicted felons that governor brown released early from prison. dan springer has more on this possible link live from seattle for us, hi, dan. >> this was almost bound to happen with all the convicted criminals that were released early in the state of oregon after 2020. the district attorney's office is taking the lead. nine agencies involved and confirming for the first time the deaths of four women recently are all connected and have identified a person of interest. the bodies of the four victims were all found between february and may of this year. no cause or manner of death has been released but all are suspicious. the victims are 22-year-old kristin smith, 24-year-old charity perry, 31-year-old

bridge it webster and 22-year-old ashley reel. the bodies were found in remote wooded areas around portland and surrounding counties. initially police tried to tamp down speculation of a serial killer saying they had no reason to believe the cases were connected. late yesterday that all changed in making the announcement they said the public is not believed to be in any danger and this is perhaps why. media outlet attention are reporting that 38-year-old gelsy calhoun is the person of interest and he is in custody. the department of corrections tells us calhoun was sentenced in 2019 to 50 months for burglary, assaulting a police officer and car theft. in 2021 his sentence was commuted and back on the streets. two years later on july 3rd at the request of the d.a.'s office clemency was revoked by the current governor. former governor kate brown

granted clemency to 912 non-violent inmate. calhoun was among them even though his criminal history includes assault. she granted the 130 pardons and evented death row making her one of the softest on crime governors as she left office. now it's important to note that jesse calhoun has not been charged with any crimes but the investigation is continuing and they have at least about a year before they have to charge him. he has now had the clemency revoked and in custody without any urgency to file charges. back to you. >> bill: now for something very different. country singer miranda lambert lashing out at fans during her concert in vegas saturday. started singing her hit song and paused and had this to say to the folks in front of her.

justice. i know a lot of conservatives like me frustrated by things like the new york indictment but there is no doubt these things are a distraction to the former president. i would just tell you if i was the prosecutor bringing these charges, he better have some damn good evidence if you go after a former president. we'll see as the process plays out. it is certainly a distraction from us beating joe biden. >> bill: you did an interview last night on another network. i want to ask you about a few of the things that you said. first, what's going on in fulton county? when would you expect the d.a. in your home county to deliver news, whether there is news, from two grand juries that were seated a week ago and another grand jury that was seated months ago? >> really frustrating to me personally that it is taking this long. i think that frustrates a lot of them and makes the question why is that so? i guess it will be sometime in

august, bill. that's what the synopsis was through a letter she sent to the sheriff's office for security of when the indictments come down for whoever is going to be indicted in this case. it has been going on a long time. i know a lot of people are frustrated by that. we'll have to see what the charges are. but also in cases like this when they take so long and they get in the middle of a political season a lot of people feel like the whole system is being targeted and politicized. that is unfortunate and shouldn't be that way in our country. my best guess is sometime first middle part of august. >> bill: do you think it is that way? >> what's that? >> bill: the justice system is being politicized? do you believe that based on what you are saying? >> i think aspects of it are. i know i saw this, you know, in my re-election campaign when this investigation was going on and it was -- i think in some

aspects of it were political then and they are political now. but the bottom line is eventually the people are going to decide this, right? the jury will decide this and the facts will come out. we don't know what these are now. so i would reserve judgment. i just think that the way the process is, is really suspect. >> bill: she said months ago one grand jury had reached a conclusion. and she was going to announce her findings in august. it is time she said late summer, either july or august, which raises the question as to whether or not a d.a. is working on specific timing on a schedule to drop what could be a whopper? do you think that's at play here? >> i guess it could be but i won't really be able to tell that until i see, you know, what charges there are, who they are charging. i think especially in the georgia case there could be multiple people that could end up being charged. i just don't have a good feel for that. i'm not part of the

investigation. i did testify in front of the grand jury, which was an interesting process. but we got to let that play out. regardless, bill, all of this is what the democrats what. it is a distraction from us being focused on joe biden's record and talking about the disaster at the border, disastrous pull-out of afghanistan, how, you know, he talks about building the economy from the middle out and the bottom up and the only thing coming out of the middle right now is cash out of their pockets because of joe biden's 40-year high inflation, high grocery prices, high energy prices, you know, $4 hundred thousand cost, 1,000 more a month. they want to distract from so-called bidenomics. >> bill: you said we got to win talking about republicans in 2024. i think the difference was 9,000 votes between biden and trump in 2020. maybe it was 10,000.

i'm sure you have the number in your head. can donald trump win georgia if he is on the ticket in 2024? >> well, bill, my advice to all candidates, including the former president, is we have to tell people what we're for, why they should vote for us. we need to focus on the future, not concerned with things that happened in the rearview mirror, whether it's the 2020 election or anything else. americans are hurting out there. they want to hear from republican candidates for president on why we should vote for you. they want to know what your solutions are. rebuilding our military, turning this economy around, moving us forward without high interest rates and high energy prices. so i think any candidate, including the former president, can win georgia if they will do that. >> bill: you went through a long list of things that joe biden is doing very poorly. >> correct. >> bill: you are grading him at

constitutional law attorney and fox news contributor joining us now. we are trying to figure out what to make of this. tell us what you do. >> thanks, sandra. this is a step that usually will come towards the end of an investigation when you receive these types of letters it gives your client the opportunity to appear in a grand jury. they are never a welcomed thing to receive. usually a target letter is before you receive an indictment that's not necessarily the case. but it is viewed that way by most criminal defense attorneys. these letters often tell the target that they need to preserve evidence, that they need to look at counsel. that they have a set period of time where they can appear before the grand jury. the concern here is that the special counsel could be proceeding on a case that might be constitutionally challenged. if the case is built around trump's speech on the on the six

this. does smith have something else? something that's a direct link to a conspiracy or effort to cause violence? we haven't seen that. the january 6th committee in congress came up with nothing as a direct nexus to that type of evidence. >> sandra: we're getting word right now that we confirm jack smith's office has said they sent the former president a target letter. that letter, though, that the president -- the former president put out on his truth social page, a statement from donald trump calling jack smith deranged, saying the prosecutor sent a letter sunday night saying i'm a target of the january 6th grand jury investigation giving me four days to report to the grand jury which almost always means an arrest an indictment.

does the former president have a point about the timing of all this in the letter? >> prosecutors don't give a target ample time. they aren't accommodating in that sense. part of the reason is most targets will not go in front of a grand jury or neither will trump. it would be looney to go in front of a grand jury. you are not allowed counsel. i have had clients go into grand jury. for god sake talk to me if there is a question, they rarely do so because they are there in front of 23 people and they want to convince them of something. but most defendants do not go into a grand jury. >> sandra: jonathan, also the reaction that is pouring in, asa hutchinson, for example, put out a statement saying the former president should suspend his presidential campaign in light of receiving a target letter.

any reason why he should? >> there is no legal reason why he should. there might not be a political reason. each of these indictments seems to give him a boost in the polls. this is fulfilling his narrative that there is a weaponization of the criminal justice system. that's why this indictment, if there is one coming, could be so important. with mar-a-lago, those were classic types of charges, a classic built case. this one they have to really stick the landing so that no one will question it or few people will question it. that will require some very direct and strong evidence. we haven't seen that. so if smith doesn't have that type of evidence and he is moving forward largely on the speech, then i think he will fulfill the narrative of donald trump. he will be the federal version of alvin bragg in bringing that indictment. >> sandra: interesting statements. we're left wondering based on everything you've just said does this go anywhere or does it

indicate jack smith does have something else? at some point we'll have to learn that very fast. when will that be, jonathan? >> well, you'll learn that with the indictment but there are lots of leaks coming out. we may be hearing whether there is something else there. smith has a reputation of stretching the criminal code. sometimes too far. this is not an occasion for that. if you are going to indict the former president over january 6th, you are going to need a lot of evidence showing that he was doing more than engaging in a political speech. in my view, what donald trump said in his speech is entirely protected under a case called brandenburg and the first amendment. smith will need a lot more than that speech. >> sandra: appreciate you joining us on that breaking news. what a morning it has been. you never know. >> bill: so all this has been

one individual showed up at the airport yesterday at 3:00 p.m. and still here today and hasn't slept at all. take a listen. >> i got here at 3:00 p.m. yesterday. i was supposed to leave at 6:00 p.m. our flight got delayed until midnight. they put us on a plane at 1:00, kept us there for one hour. after an hour they told us our plane was canceled and they sent us down here for us to get a voucher, to get some kind of answer from these people. but we haven't got anything at all. >> sergio is still here right now and unfortunately far from alone. part of the reasons why we're seeing the lines is because of these delays and cancellations. over the weekend 19,000 delays and over 2,000 canceled flights. unfortunately you see the percentage of flights delayed. that continues to climb from just over 16% in 2021 to nearly 23% of all flights in 2023 so
