and killed because he was at the wrong place at the wrong time, caught in cross fire and the funman was 17 years old. this is an example of how this breaks apart families that will never be the same. where are children getting the guns? >> unfortunately, it is not that hard to get an illegal gun. >> carley: an illegal gun, yeah. >> more and more kids are trying to get them. they report and a survey this past week, kids are more afraid of being killed by each other than going to jail. kids that would not be in criminalality are live nothing fear and it makes it hard to stud and he learn and develop. they need us. >> carley: kids need structure, they lost that, kids shut down, children felt lost and message they were receiving is they are

victims and the system is stacked against you. you should be angry and committing crime thachl is recipe for disaster. how do we fix this? >> they have challenges, math and reading scores are low, they have to contend with social pressure and media. the least we can say, say tenth and 11th graders and ninth graders won't have illegal weapons. we need to not -- to reverse decriminalization of low level offending and bad behavior and say there will be consequences, there need to be consequences, because children need to know there will be repercussions or they will behave badly. >> carley: absolutely, new york city alone, one in 10 gun violence victims is a minor or child. it is not just new york, it is across the country.

messages where hunter biden suggested he was sitting income to his father. >> todd: matt whitaker joins us now. to the layperson, this was eye-opening. you were the top lawyer in our country for a time, what stood out to you? >> yeah, several things, todd. good to be with you and carley this morning. i saw what was outlined consistent with what the two testified in sworn statements thchl is under oath, these people putting themselves out there, their careers on the line. what was done was this case was different than any other case and i was u.s. attorney for five years and did cases of this tenor all the time. hunter biden is getting extraordinary plea deal issue he's not having to testify or to talk to agents or investigators about his case. i've never seen that, with a

favorable plea deal, always a profer is made or debrief to be sure investigators understood the scope of the case. this case is so different and outside of the mainstream of the way the department of justice does cases. it should have been appointed to special counsel. it needs to continue to drill in to the details temperature is just so different than any other case. >> carley: what did you think about how democrats used their time. they didn't talk about the hunter biden case. counter argument was about racism and the irs, donald trump talked about george floyd, breonna taylor, talk about that. >> it guild back and forth between republican and democrat

questions. you just got a sense that the democrats don't understand the gravity of this situation. they don't want to see. one point in time, representative goldman elicitd that joe biden did talk about deals with his son and that is inconsistent with what the white house has been telling us for eternity since the laptop came on the scene. they were trying to score cheap political points and that is disappointing thing we see in house hearings. it just ends up becoming political back and forth and no new ground is plowed. the gravity of the situation together with earnestness of witnesses, the two witnesses are beyond approach, any time someone tried to undermine their position, it came off as cheap political theater. >> carley: a lot of republicans

devastating for the people. >> todd: if you think that is emotional, look at this photo you took your daughter. what is going through your mind when you took this pth? >> my mom took that picture, i wasn't able to pick her up that day. this was the day after. i was just overwhelmed to see her and hug her. i felt guilt and emotion from my shooting. i was thankful to be home. >> todd: you blame defund the police movement for letting this guy off the hook on the serious charges, what do you mean by emotional bias. >> the bill was introduced and became law january 1 of this year and what the language of the bill states, if you have a

bias toward law enforcement, you are allowed to sit on a jury. we had many jurors who expressed bias toward law enforcement and still allowed to decide guilty or not guilty on my suspect. >> todd: do you think police officers can be treated fairly in the justice system so long as defund the police movement is in existence? >> i would like to think so, i would like to think the law enforcement has backing of the justice system. bills like california 3070, make it nearly impossible to have that. >> todd: when the da asked if you could give a victim impact statement, happens in almost every criminal case, the judge said, you were not a victim of any crime. what was going through your mind when that judge said that? >> i was heartbroken.

i spent nearly four years healing from this incidents, to be told, you don't get to speak and have the closure, that was knife in the back. i was hoping for closure, justice and peace and i never saw that. >> todd: let's be clear, you volunteer, granted, you get paid for this be jo, to put yourself in harm's way to encounter situations like that, knowing you could lose your life. you do that to protect your community and your daughter. when a judge -- what are you supposed to think about the system that you are fighting on a day in and day out basis to uphold? do you think the system is letting you down? >> i definitely believe that the justice system and the state of california let me down. nobody wakes up in the morning wanting to go to work to be
