alexis mcadams is live with the latest on these new poles. >> polling shows that former president donald trump is a clear front runner here with the larger share. desantis would be the second choice. trump leading by 30 points in the fbn survey of iowa republicans. rod desantis sits at 60% followed by south carolina senator tim scott. over in south carolina we go where there is a similar story. the commanding lead. republican primary voters say they would back the former president and believe he has what it takes to beat out former president joe biden. far behind is nikki haley followed by desantis. mike penn says he does not focus on these poles and believes voters are ready for change. listen. >> some of them think it's different out there.

these are unusual times when they in administration is potentially launching a third indictment against the sitting president most potent political rival. how do you see it? >> i agree with you. this is a really complicated situation. mostly because it is unprecedented. we have the second indictment if it happens soon. the federal government run by joe biden and the department of justice that is joe biden appointed department of justice will bring charges against his most likely appointment in the general election. quite a bit of concern that the venue will be washington, d.c. the charges, i have not seen the evidence that would support these charges.

evidence to defraud the government, depriving people of constitutional rights. this could be a very complicated trial. someone is prosecuted and tried cases as a prosecutor, a defense lawyer, it boils down to whether the jury instructions. it will be hard to craft that and consider the first amendment rights of the president and what he was doing at the time and two was part of the conspiracy. a lot more questions now than there are actual facts of the case. >> even the former presidents competitors, announced as a gop candidate and mike pence his former throwing a lot of cold water by the justice department. listen to their takes. >> i have been consistent all the vault that i would have made

different judgments and donald trump made. but that judgment is not the same thing as a crime. when we conflict the two that sets a dangerous precedent for this country. i don't want to see us become some banana republic where the republican party uses its police force to arrest its opponents. >> i am not yet convinced that they were criminal. in one town hall after another across new hampshire i heard a deep concern for a perception about the unequal treatment of the law. >> unequal treatment under the law. do you see it that way? most likely one of the main witnesses in this case regarding january 6. we cannot have a two-tiered system of justice, we cannot have it only calls system of justice. political differences cannot be

criminalized because we will just end up being a banana republic ultimately. the previous administration will prosecute the next administration will devolve into anarchy and that is not what our founding fathers intended the system to work. jon: the reason gerald ford parted richard nixon so there would not be ongoing turmoil about a predecessor. >> we will warn throughout our history about partisan actions. a founding father very concerned about that. concerned about this exact issue political power being coveted so much that the statesman and states women are not able to act in the interest of all americans. you are right. this situation i think raises many serious issues. we have outlined many of them. this will really require the american people to step up. jon: what about the timing of

this? just when the irs whistleblowers are coming forward with new and seemingly viable information, the former president is looking at another indictment. does a timing strike you as unusual? >> it does seemed like every time the biden family has some major controversy that the department of justice takes some action that distracts and draws the attention away from those issues and onto, for example, donald trump. i think it would be very hard for the trump team, especially if this new indictment that we expect as early as this week sets a trial sometime in 2024 before the election. prepare for two federal trials and an election campaign seems to be a lot. i know donald trump has a large capacity of taking care of focusing on what is important,

but his team will be stretched pretty then i would expect. jon: current attorney general is saying that he has been hands-off. the investigation has been above board. any criticisms of your successor >> was he to hands-off that others were putting their thumbs on the scale? i look at what the whistleblowers outline. the attorneys in los angeles and watching did d.c. were unwilling to pick up this case. he was denied that status and that allowed essentially the most serious felony charges to expire under the statute of limitations and in that case that is a sweetheart deal. jon: matthew whitaker. we appreciate your time. >> thank you, jon.

jon: returning now to one of our top stories. the major claims made by irs whistleblowers into the investigation into hunter biden. let's bring in tony, david, also former new york state senator.o. we learned a lot of new information this week based on the testimony of those two irs whistleblowers. what is your take? >> this is a real gift to the democrats. for a long time i was saying the focus of the republicans on hunter biden is really a distraction from the rest of the issues that are important to the american people. in this latest hearing we did not find any new evidence against hunter biden or anything that links him to that. i think this is a real waste of time by congress. we have so many pressing issues.

republicans are in charge of the house of representatives and how do we spend our time? probing hunter biden. i think it is a distraction from really important things and it highlights the fact that the leading presidential contender for the republicans is under indictment across the united states. it just puts more pressure on president trump. it is a real move. i think republicans will pay the price come next november. >> this is exactly what happens when you spend too much time in new york. a two tiered justice system is everything the american people oppose. hunter biden getting a sweetheart deal, the idea of money changing hands, millions of dollars and no investigation takes place, a whistleblower that states that the attorney bear delaware was not allowed to bring charges.

hunter biden has been proven guilty on a few of these charges. has pleaded guilty and that is a point. let's move on. justice should be served and no one is above the law. the reason why bring up donald trump is because we have the same situation. this is a problem, it becomes just about partisanship. let's move beyond partisanship. let's make sure justice is followed and no one is above the law but let's not have a two double standard. jon: that is exactly what we want to avoid. you bring up president trump because you are obsessed like far too many members of the political left. you have a guy that if you or i committed the crime or anyone in midwest america would commit that it would be a felony. for mr. biden it is a misdemeanor that is insane. then whether or not he went to the president of the united states and things were set up while joe biden was vice

president. every rational person says this gets an investigation. you can have primetime hearings about january 6 which was a riot not in insurrection but this the biggest scandal in history far outweigh watergate does not get an investigation western mark as law professor at cornell in the line setting up a committee to look into impeachment to actually engage the investigation to figure what happened. attorney general garland clearly cannot be trusted. jon: david, you say this is political, the focus on hunter biden. there are those that say the charges against president trump are exactly the same thing. trying to handicap president biden's chief political rival. >> well, yeah. look, i don't want to get into it tit for tat here. donald trump is under indictment in many jurisdictions for many

different alleged crimes. this obsession with let's make sure that justice is served, but only for the son of a democratic president. i think that that is the double standard. yes, if we are equally obsessed about all of these crimes and follow it through. but the bottom line here is we have major issues in this country. we have people that cannot afford to live in their homes. chasing hunter biden, hearing after hearing with no new evidence is something that the american public overall i think is sick of. what about affordability. what about all of these things. >> tony, last word. >> if you want to be concerned, welcome to the rest of the country. we all know it does not work. we all know that president biden is the driving force of his administration and failing us. then they continue to do things

terminology such as flying or to the air. the air domain underwater. this is really a first principled approach to look at this without all the cultural baggage that there is been in the past. >> i spoke with some experts in this area who say that it could be an earth bound enemy or opponent who has some very sophisticated drones, basically that they are putting up in the atmosphere. is that possible? >> absolutely. we treat this primarily as a domain awareness cap. a matter of national security that we understand what is in our airspace. aviation security that our aircrew no what is in front of them when they are flying around. >> when you are flying in f-18, what did you see? >> we still do not know. what we were seeing were objects

primarily spheres that were traveling anywhere from completely stationary and very high wind to order of mark two, we are seeing these objects on a new daily basis. they would be out there all day. we still do not know their origin, what their intent was. we had to start modifying our training so we would not hit these objects. they were getting pretty close. >> we are watching some of the videos at the department of defense has released. do the videos give you any answers as to what we are looking at here? >> unfortunately, the videos are unclassified low resolution images. most of these images were gathered through the use of sophisticated radar systems that allow the camera systems to get enclosed in order to see. i am a skeptic myself. i would like the general public to see some of this more detailed information so that it can show the different behaviors over time. that is one of the things we are

pushing for. transparency on this topic. we believe that data deserves to be outed to academia so that observers can study this and we can reach conclusions about what these actually are. >> we, apparently, will hear some testimony this week from i believe david who was ready to say he knows of evidence of don human spacecraft being held by the department of defense. are you willing to go that far or are you just looking for an explanation to the things you've seen? >> my personal experience are very pragmatic. they are dealing with this in the context of their professional aviation experience david's experience is different. he was tasked as a member of the task force that ultimately arose because of the greater reporting from pilots. during his investigations he came across various materials and evidence. i have heard him say publicly

shoplifting incidents. jonathan is live in atlanta with details. >> it occurred in a small town just outside of savannah in south georgia. police say three people walked into the store loaded up shopping carts with about $2100 worth of merchandise and attempted to leave without paying. a store employee grabbed one of those shopping carts and that is when the suspect allegedly struck the employee three times in the face. that employee 68-year-old donna suffered a black eye and lost her job. according to pulleys lowe's stated that her actions grabbing the cart was a violation of their policy and she was terminated as a result. donna has worked for lowe's for 13 years. >> i loved my job. loved. i enjoyed working with the people i worked with. i enjoyed helping the customers. i enjoyed everything about it.
