i'm harris faulkner and you are in "the faulkner focus." in just 48 hours at least six people were killed, 27 others shot in areas spread across the city. the youngest victim was just 13 years old. he was shot while riding his bike. crime in the city is up by 38% over last year and there have been more than 1,300 shootings in chicago this year. it's only july. mayor johnson said this in may at his inauguration, watch. >> we don't want our story to be that chicago became so traumatized by violence and despair that our residents felt no other choice but to leave. that would not be our story. not on my watch. >> harris: maybe that's why he is not saying anything. that's their story and it is his watch. garrett tenney in chicago. garrett. >> harris, that 13-year-old boy, the youngest of this weekend's

victims of gun violence shot was light outside friday while riding his bike in a drive-by shooting. he was taken to the hospital and ultimately survived but at least six other people died in the gun violence this weekend including a 16-year-old boy who was shot multiple times in the chest friday, also on the south side. the city's downtown district and northern neighborhoods until the past few years were largely safe are also continuing to be hit by a wave of crime including a string of daylight robberies over the past few weeks with several crews of criminals driving around and picking out their victims at random, taking their wallets and cell phones. then there is this video from saturday night showing a large street fight that reportedly broke out outside a bar in the wrigleyville neighborhood not far from the chicago cubs stadium with security and police trying to get things under control. while murders and shootings are slightly down from last year's near historic highs, crime in

nearly every other category is up. robberies are up 16%. thefts 14. the number of carjackings is more than double what it was at this point a year ago. right now all eyes are on newly elected progressive mayor brandon johnson who promised the make the city safer by addressing the root causes of crime and the impact of his progressive policies will be getting a lot of attention as we get closer to the democratic national convention being held here in chicago in just over a year. harris. >> harris: thank you very much, garrett. this breaking news as we have learned for a third time a key witness under subpoena by house republicans has skipped out on talking under oath. the house oversight committee ramping up its investigation of president biden's son high school and they want devon archer to testified. he worked with hunter at that ukrainian energy firm, burisma, and they want to know what does he know about the foreign

business dealings that allegedly netted the bidens millions of dollars? we won't find out today because archer just canceled a deposition again. the "new york post" casar mucher's testimony includes firsthand accounts of times hunter biden would dial his father, then vice president biden, into meetings with his overseas business partners on speakerphone. remember the president's repeated denials of any knowledge of anything to do with hunter's shady business deals. >> i never discussed a single thing with my son about anything having to do with ukraine. never spoken to my son about his overseas business dealings. >> are there tames you accepted bribes, president biden, is that true? >> president biden: where is the money? i'm joking. that's a bunch of malarkey. >> harris: this all comes on top of the f.b.i. form that we

reported to you on friday. in that document from the f.b.i. known as the fd1023, burisma ceo tells a source he was coerced into making payments to the bidens and also the i.r.s. whistleblowers' testimony claiming the bidens raked in $17 million from foreign business deals. former house speaker newt gingrich with this. >> the evidence keeps mounting up every single week. at some point, the dam is going to break. we may have a criminal family sitting in the white house that took money from foreigners in ukraine, romania, russia, and china. now, that's a pretty sobering comment that has huge national security implications. and basic honesty implications. >> harris: former attorney general matt whitaker is with me.

first go to gillian turner at the house as we continue to get more information. gillian. >> this just breaking right now. house oversight chairman james comer confirms that devon archer backed out of testifying before the committee three times. the former burisma board member and friend of hunter biden. he has been citing scheduling reasons. a couple of days ago last week two i.r.s. whistleblowers testified that they recommended felony charges for hunter biden but that more senior justice department officials intervened and even tipped off the biden transition team about a keyser much. they also claimed never to have seen that now infamous f.b.i. form in which a source says both bidens received $5 million each from burisma ceo for getting ukraine's top prosecutor fired while investigating that company. republicans are calling for an impeachment inquiry. >> we're at the important final

stage of this whole thing, which is who are you going to believe? the two whistleblowers whose testimony has been consistent? or the garland/biden justice department which can't get their stories straight? >> the last time the white house addressed this issue on camera was last week on july 19th. take a listen to what karine jean-pierre said. >> we respect the department of justice as it relates to their conduct in investigations. that's something we say over and over from here and heard from the president specifically on this case let's not forget, this has been led by a trump-appointed u.s. attorney. >> now, harris, comer also tells us this morning he hopes devon archer will testify or be deposed this week. it is make or break time for comer as the house as of friday will go on recess for all of august. back to you. >> harris: so you hit the word that i want to get into and that's hope. you go to war and you have

strategy, you don't just take hope. you need both. you definitely need strategy. gillian turner, thank you. fox news contributor jonathan turley says all of this cannot be ignored. >> the key about that 1023 is that it mirrors perfectly what the house committees have found. it describes how the bidens preferred to use a lab writhe of accounts and banks to hide payments. no payments would go to the big guy. a term we've seen on the laptop. and it was all an effort to conceal these transactions. there is no reason why this would be withheld because of confirmed independent information that they had access to. >> harris: watch the liberal media play defense. >> the reality about the republican investigation into the biden crime family. it sounds like deja vu. the allegations have already been investigated over and over

and over again. >> harris: "focus" now matt whitaker, former acting attorney general under former president trump. great to have you on the mezz. hope won't be enough. you have to have strategy. how do you get this important witness, devon archer, former best friend of hunter biden and worked together on the burisma energy company? how do you get him to come? >> he is under subpoena and he could be prosecuted for that crime. recently especially. and, you know, once you do that, once you play that final card of holding somebody in contempt, then no longer are they a witness. i think this witness in particular has a lot of information he can verify these calls with then vice president biden happened and that's a big deal. >> harris: well, there are purportedly 17 recordings that

f.b.i. document talks about. those would be helpful. >> the 1023 leading up to the 2020 election was being investigated and things in it were being verified and seeing from congressional hearings that this money was flowing through these various entities. the f.b.i. put a halt on the investigation because they said the presidential campaign and biden's candidacy they were in the window to shut that down. >> harris: what is that window? >> i've believed it's 90 days to do investigative acts or indict somebody. >> harris: a judge in trump's case that has been set for may of 2024, that is just a few months out from november of 2024. not to mix apples and oranges but i do bring that up. >> it's a good point. >> harris: is it a moving window, a shade, a screen, what kind of window? >> it's a policy. not written anywhere but it is a

guidance that -- >> harris: nice if they stick to the same thing for each person. i want to get with the devon archer person. you say his testimony is so critical. if you're his attorney you might be told to wait out the evidence to see what republicans put up. >> no doubt about that as we were talking at the beginning. the lawyer in me was you don't want to put your witness on the stand and sworn to a story that they don't know all of the evidence that is available. so clearly they are trying to run out the clock on the one hand but at the same time knowing that a contempt of congress could be in their future, make it seem like they are willing to come in at the right time. >> harris: these aren't prosecutors. this is not a prosecution. it is not run the way you would run it in a courtroom. what else are we missing that they aren't doing? >> well, i think they're methodically doing it. the hard thing about congress investigations is the public part of them are subject to the five-minute rule.

you see these investigations start with a line of questioning and a line of cross examination and then it people yield back time and claiming their time back and it really no points are actually scored. >> harris: that's interesting. well all right. hunter biden's plea deal court date just two days from now. oh, yeah, the judge hasn't just verified that yet. republican presidential candidate chris christie says the investigation's top prosecutor david weiss still owes everybody some answers. >> it doesn't matter whether you are appointed by a republican or democrat. if your work experience to be incompetent and inexplicable you need to explain it so we have confidence in the justice system. i don't care whether mr. weiss is a republican or democrat. he owes if american people an explanation. >> chris and i were use us attorneys together in the bush administration. i agree with his point. this is so far out of the mainstream of what plea agreements typically look like

and this investigation seems like so many leads were not pursued that this u.s. attorney certainly owes the american public and explanation why these normal prosecution investigation wasn't done. >> harris: would the judge look at that and ask about that? could the judge reject this plea deal? i know it's wild, but could it happen? >> certainly. this judge is not going to be able to put aside the previous cases she has worked on. she will not not only her own caseload but nationwide. there is a comparison to make sure that like defendants are treated alike. >> harris: could that reopen things for hunter biden? >> i don't know where it goes because while the judge could reject the plea agreement, if you were the prosecution, the best charges, the felonies, the clock has run on those and you can't dig those back up once the statute of limitations has run. >> i'm sure his attorneys knew

>> harris: fox news alert now. investigators are at the home of a suspected serial killer searching for an 11th straight day. this time at that house of rex heuermann they brought ans ca vator to bring up the backyard, cadaver dogs and ground penetrating equipment. the "new york post" is reporting police found a soundproof room inside heuermann's home where one victim may have been killed. he is charged with killing three women and suspected of a fourth killing. the victims known as the gilgo beach four. their remains were found on gilgo beach in long island in 2010, along with the remains of several other people. we have a crew now on the ground at heuermann's how and bring you updates as we get them. as they begin to make more progress on the 11th day, we'll

bring in our reporter to update everybody. the white house heaping praise on president biden's economic performance. many americans may not see bidenomics the same way the white house does. a new fox business poll finds more than 40% of republican iowa caucus goers say the economy is their top concern. over half of republicans south carolina voters say the economy is their top concern. and it is not just a republican issue. another poll finds biden's approval on the economy is at just 37% with all voters. that poll has his disapproval at nearly 60%. you see it there. 58 on the biden economy. team biden and top democrats keep insisting the economy is strong. >> i think we also have to understand what folks have gone through. what american households have

gone through. this president kept his head down and tried to make sure families and businesses got to the other side of the crises intact and good economic health and that's exactly what happened. >> it has to be messaged. it is a busy job being president. i can say that as being speaker. you are doing your works. he is just going to have to make sure the american people know at that kitchen table what this means to them in terms of jobs and pay. >> harris: imagine how that feels as the president of the united states gets schooled by nancy pelosi on how to do your job. an op-ed with this headline. biden bets on economy, good, republicans bad. re-election message. republican senator, march is that blackburn is a member of the finance and commerce committees and knows what's going on for americans now. spell it out for us what the white house wants to sell versus what people are buying.

>> well, people know what is happening with the economy and with their personal economy, harris. when i talk to people in tennessee they talk about the impact of food prices being up 20%. clothing up 12%. home heating oil and cooling up 36.8% and the tank of gas is up 51%. now, that is the impact of bidenomics. this white house wants to say we aren't in a recession, times are better. people know that inflation continues and especially in the market basket of goods that they're purchasing. >> harris: that's really what counts. find somebody who doesn't eat and in the heat wave that has hit 120 million people across the country doesn't need cooling. and the gas situation is interesting. those prices go up in summertime, transportation people are visiting relatives, so on and so forth. it has been up for a while now.

it starteding up before summer hit. >> right. it has been consistently elevated. as people are getting out and about, especially after cord and wanting to visit relatives, they see that those trips are costing them more. it is not only the fuel, it is hotels, it is food as they are traveling, it is the combination of all of these impacts. so harris, they know that at the end of their money, they have too much months left and dollars aren't going as far as they did under president trump because of what you are seeing with the inflation rate. that inflation is not where it was under president trump. it was at 1.4%. when joe biden took office. and now look at where it is and look at the escalation rate in those costs that are outside of

that core inflation but that affect people every single day. >> harris: you are just saying it. you are putting it out there. i don't know how the white house doesn't understand that you have to meet the reality, senator, you just pointed out and you put it so suck -- so plainly. you are out of cash before the end of the month. let's get to this. the biden administration is now proposing new standards for water heaters to take effect in 2029 saying it would save consumers more than $11 billion and reduce carbon emissions. critics say it is the latest in biden's war on appliances that will only cost consumers more money. is certainly in the short term. if you get a water heater it's because yours doesn't work. nobody does that shopping for fun. >> you are right about that. it has been your washing machine and dishwasher and your

fireplace, your light bulbs, anything that they can go after that is a convenience item that makes life easier at home. they are trying to change the standards on this in order to have people buy more efficient appliances. and harris, people don't want this. you know, it's like with electric power generators and transformers. what w the transformers they are trying to change the rule on that and to make it, what, 2% more efficient in the long run? think of how long it would take you to reap that cost. people are so frustrated with this. they like their washing machine and dishwasher and water heater and don't want to buy a new one because the federal government is forcing them to buy a new water heater. >> harris: what you just said might be another generation before they reap that $11

billion. >> that's right. >> harris: amazing. >> exactly. >> harris: two university professor are urging president biden to defy the u.s. supreme court on a couple of rulings. here is what they wrote. we urge president biden to restrain maga justices immediately by announcing that if and when they issue rulings that are based on gravely-mistaken interpretations of the constitution, the administration will be guided by its own constitutional interpretation. jonathan turley, law professor and fox news contributor here. >> they are arguing that president biden should become a government unto himself. that he should decide what the constitution means, and he should implement changes without the approval of congress in some circumstances. that is the definition of a authoritarianism. >> harris: do you trust the white house and this president to create their own constitution

that the rest of us live by? >> so many people are frustrated. people in tennessee are talking about this one. we abide by the rule of law. we have constitutional justices that are on the supreme court. and they don't do everything that liberals want or that conservatives want. but they are charged with a lifetime appointment and to abide by the rule of law. and these professors, they are so juvenile in their response. they are basically saying if you don't do everything we want, like we want, in the time that we want, then we're just saying you know, just have at it and make up your own rules. that is the type thing that happens as professor turley is saying in authoritarian governments where they tossed the constitution aside in order to get their will.

>> harris: republicans trying to chip away at former president donald trump's persistent lead in the polls. vivek ramaswamy is hosting a fundraiser in iowa today. chris christie has a town hall in new hampshire. new fox business polls show the former president is the clear frontrunner over his gop opponents, particularly in some key primary states. trump has a 30-point lead over ron desantis among likely iowa caucus goers. south carolina trump has a 34-point lead over his closest rival in that state. former south carolina governor nikki haley. she is up by a point over desantis there. former maryland governor larry hogan says he believes trump's legal troubles are overshadowing the race now to the detriment of his rivals. >> it hasn't hurt trump the way most people would imagine it should have hurt trump. but it has impacted the dynamic

of the republican primary race. nobody else can get any traction or attention because all we're talking about is donald trump's legal troubles. so while people haven't left trump as quickly as i would have hoped they can't decide on which of the other 11 candidates they want to support because they aren't getting much oxygen or air time. >> harris: power panel now. david avella and marie harf. great to see you both. david, i will start with you. you heard larry hogan talking about you can't get any oxygen in the room. you are seeing some movement in some of trump's opponents. >> this is why with 29 days until the fox debate it becomes so essential for these candidates to get on that big stage platform and make their case that it is their ideas that are more in tune with what republican voters want than anyone else. meeting voters is perfectly fine right now.

it pales in comparison to being ready for this debate. for donald trump, it gives him the opportunity to show that he understands republican primary voters at a far higher level and to keep that distance he currently has in the field. >> harris: i saw that we just popped up the gop declared candidates. i will ask my team to put up those who have made the debate already because people are really trying mightily in these last few weeks to make sure they are on that stage. kevin walling, a former biden campaign surrogate said last week south carolina senator tim scott is the one to keep an eye on. >> this is a guy who has won in the deep south, has worked with democrats in the past, has a strong record to run on. refocus that compassionate conservatism we saw from george w. bush in the 2000s. he is at 8% in a state like new

hampshire overwhelmingly white. he is doing very well in iowa as well. the fact that his pac has just announced a $40 million investment in early states you'll see the numbers rise. that as a democrat is what i'm most afraid of. >> harris: in the new fox polling tim scott is gaining steam, 11% in iowa. 7% in south carolina not far behind governor ron desantis. marie, what do you think. kevin walling is a surrogate for joe biden this election cycle and watching people closely and says his biggest concern is tim scott. >> well, tim scott is certainly rising in the polls. we have seen that and we know that other second tier republican candidates are started attacking him. people like nikki haley and mike pence. the polling doesn't lie. david is right. people need to get on that debate stage. the question is whether donald trump will show up. he is double digits ahead of his closest opponents right now and

we're probably going to see by most reporting accounts in the next few weeks a third set of criminal indictments come against him. it hasn't shifted the race yet. but i believe there are republican voters who are looking for an alternative to donald trump. the challenge has always been there are too many options. the more other candidates are out there, whether it's mike pence, tim scott, nikki haley, chris christie, they are splitting the anti-trump vote. they split that anti-trump vote the easier for him. >> harris: the easier it will be for democrats and part of the reason even with his lowest of low percentages of approval, joe biden doesn't want rf kennedy jr. coming about or joe manchin giving a wink to the no labels third party. come on, i know you want to see a lot of republicans. it helps your cause, marie. >> david. >> you are spot on. the more candidates that it does

dilute the field on some levels. but it doesn't change the ultimate point, harris. someone has to have a message that republican voters say i want that message more than i want the message that the frontrunner donald trump has right now. if someone can't communicate that message, whether it's 1 or 11. you only need one. ultimately trump is in the position to be our nominee again. >> harris: republican presidential candidate and former v.p. mike pence says he is confident he will meet donor thresholds for the upcoming debate on fox. let's watch. >> i'm very humbled at the support around the country, which is one of the criteria. but having 40,000 individual donors, we're working around the clock. got about a month to go. i'm confident that we will be there. >> harris: here it is. my team got this together. six candidates who have as of yesterday met the polling requirements to appear on the august debate stage. fox news will host that debate

set for august 23, 9:00 p.m. eastern in milwaukee, wisconsin. quick thoughts on this reverse order, david. >> you either make it or you don't. if you don't make this debate you have to decide how viable you can be if voters aren't going to hear your message. >> harris: marie, what will you be watching for for this? you have to start to get your candidate, if you can. i know you can't cell phone or text him but he has to start talking about what people feel, and that's the cost of things. >> look, the bide campaign they outraised trump more than 2 to 1 in the second quarter. no one able to take him on. the biden team feels good starting to see the impacts of their legislative agenda in terms of manufacturing jobs. they feel good about that. the big question in the fox debate whether trump shows up and who makes the stage. a lot of these candidates feel

empowering. what about, you know, the actual math part? hum. senior national correspondent william la jeunesse is in los angeles for us. william. >> harris, the reason you should care is this. as the nation's largest textbook market, when california enacts a new curriculum others the end to follow. in this case math, which actually is encouraging people not to focus on numbers or memorizing tables but social awareness. this this a state where 1-third of the students are proficient in math. it received push back from professor of science and math at the university letter. in a letter they said the reforms are a big mistake. insulting, immoral and foolish to replace math with an endless river of fads that insert equity, social justice and environmental care into math class.

>> so the state declined our request for an interviewing saying, harris, that these reforms will provide new opportunities for those in need of more assistance to catch up and surge ahead. critics say because it's easier doesn't make it better. >> harris: the playing field won't change. it will be tough as ever all over the world wherever those kids want to work and follow their dreams. this is really hard on them. california got it wrong. william la jeunesse gets it right. thank you. a georgia mom was petrified when she got a call for help from her daughter. it turns out criminals were using artificial intelligence to recreate her daughter's voice and make it appear she had been kidnapped. when debbie moore picked up the phone she heard what sounded like her 22-year-old daughter lauren crying for help. a man's voice demanding a $50,000 ransom. debbie and her husband got together and face timed their daughter and then determined on their own she was okay.

they contacted police to report the scam. >> we had someone call my wife on the phone i'm calling from saying they kidnapped her daughter. we got in touch with her daughter and we know that her daughter is okay. we still want to report this because obviously it is quite a horrible scam. >> i understand. somebody called your wife's phone saying her daughter was kidnapped. >> correct. and that she had to pay $50,000 or she would never see her again. >> harris: georgia mom debbie is here. debbie, first of all god bless you, thank goodness lauren is okay. was that you crying in the background on that 911 call? you were wailing. what was going through your mind at that point? >> i'm getting teared up hearing it. by this time we had confirmed my daughter, lauren, was okay. but it took me an hour to calm

down. even when my husband said he had her on his phone that he had made contact, i still just -- it was hard for me to grasp it because i was so sure that these guys had her. >> harris: why were you so sure? what did it sound like when you picked up the call and realized my daughter has been kidnapped? >> when i picked it up, she was crying and she was saying mom, mom and just crying and the reason why i fell for it is because she has called me like that before when she has gotten into a car accident and so i thought she got into one. she has had like a health issue and she has called me a couple of times this year, actually calling me and just initially just crying. and asking me -- >> harris: my teenagers do the same thing. you can be someplace in a store and somebody else's kid can say

mom and cry and don't you look? >> always. >> harris: they have us by the heart these criminals. what made you think to face time her? your decision or your husband's? >> my husband called her while i was on the phone. i was not about to hang up with these people. i didn't want to lose that lifeline to my daughter. but he works inside security and he just called and i even after he said she is safe, she is safe. i said put her on speaker. he put her on speaker to make sure. face time. i need to see her. i was just in a state. i was panicking. >> harris: what did police tell you? >> this is new. it's been out for a few months. what they do is hide behind computer generated numbers so basically impossible to track the number and of course they
