confirming to fox his committee expect's devon archer, hunter biden's former business partner, to appear this week. expected to tell congress he witnessed the president's son dial in then vice president biden on speaker phone at least two dozen times into meetings with his overseas business partners. >> could his testimony make it crystal clear the president was unfaithful -- excuse me, untruthful in repeated denials. jonathan turley to discuss. >> john: count down to the first 2024 presidential debate, less than one month to go until the candidates square off in milwaukee. we are learning which candidates are expected to secure a spot on the big stage. i don't know roberts here in washington, good afternoon to you. >> jacqui: good to be with you, john. jacqui heinrich in for sandra

smith. six candidates have met the polling and fundraising criteria laid out, that includes former president trump, desantis, ramaswamy, tim scott, and chris christie, nikki haley. >> john: mike pence has met the polling criteria but is short of the required donations. complete coverage now, juan williams and mary katherine here to break down the state of the race. >> jacqui: griff jenkins, new fox business polling shows the former president has a strong lead in the early states. do we expect to see trump on the debate stage? >> good afternoon, jacqui and john, and good question, jacqui. i mean, that's the burning question. will the front-runner, who has a commanding lead show up in less than a month, trump has not committed one way or another but one of his rivals is calling him out. >> i think i want trump in the debate and the reason is i think the american people deserve to
10:03 am
know what their options are and it's offensive for a candidate to say they are not going to be on stage. you are basically trying to earn the support of the american people. you can't earn the support of the american people if you are absent. >> fox business latest polling, haley is in second place behind trump, desantis 13%, tim scott 10%. fourth. in the hawk eye state, 46% of iowa gop caucus-goers back trump. scott, 11%, ramaswamy at 6%. pence is in sixth place at 4%. even worse, the former veep, he tops the chart in iowa among those who say they would never vote for him. >> i know that some of the pundits and the pollsters think it's different out there, but i have to tell ya. based on the enthusiasm and the support we are seeing, not only
10:04 am
across new hampshire this week, but iowa, and states around the country, i'm absolutely convinced that we are going to have a new standard bearer in this party. >> as history shows, national polling in june of 2015, jeb bush led 22%, donald trump was at 1%. see if he decides to take our stage on august 23rd. jacqui. >> jacqui: a lot can happen. >> john: bring in the panel, juan and mary catherine, great to see both of you. put it up on the screen so folks can follow along, who is expected to be on the debate stage. expected to qualify in terms of what the polling numbers are and the number of donations. on the bubble, though, mike

pence, asa hutchinson, doug burgum and larry elder, the former vice president i know is working hard to try to get to the threshold of donors. will he make it, will he be on the stage? >> look, i mean, he's been through campaigns before. he's done this many times. he can sort of drum up support but running a campaign that is bizarre in that it is aligned with the trump administration of course because he was the veep. but because of his july 6th -- january 6th stand, which is that the president lost and shouldn't have tried to win by man handling the vote, he's in opposition to many trump voters so it makes it hard for him to pick up support and i think that's what you are seeing. people want to turn the page, those that want to turn the page will not vote for him. and those that love trump will not vote for him. a tricky position at that point. >> john: when you take a look at the polling juan, maybe it's
10:06 am
inaccurate, jeb bush was leading, and donald trump was 1%, and july of 2007, hillary clinton 45%, barack obama at 30%, could we be in a different place six months from now depending can on how this debate and others that will come after it go? >> absolutely. debate is a big deal. let me explain to you from a pollster point of view why we see a difference this time. the key is that none of those candidates in 2007 or in 2015 were the former president of the united states, and that's donald trump who is running in these primaries. so he has a solid base. he is -- he has name i.d., donors all lined up and so what's really taking place here, john, you have a competition for second place, the alternative route to the nomination to
10:07 am
challenge trump. and none of the others who have qualified to get on that stage really are known to voters, they don't have high name i.d., you know, you think about it for a second and you have to say when it comes to town hall meetings, when it comes to interviews, and especially to the debate, this is the moment in which they are going to introduce themselves to the american public, to the republican primary voters in specific and make or break for them in that moment. >> john: yeah, and of course we are all hoping that president trump will show up as well, or former president trump will show up as well to see how he does against the crop of newcomers. there is new information in the hunter biden investigation, put up "the new york post" cover from earlier today, sets the stage here, phone a friend. apparently devon archer, used to be hunter biden's best friend will appear, according to james comer, before congress this week how he saw hunter biden dial in his father in conference calls
10:08 am
with overseas business partners at least a dozen if not more times. how does this change the whole investigation, mary katherine? >> the question is how close does this get to joe biden, and the issue has been up until now, whether it's hunter's laptop, whether it's text message, whether it's investigations that grassley has done in the senate committee about this, people are trying to obscure the hunter investigation by saying hunter is just his son, it doesn't matter. well, it does matter if he's pedalling influence and involving his father. we have millions of dollars from foreign entities, flagged to say these look suspicious, looking into that, and his own text messages, and his laptop, a massive attempt to censor this investigation. voters are worried about other things and a question whether he's treated equally. whistleblowers last week with the irs, many fronts people are

saying hey, is this guy getting the same treatment someone else would get or someone pulling strings to protect the president. i would like the answer to that. >> john: according to the federalist, the fbi told david weiss, the u.s. attorney in the state of delaware, it had corroborated part of form fd-1023, in particular what the controversial human sources quoted about meeting with burisma executives, according to this article that human source did meet with the burisma executives. could -- this is only a single source, we should point out, but could this begin to change david weiss and the rest of the country is seeing that form fd-1023, which democrats have done their best to describe it? >> well, i think it's more than democrats. you know, even republicans say it's unsubstantiated. we just don't know, and this is
10:10 am
coming -- based on what was a blind source, the fbi said they did not want that document released because of sourcing, but it's one source, it's not substantiated, and i think mary katherine is on to it, this is a people who don't like biden who are trying to undermine biden and want it to go forward. but it's the lack of substance. it's like conspiracy, is someone saying nepotism is a crime, no. how many presidents back to trump, you know, his children benefitted from the fact that he was a famous man and he was president of the united states. it's just not a crime. >> not a crime -- we chased russian ghosts four years and there is information here and i would like to have it substantiated as much as possible and we have the opportunity to do that by asking more questions and not stopping the questions. >> john: devon archer does appear before congress, maybe we will learn more about all of this. as always, thank you for kicking it off this monday.

jacqui. >> jacqui: biden administration is targeting hot water heaters as part of the green energy agenda. rolling out a proposal, new efficiency standards for hot water heaters. critics argue the plan will backfire by making appliances more expensive. lydia is live in the new york city studio. lydia, how soon could the new standards become a reality? >> jacqui, if the new standards are finalized, they would take effect in 2029. the biden administration also claims in addition to the cost savings long-term, that the proposed standards for hot water heaters will cut more than 500 million metric tons of emissions over 30 years. proposed mandate would require most electric water heaters use heat pump technology and gas powered heaters use condensing technology. but industry sources say the energy efficient hot water heaters are already available on the market and they are more expensive to buy and install. in fact, a search for the

products shows an energy efficient water heater can cost as much as two times more than a standard water heater. and if these rules are finalized, they could force some currently available cheaper energy efficient gas water heaters off the market which will limit consumer choice. i talked with the president of a company making gas water heaters right here in america. watch this. >> we have 450,000 consumers today that buy noncondensing tankless water heaters that come five years won't be able to buy that product anymore, and either have to go down to a less efficient tank or spend more to get to condensing tankless water heater. >> this is the latest appliance to be the target of regulatory mandates. other potential rules at gas stoves, washing machines, air conditioners, refrigerators. 2027 for dishwashers and washing

10:19 am
the home. nancy grace, crime stories on fox nation and all things like this, nancy, the information got out, a secret room, turns out to be a vault, what does it tell you the police are looking for in terms of how this room was used? >> the police are referring to it as a misinterpretation like cross wires. according to a colleague of rex heuermann's, he had a room specifically built in his basement that was cement, reinforced, cement poured in around it. that even his wife was not allowed to enter. whether it's called a vault or a soundproof room, in my mind, irrelevant. what is relevant is what, if any, evidence is found in that locked room. i understand that the back porch, the deck as many are calling it is being torn apart, tile by tile, and very
