first state in the country to end cash bail a sheriff joins us on how that will affect law and order but we began with big news on the hunter biden investigation. on the eve of a court appearance regarding his plea deal a lawyer for the presidents son is facing possible sanctions after a judge in the case claims the lawyer misrepresented herself to get documents removed from the public docket. good evening kevin. >> we could be looking at a disbarment. for right now i can tell you this the district judge in question has threatened to sanction hunter biden's lawyers tonight after a member of his legal team misrepresented her identity to court officials to

properly get documents removed from the public docket it's an extraordinary charge and it's one of those things you almost never hear. this is happening on a night that also showed the gop chairman submit materials to the very same judge flagging recent claims from an irs whistleblower that the probe into hunter biden is tainted by interference. jason smith a missouri republican wants the judge to consider these allegations while she presides over his plea deal and hearing wednesday morning in delaware. the defendant appears to have benefited from political interference which calls into question the propriety of the investigation of the us attorney's office he added this, it's critical that the court consider the whistleblower materials before

determining whether or not to accept the plea agreement. more on that just a moment in the meantime critics are accusing an obama appointed federal judge of potentially opening the floodgates of a massive wave of illegal migrants looking to gain the system by using asylum claims in the us. ? agreeing to block the biden administration result ? revised policy for asylum-seekers on the mexican border it require the use of a custom border protection app to make an appointment to enter the country illegally and it had another rule that demanded asylum-seekers apply for protection and other countries that they travel through before seeking refuge in the usa. now both policies have been championed as the main reason

i know you want to talk about ufos but i want to get to the breaking news on the hunter biden investigation. the sanctioning of this lawyer, not necessarily connected in any way to the business dealings etc. that we are talking about with president biden, his possible involvement but it just adds to this growing feeling of some sort of cover-up in your view. >> it does. it begs the question why? why would hunter biden's attorneys lie to the court? the allegation from a judge who is about to rule. that's a pretty serious charge demanding questions that need to be turned into night. i can't wait to see what they came up with. there doesn't seem to be any reasonable excuse as to why they do this and to get under and put eber under the judge's saddle right before they're going to make some rulings is critical. i think what chairman smith on that letter went to the judge is important if you don't understand the whistleblower allegations i don't know how the judge can allow this deal

to continue. >> anton immigration a setback for the biden administration today from a judge ruling the new asylum policy cannot be enforced.they have two weeks to appeal that i want you to listen quickly to jean-pierre at the white house and her take. >> the border enforcement plan works, we have seen that plan working unlawful border crossing has come down to the lowest we have seen in the past two years and so again nothing has changed. >> this is the same judge as i understand ruled against some of president trump's immigration policies. is this judicial overreach?if it's president biden or president trump the target of this judge >> i don't think is judicial overreach i think is the administration making up the

rules. the law is crystal clear regarding credible fear as it relates to amnesty. you can't continue to make up new rules along the way and that's what the judge is saying. it's fascinating to see how they rule on this but as they change what is called credible fear and who can apply for asylum and how, that's the problem and she said the lowest level in two years. joe biden has been the president for more than two years for that's the problem. he created a open border and attracted people here that's why we are seeing record numbers. >> and coming down a considerable percentage from a record number means you're getting a considerable number crossing that border. let's get to ufos because i know you are fascinated by the subject . what you expect we are going to hear tomorrow and i guess the bigger question is, you know the truth.are there aliens out there?

>> expect the unexpected if you talk about bigfoot or ufos, you've got my attention. these witnesses have been, have gone through some pretty thorough background checks with the committee.i fascinated to hear what they say i don't think you're going to have anybody who says i have first-hand knowledge i have seen this but they are going to open up and put more pressure on the administration to be more transparent. donald trump is pretty transparent but that not has not been followed through the allegations they're going to create. i don't know but to say there is an actual craft from another world. that's a pretty, that's out of this world. that something you see on the news stands and just laugh at when you're buying your groceries but we are going to find out tomorrow if they've got something real. >> i believe if they do know that we the american people have a right to know.

bail but more important than that they call this the safety act should be called the dangerous act because this is a recipe for chaos. people who commit crimes are not going to have to post bail. what happens? they are on the street the next day committing another crime and this is also important the morale police officers can you imagine the sheriff and other officers out there they arrest somebody in the next time they look somebody in the face and they are going to create that same crime the next day. >> is that your experience that this strikes a blow to the morale of your deputies? >> absolutely. this is my 32nd year in the criminal justice system. i worked investigations and i washed a revolving door type programs where it was cash and beliefs and very little accountability and consequences and each time that you see a revolving door program it does demoralize the officers putting it on the line every day. >> have we seen any evidence anywhere and i know we have had

a zero bail system here in la. have we seen evidence that it reduces crime? >> absolutely not. we have had this in la. i don't mean to scare the folks in illinois that we live in dangerous times. think about this. what if somebody commits a crime has a mental health issue or a drug issue they go in they are back on the street again and they have received no treatment. we are just propagating criminals and really what we are doing, we are using human beings as guinea pigs to promote these radicals and we should not be using people to promote these policies that do not secure safety. >> what kind of conversations have you had directly with those who supported and voted for zero bail?

>> in the conversations i have had i have kept it simple and to the point and those who would claim that the system is racist or discriminatory against the poor that that is an argument without evidence or fact if you have a poor person or a wealthy person that has a choice in front of them to commit a crime there is a consequence of committing that crime. so the poor person knows he will have to post cash bond if he is caught a wealthy person will know he has to post cash bond if he is caught so before they commit the crime they have the choice and if they choose to commit the crime it doesn't make a difference with their socioeconomic statuses are what their skin color is they chose to commit that crime and there's consequences for it and this is taking away consequence making the system weaker.

yesterday while practicing he suffered a cardiac arrest medical staff was able to treat him and taken to the hospital. he is in stable condition. we asked for respect and privacy for the family and we will update the media when there is more information. they have also think the usc star and hospital staff for the work they did to help him. so you have an 18-year-old super fit collapses on a basketball court goes into cardiac arrest. how does that happen? >> it's a good question and a lot of people are wondering this given who his father is in his own prospects to make the mba himself the problem is this is something that happens on a regular basis we have had more attention on it because of the vaccine induced cases and otherwise young healthy men but we have to exercise caution.

young men who have been playing basketball who have been at the peak of fitness regularly have suffered cardiac arrest. a basketball player here in la many years ago died during a game on the court you had another player a freshman just exactly a year ago who had cardiac arrest under similar circumstances and there's no way to know what's happening. the family asked for privacy and respect and i understand that he's not a public figure he doesn't owe us an explanation if he is willing to say something fine i'm sure at this point they ruled out things if they aren't there but if he does have it this is probably his first time knowing it. >> these young men and women can have these kinds of conditions they can have an issue with their heart and you don't realize it until you push

your heart all the way and that's happens to young athletes. >> hyper myopathy which is sudden cardiac arrest and otherwise healthy people who are playing extremely physical sports when their heart rate goes up these are people whose enlarged hearts are they are due to a genetic problem not from anything they acquired during their lifetime and normally their heart is doing fine it's only when you push it to its absolute limit that you notice something that something goes wrong and in this case it may be happening but we are just speculating. but time will tell. >> we know he has talked extensively about really wanting one thing and that would be to play in the mba with his son which would be an extraordinary thing. does this rule that out or can he recover from something like this and go onto an nba career? >> jamar hamlin who had this
