they call it as joe biden's legal team, rather hunter biden's legal team is accused of misleading the court clerk's office and the judge is steamed. >> lawrence: my my my. lucas thomas son is live in washington with the latest. what can you tell us? >> good morning. lawrence, if those irs whistleblowers had their way hunter biden would be facing felony tax charges. expected to plead guilty in the gun charge as well. the judge presiding over the criminal case threatened biden's legal team with sanctions over allegations hunter's attorney lied to the clerk's office. hunter's counsel is accused of avoiding procedure to aggravatedly get information from irs whistleblowers removed. the judge said, quote: it appears that the caller misrepresented her identity and who she worked for in an attempt to properly convince the clerk's office to remove the amicus materials from the docket thereby it is ordered on or before 9:00 a.m. today counsel

for defendant shall show cause as to why sanctions should not be considered for misrepresentations to the court. now, a larry from hunter's legal team accused of misrepresenting who she was when asking to remove those materials. she allegedly called to ask the clerk to seal the information instead of making a formal motion to the court. the matter under consideration appears to stem from unfortunate and unintentional miscommunication between a staff member at our firm and employees of the court. we have no idea how the misunderstanding occurred our understanding was there was no misrepresentation. the house ways and means smith filed a brief of his own asking the judge to throw out the sweetheart deal saying the defendant appears to have benefited from political interference which calls into question the propriety of the investigation of the u.s. attorney's office this. in the interest of full transparency and fairness for all citizens, it's critical for the court to have this relevant information when evaluating the plea agreement. here is former congressman jason

comeback. this is shocking on two levels. you got lebron james, who has some of the best doctors in the world. he has his team doctors and then he has his own set of doctors that manage him. i assume with his son being a top playing college athlete that they manage his son as well. so why is all of this happening? >> i think it's a great point. what's going on. cardiac arrest is essentially when the heart has an electrical malfunction that causes cardiac stand still. lack of blood flow to the body. so that none of the vital organs are getting profusion, getting blood supply. obviously associated with extremely high risk of mortality, brain damage and possibilities of cardiac damage in the future. the etiology of cardiac arrest in an older person is usually from heart attack. in a young athlete, usually something genetic underlying, something electrically or

structurally incorrect with the heart that's undiagnosed. >> steve: unless it's the case of damar hamlin who was hit in the chest. he tweeted this out: prayers to bronny and the james family as well here for you guys. just like you have been for me for my entire process. earliy for me to read. one thing that i was wondering about yesterday. we have been doing stories the last month about how hot it has been out wet and throughout the western half of the united states, could the heat -- i know this was an indoor air conditioned situation. but, if you are exposed to during an extended period to te hot weather, can that impacts you? looking at heat and increased risk of heart attack. i think that's a separate situation we had with bronny james because that's really heart attack. most likely his cause of cardiac

there together. they played on the same team at one point. >> lawrence: last year until he moved to college. >> ainsley: doctor can they all be tested if we have children that play basketball or football can we test them to see if they're prone for this? >> certainly i think it raise as good point and in the national spotlight now that we have seen several cardiac arrests this occurred in ncaa collegial athletes the question is should there be some sort of prescreening not just history and physical examination but also an electrocardiogram. something like an electrocardiogram could show underlying electrical or structural issues that may be -- that some of these athletes may have and, perhaps, it's something that we can pick up in some young athletes and prevent cardiac arrest in the future. >> steve: real quick, full recovery. >> i think full recovery and then the question is what is the underlying etiology and if it's something that is lower risk, you know, shared decision-making to decide if it's appropriate to send him back to sports.

fishy. >> yes, steve, i don't think anyone out there will be at all surprised that there has been some last-minute shenanigans in these case. high stakes for hunter biden and his father joe biden there has been a lot of shenanigans going in to minimizing any penalty for many years of tax let's call them irregularities. alleged tax evasion and now it's going to come to a head this morning but last night the judge was so disturbed by what she had been told by her clerk had been done by hunter biden's lawyers that she threatened his lawyers that they might be sanctioned unless they came up with a good explanation. >> steve: right. >> they did come up with an explanation. they said it was just, as you said, a misunderstanding, unfortunate unintentional between one of their lawyers and

the clerk who -- their lawyers did not misrepresent herself as being coming from the g.o.p. lawyers. so, the judge will have to sort out who is telling the truth and really was a misunderstanding and maybe, maybe this would have effect her rubber stamping that plea deal but it's a lot of pressure. it's delaware. it's j home state i wouldn't be holding my breath. >> steve: sure. at the 11th hour as well yesterday, a chairman, republican, jason smith of the house ways and means committee submitted an amicus brief to the judge and said, hey: before you have go ahead and rubber stamp, this take a look at what these whistleblowers said. i understand that's some of the stuff that this call tried to seal so that the public couldn't see it and apparently the caller said yeah, there is tax stuff. there is social security stuff and there is grand jury stuff. and that would seal it; however,

it's all fishy and thankfully they are going to work it all out. miranda, ultimately, though, this particular judge who was appointed by donald trump nominated by donald trump, you know, do you think it's just going to be a rubber stamp? don't you think she is going to ask a lot of questions? and there are a lot of people hoping that she reads what the whistleblowers said and says, you know what? can we go back and look at this a little more? >> yes, look. that's a 400-page something amicus brief that was filed by jason smith yesterday. and, of course, hunter biden team hates what the irs whistleblowers say which is that there was obstruction and slow-walking to save hunter biden and get him this sweetheart plea deal. that's a lot to read and digest. two other amicus briefs i brief that have been sent in.
