5:02 am
part of the crane collapsing earlier and caught on fire first. >> building nearby being evacuated as emergency crews respond to the scene. unclear if anyone was inside the crane when it caught fire. >> steve: the crane has gas on it providing fuel up there. police department urging everybody to avoid the area around 41st and west side in hell's kitchen neighborhood. we'll have a live report coming up shortly. right now, from the scene is paul morrow, retired new york city police department inspector. good morning to you. >> good morning to you. >> steve: calling a crane collapse, the please are calling it that. doesn't look like the crane structure has fallen issue but the arm has.
5:03 am
we've seen cranes clap in new york city. figure out police and fire very worried about the structure there right now could come tumbling down and crash into a building and they are evacuating everybody issue right? >> that is accurate. according to the source on the scene, there were two cranes in play, the first did collapse and landed on the ground. minor injuries. there was a dump truck, the back is still revolving much the driver was out of the truck at the time and that truck took majority of the brunt of the first crane collapsing. the second is on fire, but still standing. authorities are concerned and cleared the streets and are
5:04 am
pouring water on top of it. >> steve: what floor are we talking about? we can't tell, we don't know how many stories high this is? >> very high building, i would make it say 30 stories to 40 stories and the crane is above that. the structure is the old covenant house, you may recall. >> steve: i know where that is. >> they sold a portion of their footprint and sold this piece to a developer. this building was being developed, it was uninhabits and you know the rest. one of the cranes came down. there is no wind today, it will be interesting to see what led to this. >> lawrence: paul, this is our neighborhood issue the video you sent me shows one crane collapsed at the bottom.
5:05 am
did it hit two different buildings or one building that is on fire right here? >> same building, on two different sides of the building. one facing 10th avenue came down and hit the scaffolding that every new yorker is familiar with, green scaffolding that blocks the sidewalk everywhere, went through it like a knife and landed,a top the cement truck and the driver was not in it. the crane attached to the building on the north side of 41th street is still standing way up there and appears to still be on fire. i don't see flames anymore, the flames, i'm getting wet issue the water is dropping on 41st here. looks like they are making
5:06 am
progress, doesn't look like the crane attached on 41st side is in danger of coming down. >> ainsley: if you lived in new york for a while and all of us have, we know sometimes this happens and usually there are fatalities and major lawsuits and hinders construction. hopefully no fatalities. i hope that is right. why can't the fire department go upstairs and put out the fire? looks like they are spraying from an adjacent building. >> good question, you are right, they are doing what they can from the adjacent building. there is not a cherry picker that can reach that high. the crane is situated seven or eight stories above the top of the building in question here.
5:07 am
if you were to ascend that building half constructed and achieve roof of that building, you have to go up the crane to reach the fire so there is no way to reach this other than what they are doing from an adjacent building. they are doing their best. i see flames now thchl i. this is a stubborn fire. i wonder what is on fire on this ib crane, it looks to be all metal. hope it is not tchemical or nothing. >> steve: could it be gas? there is a picture of a crane that belongs to new york crane. could that be a fuel gas-powered crane? they are not electric. >> ainsley: at american flag
5:08 am
panel. >> could be, you have better perspective than i do. all i see is underside and flames shooting up out of the top. whatever it is, it is pretty stubborn. if you are right and it is chemical or fuel fire, that is bad news, water will not have a lot of effect on it. >> lawrence: paul, i'm curious, what about the fire department, are they establishing some perimeter? are they evacuating the buildings nearby? describe what you are seeing out there? >> on the ground issue fd is doing what they do inside the perimeter, addressing the fire situation. the task force is around the block, that is how i got a heads up about this. came running around the block and there you are. they have the perimeter established.
5:09 am
they are keeping people off the block. i do not see them evacuating buildings nearby. they are leading people into businesses if they live on the block. they are pretty confident the situation is stable. they would not let people into ad adjacent buildings. you got to keep people out of their homes and they are not happy about that. people are walking dogs and i see them being allowed up the block and entering their building. >> ainsley: our city, the whole country, we see a fire, structure onir foo, it fire, it could collapse. glad they evacuated people below. what was it like when everyone was running from the building or an hour ago? >> call it about half-hour ago,
5:10 am
very loud boom that just reverberated, a rumble and a boom that just reverberated around the neighborhood and full disclosure, i had just gotten back from being on air on the maria show. this second crane for whatever reason, caught on fire and continues to burn. >> steve: yeah. there are actually images and we are efforting to get them off twitter that shows that arm from that crane that is burning out of control. how the arm falls, another crane collapse and probably hit that arm thachl crane we're looking at is still standing and burning out of control. it doesn't look like the wa

water -- the adjacent building is on west side of the avenue. that is a wider block. they are trying to arch the water over 10th avenue and reach the east side of the block and one stream seems to be hitting more consistently and having no effect. i see flames now. >> ainsley: >> lawrence: is on his video. >> this is from paul, what he's seeing. >> ainsley: this is a picture of the crane that fell. it went through the first floor roof of the protection. they build scaffolding over the sidewalk so you can walk
5:12 am
underneath it. this went through the scaffolding and hit a cement truck, right? >> yes. i was told by a sergeant that said they established themselves quickly, which i'm sure led to a lot less chaos, they locked down fast. my information from him, the cement truck driver was out of the truck, probably just getting coffee or something and as a result, he wasn't injured or that could be more serious. that truck took a big hit. minor injuries, one crane burning, the other down and no indication anybody inside the building or adjacent buildings is at risk. >> steve: another question. somebody, when you said covenant
5:13 am
house, it is over the old covenant house on the west side. i would come out of lincoln tunnel and drive by that. i imagine the lincoln tunnel, if traffic coming out from new jersey is not stopped, it is being diverted to the north or south. any information? we're rush hour right now in new york city. >> i have to imagine this is a debacle, you are right on the money. lincoln tony is one point of the tunnel. you are getting multi agency response, port authority will have the ticket on that. lincoln tunnel gets out into manhattan down the block from that and cannot be healthy, zero traffic going up 10th or 40th
5:14 am
street. >> ainsley: citizen app notifies us of a robbery or breaking news. this says two injured after partial crane collapse. two-alarm fire. it says two were injured according to citizen app. >> could well be true, i was told minor injuries. >> steve: that could be it. >> my first question was fatalities and i was told no. i was told minor injuries, that is likely the two. there isn't a heavy ambulance presence here. as of now, i see maybe one ambulance standing by outside the perimeter standing by.
5:15 am
>> ainsley: this says to clarify, 10 minutes ago, firefighter clarify one firefighter and conrstruction worker is injured. >> lawrence: we just got the video paul sent us, play some of the video. you can see that is -- the crane right there. >> steve: and there is the building under construction on side of the old covenant house at 41st and 10th and remaining crane in place, the one onir foo. new york's finest heading to the scene, which they always do. paul, thank you for the live report from the scene. bring in joe, long-time law enforcement vet in new york city. joe, look at what is burning out of control on the west side of
5:16 am
manhattan, what are your thoughts? >> reported serious injury, large perimeter set up, don't know if anything is going to fall from the crane much people say, why don't the firemen go to the building that is close. god forbid firemen go into the elevator and the smoke get serious. be careful if the crane explodes. they will have to interview the crane operator or company and figure out what was on there, are there toxic materials and how will they burn it out? >> steve: looking right there, it looked like the fire was out, just smoke for a while and reignited with great big burst of orange. i asked this of paul morrow, do we think that crane is operated by diesel or gasoline or something that is burning up
5:17 am
there? >> there is some kind of oil used for hydraulics, i assume there is something flammable on there. be careful. down below, foot traffic or vehicular traffic, there is traffic agents all around, this is not just a one block radius, several blocks to make sure god forbid, nothing is injured. there are so many buildings, god forbid a piece much metal goes into a building. from what i know issue the building was vacant, that is positive. >> lawrence: talk about the response, special response group is in the area, multiple law enforcement groups. >> ainsley: that is your neighborhood. >> lawrence: when i'm in the city. explain to me what it takes to secure an area like that. >> more so on the police side,
5:18 am
restricting pedestrian and vehicular traffic, you do not want people going to the scene, god forbid something come down. fire department will take control of this and police and fire will interview the building and see what was it, are there any chemicals that can explode and the fire department will work on putting this thing out. it is not going to be easy, you can't have a fire and climb up. you have to be careful of surrounding buildings. the firemen or people in surrounding buildings could get injured. >> steve: there is not much wind and now we see good stream of water going into the actual fire. joe, you know that neck of the woods, hel's kitchen to the west
5:19 am
of time square. a lot of tourists in the area and i'm looking at some online stuff about a hotel in that neck of the woods that has been evacuated. that is one of the first places, any place somebody lives, apartment building, hotel, restaurant, they cleaned out a long time ago. >> number one is public sa safe and people with breathing conditions and asthma. evacuate people that are high risk and make sure nobody, frozen zone, nobody is allowed in or out, god forbid that crane comes down, we'll have bigger problems than we're seeing right now. >> ainsley: have you everbeen working on day when cranes
5:20 am
collapsed? in 2008 or 2010, i moved into a new apartment on midtown and the building next to me yourn construction and the crane had collapsed and gone through my brand-new apartment and then collapsed on the other side and landed on a brown stone and there were people that were killed when the crane collapsed. have you worked any of the collapses? >> i've had two, i believe one on worth street a few years back, i believe a fatality, they were in a car and the crane came down. also, when the helicopter landed on the rooftop and crashed in midtown. we were in the area and thank god for the most part, nobody was seriously injured.
5:21 am
that is the biggest concern. end of the day, most important thing is safety of everyone in that area, along with surrounding individuals. it takes an hour as long as nobody is severely injured or killed. >> ainsley: what is the reason? wind blowing or assembled wrong? >> the heat and sun, we have seen when you take a glass, imagine the heat up there and chemicals from the hydraulics. could someone have left a cigarette? yes. early in the morning, doubt somebody was up there. very clear day, no clouds, only imagine how hot it is up there. >> steve: if you are just joining us, folks, looking live at split screen. a crane on a building under construction in new york caught
5:22 am
fire and then the arm, the crane arm collapsed down below and crews evacuated surrounding buildings and are tending to the fire and looks as if flames are at minimum and they are still burning. >> lawrence: we'll continue to follow this and bring breaking news as it warrants. prayers for those firemen and police officers that are there keeping all of us safe. >> steve: 8:22 in new york city. another fox news alert. we are awaiting hunter biden arrival in federal court in delaware, he is expected to plead guilty on tax charges. we have a camera in the front and back door and sides. >> lawrence: that is right, republicans calling on the judge to scrap the sweetheart deal as biden's legal team is suspected

of misleading the court's clerk. >> ainsley: mark meridith, what time do you think he will arrive? >> >> mark: i would imagine -- it is federal court, we will not see cameras inside the courthouse. we have a team inside, after the proceedings. today first son hunter biden is expected to be accused of failing to pay income tax and will enter a diversion program because he owned a first republic bankarm while he was a drug user. this deal is between prosecutors and hunter's legal team. unlikely he will serve jail time. on capitol hill, republicans are furious and claim the first son is getting special traechl and point to the testimony of two whistleblowers who say

prosecutorial decisions were affected by politics. this involves a brief filed by chairman of the house ways and means committee. first son got a sweetheart deal. the judge's office claims member of hunter's legal team called claiming to be from another law firm asking for the document to be removed over privacy concern. the judge writing, it appears the caller misrepresented her identity to improperly convince the clerk's office to remove the amicus material. the matter under consideration appears to stem from miscommunication between a staff member and employees of the court. we have no idea how the misunderstanding occurred. critics not buying it.
5:25 am
>> there doesn't seem to be reasonable excuse as to why to do this and to get under, put a burr under the judge's saddle before they make rulings is critical. >> the white house has been asked what is happening in delaware and they say the president and first lady continue to support their son. white house not engaging in back and forth on the case. they are saying it will process play out, president biden doesn't have public events today, it is possible we could hear from hunter's legal team later on today. >> steve: that is why we have cameras out there. thank you. hunter will go in and the judge will say probably ask questions. whatever happens to him, if the judge accepts the deal, although i've read because there is so much scrutiny on this judge appointed by donald trump, she will ask questions and probably

go, i will take the deal that david weiss negotiated with you. after today, hunter biden will have to come back to court at time in the future to be snszed. >> lawrence: i expect the judge to say something about them trying to mislead the court clerk. the clerk is an officer of the court. the judge can't do business without the clerk. the fact they tried to do that and doesn't seem like the judge is buying their representation. i'm not buying it at all. they got a sweetheart deal, only imagine what has been going on for months, years, five years for this investigation. >> steve: how many other calls have there been? >> ainsley: judge is asking the attorneys to please explain themselves, she wanted ecplan agsz because she said this is a dirty trick and his attorneys,

his female attorney, one called and said i want the irs whistleblower testimony removed from hunter tax offenses from the court docket. she was upset with his legal team and asking questions and wanted an answer. as far as pretrial diversion, hunter must remain drug free and never own firearm again and charges carry 10 years in jail and hefty fine. yesterday reporters were trying to ask the president about possible impeachment inquiry sp speaker of the house is talking about. kevin mccarthy says we have to go through with impeachment inquiry and find out what the paperwork shows if there is trail where we could impeach issue this is the president's response when asked by reporters. ♪ [indiscernible] --
