another significant story happening at we speak. live look now federal courthouse wilmington, delaware. hunter biden about to plead guilty to avoid jail time. could a last minute legal dispute derail this thing? republicans are waiting on this moment for five years. that day is today. it has arrived. i'm bill hemmer. next two hours. >> dana: it will be a big one today. i'm dana perino and this is "america's newsroom." we have a lot going on in the show today. hold on tight and we'll take you through it. hunter biden's court appearance is 10:00 a.m. eastern expected the plead guilty to two misdemeanor tax charges and entering a separate agreement on a gun felony. >> bill: the deal has outraged republicans. they say prosecutors were pressured to go easy on the president's son and urging the judge to disregard the agreement. >> dana: and here is what

happened. republican congressman jason smith tried to intervene in the case. he filed whistleblower testimony on the public docket detailing allegations of political interference. >> bill: the allegation. apparently a member of hunter's legal team called the court to have that information sealed. the judge says that person lied about who they were and who they represented and present tended to be a member of the republican smith's legal team. >> dana: hunter biden's counsel denies that accusation chalking it up to a misunderstanding. will the judge buy that? we'll find out in less than an hour. analysis from andy mccarthy. we start with griff jenkins outside the courthouse in wilmington, delaware. >> good morning. we're keeping an eye out. any moment now we expect hunter biden to arrive at the federal courthouse here. a lot has transpired since last night, including whether or not

this hearing will begin with the judge deciding whether or not to bring sanctions against hunter biden's legal team for a misrepresentation. let's back up and start with the amicus brief filed by the house ways and means committee chairman jason smith. it wanted to insert the testimony of those whistleblowers. here is what congressman smith writes. the defendant appears to have benefited, hunter biden, from political interference. in the interest of full transparency and fairness for all citizens it is critical for the court to have this relevant information when evaluating the plea agreement. but as we have now learned late last night, a member of hunter biden's legal team from the law firm called the clerk's office and apparently may have misrepresented herself in trying to get that amicus brief and this testimony sidelined and

removed from today's hearing under consideration. now, this is what we have from the law firm of hunter biden saying, quote, this in response. the judge wanted an immediate response last night saying the matter under consideration appears to stem from an infortunate miscommunication between a staff member at our firm and employees of the court. we have no idea how the misunderstanding occurred but our understanding is there was no misrepresentation. so we expect for this to start. we thought it would be a fairly matter of fact with, of course, hunter's plea agreement to two misdemeanors of tax evasion and avoiding prosecution on the gun charge. this will probably start with whether or not this misrepresentation happened. meanwhile calls are getting louder for impeachment of president biden and yesterday the chairman of the oversight committee james comer saying that he has noticed a change in tone at the white house about the relationship between the

president and his son's business dealings. take a listen here to congressman comer. >> you look at what the white house is saying, they changed their story in the last 24 hours for fear of what devon archer is going to testify next week saying joe biden was never in business with his son. that's not what they've been saying. they've been saying he had no involvement. >> as we wait for hunter and his legal team to arrive at the federal courthouse we bring you the latest developments as we get it. it changed dramatically in the last 24 hours and some indication that we may actually hear from hunter after the hearing. we'll bring it to you as we get it. bill and dana. >> dana: important reporting, thank you. >> bill: andy mccarthy and mary katharine hamer. eileen o'connor works tax evasion at the d.o.j. for six years. she said you go to prison for what hunter biden did. in reaching the plea deal the

justice department violated every norm in the tax enforcement book. that may or may not be the case. we can debate it throughout the morning and days to come. back to the issue that happened yesterday. should the judge make a ruling today? should she accept the plea or should she punt this decision until you figure out what exactly went on yesterday? >> i certainly think that the judge should at a minimum put off the plea until a lot more information comes in. i actually think what happened last night is probably a garble in terms of communication between the lawyer and the clerk. it would be odd to me if a lawyer -- i believe the woman's name is jessica bangle, would use her own name and try to commit a fraud this way. i think what probably happened is she was looking to get a process to try to get that information removed from the

public record and the court clerk misunderstood what she was asking for and whose behave. we'll see what happened. that's a side show compared to the importance of today and through all the business about the house committee objecting, what really -- the objection here really ought to be coming from the i.r.s. more than anyone else. what we heard those agents testify to, among other startling things, was that the f.b.i. never told them about the information they had gotten from this informant, the founder of burisma bribed or says he bribed hunter biden and joe biden $5 million a piece. a lot you can say or name a $5 million bribe. what they call it down at the i.r.s. is income. and what it means is there is $5 million potentially that hasn't been investigated and that isn't

accounted for in this plea arraignment. >> dana: mary kathryn, the andy is talking about is this quote here. it says it cost $5 million to pay one biden and $5 million to another biden. they hired hunter biden to protect us through his dad for all kinds of problems. he replied to the effect don't worry hunter will take care of all those issues through his dad. what do you make of the changes, the slight changes in the language from the white house as this gets a little bit closer to coming to fruition in terms of all this evidence coming out now that the house republicans have the ability to subpoena and get documents? >> i think president biden foolishly gave himself no wiggle room when he was talking about hunter biden and business dealings whether or not he was involved. turns out there is millions of dollars flowing and actual evidence that this was with possibly joe biden's knowledge and it turns out at the public library you can't pick up a form

come to an agreement on a gun felony. mary kathryn i'll turn it back to you. >> what is happening here they are trying to get important information into this proceeding, right? to paraphrase, new information has come to light via the whistleblowers. i didn't expect i.r.s. agents to be on my thank you letter list this year. it wasn't on my bingo card but they are saying the right thing. look, we care about equal protection under the law and he is quite clearly not being treated like a regular american. i feel if i had done the same things i wouldn't be getting this deal and would not be given the benefit of the doubt on these many, many, many shady coincidences that amount to many, many millions of dollars. >> bill: andy, this is the moment republicans have been waiting for for years. it has arrived and about to find out what the judge says in 50 minutes from now. meanwhile you have what appears to be a whole new chapter on capitol hill because the house

speaker, kevin mccarthy, has been quite forceful in explaining himself about some sort of inquiry about an impeachment. now he is not saying we should gavel this thing together but start the process of gathering information. here is the back and forth from yesterday and we'll get you to tell us what you think will happen next, watch. >> such as what? >> on talking about impeachment inquiry. >> right now you have a president who told you and every other american that he has never talked to as a family about business and never got $1 from china. you know it's not true. having all this information should i ignore it? no. >> bill: that last point is what he was driving at. he had a monologue that went four minutes in length. that last point, if you have all this information, should i as house speaker ignore it?

he is giving us the suggestion he will at least look into this stuff. what would you expect from it, andy? >> well, i think he is quite right. look, let's go back to ukraine for a second, ukraine impeachment in 2019. what we were complaining about in the run-up to that was that you had a bunch of house committees who were looking at this but the democrats wouldn't be transparent and tell us what they were actually doing was an impeachment inquiry and that is where this is all driving at. what mccarthy is saying we have more information than what they used to file articles of impeachment in connection with ukraine where they couldn't come up with a crime. he is not writing an article of impeachment tomorrow. he is talking about opening an inquiry. they have overwhelming information to support that. and it would be transparent to

say this is what the ultimate objective could be here that we could move for the impeachment and removal of the president. for now we're commencing an investigation and under circumstances where they investigate, anyway, they ought to be honest about it. i think that's fine. >> dana: a lot of people are wondering is turn about fair play. nancy pelosi was asked this and thinks the impeachment of trump was absolutely necessary. a picture from a moment ago of hunter biden entering the courthouse in wilmington, delaware. listen to nancy pelosi yesterday. >> the president was impeached because we had no choice. he had undermined our national security, jeopardized our well-being of our country. i was very careful about bringing any impeachment forward. but when the president made that phone call in terms of ukraine, there was no choice. we had no choice.

he must be impeached. >> dana: mary kathryn, your thoughts about andy mccarthy given the evidence i have, do i have no choice? >> by the standards she lays out, if you are inquiring into this and find out much of this evidence is real, then she would have no choice once again but magically we'll find she does not feel the same way this time around. i will say we chased russian ghosts for 4 or 5 years based on almost nothing except for hillary clinton funded document. so it seems to me we have met a bar here for at least inquiry on this. a lot of solid information including the treasury department itself flagging payments from china suspicious. an arm of the government was this is part of our rules, you can't do this. this is suspicious. we look into it -- the republicans look into it instead of the press. >> bill: thank you both.

>> bill: during the commercial break we were listening to the fire chief there. there with the mayor adams. what happened at 7:25 local time, which is right about two hours ago, dana, 45 stories high this crane was in the air. the top part of the crane with the boom that weighed 16 tons crashed to the ground. there are four injuries. all of them are minor. that might be a major miracle. most of the fire is out, they say. they have about 200 firefighters on scene. it appears to be at the moment contained and under control and that would be a good scene and a good sight for folks here in new york today. >> dana: at the same time, we're awaiting any information and any additional sightings of hunter biden. he is in wilmington delaware at the courthouse expected to plead

guilty to two misdemeanors and make an agreement about the felony gun charge. we expect to hear from hunter biden. we're told it's a possibility after this plea -- he will plea. the question this morning is does the judge accept the plea, does she punt this to another day? we'll pay attention to all of that for you. in the meantime, top republicans are reportedly seeking to be more selective in their picks for the senate so they can flip it in 2024. they say they want to avoid a repeat of last year's mid-terms. josh holmes is former chief of staff to mcconnell. the fundraising for republicans is pretty good. is that an indication of things to come? >> it is headed in the right direction. recent history lesson goes a long way to explain where this potential cycle is going. you will recall in 2010 and 2012 republicans came up short losing very winnable senate races.

they changed the business model. i was fortunate to play a small role in 2014 where they won the majority and held it in 16 and 18 and were within a two georgia run office doing it again in 20. 2022 rick scott changed the business model back to a 2010 model where you threw it open and any candidate who can win was your candidate that we ended up going right back and ended up losing winnable races. there will be a different approach this year. i like where this is headed so far from republican perspective. >> bill: i will show you the three that republicans feel the most confident in. montana going up against john tester, ohio going against brown and going up against manchin in west virginia. steve danes is a republican from montana. reported he has been clear in his message to donald trump.

they want to put the best candidates forward. can you say whether or not that conversation has happened and how it was received? >> well, i'm not privy to the private conversations between senator danes and former president trump. what i can say is that steve danes is an incredibly astute political operator and understands what it takes to win and gone about the tough business of recruiting very well qualified to take on democratic en couple panties. justice and sheehy with a great shot of knocking off john tester. ohio senate race will have a big primary. all candidates look like they could beat brown. he is doing his job and republicans should be buoyed by that. >> dana: a new poll out that talks about who the republican voters believe will be the strongest republican candidate against incumbent joe biden. and definitely trump was at 45%.

probably trump at 24%. that's a pretty commanding sighting there. plus this, josh. the monmouth poll shows ron desantis, his favorability has had a 15-point drop since february. is that something that he could turn around? he claims it's a two-person race between himself and donald trump. >> look, i think obviously it was the desantis theory of the case coming in. they wanted to make it a two-person race. that hasn't happened. i think that electability question where you see trump having very high numbers is a total change and complete switch from where he was at in february. a lot of that is the result of desantis not being able to lock down that sort of one opposition to donald trump. but look, every campaign that gets itself in this situation and have a hard reset can go 1 of two directions. jeb bush 2016 or john mccain in

five alarm fire which means it is all hands on deck. right now we know those crews are working to assess the damage and debris left behind. again after a crane working on the construction of a 40-story building caught fire here in manhattan this morning. the fire causing the arm of the crane to collapse. we've been monitoring social media, videos this morning. one video shows the arm of the crane break off and hit a nearby building. officials say the crane operator tried to extinguish the fire but had to get out as the fire continued to burn. one of our fox news colleagues who doesn't live far from him. his apartment building was evacuated and watched as people ran away from the scene frantically. we spoke to one man who lives in the building that was hit by the crane's arm. he said he feared the absolute worst. >> it was so big that it was really moved our building.

sheath. matched dna at his pennsylvania phone. trace his phone near the scene, etc. what do you think of the suggestion of an alibi? >> i have a lot to tell you about that. you mention that circuitous route he took the night of the murders all the way around the his home at washington state university. i took the route. we've been out there in the cold working all day. got dark. i said let's do the route. nobody wanted to do it because it took almost an hour on these dark two lanes. no lights at all. he chose to do that instead of drive nine minutes to his home in a more direct route and the cell phone pinged all the way along the route. but to your question the alibi. you know what? this stinks to high heaven. they are saying we have an alibi but we're not going to tell you what it is. don't you know on day one if you were charged with a crime you would say oh, no, i was at a studio that day.

home. what do you know about that? >> well, i know that authorities have said the search is over, but it is not. his home there in massapequa, that search is done. they practically tore the backyard down to the studs of the deck. used ground penetrating sonar. i was using that a few weeks ago on a cold case. it looks like an ultrasound and it shows you if something has been buried. they tore apart a vault encased in cement in the basement. now more work. phase two sets in. all of this has to be analyzed at the crime lab to see if anything they found matches up to the victims or other victims. >> dana: a lot of people are paying attention to that. tell us quickly, left for dead a new special you have on fox nation. >> yes.

the judge to reject the plea deal. what they are trying to do here is we've talked many, many times about the whistleblower information that house republicans have gathered from two i.r.s. whistleblowers who basically said the justice department interfered with their investigation of hunter biden. they felt that hunter biden was guilty of felony tax evasion but the justice department put its thumb on the scale and would not charge that. what they are trying to do now, these republicans, are send their information to the judge and say you need to consider this. don't just accept the plea bargain. its the result of favortism inside the justice department. what we see in the last 12, 18 hours is a lot of fighting back and forth between the two sides about whether that information should even be in the case. >> bill: it's the judge's call ultimately and see what she thinks about all this. at that courthouse yesterday seemed to be a lot of back and

right now. there are a couple of things he was arresting in those quotes. one sean had played a video of joe biden stumbling and losing his place and appearing confused and asked whether joe biden is physically and mentally up to the job. kennedy would not answer that question. he said well, biden has never been very good with words which everybody laughed at. his saying the decisions coming out of the white house are bad decisions was his way of saying that's what -- joe biden should leave anyway. as far as the democratic party is concerned, you know, we have heard a number of traditional democrats say they believe the party has left them. it has gone too far left. you have to remember rfk junior, 69 years old, son of perhaps the most famous democratic party family in america, and his father was a very famous 1960s
