[cheers and applause] >> jonathan: good evening, everyone, i'm jonathan hunt in for trace gallagher. it's 11:00 p.m. on the east coast, 8:00 here in los angeles, and this is america's late news, fox news at night. and breaking tonight, the truth is out there, so to speak, and lawmakers were trying to uncover it today. what credible witnesses told a house panel about the existence of ufos, and a possible government coverup. and talk of impeachment cropping up again on capitol hill. how hunter biden's legal woes

could accelerate an impeachment inquiry into president biden. but we begin with that plea deal or more accurately a plea deal no more after things turned south at a hearing in the hunter biden case. the first son now pleading not guilty to federal tax charges. senior national correspondent kevin corke joins us live from the nation's capitol with all the details. good evening, kevin. >> reporter: evening my friend. the headline is hunter biden's plea deal fell apart today. that's the top headline of the day, pleading not guilty as federal prosecutors confirm once again that, yes, he is still under investigation. but beyond the top headline, there's still plenty to unpack here jonathan. first of all, the president's son was expected to plead guilty to a couple of misdemeanor tax counts of willful failure to pay federal income taxes as part of a plea deal to avoid jail time on a felony gun charge. but district court judge marry

ellen morika slammed the brakes described did deal struck by the attorney david weiss of delaware as unusual and questioned why the deal contained some nonstandard terms such as broad immunity from other potential charges and now critics are setting their sites on the doj itself which, after five years of investigating only came up with a couple charges. >> who is going to advocate for justice under the law. i was hoping the judge would do it i hope she still will by rejecting this sweetheart deal and calling for a thorough investigation and an honest prosecution. >> reporter: but the white house tonight remains defiant, adamant the president has not put his hand on the scales of justice in any way. >> the president, the first lady, they love their son and they support him as he continues

to rebuild his life. this case was handled independently, as all of you know, because the justice department under the leadership of a prosecutor appointed beside the former president. president trump. >> reporter: and recommended by democrats in delaware. the judge, by the way, did ask both parties to file additional legal briefs defending the constitution ality of the original plea deal that addresses the firearms charges. the parties have 30 days to do so, jonathan. we are not finished with this story by a long shot. >> jonathan: that's for sure kevin. thank you very much. with us now former deputy assistant attorney general in the bush administration, john yoo, and former chief down the house judiciary committee julian epstein. john, let me come to you first. anyway you look at it it has to be viewed as a bad day for hunter biden, you walk into court thinking this is wrapped up you come out three hours later with it anything but wrapped up. what does it mean though for him? is this really bad news for

hunter biden or is it simply a delay in a deal that will ultimately be done? >> it's definitely bad news because he came so close to getting the deal of the century. the idea that he thought he could get immunity from all future charges involving taxes while he was still under investigation, that's just not something the justice department does. and if he was able to get a deal like that, i would think either the justice department has suddenly become stupid or incompetent or something worse was going on. you can't give someone immunity while you're still investigating them because what if afterwards the justice department found that actually hunter biden was actually on the payroll of the chinese government and was getting this money for that, or that he was using the money for some other criminal activity? that's why the department would never offer a deal like the one he thought he was getting. so that's a bad day for him that he almost got this sweetheart deal and didn't get it. so it's going to delay it but also means his deal is going to

be different now. >> jonathan: right. julian, i gather that you are of the opinion, as some others on the republican side are, chris christie among them, that we are headed towards a special counsel now that it's going to come out of the hands of the doj specifically. >> we may be. one of the problems in american politics is democrat blindly defend democrats, republicans blindly defend republicans. that kind of thing has got to change if we're going to restore faith in government and particularly our legal institutions. i agree with jonathan. i think the more important question is about this blanket immunity that the attorneys thought they were going to get on this plea deal is, what is it that the justice department said to hunter biden's attorneys that made them believe that he was going to get a hall pass on everything, every potential future charge that had nothing to do with the charges before the court today. why do they believe that?

it just seems impossible to me that the justice department and the defense attorney had two totally completely different understandings of that. so i think that raises questions. i think the deperfectly of the gun charges tway that was structured in a way that would preclude any real serious enforcement of it, i think that raises questions. so when you start to see in just the plea deal these sort of things that i would call, say, irregular, and then you combine that with sort of the other issues in this case, the fact that the justice department let a statute of limitations on the more serious crimes lapse, the allegations that go back to 2014 and 2015, the allegations of the justice department was impeding the investigation through various different ways, no clear decision authority, sort of tipping off defense attorneys. the allegations that president biden may have been involved in phone calls. the allegations from the ukrainian burisma executive. and it seems to me that democrats are going to be in a

tough position to sustain the way they tried to do in the government oversight hearings last week that there's no there there. i think democrats would be in a better position to say, hey, let's get all the facts on the table, let's let the chips fall where they may and let's have hunter biden treated the way any other defendant would be, would be treated, and let's pursue this with the same vigor we pursued other investigations against, say, president trump when trump was in office. they're looking very political right now and i don't think that's a good position for them. >> jonathan: let me get john back in here. how messy does this look from a prosecutor's point of view, john? it seems extraordinary, these lawyers all walked into court, hunter biden walked into court thinking that this deal was done and the judge said, well, hold on a minute. it seems embarrassing at best, for everybody. >> i think this is looking worse and worse for the justice department. i agree with julian, it is time for a special counsel because the justice department can't reach this plea agreement and say, oh, we're done

investigating while new evidence is coming in almost every week from these house oversight hearings showing irregularities, pressure in the investigation, maybe more evidence that hasn't been followed up by investigators, by dedicated irs civil servants. i support it, actually, having robert mueller do the special counsel investigation. i supported the durham investigation. i think the case for this is equally if not more strong than it was for those two cases and that will solve the justice departments problems because once special counsel gets involved then merrick garland and president biden can say it's out of our hands and congress can let the special counsel do the job. >> jonathan: julian john thank you so much. there is so much to talk about here and we will come back to you, we just have to move on, there is so much to talk about tonight, thank you both julian and john >> now while some republicans have skepticism about launching

an impeachment against president biden the legal woes of his son could certainly accelerate that push. correspondent ashley strohmier has more on how the legal bombshell is shaking capitol hill and the 2024 race. ashley. >> hi, jonathan, yeah, hunter biden's legal woes than derailed plea deal could accelerate the push for a formal impeachment inquiry by house republicans. the chair men of powerful house committees say that would give them more latitude to seek more information that does include documents and offer a greater ability to put key figures under oath. but democrats seemingly caught off-guard with the change in hunter biden's plea deal are dismissing that effort. watch. >> well, if there was actual evidence, of course. but there is no evidence. >> it's bs. >> there's no impeachment inquiry in the constitution, no reason for an impeachment inquiry. >> reporter: but it is an idea that apartments to be gaining support among republican presidential candidates. >> and if he has any connection to them, and that can be proven, then an impeachment inquiry

probably would be appropriate. >> it's just an inquiry. but if there is evidence, then you're looking at an impeachment. >> reporter: meanwhile dhs secretary alejandro mayorkas faced calls for his resignation or removal. the secretary pushed back on claims that the border is open and signaled the biden administration's policies are working, pointing to a 30% drop in border encounters last month. there had been an expectation among democrats republicans would launch an impeachment inquiry on to mayorkas but there are reports house republicans have moved on and they want the impeachment inquiry toward 1600 pennsylvania avenue. jonathan. >> jonathan: ashley thank you very much. talking about fiery hearings on the hill, there were shocking claims at a house hearing today about whether or not ufos and their alien pilots have visited earth and whether the government

nick very simple question, is there a coverup? >> yes, there is in some sense. i don't know whether literally somebody has a spaceship in a hangar somewhere, david says they do, but we know from all this talk that only some of this can be disclosed in the classified parts of these sorts of hearings, that there are some things about ufos we're not being tolled so in that sense it's a coverup. >> jonathan: i want to play another exchange from the hearing today because so many were so interesting. listen to this one nick and we'll come back. >> mr. fabev, what astonished you the most about the flight capabilities of these tick tacks. >> the performance, absolutely the performance. >> reporter: you're not aware of any other objects that anybody in the world has in this world that has those capabilities. >> no, i think it's far beyond

our material science we currently possess. >> jonathan: nick, beyond anything we can do. and when you see these videos, nick, and you hear these trained u.s. navy pilots saying things like, oh, my goodness, what was that, it's hard to believe that it isn't something from out of this world. >> absolutely. and our intelligence community, of course, has a very good idea of just how advanced, say, china and russia are in terms of their capabilities. so i think people are able to say what the cutting edge of terrestrial technology is. even if one is skeptical about ufos, when these top guns to have congress, that these things run rings around the best that we have, that has got to be, as was statedd in this hearing today, potential extensional threat to the united states. >> jonathan: so, nick, what would be the reason for a coverup?

is it simply to prevent worldwide panic or is there another darker reason for this? >> well, you know, i don't think -- it's a whole different subject but our response to the pandemic didn't exactly show that people handled things well when it comes to panic, so maybe that was a lesson for all this. but maybe there is a dark side to some of this. >> jonathan: well, alone in the universe. >> jonathan: just really quickly, nick, do we have an absolute right to know? >> within reason, but not the technology, if it could be weaponized and an adversary could get to that. so most of it buzz not everything. >> jonathan: nick pope great to talk to you. as always i love this subject, i hope we are not alone. nick pope thank you >> a man in los angeles has been terrorizing residents in an apartment complex by running

around in his birthday suit and police say, because this is la, there is nothing they can do about it. correspondent jeff paul joins us now with the details. good evening to you jeff. >> reporter: good evening jonathan and i think the main concern from the folks who live in this apartment complex is the safety of their young kids. and when you see this video recently captured, you're going to understand exactly why. that's the intruder they say walking naked through their east hollywood apartment complex. they have no idea why he's doing it or what he's exactly after. but they say at times their security cameras have captured him sexually exposing and touching himself. in another incident their cameras caught him appearing to enter an apartment through a window, but they don't know if he knew that person inside that particular unit. now, despite the complexion being gateded and someone needing a key to get inside, it keeps happening. i spoke about it but wanted to coner conceal their identities out of obvious safety concerns. >> none of us can get any sleep

because we're actually keeping an eye out for each other. >> he looks very scary because he's walking around, roaming around our building naked. what are the lapd waiting for? for someone to get attacked or sexually assaulted? >> reporter: the los angeles police department is reportedly aware of the issue. however, they have told residents, reportedly, there isn't much they can do since no crime has been committed. folks who live there say they have no idea if this man needs help, if he's on some sort of drugs or if he's experiencing homelessness but they are hoping, jonathan, that this bizarre behavior stops and stops soon. >> jonathan: i bet they are hoping that. thank you jeff. for more on this and other distinctly left coast issues let's bring kyle dimeo. the naked guy isn't doing anything illegal technically correct isn't it. >> the police have also said the reports of this naked intruder has been carrying around a knife.

now you have a naked guy in lars walking around an apartment complex allegedly with a knife exposing himself. you also have a naked lady yesterday in the building in the bay air on the bridge. >> jonathan: firing a gun. >> firing a gun. and so first you had shoppers dealing with smash and grabs. now you've got people seeing naked crazy people literally walking on the streets in the housing complexes in california. how much more do we need to see before we realize adults need to be put back in charge of the state? >> jonathan: yeah. well we're seeing a lot every day. we just had phil brock council fran santa monica the other day got in a tussle with a homeless man. it's happening more and more without a doubt. one of the reasons it's happening more and more, i think most people would agree, carl, is the amount of drugs on the streets now. but there is a new proposal now for how we might deal with this. cal matters reported on it, basically they're going to give

out rewards in you're not on drugs. clinicians will test participates once or twice a week, each time they test negative they get a $10 to wal-mart or another retailer. every time you test positive you get nothing. it's had succeeds in clinical trials and the u.s. department of veterans affairs have been using it for more than a decade. good idea? bad idea? i think i know what you're going to say. >> terrible idea trying to normalize drug use and giving reward outs. they're handing out hype determine i can needles to drug users, giving them crack pies, kits, taxpayer funded they're distributing throughout california. more importantly why settle for the gift card when you can get a free apartment, free motel, taxpayer funded in california, even if you're still using drugs under the housing first program. again, what we need is compassion and accountability.

you're not going to save these people, you're not going to deal with the issue unless we start using law enforcement to compel people into treatment programs. >> jonathan: and of course if they take their $10 gift card to wal-mart they'll find everything's locked up because they have that homeless drugged out people going into wal-mart. somebody has to do something, we get those programs, mayor bass throwing more and money at it for instance in los angeles, but nobody comes up with a different out of the box solution and surely that's whoa we need. >> we don't mid an out of the box solution. california is the only state fully going to the extreme on getting people an apartment, motel room, taxpayer expense without any requirement for mental health or substance abuse treatment. no other state is doing as reckless a job on homelessness. they have a 36% increase in homelessness. the rest of the country has seen a reduction in homelessness.

light-headed and left it at that. mcconnell spoke to reporters again later and said president biden had called to check on him. mcconnell said, quote, i told him i got sand bagged, a tongue in cheek reference to biden tripping over sandbags at a recent event. mcconnell's sense of humor at least obviously unscathed. ♪ >> jonathan: first up in tonight's real news roundup, the box office hit sound of freedom is now outperforming the new mission impossible in daily revenue. according to forbes, the anti sex trafficking film is also cruising ahead of the tom cruise film in total money made at the box office so far by $6 million. important to note, though, mission impossible opened a week after sound of freedom. >> i'm enormously grateful to the jury for having taken the time to examine all of the

evidence and all of the facts carefully before they reached their decision. i am humbled by the outcome today. >> jonathan: oscar winning actor kevin spacey was acquitted today in a trial happening across the pond. the jury found him not guilty on criminal sexual assault charges after nearly four weeks of testimony. a netflix job posting is getting a lot of attention not just for the high salary, up to $900,000 a year but because the role is focused largely on creating content by way of artificial intelligence. actors and writers in hollywood are currently striking in part over the use of ai technology. >> now you've heard of the cocaine bear, well, we now present to you cocaine sharks. nobody wants to get face to face with them. in the ongoing trafficking, the

amount of cocaine that gets spills or sometimes dumped into the ocean may be going up sharks noses. fox's jonathan serrie takes a look. >> reporter: when smugglers dump cocaine overboard to make drop-offs or conceal evidence, some marine biologists say sharks may be doing something fishy with the drugs. >> because they don't have hand they can't physically touch it they touched it with the only thing they've gotten their mouth, and taken a bite, they would have gotten a hit of cocaine. so it sounds crazy but the probability of it occurring is actually quite high. >> reporter: marine biologist tom conducted preliminary for the documentary cocaine shark, they simulated cocaine packages and observed shark behavior in the florida keys. >> now that is unusual, could be a past injury or maybe a chemical imbalance. >> researchers picked the shallow waters of the florida keys because of the prevalence

of dumped cocaine. in the first two weeks of this, they uncovered 90 pounds of drugs floating in 32 packages just off the island chain. he said he does not believe cocaine sampling sharks are any more aggressive toward humans but he would like to see further studies, not just on illegal drugs but everyday medications that eventually wind newspaper waste water discharges to the oceans. >> looking at the wake farms but going through and entering our waters, that is something that we need to be very concerned about and need to start looking into right now rather than being too worried about some, you know, kept-up sharks, you know, reaching for the lasers, dancing till dawn kind of thing. >> reporter: he says it raises important questions not only on the impact of marine life but the seafood we eat. in atlanta jonathan serrie, fox news. >> jonathan: jonathan, thank you. love that image of sharks at a

♪ >> jonathan: the box office is blowing up after the release of barbie and oppenheimer. last weekend was the fourth highest grossing weekend for theaters of all time. but could that success be short lived with both writers and actors on strike? let's bring in former major label music executive and managing director of vat at americas seth schachner and entertainment attorney and culture expert mitra ahouraian. seth thank you both for being here but seth let's start off with the good news.

amazing weekend for the box office and it was interest whatting the ap said about this, in the barbie and oppenheimer successes views were sending a message give us something new. they went on to say it was originality here that was reward. two movies not sequels or reboots pushing the box office to highs not seen in years. it seems like a reece message we want something fresh. >> this really seems to have cut through the clutter especially on the barbie side, i view oppenheimer riding the coat tails. but it hits a certain spot in the landscape. i think warner, the studio behind it took a little bit of a chance in creating a different type of barbie story for people. they've done a magnificent marketing campaign, the partnerships out there are spectacular and it's working. it's great stuff to see for sure. >> jonathan: i should mention my 13-year-old son is in barbie. they filmed some scenes at his

school he walked past ryan gosling and margot robbie. more about ryan gosling i think. to the bass news, this is a bad news for cinemas they cannot survive another pandemic and loss of big movies, i don't know if people are sitting at the negotiating table taking this seriously meeting the writers and actors strike enough or understanding it, maybe the prefreeze different agendas. maybe if you're netflix you aren't concerned about the box office. the strikes loomed large over this great weekend we've just had. >> yeah, it's so fascinating the timing of all this, right? so we are deep into the strikes at this point, and all of the promotions leading up to barbie happened up until the 11th hour even for oppenheimer because the actors, of course, could not promote during the strikes. so i don't know if you noticed there was a very heavy marketing campaign, which, you know, about $150 million worth of marketing

for barbie and i agree that oppenheimer sort of rode the coat tails there, but, you know, but it is sort of this almost feels like a last hurrah. we're not going to have this for a while. >> jonathan: seth i remember talking to you months ago when the writers first went out and i said to you, how long do you think this will go on and you said months and i said you're not serious. but it is. >> i guess it's one good thing that production cycles and marketing campaigns aren't necessarily in sync with all the current stuff. the movie was probably made a year or so back and i think they even start these marketing campaigns, the one we're seeing with everything from, you know, barbie house basically in malibu to all these different things they've done, it's unbelievable. probably has been implanting for quite some time. but, yeah, i do think if the strike keeps going on, you're going to start to see some very serious disruptions and the overall economy could be hurt. but i think they're closer than

well i have, me and my wife and kids have a wonderful golden retriever called cali there she is in the car with me just the other day after i got a hair cut. she weirdly loves tooth pavement i have a habit walking around the house while brushing my teeth she follows me everywhere hoping she's going to get a little bit of toothpaste. and before you ask i know it's dangerous for dogs, we have it free toothpaste specifically for cali which is why i have terrible breath because it doesn't work. the nightcap, do weird or abnormal things make your pets happy, 79% on twitter said yes, 75% on instagram said yes. so pets are just weird. the responses we got on line, guy collar, i hope i pronounced that correctly, my dog ace has a mr. bill dog from old snl days who says oh no every time he bites it.
