>> laura: thankfully the senator is said to be okay, concerns linger. federal court in wilmington, delaware, brazen move by hunter biden's attorney shows how accustomed to special treatment the president's son really is. what many of us thought might be routine plea deal by the judge turned into more than three hours negotiations between the prosecution and the biden legal team. the intense back and forth ended with hunter pleading not guilty to tax and gun charges, meaning this will drag on for sometime and perhaps drag the biden campaign down with it. another dramatic turn today brought confirmation that the investigation into hunter biden is continuing. the doj would not give details, but when asked by the judge if this could potentially bring

that private citizen, hunter biden rolled up to the hearing about a personal matter in a six-car motor cade. joining me is solweisenberg. sol, take us through briefly what shocked you most when you learned the terms of this original plea deal? >> well, we still don't know the terms. we do not have the written plea agreements and that is the most shocking thing of all. it is outrageous, as american citizens, we have not seen the actual agreements discussed in open court. they are not confidential, they were discussed for three hours in open court. what we can tell from the hearing, he was going to be given probation, it looked like a binding plea.

the judge would have to sentence him to probation, the felony gun charge turned into pre-trial diversion with no jail time and he was going to get broad immunity that would keep him from being prosecuted potentially for anything that was uncovered during the investigation. that is really what broke this down because there was a disagreement on the record about how broad the agreement was, the immunity was. laura, that is part of the problem, they should never have brought this deal to court unless it was totally clear from the terms what the deal was. shocking incompetence or corruption by the department of justice. >> laura: what is your guess, given history of what has gone down here? which is it? >> i believe this is a corrupt deal and a tainted investigation, absolutely. there is no reason, no

legitimate reason for this to have happened. these people are not incompetent. weiss does not have a reputation as being an incompetent person, and in particular, the guy who looks like the lead prosecutor, leo wise, is a very competent and aggressive prosecutor. the idea this could be left to chance is ridiculous. the judge said two things today, she said this agreement is not straight-forward, number one. number two, she said, it contains atypical provisions. it is not straight-forward and it contains atypical provigszs, that again, is unacceptable. >> laura: "new york times" chimed in on this early in the day and said the judge seemed skeptical of the deal questioning why it had been

filed under provision that gave her no legal authority to reject it. when she asked leo wise if there was precedent for this kind of deal being proposed, he replied, no, your honor. who makes hunter biden different in this? why would he get special treatment? he has to admit, no, this doesn't usually happen. >> you are talking about two different things. you are talking about a binding plea, which is what the judge was asking about. that is unusual, but happens every once in a while. once the judge decides to accept the agreement, she has to accept the terms in it. if it calls for probation and the judge finds out when she reads the report, this guy has done all sort of things, he shouldn't get probation, that would be too bad. she would

have to give the guy probation, unusual, but not unprecedented. when you combine that with this weird provision, which we have not seen yet, where the judge on the felony gun part, pretrial diversion agreement, where the judge is the one who decided whether or not charges would be brought, if hunter biden breached that agreement, she said that is a constitutional problem, that i have never heard of and that is truly unprecedented. >> laura: sol, unbelievable day, thank you. great to have you on. the conditions of hunter biden's release, the judge ordered him to actively seek employment. who would have thought of that. refrain from alcohol and elicit drugs and submit to random drug testing and not possess a firearm. he better hope burisma is hiring again. senator ron johnson joins us.

hunter's team is scared of what may come down the line with future prosecutions. what should they be most concerned about, given the facts of the case, fara charge, the foreign agent registration act he did not register under while operating overseas? >> my concern there, it is difficult to convict a democrat in washington, d.c. under the fara statute. you can convict republicans, convicting a democrat is difficult in this jurisdiction. they should be concerned about the tax evasion. excellent "wall street journal" yesterday by the former head of the department of justice said any other american would be in jail had they evaded jail the way hunter biden does. what i'm looking for, who will advocate under equal justice
