barbecue. >> lawrence: moral support. >> ainsley: i will be standing right behind you. >> lawrence: we have news to get into. >> steve: lead story right there. >> ainsley: sun burn? >> steve: hunter biden plea deal implodes in shocking court scene. andy mccarthy said the fix was in until the judge saved the day. it was extraordinary. and in fact the judge said i'm not a rubber stamp and she wasn't. and she just started taking apart their case asking a bunch of questions. but the amazing thing and the two sticking things were two different paragraphs and they were both about what would hand to the hunter biden case if a republican were elected president in the future and the new republican president try to reopen the case? hunter biden essentially got immunity for ever, according to his lawyers. but the government said hey, wait a minute, that's not what we thought was going on. >> ainsley: yeah. you are right. the judge raised concerns about the termination of the agreement and the lawyers need to untangle

the technical issues before moving forward. his attorneys thought the plea deal would grant him immunity for all future charges no matter what happens in the future. >> steve: sweet. >> ainsley: the judge refused to accept that agreement and said she will not shield hunter from charges in the future. what could those charges be? we don't know. prosecutors said that hunter remains under active investigation but would not revia view the details. some are saying maybe not registering as a foreign agent which is required by the fara regulations. >> lawrence: if you have been following this story when the deal was first announced you have got all these people lil' wayne's former attorney. and that's not even including the thousands of americans that have been indicted on the same charges and did not get the sweetheart deal saying we have never heard anything like this before. why the two tiered justice system? and then you had congress doing their investigation and, honestly, i think it is the investigation that really put this on the judge radar.

because the moment they send this brief over to the court hunter biden in the 11th hour attorneys tried this dirty business of trying to get something stricken from the record. and they put it on the judge's radar and she didn't like it at all. when they got to court, she began to assess the deal and say look, can he still be prosecuted in the future? have y'all come to a resolution here? and she also asked was there any precedent for any of this and the prosecution. >> ainsley: said no. >> lawrence: said no. so for all of the nonsense that they have been saying about this being political, that the republicans are [inaudible] production. when the prosecutors have to answer under oath and judge was there any precedent for this? they said no. >> steve: because, here's the thing, lawrence. it's not like lawyers trying to pull something over the

government. all that was laid bear yesterday was a little embarrassing to david weiss appointed by donald trump. to her credit the judge said this is not completely above board. >> lawrence: i think we have the quote from the judge. >> steve: we do, but, first, what we have got to point out is what really the part that was -- she felt, unconstitutional was the drug diversion because the drug charge is going to go away provided he stays off drugs, gets a job, all sorts of stuff like that. here's the thing. the judge said this is not legal because, essentially, the way the hunter biden lawyers wrote the deal was if a republican becomes president, and because usually it's the doj that enforces this kind of diversion program. but the hunter biden lawyers made this judge the arbiter of whether or not he was breaking the deal. and she said.

>> lawrence: i don't want to get in that. >> steve: there is separation of powers right there. that should be executive branch, not judicial. she said that's unprecedented and probably unconstitutional. >> ainsley: so the conditions of hunter's release. he has to actively seek employment. she said go get a job. he can't use alcohol. >> steve: poor guy. >> ainsley: he can't use elicit drugs. he has to submit to drug testing. he cannot possess a firearm. as long as he adheres to this agreement, the gun case is wiped from his record. otherwise, the felony charges carry 10 years in prison. >> steve: well, the interesting thing is and for people to say look, he got a sweetheart deal. they were only going after him on the gun charges. and the tax eevaporation. the u.s. attorney said the investigation into him is continuing. >> lawrence: ongoing. >> steve: they might get another bite of the apple and go after something else. >> ainsley: when she says go get

a job does the painting count? >> lawrence: i'm not sure. >> ainsley: making a lot of money from it. >> lawrence: jonathan turley talked about how this deal is falling apart. watch. >> the problem with a plea agreement is you can't actually type in wink and nod, right? the problem with this agreement is that the judge read it and said what is this? part of the obligation of the court is to make sure that the defendant and the government are very clear on what the agreement means. and they weren't. and it broke down with the most basic questions. that was what was so surprising here is that these are the types of questions as a defense counsel you work out with prosecutors in advance. but she basically asked one question and the whole darn thing fell apart. and so the question now is where do you go from here? it's like a wedding where both the bride and groom objected. and everyone else is sitting there saying, wait, how did we get here and where do we go from here? >> lawrence: yesterday was the

first time, i think, hunter biden was ever held account being. the judge, at the end of the court proceeding apologized to hunter biden. she said, look, i know you want to put this behind you, and this is really not fair to you but essentially she said this is not how the system works. you don't get to negotiate some sweetheart deal like this behind closed doors and you still be under investigation. the standards that have been applied here and according to the counsel is unprecedented. you have got to come back to court and this is my order to you go get a job, no drugs, no alcohol. the white house press secretary said that the president and the first lady, they just support their son. watch. >> hunter biden is a private citizen and this was a personal matter for him. as we have said, the president, the first lady, they love their son and they support him as he continues to rebuild his life. >> steve: and we have heard her

safe that from the podium before. but, you know, when you think about the part where she said hunter biden is a private citizen, that is absolutely true. he is in the public eye, but is he a private citizen. he is a private citizen who lives at the white house. think about that. you know, essentially, the prosecutors are leaving open the door that they could go after him for the foreign agent lobbying thing. can you imagine if there was an unregistered foreign agent for another country living upstairs at the white house? that's a possibility. >> lawrence: what a liability. >> ainsley: the judge also accused a member of hunter's legal team, the lawyer of pretending to a staffer for republican congressman jason smith. jason smith is going to be on our show. we are going to ask him about it, on a phone call to try to get a court filing removed from the docket. there was testimony from these two irs whistleblowers and they wanted that removed. she says, the judge says that they pretended. they called up the court and

>> steve: all right. on this thursday morning, we start this segment with a fox weather alert. the heat is all about to heat the east. more than half the united states under heat alerts with extreme temperatures expected today and tomorrow. get ready, folks. >> ainsley: officials are warning temperatures will approach or they will top triple digits in cities across the northeast. >> lawrence: senior meteorologist janice dean is live with our fox weather forecast. j.d., what can you tell us? >> janice: yeah, extreme heat warning in the new york city area. this is the first time in a couple of years we have had heat indices well over 100 degrees.

you can feel the humidity right now. 82% right now. not only is that going to fuel the potential extreme heat for the humidity. we could have some severe storms later on today. keep that in mind. a couple things to worry about in and around the new york city area all up and down the i-95 corridor as temperatures get up towards 100 degrees and feel even worse than that heat alerts as you mentioned for millions of folks stretching across the plain states in towards the northeast, including d.c. up towards boston. there is your forecast today. not including what it feels like with the humidity. and look at phoenix. holy moly, i mean, we have just seen weeks on end of temperatures well above 110 degrees, but by the weekend and into next week, things will start to be a little bit more normal for them. i know 106 is not normal for us but it is for them around this time of year. strong to severe storms for the midwest and the northeast today. and it feels like summertime. also want to make mention that the monsoon season is back into

>> so these tactics have been used multiple times. but this is about timing. what we're seeing right now, it has everything to do with timing. these are people that are trying to evade apprehension. they are not giving up. they are not wanting to be taken into custody. what the smugglers do, what the cartels do is they flood our resources with the number of people. we have to then take them into custody. it takes our agents out of the field. these vehicles are not meant do be disguised from border patrol agents. we know what our vehicles are we know how many vehicles we have in the field. when we don't have the resources in the field, these vehicles are meant to disguise against other law enforcement agencies. that's what they are trying to get across. they are trying to get undetected from other law enforcement agencies. not from us. they know when we're not in the field. they know when they can deplete our resources and that's when they bring these vehicles across. that's why it's all about timing. >> ainsley: we remember this happening before and our producers did some research for us and they said this happened

2021 when a cbp vehicle was transporting 10 migrants. and then just this last june, the fedex truck in el paso, that had 26 migrants inside. how are these -- how do you detect these trucks because that looks like a fedex truck to me i would never pull it over and think there are 2 # migrants in the back. >> so, there's a number of ways that border patrol agents will detect these. first off, fedex normally does not use vehicles that are so beaten up like that vehicle. that's the first key right there. the other thing is look at specific, you know, the tires, whether or not that looks like a newer vehicle. it looks like an older vehicle. so that's going to be the key issue right there. also, when you look at the colors, when you look at the lettering it just doesn't completely look right. and that's going to be. and that's something that we are all trained to do. we are all looking out for those things. but the problem, ainsley, is if

we don't have the agents in the field, it doesn't matter. those vehicles are going to get by us. we have to have the agents in the field. as long as we are tied up with 4,000 apprehensions every single day, we're just not going to have those resources in the field to be able to protect the american people. >> steve: brandon, i don't know what you are talking about because secretary mayorkas was on capitol hill yesterday and he made it very clear that first of all is he following instructions from the home office. this is what joe biden wants him to be doing. and the cartels we're all worried about actually weakening under joe biden and mayorkas. watch this. >> have they become stronger or weaker on your watch? >> congressman, the cartels have been a challenge for not only this country but many countries. >> are you not able to say whether they are stronger or weaker on your watch? >> we, through our efforts, our efforts have weakened those cartels by the investigations and prosecutions that we have

her house. ruffle ultimately told police the story was made up. those your headlines, steve? >> steve: carley, thank you. a years' long investigation into the president's son hunter biden still not over. hunter still under federal investigation, apparently as his called sweetheart deal dramatically fell in part in court yesterday. the prosecutor saying hunter could still face charges over deals in china and ukraine. next guest calls it a from the beginning. sol wisenberg joins us from houston. sol, good morning to you. >> i wouldn't call it corrupt from the beginning. it is certainly tainted now. >> steve: indeed. in fact, you and i were talking during the commercial and have you looked at a lot of plea agreements. you have never seen anything quite like this. >> no. and neither had the judge. now, she has only been doing criminal stuff on the bench for a few years. i have been doings it a prosecutor and defense attorney

federally for much, much longer. i have never seen anything like this. they basically, both sides basically buried a key provision within the diversion, the pre-trial diversion. there is the pre-trial diversion which usually the judge has nothing to do with. there is a very broad provision in the pre-trial diversion agreement is basically what gave him, hunter biden broad immunity. and the judge figured it out and wouldn't let it happen. and, by the way, this is paragraph 15 of the pre-trial diversion agreement. she didn't even get that apparently until a few minutes before the actual plea hearing. very, very hinky. >> steve: no kidding. and the day before the judge received, i think, 400 pages from the house ways and means committee chairman jason smith who is going to be on our program in a little bit which included the whistleblower testimony. and we heard them live last week.

did that -- how did that change the case? >> i don't think it changes what she is going to do at all. unfortunately, i think she has the right to consider anything in the public record and to say i just don't think this deal is in the public interest. and i'm not going to accept the plea agreement that calls for a misdemeanor. but i don't think she will do that. she sent kind of a signal early on, kind of a subtle signal that she considers that -- that's an executive branch issue. so i think ultimately, she is going to accept whatever -- whatever plea deal, whatever compromise is hammered out by the prosecution and the defense. >> steve: seems like even though the two sides have been working together on a deal for months, reportedly, it seems like they show up in court, they don't have -- they haven't kept their answer straight. one side, the prosecution says the investigation is ongoing. and the defense says no, it's

not. the prosecution apparently agreed to one of the provisions regarding the tax evasion was he would wind up with broad immunity forever in the event that a republican is elected president, sol. they wouldn't be able to come back at him over something else like foreign lobbying. >> well, that's the provision i was telling you about that's hidden in the pre-trial diversion agreement. and, again, you should never go into court for any kind of a plea agreement, particularly something this important, where the -- where the terms aren't very clearly spelled out and where the prosecution and defense aren't on the same page. and so what happened here? these people incompetent? no. they are not incompetent. i agree with what andy mccarthy said yesterday on one of the shows that they really thought the judge would rubber stamp. this and as she said yesterday several times, i'm not going to

be the rubber stamp. >> steve: so, ultimately, you think after they put their heads together again, the they will work out the agreement in two or three weeks from now she will go okay, i will take the deal now? >> yeah. they are going to have to make it very clear what kind of immunity, if any, he has going forward on other issues. they are going to have to make that very, very clear. and it's got to be in the agreement itself and not in this other agreement. the good thing is, i guess, it does give anyone else who wants to file an amicus brief like the house did, like congressman smith did a little time to do that. >> steve: indeed. all right. sol, thank you very much for getting up early out there in houston today. >> you're welcome. >> steve: thank you, sir. coming up on this thursday, ufos sore. >> they are airspace.
