families. >> ainsley: we begin with a courtroom curveball, hunter biden pleading not guilty in delaware after his so-called sweetheart deal on tax and gun charges falls apart. >> steve: sticking point is immunity from future prosecution. >> lawrence: lucas tomlinson is live at the courthouse. >> lucas: thank you, this was supposed to be five minute pro-forma deal and it stretched three hours. just getting word from our colleague jake gibson, both parties have 30 days to come up with written responses to her question. this was supposed to take five minutes, the case starting unravelling when the judge asked the prosecution, is this criminal investigation in the president's son over?
5:03 am
the prosecution said it isn't. the judge did not let him plea if he thinks he has protection from something and he doesn't. karine jean-pierre added the following. >> hunter biden is a private citizen and this was a personal matter for him. as we have said, the president, the first lady, they love their son and support him as he continues to rebuild his life. >> lucas: the plea deal is not over, hunter could enter a guilty plea 30 days from today, two days after fox hosts the first gop presidential debate in milwaukee. the terms hunter musts look for a job, not possess weapons, not use alcohol, not use narcotics and permit to testing of

5:06 am
that was a bombshell and signal from the judge and i amraud the judge, something stinks in this plea agreement. some point, the people working for the federal government cut this sweetheart deal with hunter biden. "wall street journal" pointed out anyone else in america that did what hunter did would go to jail. here you have blanket immunity and judge was concerned with that, how do i sign an agreement for things that let him off the hook, when we don't know if the investigation is over. we've been doing in the house and jason smith's committee and james comer committee and jim jordan's committee, combine last week with whistleblowers that came forward and brought evidence. they talked about deeper crimes they were trying to look to and told to stand down by superiors. everywhere you turn, hunter was
5:07 am
getting sweetheart deals and treatment that nobody else in america would get. there are questions and jonathan turley raised this, if he should have been registered as a foreign agent. he is getting millions from foreign countries, ukraine, getting money from chinese companies to be an energy expert even in america and yet wasn't registered as a foreign agent. others have gone to jail for that. there are more questions. our committees will not stop working. you showed the clip from jason smith. this bizarre twist where jason smith's attorneys filed some information with the judge and then the -- somebody from the other council from hunter biden's law firm called and got it pulled down. the judge said, were you misrepresenting yourself? that hasn't been answered adequately, bizarre your honor it of events. over and over again issue the judge got sick and tired of seeing the special treatment and said let's go back to square 1.
5:08 am
>> ainsley: what was your reaction to the judge finding this, seems like she found the fine prints, he will be granted immunity from everything going forward. they put this word and language in there and she saw it and said, no, this will not fly. >> that was section 14 and 15 of the plea agreement. the judge looked and said, hold on, you're telling us you can't turn over information to congress and we're trying to get more information. the justice department and fbi says there is an ongoing investigation. the judge said if there is ongoing investigation, how can you give him immunity when you are still looking into it. i will not sign off on this. i applaud the judge, nobody in america would get that sweetheart deal and he shouldn't because his name is biden.
5:09 am
>> steve: we've heard over last couple months, david weiss, the u.s. attorney whose department brought this, they agreed to the sweetheart deal and it is a head-scratcher why would hunter biden get such great treatment? they all work for his father, who heads up the executive branch. david weiss said, i'm not the decider about this stuff and you hear the attorney general say, it is all on that guy, david weiss, it seems like between david weiss and the attorney general, somebody else at the department of justice is calling the shots. >> right and keeps pointing back to people like david weiss, if not weiss, start you can taking about who it is. we are not done with this investigation and it is not just about hunter biden, we've seen references to the big guy and there are bank accounts we are seeing the administration trying to block and the white house trying to block. you just saw days ago, for
5:10 am
years, including during the campaign, joe biden kept saying he never talked with his family about business dealings. we have video of joe biden saying that and a couple days ago, karine jean-pierre changes that and says he never was in business with his family. that is a major change. the white house hasn't explained that, what about the times joe biden chided other people, including during the campaign by saying i never talked to anybody in my family about business dealings. it emzoos clear that is no longer the case, there is evidence of him talking about business dealings and talking to people at burisma. that is another change white house hasn't explained. >> lawrence: congressman, you guys deserve credit, when i'm innin dooers talking to voters, especially republican voters they say you guys are not fighting enough. you guys fought and were on the gas and i don't think we would get this revelation without you

guys fighting. i think the judge saw the documents you provided and was moved to dig deeper. you deserve kudos. thanks for joining us this morning. >> i think we were at one of the diners in pennsylvania and said we would dig to find the facts and get to the american people. takes time, but look what we've done, not trying to short cut things, it takes months and months and all that time we had the administration trying to block this. they do not want to give us this information. we have gotten a lot, there is still to come and more we will keep fighting to get and the american people need to see all this. >> steve: yesterday a scary moment there in the u.s. capitol with mitch mcconnell, where reportedly he got light-headed what his office said. have you heard how he is? >> i haven't, i need to reach out toim had. my hearts and prayers go out, i

have not spoken to him yet. >> steve: hope he is okay. >> ainsley: there he is right there, froze for a while, talking and stopped talking and froze. >> steve: thank you very much. all right, last week on the program, we told you how there was outrage over jason aldean song called "try that in a small town," and remember the song came out in may and nobody complained about it until the video came out. critics said it is anti-lynching and all sorts of things and him in front of the courthouse. they said once upon a time there was a lynching there. supporters said they filmed about a hundred things in front of the building and nobody had a problem until he sang this song. >> ainsley: joe rogan said so many songs have racy and raunchy lyrics and this is the song
5:13 am
people decided to be outraged about, so strange, he said. listen. >> the level of outrage coming from people upset about that song and so strange when there are hundreds of rap songs out there that are infinitely worse. there is hip-hop, wild rock songs, a lot of wild -- and to be focusing on that one and it is the racial aspect of it. crazy. the real antifa problems happening, i think a lot of white people doing it, wasn't it? lost liberal whites who were angry and decided to take up this movement, so the racial aspects, there is nothing racial about the lyrics. >> lawrence: what a great point, i made a similar point on my show on saturday, about when it comes to art in general, whether
