always dancing. new questions surrounding the collapse of hunter biden's controversial plea deal and why the judge blew up the deal over immunity provision. the hearing was supposed to be cut and dry, in and out. the president's son was expected to agree with the plea deal and plead guilty to two misdemeanor tax charges and one felony gun charge. the hearing didn't go the way as expected. judge maryellen noreika took exception to several parts of what has been called a sweetheart deal and questioned the terms of immunity provision granted within the agreement. noreika claimed she had never seen an agreement quite like it, the deal was too broad and should state hunter protection from future charges. judge the said, i have concerns

about the agreement, i can't let him plea to something if he thinks he has protection from something and he doesn't. emily, break it down legally. where is he today? next steps for him? >> emily: i would like to provide detail so viewers understand what happened yesterday. pretrial diversion agreements affect a lot of us, oftentimes just between prosecutor and defendant. usually the judges do not have anything to do with it. that is the point issue the judges rarely sign off, it is something to crease efficiency in the court and increase rehabilitation and independence of defendants. think of something between prosecutor and defendant outside of the judge's purview. so why in hunter's pretrial diversion agreement on the gun charge, did it say if there was any violation it would be the judge that would step in and

levee the punishment and results? that is unheard of, it is the doj, the prosecutors who define and bring charges. that is the first issue. the second issue is one of immunity, blanket immunity people keep addressing was buried inside that pretrial diversion. >> harris: page 15. >> emily: again, it is outside the judge's purview, she might not have seen it, it was outside her realm to accept it or reject or change the terms whatsoever, ask questions about it. largest question of all, why did the doj or why did hunter biden attorneys bury that in the pretrial diversion agreement and why did hunter biden's attorneys have no idea that immunity wasn't blanket? when asked about it and yes, the door is open for future charges

potentially, there is ongoing investigation, this does not limit liability and vulnerability of fara and the like and other business dealings. hunter biden's team aghast said, if that is the case, we're pulling out. there was massive miscommunication between both. they thought they had blanket immunity and they didn't and this blurred blanket immunity was hidden and gave the judge purview over gun felony diversion aspect of it when she normally wouldn't. so many issues with this, greatest question of all, what now and what does this mean for the president joe biden, who played a probably quite large role in underpinning facing hunter right now.
