misconduct used at level never seen before. our country is suffering from doj abuse. latest charges include one more count of willful retention of national account information and conspiracy, false statements and destroying documents, bringing the grand total to 41 criminal charges with the possibility of 140 years behind bars. some lawmaker are calling out what they consider more evidence of corruption within the biden justice department. listen. >> it is any coincidence the doj rushes today after the hunter debacle, after their two-timing is exposed, the plea deal gets blown up, oh, let's indict trump on something else temperature is subversion of the rule of law. they are taking the rule of law and turning on its head.

>> brooke: the third defendant to face charges is set to appear in a florida courtroom on monday. >> carley: brooke singman, thank you. bring in mark smith, constitutional attorney and former member of president trump's transition team. what do you think of this latest development regarding the additional charges? >> we've talked before, justice in america requires not just actual process be fair, but the appearance of justice is equally important. this is a criminal case, americans have a stake in the outcome and how it is perceived and does not look good in my opinion that the department of justice rushes out and brings this superceding indictment right after what happened in the courtroom. doj did not look great with the hunter biden situation. one level from a public perception point of view, timing does not look great.

beyond that, every additional count doj brought is potential legal land mine to them, you can overcharge someone to the point if one count blowup in front of a jury and hurts credibility, it could hurt the entire case and there are risk associated with the government's position. >> carley: land mine, i see another potential land mine and carley eluded to it. with each charge, either brought by jack smith or other doj attorneys, doesn't it bolster trump's argument of this two-tier system of justice? look at the charges against me and you have special counsel hurr, investigating joe biden's document case and we've heard crickets. what say you, mark? >> some point it begins to look like it is piling on, remember end of the day, this is document

case and seeing charges involving proceedural crimes, this indictment of low-level employee, they are indicting low level employees, they want them to flip and cooperate with the government, my best guess. that is what prosecutors do all the time, more they pile on donald trump and compare, mar-a-lago was raided by the fbi in contrast, joe biden's home was never raided and the documents joe biden had he procured when he was not president of the united states. donald trump got the documents as the president and he is uniquely situated because he is constitutional officer under the u.s. constitution itself with special power as commander-in-chief. joe biden never had that during the relevant time period and no one is invading his home, he's not been indicted. from a public perception point of view, it does look like two standards going on here.

public perception is extremely important, you want people to trust the rule of law in our country. >> carley: i understand perception, legally, he ordered head of maintenance to delete footage federal officials were asking to look at, that sounds like serious allegation to me. is there avenue where he could fight that? >> well, the charge is specifically what is known as an attempt crime, which means you attempted to do something, but you didn't succeed, according to the indictment and allegations, there were conversations about whether or not to delete security footage that arose after a draft, i repeat draft subpoena was somehow made aware of a draft subpoena involving the tapes. yes, i don't think it looks great that this were to happen. attempt crime requires not just there be intent to commit a crime, but substantial step

taken to accomplish that. the question here for a jury to decide whether or not conversing and discussing possibly removing tapes, whether or not that is sufficient of material step to go along with the intent to commit the crime. you have to do more than think about it, you have to do something about it, there is threshold the jury will have to decide. >> todd: the extra charges will in all likelihood push this case beyond the may 2024 trial date put out there, more charges you add, more classified clearance you need, looking after november 2024. thank you for your time, we appreciate it. teenage girl begs lawmakers to put an end to gender treatment and surgery for kids after sharing her own personal story. >> i don't wish for a child to have the same result as i did. i don't wish for anybody to regret transitioning or detransitioning, it is

>> find authority in the laws this legislative body considered and passed. it may not use gender ideology to twist a statute. >> carley: those people were testifying for the house judiciary sub-committee, the first woman, chloe cole, she said doctors put her on hormone therapy when what she needed was therapy. she's detransitioned. there are young people who go through the process that live to regret it and it feels like it has become controversial, unpopular, deemed hateful to point that out. you have to wonder why. >> todd: it is unfortunate it has become that way, democrats, so many on the left saying if you talk about the issues and raise questions with regard to gender dysphoria and things along those lines, you are a bigot and don't love kids. i argue it is the exact

opposite. we are raising issues because we do love kids, as parents, you love your kids more than anybody else. you care about all children and all we are asking for is an examination into the kids mental psyche to make sure we have gone through every single psychological step possible before we pump drugs into them. in some instances, or even surgery, that may be the only step, if that is the case, fine, but you need to go through a long process before then. it can't be the first step, then you have irreversible experience, like this young lady. >> carley: i agree, there are people who have gender dysphoria, small segment of the population, if you look at the trends now, young people who say they are trans has increased exponentially and you have to wonder why, could there be

another reason? is it popular to say you have this? you get sympathy or some other ulterior motive. a republican from louisiana played a clip from a doctor named blair peters, he calls himself the queer surgeon, at oregon hospital in portland. this doctor admitted no one has examined safety and doctors know almost nothing about the outcome and he's like in five to 10 years, it will be interesting to figure out what happens to these people. these people are children. it feels like these doctors, adults, are experimenting on young kids and in some instances, it is irreversible. you can take hormones to reverse what has been done. >> todd: if you care about the children, you would look into that and they are not and that

saying it, what the american people are saying. the most recent quinnipiac poll shows the economy, number one, top issue facing our country today. past month, we've seen headlines saying half of americans wouldn't be able to afford bills and groceries if they lost their job and four in 10 americans struggle to pay their bills. more americans, this is not fox news, this is yahoo finance and the like. jessica, the election could be decided by your state of pennsylvania. do you expect the voters to punish joe biden or whoever the democratic nominee is for the way the economy is right now for how everything is so darn expensive? >> i could tell you personally, i am still very torn as to where my vote would go. it is not going to joe biden, i know that. i've struggled so much with the
