>> we are out of time. i love you, america. >> and good evening, everybody, i meant for trace gallagher and this is america's late news. fox news at night. fox news @ night. making, parents teachers and faculty at catholic schools in western oregon tonight are no real uproar over new guidelines from the archdiocese there regarding transgender students. portland archbishop says "students should be based on their next assignment is." we'll talk about that and also president biden appearing at least intimidated by talk of a possible inpatient requiring by republican but truly think the matter more seriously?
8:01 pm
we begin this hour with candidates sending in the hawkeye state of iowa is to begin to heat up in the 2024 presidential race with the former president donald trump sharing the stage with opponent the first time this cycle hunge correspondent ashley strohmeyer is now with the latest. hey, ash hunger. >> the first time the republica primary nearly all the candidates were in the same roo in the early caucus state of iowa. hawkeye state voters got to hea from the team republican potential candidates tonight at the iowa gop annual lincoln day dinner his with the leading candidates had to say. >> if i were not running, i'd have nobody coming after me. or if i was losing by a lot i would have nobody coming after me. >> in my white house there will be no cooking allowed in the white house. and, look, my son is only five years old, so he's not going to be learning his pockets with money from foreign governments. >> joe biden and the radical left, he is attacking the value

>> we knew a lot of them were going to be because this is about fundraising, this is abou money. but the reality is, no, this isn't the type of event where they are going to be going head-to-head. each person had ten minutes to speak. so in my opinion this just a precursor to the main event tha will take place in the a little less than a month in milwaukee, the first republican primary debate. is still up for debate whether or not donald trump is going to be there. i really think he may not because his poll numbers are doing so well go here looking a that same, local manqué i don't want to give other people the spotlight by going head-to-head with them," so i think you may take a backseat as we start the initial debates. we will have to see. grades see them all on stage, and why they think they would b the best choice please i think you better educate everybody ou there competing dispenser, do you agree with that? i saw you nodding to the commen that maybe president trump doesn't want to get out there and debate. he doesn't have to now at least if you see numbers. >> i think beverly was right on that angle as trump has such a

lead right now that if he goes there it will be all of these are candidates watching up at him and him deciding what to punch down on those that are candidates, and that doesn't necessarily serve him well when he is already doing so well in the polls regarding the damage and it was interesting. i hope will be more troublesome candidates to maybe hear something before the debate, bu mostly the same fear we had before not a lot new on the dinner. >> you know, i'm curious to see how the vp do because i think a lot of people are beginning to wonder, does he have the momentum even make the debate stage, and yet even if you make the debate stage, how much of a impact even have on the race to change he has been assistant he will make the race a bit he hasn't met all the criteria as of now set by the republican national committee. he said he will be there but is still missing the donor criteri that he needs to get those 40,000 donors in order to appea wrong it will be interesting if he is on the state to see maybe if that changes president trump circulation on whether or not h wants to be there for the
8:05 pm
excellent point. beverly, on that, what do you think? >> yeah we have to see whether or not he does make the criteri but it is not just him that you have out there, who worked in the administration as vp, nikki haley part of the administratio and also you wonder these peopl that work for them, are they really going to hit from heart if he is on the stage. i think a lot of them are going to have to start taking a lot o those shots and explain why the would be better than trump, eve though they praise him while working for him. i think he gets a little tricky for them. yeah it is very tricky because you are dealing with a possible cabinet position later. you to be careful how you handl him because, as you know, he is a political ritualist at the highest level. why we have a moment, and i think we have about 60 seconds left so very quickly want to ge your take, beverly and the facebook files. this one of those stories i think is really being under reported. it certainly appears that the biden administration was in, if you will allow me, hoots with big tech to censor americans. >> yes, this is a huge story if this is proven to be true. and a lot of us thought this al along, that information was
8:06 pm
being suppressed. and we knew it had to come from someplace more than just facebook in this instance. and what this is pointing to that even facebook's such as your policies were not on the level that we saw. it was actually the biden administration demanding and putting pressure on social medi companies, in this case fac facebook, to censor more information than what they woul have normally censored. so when you look at covid vaccine lab victory, really considering that the government would be involved in suppressin free speech in this way. i tell you, spencer, this is on of those stories i think should be bigger. jim jordan has really been all over this. yeah i think the more sunlight you can put on this situation, crowds, collusion, whatever you call it between biden administration and his big tech companies we need more of it because right now the democrats might not have a problem but it had become the standard will come around to bite them in a big way. >> you nailed it goes sometimes a worm can turn, if you will or if you are not careful turnabou becomes fair play but it great to have you both was us. we appreciate both of you being

and the separation of powers th court stays out of it. politically speaking it is whatever congress says it is. strong words there. your thoughts and what he had t say there, john. >> whether president biden couldn't be impeached. that's a very tough question. because a lot of the conduct that we are talking about, whether president biden himself benefited in some way from the money that hunter biden seems t be collecting from foreign governments and foreign countries, and then was rooting through multiple shell companie and disturbing the family members. that all took place before bide was president. so it is not clear whether he could commit high crimes and misdemeanors within the scope o the impeachment clause for comment before hand. but -- and back this is the big but, if the prison for working through the attorney general were trying to forestall or eve obstruct the investigation into hunter biden, while president

biden's president, that could b the aggressor in impeachment inquiry. and andy is completely right, the supreme court has said for many years it will not review and get involved with impeachment inquiry, for not review what the congress thinks is a high crime and misdemeanor. that is up to the house and the senate to decide. >> will, are you in agreement? i think what john said there is very important in particular th timing. what is the old saying, it is never the crime, it is always a cover-up. your thoughts on what john just said. >> i think that's right. i think it is worth pointing ou that the hunter biden plea agreement that blew up in court the other day was so highly regular and so strange in terms of the way they structured it, both to attempt to avoid judicial oversight and also to avoid look attention at the scope of what was effectively this broad grant of immunity being given to hunter. it certainly begs the question, what the justice department, an potentially in the white house
8:12 pm
knew that this deal was on of offer? and who was involved down the line i don't think we know enough to say whether president biden could be susceptible to impeachment or potentially criminal charges after he leave office. but i think that that whole hearing the hunter really raise more questions than it answered. >> i think certainly a good dog and there is just so much -- so many questions that still deserve examination here. and i think if you are the whit house, having the president lef this off is probably not the wisest strategy. because i think it is deadly serious for him politically. speaking of hunter biden, i wan to talk about the latest involving him. let me share a little sound on the former secretary of state mike pompeo in your reaction on the backside. about 15 seconds each.
8:13 pm
listen to what mike pompeo had to say about that: belief that just got to the heart of it wit a simple question: have you ever done anything like this before? is this unique? can you sign the president for what you have just done? of course, the prosecutor candidly under oath, in front, of course, had to admit, no, never done anything like this before. i think every american, frankli are just red america, could see that that is unjust, it is unequal that these parties weren't actually negotiating a plea but were actually working to undermine our justice system. >> about 15-20 seconds each, guys. i am thinking special counsel, professor you processing secretary pompeo said everythin will now just said, everything we heard the man's a special counsel in this case. the government is in a conflict of interest because it cannot, into government led by presiden biden without conflict to investigate the son of the sitting president. >> will, do you agree? >> yeah absolutely. i would just add that hunter biden's alleged crimes directly advocate president biden. of shared that offshore deals with charisma, all of this ultimately ends up with the big guy, and the big guy is sitting behind the resident asking the white house is exactly what a
