country. the naacp i am proud i'm very, very happy they did this. i applaud them for finally pushing back at the perpetrators of crime and the root causes as many like to use the phrase root cause which in this case is defund the police movement. along district attorneys and other rogue district attorneys around the country per. >> using the city leaders, not just in oakland but also it san francisco and elsewhere do you think they will listen to the naacp that calls this a state of emergency and went to public officials to do something. >> over here in san francisco we've already move past that in a sense with recalling the district attorney prior last year bodine. now our eyes are focused on what can we do? what can the nation do? what can the bay area do to help out oakland and alameda county.

of the i's are dotted, the t's are crossed to make sure it is an ironclad case. that is what we are seeing right now. she has not completely dropped this issue. she is under rules, under the law she cannot hold those who are potentially prosecuted those potential suspects hold them indefinitely so she is required to let them go. she has them on notice she can bring them back in and charge them. she is looking for more evidence, video evidence and eyewitnesses that's what's happened there. and i applaud her for doing that. we do not want to have these cases just dropped. before we do not want them dropped meanwhile is taking steps and actions throughout the city, more funding, dealing with the police as well is calling the state of emergency here is what the mayor recently had to say about crime. >> we know that public safety right now in the city is what

everybody's talking about. we know it is the number one concern. it has to be reflected in our budget investments. eric: they speak it but do they finally really get it? >> london is coming under a lot of pressure. next year she is facing the reelection and the polls are showing her polling is dismal. there's a very good chance she's going to be thrown out of office and deservedly so in my opinion. she started defend the police here in san francisco back in 2020. she dated this is all on her. she has been very reluctant to bring back the police. she is not brought back the kind of funding that would be required to bring our police department back up to snuff as it was before. she is just dragging her foot because of the public sentiment initially was in her favor saying we need to defund the police.

the whole fallouts of the movement back in 2020 and george floyd. but now the intense public pressure to rain and crime here in san francisco, she is trying to say whatever she wants but it is not quite help in my opinion i do not think she is going to help. eric: she's not here to defend herself but we will reach out she would likely say they're taking steps. but the result will be the result if crime indeed is cut. richie, always good to see you, thank you. >> thank you so much for having me. arthel: eric, san francisco building inspector say they are investigating elon musk twitter or installing a giant x logo on top of his company's headquarters yesterday without a permit. it is part of musk rebranding of the social media company which just changed bluebird icon to the black x on app stores. most of permit problems come just days after police stopped

devon archer closed her deposition on capitol hill could potentially provide devastating testimony in the hunter biden case. meantime former president donald trump's legal woes are mounting as mr. trump is facing new charges in the classified documents case. among the accusations that he tried to erase mar-a-lago security footage to obstruct the investigation. let's bring in former federal prosecutor andrew now. i want to get your legal analysis of both cases we will start here. if you could tell me what are the greatest legal challenges that hunter biden is facing? >> the information we are going to get from devon archer tomorrow is going to be something very important in understanding whether there is a case to be made that bribery took place here. in a bigger context i think hunter biden really has to first concern himself with what is going to be coming up with the deal that he cut for his tax evasion.
1:14 pm
realistically many defendants in the same position with the same tax violations plus the gun charge base of federal convictions with jail time. i think that's probably what is most concerned about in the instant moment but that bribery scandal is i think the bigger overarching thing that could ultimately lead to significant jail time if true. arthel: what is the likelihood in your estimation of hunter biden being prosecuted and incarcerated? >> ultimately entered biden has a very difficult situation trying to justify or having his counsel justify to the court the plea deal especially with the guard duty diversion is appropriate constitutionally essentially putting the judge in charge of deciding whether or not there are violations of the diversion program in the future. i think that is one piece of it. on a much bigger scale i think the pressure is on joe biden
1:15 pm
right now because it can be shown there was a money exchange in order to influence his acts and office when his vice president, that could amount to bribery. that is the exact type of crime that leads to impeachment is called for constitutionally to lead to impeachment. arthel: as you know that part of the investigation has been debunked or that part of the claims and allegations i should say have been debunked over and over and over, disproven. but we will continue to wait and see what unfolds in this trial. meanwhile, i want to ask you about the former president. what is the greatest legal challenge facing him? >> us up the crime itself it is the cover-up they say. that is exactly what i think president trump with the new indictment in florida adding on essentially dealing with the cover-up of the dispute about the classified documents.
1:16 pm
i think that's going to add a lot of pressure to him. it's different than the claims he might have to bake about the right that he has are issues that may arise with the prosecution of a former executive for acts that were related to his time in office. there are many legal arguments to the original charges. i think he has is and more hot r in florida with the new charges. it would be shown we have a right to these documents in the first place. especially through the lens of the presidential electric records act. if i've let me ask you this, let me ask you this, whether or not he had the right to hold them or declassified them i should say. the point was he had been asked over and over to return them to their rightful place.
1:17 pm
in the archives and that did not happen. and also if you could speak to the new tape that has been released former president trump holding up these documents. saying they are not declassified here when the staff members the 'now it got big troubles. how does that amount against te president there thing is to be proven in a court of law. talking about the forward facing evidence that is mounting at the moment. the allegations. >> this idea there are demands for the records to be returned any fuse to return those records. the issue comes in and whether they had the authority to demand he returned those records in the first place. i think ultimately what should have happened. >> i beg your pardon, you did
1:18 pm
not understand my question. i do not want to relitigate that here that's not what why i hav. let me move on to this i asked the same question about hunter biden. what is the likelihood of the former president prosecuted and put under house arrest i don't again he would call for that. >> i think it is very early to put those productions on. he keeps maintaining he has a strong defense strategies here we have not seen something comparable like this today. they're very interesting issues for the supreme court to decide upon in terms of the authority to address the questions that are before the court. from a constitutional angle. to put a percentage on it without having any sort of a precedent for a case like this is shortsighted and unnecessary ppay but we have to talk about s what the evidence shows but how that affects the former president's campaign and his

credibility before the american people at the jury do their job when they are selected if it actually does that point. arthel: do you think at this point there is a possible plea deal for either men? >> i certainly do not think there is a plea deal potential for donald trump. i think that would effectively cut off his nose despite his face and not lead to a beneficial outcome for him. i think the whole premise is based on the idea he had the authority to do this but when it comes to hunter biden i think he really does want to avoid a signsignificant exposure to jail time. and also likely was to wrap this up before his father is set to go back through that reelection campaign coming up. i do think hunter biden is very motivated to find a plea deal it may end up including some jail time he wants us to finish, wrapped up and put to bed. >> he went to finish, wrap up and put to bed it appears by all

analysis the former president wants to drag it out. he does not want this to be prosecuted for this case to go to trial before the election, is that how you see it? >> i certainly think he wants us to extend beyond the election but i think there are certain efforts he can make along the way to extend the prosecution of it. the timing of things is going to be a very important thing in the american politics, less interesting from a courtroom drama perspective we see delays all the time we see cases go very quickly or cases extend throughout months or even years the interesting thing that may happen and donald trump's case is certain appeals are taken ahead of the case going to trial in fact going to the supreme court that could extend the process for trial will be on the election will that is not does notusually happen in crimil cases, this is not an ordinary criminal case.
