terms of the original plea agreement like what was and was not part of the deal. the judge was very concerned on whether hunter could get blanket immunity from future prosecutions and the judge said she's not going to be a rubber stamp. the prosecutor admitting there's still an ongoing investigation surrounding hunter biden and potential violations of foreign lobbying law. the white house, well, you can imagine not too keen to talk about any of that . >> hunter # biden is a private citizen and the president and first lady love their son and continue to support him rebuilding his life. >> as president he talks often about the need to get illegal firearms off of our streets so when someone possesses one illegally, what does the president believe should happen to them? >> i'm going to be very careful because i see where this question is going and i'm just going to refer you as this has

been an independent investigation, it's overseen by the department of justice. i'm going to let them speak to this as they're moving forward. dana: judge, there's probably a good reason that the justice department did not release the plea agreement for all of us to see because what the judge started asking basic questions, it was pretty clear it was outrageous. they should be embarrassed. jeanine: well, the deal was laughable and the department of justice is not in a good place and what normally happens in a plea deal and when i was a judge, the day you took pleas was a slow day. never any drama and everybody unlaces the parameters of the plea and the judge comes in and has to do an allocution to make sure the defendant understands the parameters of the plea and the judge will be very specific about what did you dorks what did you say, what were you thinking? in this case, in a tax case, where did the money come from, who were you working for in the tax years that he's charged for.

but in this particular case, normally you'd have the defense and the prosecution would have hammered this out. i mean, this would have been your clear. i've never had anything like that happen to me ever. dana: wow. jeanine: never. plea deals are hammered out. if they don't do it, they're going to go to trial n. this case, it was really laughable what happened. when the judge started the discussion and the intro to the allocution, it was clear that when she said what is going on with this continuing investigation? then the defense attorney started talking about immunity. and it appear that had they were thinking about immunity going into the future, not just past immunity but immunity going into the future, which is something that is just not danube less you're at the very least cooperating and bringing in someone like a major drug dealer. so the allocution as it was

supposed to go forward basically couldn't happen because once it was on the record, the department of justice had to say, well, it's the continuing investigation and the judge says so you might file more crimes, more charges? and they say, possibly. and she says like foreign agent like paul m manfort and at that point the attorneys get very uncomfortable. here's the insult, dana, this was a deal where everyone was in on the con but the judge and the american people. it was a con going down. they didn't expect the judge to ask any questions and they said, you know what, we're going to get this through and hunter is going to walk out and be just fine. the judge was not interested in what had gone on in terms of, you know, they're saying that we're going to give him future immunity because she knew it was a continuing investigation and

even if not that department but the next department of justice can have the statute of limitations and go after him. she then said to the prosecutors, is there any precedent in the department of justice for doing something like this with both of the diversion program with the gun, which she said was unheard of. i've never heard of it and one of the things i've talked about it. how can a guy plead guilty to a gun charge when he hasn't been charged with a gun charge? they didn't have any answers to any of this. now, this started, dana, the night will be last night before the plea. there was someone that called to strike testimony of the whistle blowers and happened on, i believe, on tuesday or monday of this week, from the transcript. the judge tracked the phone call. the judge found out that it was traced back to someone connected to hunter biden's lawyers. the judge is the one who found that out so when that judge walked into that courtroom, she had a bad taste in her mouth from the beginning when they tried to strike the testimony of

the whistle blowers. in the end of the doj not being able to offer this deal and say with a wink and a nod, it's under investigation and it was clear why they were doing it, to keep congress from it. dana: probably going to hear a lot about this from the left, judge, and scrutiny is coming and she is the one that ruled against laptop repairman in the defamation suit and not like she's been somebody that's just trying to help the antihunter side if we can call it that. greg, do you remember when the hunter lawyers announced this plea deal and said we have a plea deal and we consider this matter closed and the justice department sate it could be open but maybe not and maybe it is and now we know it's not closed. greg: yeah, by the way, congratulations on winning that medal at the track meet. dana: do you know you say that every time i wear it, which might mean i wear this way too often. greg: it was like they tried to

trick us and they said oh, this matter is closed and as open as hunter's robe. he demanded blanket coverage, probably the only time he's demanded a blanket. but i'm not a lawyer. all though people often mistaken me for one, i always thought you plead for the main big crime and then they forgo the little ones but this n this case, seemed like it was the reverse. the little ones only had to deal and big stuff you got away with. i'm always -- i think this is good news what's happening because if this was you, would it go better or worse? when your last name is biden, you know, not only are are you afforded exceptions from all kinds of ludicrous behavior, even the mention offed going after them was seen as off limits by the press. go after trump and that family, but how dare you go after the biden family. this guy, you have to motorcade to court. who are they protecting him from? an angry pimp or united federation of hookers?

judge is angry going in. this deal was struck before the irs whistle blowers came out. this deal was struck before the bribe document dropped, the $5 million to the big guy. so the deal probably wasn't even papered. this might have just been a gentlemen's agreement. let's not put it in writing. so a lot's changed since this deal was done and they get out there and the minute it was scrutinized, one little bit, the whole thing collapses. the justice department said, yeah, we night have to keep looking into this guy. then hunter's attorney is like, well, then the deal is off. you know, we're not supposed to look into my guy anymore. they try to put it back together and they went to chambers and could not put this thing back together. wise, the delaware prosecutor at this point, now with impeachment on the table, does not want to be a part of the coverup. remember, there's the crime and

the coverup. if this goes to impeachment hearing, they're going to look into obstruction of justice and if the delaware prosecutor is in on the obstruction, that's going to be a problem. so he tried to get a little distance from this thing. and the judge is right -- the judge comes out with this gun charge and it's a felony gun charge and just expunged for nothing. she said this has never happened before and you're not giving me any discretion. once you sign this deal, i can't even decide whether i like it or not. it's a done deal? she said get this gorge out of here. garage out of here. a lot can happen between now and september 1 when they have to come up with a new agreement. devon archer testifying on monday and then bank records coming out later in the week with comer. this will only get worse for hunter biden is that means joe biden. dana: take a listen to joe biden ignoring questions today about that. >> mr. president, mccarthy says he may go for impeachment

[inaudible]. dana: remember, harold, the white house at the time when this plea announcement was made, said case closed. we're all done here and were like we're never talking about this again and that's not what's happening heading into a pretty tough election. harold: good to be back around the table. dana: oh, yes, welcome back. harold: i think the process worked. for those that may say our process is broken in the country and two standards, this was an example of there not being two standards. judge is right, when you have a plea deal, you -- the judge often is asking the questions to protect the defendant because the defendant is entering a guilty plea, he or she needs to be afforded to say that before the court and before the jumped. as these questions, basic questions were asked, what is inexplicable to me, is how the agreement between or the miochol understanding between the prosecution and defense was not there. the defense believe that had he would get immunity for everything going forward, even un-relate to do the tax stuff and the gun stuff. i thought there would be

immunity for the tax and gun stuff, but it's hard to believe that they thought there was going to be immunity going forward unless they agreed to that. two, we learned there's an investigation -- a continued investigation on the way to hunter and some of his business dealings and three, i go back to the start because i am relieved that the process worked. i'm relieve that had the judge asked these questions, and i'm relieved that americans, every day americans are starting to understand how our process worked. we shouldn't have cameras showing cameras and audio in the courtroom and i do -- i am relieved and frankly gr gratifid that the court asked these questions and inexplicable the questions were not the same going in. jeanine: they were and couldn't admit it. dana: i think that was so not there.

talk about him here and greg talked eloquently about him and his candidacy and he's speaking to a part of the country and middle class aspirations and values. i don't agree with him on his position on the war, but he's veered in the last few weeks talking about conspiracy theories and look at polling data, he's come down a bit in the polls and i think the vaccines and even the words about israel and jewish americans. that's not why i think people were interested or tantalized by his campaign from the outset. if he wants to get back to the kennedy camelot mode and talk about middle class family issues and aspirations and va values ad how the wealth gap is worsening and how he'll address that. he's not helping to advance his campaign. jeanine: greg, 65% of americans think that the country is too divided and one of the reasons joe biden was elected because he was going to unify us he said. if that's the case, why are so many people supporting biden and
