former police officer and legal advisor to the georgia sheriff's department. so let's jump in work going to do hunter bided and president trump let's start with hunter bided first. judge accused someone from the law firm representing hunter of calling the clerk's office and allegedly misrepresenting their identity. the person who made the call said it was a misunderstanding by the person who took the call at the clerk's office. what is more though, judge assess list that you've got issues or inquiries, send them my way. so it phil, how would you describe the status of hunter biden's case? x well, it's a big giant mess, great to be with you by the way but listen, the judge started noticing some irregularities about these proceedings before court even started, as you mentioned there was this communication between someone apparently in the hunter bided defense team sources and reportedly they say this person
9:08 am
misrepresented themselves as a possibly being a lawyer affiliated with the house of representatives. now, will he do not exactly know is what, if anything the judge is planning to do to further look into that. but, if i were in her shoes i would consider what is called a show cause hearing what he ordered the parties and the people involved to come to court and maybe you take testimony from the core employees court es involved, you take testimony under oath from the person who made that call to get to the bottom of what exactly where they tried to do, what were they trying to pull a fast one? if so there will be consequences. who is merely an oversight or some kind of sloppiness, maybe there is amiri admonition with the court needs to get the bottom of what happened because courts cannot tolerate this kind of shenanigans. it looks to a cynic if you are cynical it looks like the hunter biden team did not want the judge to consider the material
9:09 am
again from the house of representatives that included the whistleblowers testimony. arthel: into your point phil i want to go there with you because the judge is also on record as saying the council for the house ways and means a committee chaired by republican congressman jason smith of missouri needlessly included on the public docket and e-mail from a clerks office staff member that contained her personal contact information. so i ask you. listen we note the court of public opinion is powerful. however with the legal process be better served if lawmakers would let the legal proceedings speak for themselves? >> yes, that is generally true. it was very unusual for the house of representatives or a member of the house of representatives to find out what we call an a in amicus brief basically asking the judge as a third party to reject the deal. it is really the judges decision
9:10 am
and each person or each interested party kind of need to stay in their lane this is not like an appeal before the supreme court were amicus briefs are expected and they are commonplace we don't usually see this in the context of a plea deal. but at the end of the day i don't think the judge really considered it that much i read the transcript and she even said she had not had an opportunity to look through it. so without looking at it the judge had some red flags. she said these are nonstandard agreements for their things here that give me pause and so she wanted to look into it a little bit further. what she found was a particularly with respect to the diversion agreement, the diversion agreement would have potentially pulled the judge into the charging decision process which is a function for the executive branch of the prosecution. arthel: she said listen do not release anybody's personal contact information for it let me move on out to former president trump in that little
9:11 am
bit of time i have left with the fill the classified documents, indictment with the new defended as you all know, new charges including accusations that mr. trump sought to delete security camera footage at mar-a-lago to delete the server possible indictments loomed over him in d.c. and atlanta the latter for alleged interference in the georgia election process in 2020. how would you assess the status of donald trump's cases? >> he certain he has a mountain of legal issues he has had to deal with all at once that does not include some the civil matters that are pending against him. look i think as early as this coming week right here in atlanta we might very well see the local district attorney willis file something a in the nature of a racketeering case possibly alleging the solicitation or conspiracy to commit election fraud but it may not just be donald trump it may be other people perhaps some big names that are in his orbit. this potentially could be a very
9:12 am
big deal and impediment to his ongoing presidential campaign for the new charges that were added and superseding indictment and the documents case down in florida, the worst of that is the obstruction charge or he alleged to have asked a staffer to delete video. so regardless of any defenses he might have under the presidential records act, any other defenses he might have two holding onto those materials, these obstruction charges against donald trump and the others are i think the most dangerous counts in those indictments and previous convicted of just one of those he could very well be going to prison. so he needs to be very careful how he moves forward through this maze of legal problems he is now facing. if i fell hollowly at the leave they appreciate the conversation pray thank you very much take care, phil. >> thank you arthel. we were foxnews lawyer at least 40 people and killed 150 wounded

federal prosecutors have found no evidence of wrongdoing by hunter biden besides his tax and gun charges. or any corroborating evidence tying the president to his son's a business dealings the press has long denied he had any involvement in them. but you know tomorrow's congressional testimony by one of hunter biden's former associates devon archer could change all of that. archer is expected to say saw the president speak to and meet hunter's foreign business partners at least two dozen times. how will this affect the investigation? tennessee republican senate marsha blackburn is a member of the judiciary co judiciary comma snowbird senator, good to see you. what do you expect to hear? what do you want to hear from
9:23 am
devon archer tomorrow? >> like most americans i would like to hear the truth. and eric, we hear from so many people every day the awareness is heightened around these issues, they want to know exactly what happened. was it joe biden a participant? the white house is change their tune rather than saying he never discussed, they are saying now he was never in business. so people are very concerned about two tiers of justice. they are concerned about what has come forward like hunter's lawyer admitting he got $664,000 from that chinese energy company. they want to know if d.o.j. and fbi with weaponize against those who were accusing hunter for why they tried to shield the bidens and keep them from facing any

accountability for these actions. steve are what is your sense of what the bidens may or may not have done questionable with hunter doing and was his father indeed involved despite the denials? >> as we go through these hearings and it is up to the house to conduct these hearings, we are going to find out what that level of participation was. it is a vi vitally important to people to know, are there two tiers of justice? they never had any of these participations than they need to come out and explained what was the $664,000 for comic gary shapley the irs whistleblower thanks there is a total of 8.3 million from chinese ukrainian and romanian interest in the very short window of time. but, this is something there should be an explanation for.
9:25 am
there is irrefutable evidence that he took this money and has he said his attorney has admitted in court to the money from the chinese energy company. eric: here's what has been whatn reported by the new york post, but we do expect devon archer to testify to and talk to merge the oversight committee but let me read you some of this in a recent article. hunter set a business meeting abroad was some ukrainians on this is what they say but hunter then called his father, put them on the speaker, place the phone on the table introduce ukrainians to joe biden by name i didn't set the words of the effect that burisma bigwigs need our support vice president biden created the ukrainians but spoke only in vague pleasantries during the short call and other such inter- actions with hunter's overseas business partners for archer is expected

9:27 am
they chose not to do anything with it. and you were talking about the plea deal that unraveled earlier this week. that shows you an awareness, i believe in my opinion that they know this is more troublesome then what was originally anticipated or people thought. this is something that is going to carry forward because it is two tiers of justice. rules for the bidens and the clintons and the democrat elites. and then these separate set of rules for everyone else. people want equal access, equal treatment and equal justice under the law. when you look at this and how they are coddling and protecting the bidens and then you look at president trump's situation
9:28 am
where they are going after him, after his aides. after workers a prick would let me stop you there for second they're doing that because he did not give over what he should have done this or not has classified documents. he can't do that. and he should have given them back a year before. when he was asked. go ahead. there is no moral equivalence here progress it is passive on one and aggressive on another. that is the inconsistency that people see and tennesseans are talking about. why is it this way? why is it the other way? this is why i t think having den archer there, getting to the truth and say this is what was done. and then holding people accountable. may be going back and looking at what happened with the clintons.
9:29 am
what happened with the clinton family, what happened with russia collusion? >> oh man the clintons. all of those years, all of those investigations. let me end this way, is not always scandals us not always investigations but let me remind people that capitol hill and legislators are actually there to do good and help people. i want to tell our viewers you do just that with a bill that expands breast screening for women who are vets i think that is so important. we think our veterans with the what reason i want to bring this up as we hear all these investigations, all the alleged wrongdoing and alleged misbehavior you've got something great like that helping people. >> yes, yes the kits online safety act came out of committee this week. we are really excited about that it is completely bipartisan center blumenthal and i have had the lead on this.
