testimony. lucas tomlinson is live with that developing story. hi, lucas. >> reporter: hi, aishah. >>. first, some breaking news this morning. on "sunday morning futures," maria bartiromo exclusively obtaining a letter about devon archer just one day before he's supposed to appear before the house oversight committee. the republican chairman of the committee, james comer, says this letter's an attempt at intimidating his witness. the justice department wants archer to surrender to be put in prison. he was sentenced last year for swindling a native american tribe out of $60 million in bonds. the letter from the justice department reads in part, quote, the government writes to apprise the court of the status of the defendant deafen deafen arch ear's appeal of his judgment for conviction and request the court set a surrender iser date to to commence his term of imprisonment. now, james comer appeared on "sunday morning futures" earlier and spock about this letter.

>> the letter from the department of justice is trying to nudge the judge to go ahead and sentence devon archer for something unrelated to what we're going to be talking to him about tomorrow. it's odd that it was issued on a saturday, and it's odd that it's right before he's scheduled to come in to have an opportunity to speak in front of the house oversight committee and tell the american people the truth about what really went on with burisma. so, you know, i don't know if this is a coincidence, maria, or this is another example of the weaponization of the department of justice. >> reporter: delaware senator chris coons defended the investigation into hunter biden and says president biden is innocent. >> look, i think the hiccup in the delaware district courthouse will get ironed out pretty quickly, and i don't think president biden needs to say anything more than he has. >> house republicans are going to accuse him -- >> they are. they're going to accuse him of all sorts of stuff. >> you don't think he needs to, hey, despite what you hear, just

so you know, i didn't -- i don't do bids with my son or my brother? >> i think he's been perfect ifly clear. >> devon arch's expected to testify tomorrow morning in that closed door session with the house oversight committee. we're told a transcript will be released horsily after the interview is. aishah: i know they've been worried about whether he was going to show up, to could this prevent devon archer from testifying tomorrow? >> >> reporter: so far james comer says he will appear tomorrow morning, but it certainly is a new wrinkle. it's it's not clear whether the u.s. marshals are going to set up a stakeout -- aishah: doesn't have a lot of time. >> reporter: no. aishah: lucas tomlinson, thank you so much. for more on the legal fallout and what could be next for hunter biden, constitutional attorney mark smith joining me now. hi, mark. good to see you. i want to get your take on this breaking news here, fox breaking that this letter was sent by the doj requesting that archer be sentenced what do you make of the timing? >> well, look, it smells, right?

i mean, it does not look at all good for the department of justice. i mean, this is a letter sent on a saturday. how many government employees work on a saturday outside of the military or police, right? that's the first thing that looks odd. and and, of course, the timing is suspicious if. we've talked about this before, it's not just that justice has to be done, it's the appearance of justice is extremely important. and these kinds of things really make it look like there's something going on here. even if there's nothing going on here, the appearance really does count when you're running the justice system. and i don't know why the department of justice continues to make these kind of actions, because to me it looks bad even if there's nothing nefarious going on. it just doesn't look good, and i don't understand why the department of justice can't figure this out before they act. >> all eyes will be on the capitol tomorrow because devon archer, if he does come forward, will have a lot to say. he was right this in the room. here's what congressman, congresswoman nancy mace said on fox news sunday about what she anticipates he's going to say

tomorrow. >> this was a person who was in business with hunter biden and biden family members, he was the bff of the president's son. is he going to tell us that joe biden us in the room via conference call or in person and to what extent he was involved in this mess? >> so, mark, let's say he comes and he says all that. how damning could this be for president biden? >> well, i think the ripple effect will be what will be key, which is if that testimony is given, i it's going to put a lot more pressure on two critical playerses here; on the department of justice to extend the investigation from hunter biden into other people involved and potentially the president himself, right in and, of course, it's going to put added pressure on the federal district court judge in delaware who ultimate wily would have to sign off on any future potential 34r50e deal, and if this kind of testimony comes out, that's going to to have her laze arer focused on it even more. she was already focused on the

immunity deal associated with his foreign business dealings, and in this kind of testimony comes out, it's probably going to cause her to focus even more on it. arab. aishah: she did send both sides to work up something new, perhaps a new plea deal that fits the constitutionality that she was raising. do you think they can do that? do you think they can come back with a new deal, or is this thing, in your opinion, going to trial? >> well, i have to say that if you're hunter biden's lawyers, you're very concerned about what just happened because you thought you were going to be able to celebrate, you were going to do a great job for your client and put this behind him. now it's opened up a pandora's box of all sorts of other things. just to give you an example, aishah, the handgun that was associated with the plea deal was a .38 caliber revolver, but now we know from photographs, of course, that he possessed other hand bubs in the relevant time period including semiautomatic

pistols. so one question may be are there going to be other related gun charges involving multiple guns? these are the sorts of things that if i were representing hunter biden, i would just be like, oh, now i've got to deal with all these other issues too. on top of the fact, of course, you have these potential fallout issues with his foreign business dealings. this is all giving hunter biden's lawyers a headache and trying to solve this and satisfy the judge's concerns about fairness, protecting hunter biden's legal rights and making sure she can legally do the deal. it'll be interesting to see what happens over the next month. aishah: okay. let's move with quickly to former president trump and all his legal issues as well. obviously, jack smith hitting him with a couple new charges here, accusing him of trying to alter, destroy, mutilate or conceal evidence by asking his employees to delete some camera footage. here's his counsel, trump's counsel can, hitting back on those new charges. >> when he has his turn in court and when we get to file our

papers, you will see that every single video, every single surveillance tape that was requested was turned over. if president trump didn't want something turn over, i assure you that is something that could have been done, but he never would act like that. he's the most ethical american i know. aishah: so she is denying, mark, that this happened. trump is denying that this happened. but isn't it easier to get minute on instruction rather than the actual crime even if it didn't occur? if. >> well, keep many mind that these added charges that we saw this week actually deal with what's known as an attempt, right? they're actually not accusing donald trump and his staff of destroying evidence, they're saying that he attempted to do so is. now, whenever you deal with an attempt case, aishah, really the major legal and factual question is to what degree do you wants -- how many steps do you have to take before you can be found guilty of an attempt. here it sounds, according to indictment, that they talked about whether or not these tapes

could be deleted, in front -- response, by the way, to a draft subpoena. and again, as to whether or not that's enough to get a conviction for an attempted crime really, of course, turns on what the jury thinks. but, yeah, exactly right. is it a charge for an attempt and not the actual doing of it. aishah: and, of course, the whole world is still waiting on this possible other indictment that we were anticipating to happen haas week. it didn't happen. this january 6th probe. are you surprised that it's taking so long? usually it's about 4-5 days, right, after somebody would receive that target letter as the former president has said he has. are you surprised how long it's taking? >> no, i think it's extremely difficult issue for, among other things, you deal with all sorts of first amendment issues; the right to free speech, the right to petition the government. so i would think set aside what actually happened9 and the facts on the ground, even if you assume some of the things they're saying occurred did occur, you have some very strong

constitutional defenses potentially on the part of donald trump. and if i were the department of justice, i'd be very sensitive to makering sure that i did not indict someone and turn around and find out that i violated their first amendment rights. that's not a good look, and you don't want to be this as a prosecutor. aishah: mark smith, thank you so much for joining us, constitutional attorney. we covered a rot -- a lot of news today, so we'll stay in touch. thanks, mark. >> thanks. ♪ aishah: and off we go. gop presidential hopefuls out and about this weekend as the first debate is just now a few weeks away right here on fox. as the california republican party approves now a change to their primary rules that is expected to benefit former president trump. alexandria alexandria hoff joins us now in washington with the latest from the campaign trail. hi, alex. >> reporter: not too far away from you here. you're talking about this california rules change, and some people that this simply locks others out. the new i rule awards all 169

state delegates to whichever candidate gets 50% of the march primary votes, so campaigns are going to have to reassess how much time and money to spend in california, if any at all. plenty of time spent this weekend in iowa. you have north dakota governor doug burgum held a meet and greet there there and former u.n. ambassador nikki haley had a town hall. former vice president mike pence sat down with first responders, and he says his campaign is closing in on meeting the rnc requirement to take the debate stage next month. >> i think people look at our career, look at our consistent conservative record, and hay know that that's a voice that belongs in that debate. >> reporter: former new jersey governor chris christie i says he has qualified and seeks to debate former president trump who hasn't confirmed if he's going to attend. here's christie today. >> i want voters to listen to this. it is most likely that by the time we get on the debate stage on august 23rd the front-runner will be out on bail.

in four different jurisdictions. >> reporter: the former president held a rally in erie, pennsylvania, just days after three additional felony charges were added, an attempt to delete security video at mar-a-lago. trump denied this in a truth social post today and sounded off last night. >> they're not indicting me, they're indicting you. i just happen to be standing in their way. what you're witnessing is a continuation of the single greatest witch hunt of all time. >> reporter: the former president slammed florida governor ron desantis in his remarks as well, and the desantis campaign fired back with a at the same time reading, quote: trump has spent over 60 million this year on two things, falsely attacking ron desantis and paying his own legal fees. not a cent on defeating joe biden. governor desantis is in new hampshire today headlining what is called a ono b.s. barbecue.

aishah: and we're going to get into all of that straight ahead. alex hoff live in washington, thanks. ♪ aishah: no relief from the scorching heat across the south today and and possible severe storms in parts of the country. for more on that, let's go to the fox weather center where meteorologist adam klotz has the latest on your forecast. hi, adam. adam: you really summed it up as we're talking about heat stretching across the entire country. now maybe the northern tier finally getting a break, and you see 75 in new york and 70s across the northern tier. but that extreme heat in the south continues here again today, especially when you add in the humidity. you get your feels-like temperatures. currently aacross florida, stretching around the gulf coast temperatures have climbed up into the 100-degree range, expect them only to get higher the next couple of days. heat alerts stretching from the texas gulf coast all the way around to the florida gulf

coast. there in the middle, a in that's where the heat is going to be at its absolute worse. really no relief here. i'm taking you from your sub forecast, would love to tell you these numbers are going to drop back down in the next few days, but they will not. taking you into, ultimately, monday and tuesday, 107 in houston, those numbers just continue to climb, you're looking aing at 1 # # is in new orleans for tuesday, something actually very similar for folks on wednesday. so this extreme heat that folks are dealing with, it is going to be continuing. you think maybe i can hop out into the ocean and cool off a little bit. well, the temperatures off the gulf in central florida getting up close to 90 degrees. real extreme heat there in the southern half of florida. sunday across the rest of the country just continuing to be very warm across the southern tier, aishah, very warm in the middle of the country. but i'll tell you what, these folks up here in the northeast, they are happy to cool off just

a little bit. aishah: okay. adam klotz with the latest, thank you. yahoo! at least 40 people are dead, 150 wounded after a powerful bomb ripped through a political rally in pakistan. the blast took place at a gathering of the conservative party in pakistan's north district board bordering afghanistan. trey yingst is live with what we know so far. hi, trey. >> reporter: good afternoon. more than 40 people and 150 # wounded after a bomb went off at a political rally in pakistan. the the attack taking place in the northwestern part of the country at an event for the juif political party. reports anticipate more than 500 supporters had gathered under a tent when the explosion took place. video from the scene shows ambulances carrying away the injured as some were airlifted to a local hospital. a district health official indicated that the death toll could increase. the political rally for workers comes ahead of general elections

in pakistan later this year and concerns that similar attacks could take place in the near future. a senate from the juif party told the guardian newspaper, quote, we condemn these brutal attacks own our workers and leadership as general elections in pakistan are approaching. the militants are creating fear and started targeting political gathers. one local leader was killed in the blast. no group has taken responsibility for the bombing, but the local pakistani taliban often operates and conducts attacks in this area near the border with afghanistan. now, afghanistan's taliban now controls the neighboring country, released a statement condemning the the attack in pakistan on sunday. pakistan's general election is set to be held in october, officials in us islam islamabad are expected to increase curt ahead of that vote. aishah: a lot of political strife in that country right now. thank you, trey. well, legal issues are plaguing the run for the white

aishah: and breaking news this morning, maria bartiromo exclusively obtaining a letter from the the president of justice about devon archer one day before hunter biden's ex-business partner and friend and fellow burisma board member was supposed to appear before the the house oversight committee. for more on all of this, bring in our political panel. with me today is west front strategies' founding partner ashley davis and democratic strategist kristin hawn. ashley, i'll come to you first because now we're up to speed on this letter, just one more fold in all of this. what do you think about the timing, 24 hours before devon archer is supposed to be on capitol hill talking with the oversight folks. >> >> i think it's very unfortunate time for the democrats to be sending the letter, but i also i think it's really good meat for the republicans and the base to have one more piece of fuel that will go after hunter biden. i think the that the main problem that the administration is facing is that the hunter

story won't go away. aishah: right. >> but i also think that the republicans need to be very careful, that they continue to concentrate not only what's happening with the administration, but what happens with what the voters care about, the economy, crime and the borders. we have to walk a fine line to make sure we're not going too far. aishah: tough to do in this day and age. ashley -- or kristin, i want to ask you, you know, if devon archer shows up tomorrow and tells oversight staff and counsel that he did overhear president biden on the phone with his son talking about overseas business deals, i mean, the biden camp has to be worried about this. >> i don't think that will be the case. but he is -- aishah: what's he going to say? >> i have no idea, we'll see. but i think that is the one kind of political liability you're looking at with president biden. i think the democrats are in a

good position heading into next year. you have desantis is not doing so well, former president trump is dealing with a number of legal are issues himself. finish but, you know, i would say also with hunter biden, yes, he's a liability, but the republicans need to be careful about how you talk about people with, you know, substance abuse issues. and i don't say that lightly. i mean, there are a lot of women, mothers and families out there who have experienced manager like this. so not to, not to dismiss the serious legal things that are going on -- aishah: right -- >> but i'm talking about politically -- aishah: oversight is now looking at t not just about hunter biden and maybe he was under the influence or not, whatever you want to make of that, this is about the president possibly being involved. and if devon archer goes in there and tells them i was there and i overheard on the phone the president, then-vice president, talking -- >> sure, i mean -- aishah: -- these burisma folks

or whoever it is -- >> can i don't think there's a grand conspiracy to keep anybody if doing this. i don't think we'll see -- you know, the justice department, people that have been appoint by trump have looked into hunter biden. i mean, this has been transparent. we all know so much about it. so the cards need to fall where they fall, and we'll see what happens. i'm not going to guess at what, you know, may or may not happen. i don't think so. but we'll see. aishah: ranking member raskin actually told me on thursday that it would be a very different day if that were to happen and then he would have to take these things seriously and look at them. ashley, the doj has really gotten itself ralphed into -- raveled into 2024. it's all over the campaign trail. you've got hunter biden's plea deal that fell apart other immunity, a possible impeachment of the current president, inquiry at least. the former president hit with three new charges inspect classified docs case. this is, these are your two front-runners. this is what ising being put on

a silver platter and given to the american people, and it's hard for folks to look at this and and not consider how a biden is treated over a trump. >> absolutely. i mean, i think that's been the biggest conversation that we've had from the beginning. not that president trump, former president trump has not done something right or wrong, we don't know yet, that will play out in the courts. but i also think that it's unfortunate that the department of justice has now become a political tool for both sides. and and i think it started happening a lot during trump that people -- >> [inaudible] >> and hillary, actually. [laughter] yes, yes, it has been happening for a while. and i think that that's a unfortunate because that's always been one department that people respected. so i think that, more importantly, those are our two candidates. so if you look at the rest of the field at least on the republican side, there's a lot of good candidates out there. aishah: yeah, let's talk about

them. let's talk about the gop field. they were all, most of them, in iowa over the weekend. nothing dramatic happened. surprising when you have trump and desantis in the same place, but then former president trump said this about desantis just yesterday in pennsylvania. watch this. [applause] >> desanctus is gone. he's just about over. i think if he ever made a comeback, it would be the greatest comeback in political history. [cheers and applause] he's gone. aishah: so i don't know if desantis is gone. i mean, he's struggling. the headlines are bad out there. he's just laid off a bunch of staffers on his campaign, and he keeps getting hit with these social issues backfiring on him, the latest what's happening in florida with the curriculum involving the teaching of slavery. what's going on over there in that camp? >> i have a lot of friends on that camp and -- irish eastern what are they telling you in. >> not much. [laughter] but i think that, yeah, i think

they have a significant problem right now, and i think that that their trying to stay out of the headlines in regards to the bad media and the press. but i do think that he has a big speech tomorrow in new hampshire on the economy that he will have. but i also think that you have the president, former president attacking the so-called second place person right now, but with then you have other candidates that are starting to surge which i think is very interesting, tim scott, nikki haley, chris christie in new hampshire, and what happens when all of those candidates start getting the wrath of the former president and each other? aishah: we'll see if he onlies to the debate stage. i want to play a sound bite from i believe it is -- yeah, ron desantis who ponded to some criticism -- we don't have it. he responded to some criticism from two very prominent black republicans, byron donalds and tim scott, who are not happy with this new florida curriculum involving slavery, and he basically was defiant, kristin,

and he says who are you siding with in are you siding with kamala harris or are you siding with florida republicans? dueck that was a misstep many -- do you think that was a misstep? >> i think that what a misstep for desantis was, was saying -- he didn't take responsibility for anything, right in right when all of that came out, he said i have no idea what the board of education is doing, that was their decision, you should go talk to them. you have to take responsibility. people want people to take responsibility. whether you like them or not, whether you're a fan of donald trump or not, he takes responsibility for his actions, right? and he's just w not somebody, i think, that is being seen as strong enough. he's also taking these positions. florida, as florida goes does not go all the rest of the country. so you have to appeal to all these voters. the 10% of voters -- 90 percent of voters know exactly what they're going to do when you get to the polls. so %, you're -- 10%, you're

♪ aishah: new york city mayor eric adams pushing to limit the influx of migrants in the big with apple, going to court now to fight his state's right to shelter law and even distributing fliers at our southern borders discouraging migrants from coming to america's largest city. hmm. c.b. cotton is live outside the roosevelt hotel in manhattan where many migrants can be found both inside and outside. hi, c.b. >> reporter: hi, aishah.

while we wait to see the outcome from those efforts you just mentioned, asylum seekers and migrants are a arriving to the city daily, and the city says while its compassion is limitless, its resources simply are not. we watched that play out in this weekend when dozens of migrants waited in a line wrapped around a city block, others slept outside, all of them trying to get into the city's main arrival center, the roosevelt hotel. but many were told there was no space. of saturday night into sunday morning some migrants found relief from the elements on on buses outside the roosevelt. now, since last spring more than 93,000 migrants have arrived in the city, and more than 56,000 are still in the city's care. back in may the roosevelt hotel was opened up as the city's central intake center to provide legal, medical and other services and offer housing for parents and children. as some migrants shipment on the street -- slept on the street, the city told fox news it's

children can families who are being prioritized and found a bed over night -- every might. we still desperately need help from our state and federal partners. that plea as migrants make one of their own. >> [inaudible] >> reporter: now, nearly two weeks ago new york city released these fliers as a notice to migrants that shelter space is not guaranteed and as a request or for migrants to consider other places. the city also announced single adult migrants would be limited to of 60-day stays with a chance to reapply. amid the city's migrant crisis, mayor eric adams met with secretary alejandro mayorkas on thursday. adams says mayorkas committedded to visiting the city and even providing a liaison to help address the city's needs, so some things to watch and wait for. aishah: well, watch it closely for us.

aishah: it was a very tense hearing. i was watching it closely, and it sounded like you and your fellow republicans pelt you weren't getting much out of secretary. at the same time, it also felt like it was a game-changer in terms of a possible impeachment inquiry, so let me just ask you straightforward here because everybody at home wants to know, are republicans going to impeach the secretary? >> i believe we will get there and get there sooner than later. aye been asking for informing from this homeland -- information from this homeland secretary for two years, i got nothing. you saw the exchange with mr. gaetz, he refused to answer questions. not that he couldn't, it's that he wouldn't. and this is what we've seen, the border is wide open. he has lied to congress under oath. the last time he came in, he lied to chip roy. chip roy called him out on it this week and he ca changed the subject, won't answer the question. but what we're hearing from him are outrageous claims like the border is secure. how is the border secure if you're seeing what we just saw up in new york?

if they're complaining about board i city measures that texas is take thing -- border measures that texas is taking. no american that's a serious person believes that we have a secure border, and members of congress are frustrated and their constituents are furious. aishah: yeah. i think people are the at home are very rang -- angry and really anxious for something to happen on capitol hill. you brought up chip roy, he put a lot of republicans on notice basically saying, look, you've got to convince yourself, if you're a holdout on this impeachment, you've got to convince yourself and do it fast. have you spoken to any of these holdouts, these folks who just don't feel the bar has been met yet? >> i'm not convinced that anyone really believes the bar's not been met yet, which means it's political, and i think's a problem. so when i talk to members of my conference on the republican side and we make the case for impeachment for mr. mayorkas, i say to you, i say to this member, i say if it seems as if this is the right thing to do, then that should be the only question you ask yourself.

whether or not it's difficult for you politically at election time is not what we came here to do. we came here to do the right thing, and if the right thing is to impeach mayorkas for the american people and for our future, then that's what we should do. we shouldn't do things out of consideration for members in difficult districts. i hear that so many times from some in our conference saying, well, we're putting members in difficult spots by forcing them to take tough votes. we need to do the right thing no matter the political consequences. what's right for the american people is always the right move in congress. aishah: okay. so you are confident this is going to happen. on timing, i've got sources telling me that this could happen as early as when you with return in september. >> anything could happen anytime. if someone in congress tells you something's going to happen at a certain time, they don't really know -- the. [laughter] aishah: okay. >> i have learned since i've been there that nothing ever starts on time and rarely do hinges happen when you're fold. so it could, but we've got a lot of appropriations bills to take up in september. the government shuts down october 1st, i think september

will be a very busy month. but screw dishly is not appropriations -- judiciary is not the appropriations, so i don't know what the chairman's plans are if we get to that point, but i suspect there will be a very solid case made for mr. mayorkas. aishah: let's switch gears to texas. we've got a legal battle going on, the doj is suing the tate of texas over these buoys, these big, orange buyys -- buoys that have become a barrier on the rio grande river. and this is what the doj now says, they're dragging mexico into this and basically saying that it has caused significant and ongoing harm to the united states' foreign relations with mexico and that mexico has actually called them up and raised its concerns at the highest diplomatic levels over treeing obligations, warning that any loss of life in that river could quickly give rise to a snap international -- significant international

incident. sounds very serious, congressman. do you believe it? >> first of all, i won't stand for being preached to e by the mexican government. they're a narco-terrorist state, they let the cartels run their country. until they get them under control -- aishah: they won't even admit that fentanyl is coming from that country. >> it's offensive. but the other thing i think that is contradictory to what we heard from the secretary and democrats all the time, if we don't have an open border, what do they care what greg abbott does in the rio grande south of texas? if migrants are only coming through ports of entry and they're not coming across the river in illegal ways, then why are they so concerned about border security measures in the reason is, is because they know the border's not secure. they don't want us to secure the border. they support open borders, and i absolutely support greg abbott in texas. i wish we had republican governors in the other border states that could do the same thing, but i applaud him and his work. aishah: really quickly, do you think it's going to go to the supreme court? this casesesome.

the whole thing thrown out. meanwhile, prosecutors putting pressure on kohberger to produce an alibi ahead of the trial. for more on this we're joined now by former homicide detective and fox news contributor ted williams. ted, good to see you, happy sunday. >> back at you. aishah: so i want to get into this new defense from bryan kohberger's team. it sounds like they're going to go with an alibi defense, but here is what his attorney writes, and it's really weird, so you've got to explain this for me. they're saying that evidence corroborating mr. to kohberger being at a location other than the king road address will be disclosed pursuant to discovery and evidentiary rules as well as statutory requirements. so they're thinking it's going to come through cross-examination, witness testimony. they're not disclosing it yet. what do you make of that? what are they doing here in. >> well, aishah, the defendants know better than what they're putting down on paper concerning

the fact that through cross-examination they're going to be able to show that he has an alibi. under we're law, can kohberger', kohberger's defense is obligated pursuant to the discovery rules to provide the prosecution with any alibi information that they have well in advance of trial. as a matter of fact, that information should have been provided last week from what i understand to the prosecution if he had an alibi. in the sense they did not provide to it, well, the prosecution has decided to flush them out meaning that the prosecution has filed a motion to compel if defendants -- the defendants to provide that alibi information. and if they don't to do it at all, it will be foreclosed from putting on any testimony concerning alibi. aishah: okay. so they're trying to go after the alibi. doesn't sound like the defense

has it yet. at the same time, the defense is also trying to get this case thrown out based on a claim that the grand jury wasn't given proper instructions. it all seems a bit desperate. >> it is desperate because what the defense is saying that the grand jury should have had information beyond a. reasonable doubt and make -- in making its decision, and that is not the rule of the grand jury. you're looking at more likely than not probable cause as to the evidence that's presented to a grand jury for them to indict. it is not beyond a reasonable doubt. beyond a reasonable doubt is what the prosecution must prove at trial but not at a grand jury, so they are throwing things against the wall and hoping something will stick. aishah: okay. we've got just about 60 seconds left here, ted, so if you could quickly tell me about the prosecution, it doesn't sound
