new details emerging about hunter biden's failed plea deal and how it was handled. house republicans are looking into the president's possible knowledge of hunter's foreign business interests in places like ukraine and china and elsewhere and the potential impact on national security. house oversight member nancy mace earlier with dana and me talking about how she hopes archer tells the truth today. the interview is released as soon as possible so the american people can make up their own minds. >> the million dollar question is whether or not joe biden was in the room by phone or in person and any of his involvement in any of these deals that we're seeing. we've seen evidence of corruption, money laundering and bribery. >> bill: full coverage on fox. miranda devine with more on that and what devon archer may know. first david spunt live at the justice department with more on hunter biden's latest efforts on

the legal front. david, nice to see you, good morning. >> if you thought the tension on capitol hill was palpable regarding republicans and their efforts to get information from the white house and white house counsel's office or d.o.j. regarding hunter biden, you should check it out today. it is more intense. republicans are constantly being stonewalled when it comes to getting information regarding their investigation. their separate congressional invest into the president's son, hunter biden. expect his legal team to be at it once again this week working with the department of justice, u.s. attorney david weiss in delaware on a revised plea deal or one that provides more information to federal judge mary ellen -- the judge who refused to -- they ignore request for information. some republicans say they want

transparency but that also requires cooperation. >> i believe based on what i'm seeing, these appointees are running interference and essentially protecting not only hunter biden but president biden as well from us being able to fully do our job, exactly why so many republicans are now calling for an impeachment inquiry. >> democrats see things on a completely different plain. watch. >> it is a trump-appointed u.s. attorney, a trump-appointed judge. a very independent and thorough investigation and i think that whatever happens in the hunter biden case, we can rest assured that it was done based solely on the facts and the evidence and that there was nothing else to it. >> two separate investigations, one in congress, the devon archer testimony today and don't forget d.o.j. plea deal that fell apart last week. the judge gave both sides until

the end of next month to come up with something. the question is what and will she finally accept it? >> bill: we'll watch where it goes. david spunt, d.o.j. >> dana: right now hunter biden's long time friend and former business partner devon archer is scheduled to answer questions before the house oversight committee and reportedly tells the committee about president biden's interactions with dozens of hunter's business associates while he was vice president. he described archer as an arch enemy. miranda devine is a fox news contributor and author of the book laptop from hell. do you know, is archer mad? is he mad that he is the one facing jail time? is he mad he has been made to go through this and so far hunter biden looked like he would almost get a sweetheart plea deal and could that affect this interview he does today? >> look, i think the feeling is that he really doesn't have

flying to lose. and also friends say that he feels that he is being hung out to dry and abandoned by the bidens and that's been a feeling he has had for a long time. now that his jail sentence is imminent he maintains his innocence and he feels i guess he didn't want to throw himself into the middle of this controversy but since he was asked to come and testify, he figured he would cooperate and just tell the truth. tell what he knows without fear or favor. i think he knows quite a lot. because he was, as hunter biden described him himself, hunter's best friend in business, hunter biden at one point said you are family, part of the biden family and we'll never abandon you. and he was there witnessing when hunter biden would put his

father on speakerphone up to two dozen times during business meetings with these overseas benefactors, oligarchs and other shady characters and he was also at two dinners in georgetown in which hunter biden introduced his father to his overseas business partner. we reported on one from april 16, 2015, and joe biden denied initially that he had met with ukrainian business partner. but later the white house after the election admitted our reporting, which was that he went to this dinner, sat down and had dinner with hunter eva's business partners from ukraine, russia and kazakhstan. these were people who had given the bidens millions of dollars and they were sitting in a private room at the cafe milano. i think devon archer can flesh out what was said during those

meetings. if joe biden said anything you could pin on him. he is too clever for that. >> bill: if he was on the phone repeatedly, it may change things. republicans have been clawing at this issue for years and hard to say whether or not they are making much ground, miranda. it appeared when the judge stepped in in mid-proceeding last week when she froze everything and said come back in a month at the end of august, perhaps they are breaking ground here, but do you think this is maybe their best chance to prove their case? because devon archer traveled the world with hunter biden. >> look, i think it's one of the pieces of the jigsaw puzzle. i wouldn't rest everything -- everyone is looking for a smoking gun. this is not that kind of case especially when the republicans

have only been in power for six months. and so they are only really doing now what the d.o.j. failed to do for so many years. i think that's part of the question and part of their investigation is why? why did the d.o.j. and f.b.i. do nothing in the face of these really grave and evidence-studded allegations coming to them from all different sources? it wasn't like they were just coming from enemies of joe biden are allies of donald trump. this preceded donald trump. joe biden, while he was vice president, was allowing his family to leverage his power in these corrupt countries around the world where he had immense power. and he was aware of it. he was meeting these business partners. he was willingly and knowingly allowing himself to be sold. i think what the republicans have is an ability to follow the money trail.

he is the third defendant charged in the documents class alongside nauta and president trump. they said he lied about moving boxes and attempting to delete security footage from the estate after subpoena. it appears that the defendant is arriving and see if there is legal counsel alongside him. if not, the judge is likely to say this case should move forward on a different date in the future. he is accompanied by somebody there. it seems it might be security. could be a lawyer. that will determine whether we'll hear more today. moving on, his charges came in the thursday indictment. special counsel jack smith brought three new charges against president trump. an account of willful retention of national defense information

what makes them great athletes their competitive nature, drive, ability to take risks works against them from a sports betting standpoint. that may or may not be the case depending how good you are or not. are the rules now, after going 0 tolerance for their first couple of years, are they changing? >> they have realized there is not a one size fits all punishment with sports gambling. a student athlete betting on your own team. that would be strongly advised against because that could be considered you are using insider info or teams at your own university. that's something that you are definitely subject to a lifetime ban but different layers. if you bet on a team at a different school. now you are subject to maybe half the season getting a suspension. or even more than that general sports betting. if you are a student athlete betting on the nba finals. depending how much you would bet, that is a tiered system and

you have education aspects involved as well. they are changing it. they realize how important sports gambling to universities and getting people interested and changing. there is a lot of money. >> dana: shows you a map of where sports betting is legal and operational. these states are also now liking that sweet tax money that comes from this, right? you were saying in the break, i thought it was interesting for our viewers to hear about if you are into sports, as you know i am, you can't get away from the advertising. it is everywhere. >> it used to be you would go to certain shows or certain sites and that was where you would place your bets or the information how to place your bets. now you watch what would be considered an informational sports show at the bottom the ticker is going these are the lines of the game and props and all the different apps with different incentives to sign up.

first bet for free. if you refer someone get more money to free. people have a lot of reasons to place bets on the games and makes everything more exciting and interesting. student athletes is where they can get into trouble. they don't think about it. pick up their phone and say this is cool. i know a lot about it. >> bill: you can run track at a university and you can't lay a wager on an nba game. it doesn't make sense. at the university of iowa a major investigation into dozens of athletes. no proof they fixed games but that they wagered on other sports that they did not compete in. >> last year from a linebacker on virginia tech betting on the nba finals, a $4 hundred bet. a six game suspension. now that they change the rules like we just talked about he would have only gotten a one-game suspension. wait a second. maybe i was punished too severely. he was. the school is realizing that and doing something about it.

a lot of gray area. you look at the nfl with instances they had to suspend several players over the course of the past few seasons and they changed the rules. inside a team facilities you can't place a bet on your league in general but place a bet on a general setting. >> bill: the football coach from iowa. he lays it out saying this is not fair to young americans. watch. >> we live in a real different world right now. i think what the nfl has done with their rules makes a lot of sense and i'm hopeful this is an opportunity for the ncaa to reconsider what the quote, unquote, punishments or penalties might be that are, you know, i would say fair and relevant to the world we're living in right now. the bigger thing is there is an opportunity now i think for a lot better education process. >> bill: he said a lot and not wrong. >> he is not wrong. a lot more education can be done. it will be a gray area whether you place the bet in your dorm

as a pretext not to cooperate with congress. we already heard from the i.r.s. whistleblowers they were stopped from following natural leads and asking questions that could potentially lead to president biden. i would be very interested to know if when the prosecutors put devon archer in the grand jury they asked him any questions about the president. >> bill: would he know whether or not there was an active investigation? do you know that based on questions simply? >> well, bill, we know that there has been reporting that he testified in the grand jury. and he knows what he was asked in the grand jury. it is very common for a witness, especially a sophisticated lawyer like archer, to understand what the focus of the investigation is on the basis of the questions that you get asked. >> dana: sophisticated, and i'm just wondering about that term for a second here. he got himself into a heck of a lot of trouble for being

sophisticated and took advantage of people. he will have to pay the price for that. in your experience does a witness like this, somebody who miranda devine told us he has nothing to lose, how dangerous is it for a joe biden who not only is thinking about his son and his problems with the law, but his own re-election? >> yeah, well, two things, dana. first i think he is sophisticated and made an awful lot of money over the last decade plus. he got caught once on one thing that the bidens were implicated but not charged in. as dangerous as this is, i think i am going to respectfully disagree with miranda that he has nothing to lose because he has only been charged in that one case. he has one year of a sentence. he has crushing $60 million restitution and forfeiture provisions. by virtue of what we've heard he

has been involved in a lot of schemes over the last decade that he has never been charged with. so if you are telling me this guy who is a convicted fraudster and what's in it for me kind of guy will go into congress and implicate himself in millions of dollars of fraud that he has never been charged with and that a house committee has no power to immunize him for and can't get him out from under the sentence that he is now facing, the only people who can help him with that are the justice department, color me skeptical. >> bill: so then if republicans were to argue that the pot is starting to boil, you aren't so convinced that it is, andy. >> look, i'm open minded but i would be very surprised if this guy, who is a life long loyal democrat, who is the deputy vice chairman of john kerry's 2004 election campaign, who was in

former president trump by a fellow candidate. and you heard the reaction. i think it's also important to remember this wasn't a trump rally, right? it wasn't even a normal campaign event. it was a state party fundraiser. representative of a wider swath of iowa republican party and still illicited that kind of reaction. that showed you. >> dana: let's pull up call for number four and go to briann. a fox business poll of republican preference among iowa caucus goers. donald trump at 46% and 16% for desantis and tim scott. do you see any ability to have much movement especially we do have the fox debate coming up in about a month. are you hearing from voters that they are willing to still look around or are they all in for trump? >> yeah, i have think iowa caucus goers keep an open mind for quite a long time. i think there is -- we have still six months to caucus day.

there are big things that could happen to really shape the primary. you mentioned the debates. we mentioned trump's legal woes. those may continue to play out and my change some minds as they move forward. iowa caucus goers have a culture of hearing out candidates, going to see everyone and weighing their options. we have been around to various candidate events over the weekend. ron desantis was campaigning. nikki haley, mike pence. caucus goers at all the places list 3, 4, 5, 6, names of people they're thinking about still. >> dana: aaron. i want to show you this other piece of the fox news poll. a question of a candidate you would never vote for. i think it was an interesting question. mike pence at 37%. we are waiting to see if he will even make the debate stage in august. what do you think is going on there? >> that's not surprising based on what we've heard when we talk to people at these events.

there is just -- and it's the trump coalition, the trump supporters who feel that former vice president pence just did not do right by his president and that they will -- because of that, because they don't feel he took the right actions on january 6th because they don't feel like he has sufficiently supported president trump in the months and years since, that they will never consider him. that's the biggest chunk of that 37% and the challenge that mike pence has faced from the start of this, including here in iowa. >> dana: one of the things i love to ask people what are we missing or what should i pay attention to? you are an expert there and know iowa politics well. what are you looking for in the next couple weeks? >> i think one thing we're all playing close attention to in iowa is the evangelical vote. a group of highly dedicated caucus goers. people who the end to show up in

above average proportion to caucus. who are they supporting? the evangelical community decides to unite and make an endorsement for somebody who is not donald trump if they choose to endorse donald trump, that could have real movement. in the 2016 iowa caucuses ted cruz won largely based on the evangelical support and helped push him across the finish line. if anyone can consolidate that enthusiasm and voting block it would be really interesting for us to see. >> dana: we'll pay attention to both of you. aaron, briann, have a great day and a great week. >> bill: you have to work for it, right? alarm study finding a sharp rise in deaths among pregnant women and new mothers. we'll check into what's fueling this increase coming up.
