he telephone graphed it. jack smith couldn't be more nervous in delivering it. this time as part of this investigation into the former president's efforts to overturn the 2020 election. they loved this january 6th. >> ainsley: grady trumbull joins us from washington, d.c. >> good morning, steve, ainsley and brian. former president trump is facing four new felony charges in this indictment, his third criminal indictment. in the 45 page document. special counsel jack smith alleges the former president illegally conspired to overturn the results of the 2020 election. attack on our nation's capitol january 6th, 2021 unprecedented assault on the seat of american democracy. it's described in the indictment, it was fueled by lies. lies by the defendant, targeted at obstructing a bedrock function of the u.s. government. >> in posts on truth social and

in a statement from his campaign, former president trump is questioning the timing of the indictment. the day after devon archer's interview about the biden family's business dealings and while trump is leading in the polls for the g.o.p. presidential nomination. >> astounding document because, for the first time in american history, a former president is being prosecuted by a political opponent who wields the power of the criminal justice system for what he believed in, this is unprecedented, it effect not just donald trump, it effects every american who now realizes that the first amendment is under assault. >> and, steve, you just spoke with attorney and retired nypd detective paul mauro, he told you one of the biggest hurdles for prosecutors in case will to be prove what the former president was thinking when he made the claims that the election was stolen.

election. which he lost and ultimately it comes down to he knew that he had lost because he was told by a bunch of people you've lost, mr. president. but he kept repeating the lie and these conspiracy charges were -- are about how the people around him, six co-conspirator figured ways to keep that lie going. >> ainsley: here's the indictment. we have it right here. we have all read it. it's 45 pages on the very front page bottom paragraph it says that the defendant knew they were false. false claims. he said "i won the election" and this says that donald trump knew it was false. but, if you ask most people, if you ask really anyone this his circle, they will say he really believed he won the election. i don't know if they have something on him. i don't know if they have a conversation that he had with one of the staffers. >> steve: according to the indictment. they have people at the department of justice who said you lost. they got people at the white house who said. >> ainsley: they said. they said or he said. >> brian: you can't get inside his his.

>> steve: they told him you lost. the people at the campaign said you lost. and so they have got -- >> ainsley: they have to prove that he actually believed he lost. >> brian: and that's what is so strange. >> ainsley: you are allowed to question an election. hillary clinton did that nancy pelosi did that. >> brian: stacey abrams still thinks she is the governor of georgia. just to pro build on that point. what the indictment says. don't think for a second donald trump says that there is a lot of people that talk to donald trump regularly. he has never once stopped saying 2020 over and over again that he won that election. in fact, i think he told sean on this town hall you haven't been too great on that 2020 you won. maybe he kind of jumped down his throat because he believes he won. now, is there somebody out there that said that? okay. then you can point to another five people that said he swore to me up and down he won. you can say he listened to the wrong people, fine. lawyers, white house better than sidney powell and rudy giuliani? i'm sure by a wide margin.

do they have more of a logical conclusion from 2020, absolutely, to us. but if you are going to indict someone about what they did, and i think going back to original elliot our original guest said donald trump's biggest problem is the electors. >> the fake electors. >> he said that's the problem but about the other thing he says this is freedom of speech and we should indict everyone to wants to protest an election. i don't think hillary clinton admits she lost yet. >> ainsley: well, jonathan turley was on last night. and he said all this says when you read it, and this is true, is that trump is lying and he knew all along that he lost the election. that's what the indictment claims. >> steve: it's up to the prosecutors to prove intent and he knew it and he just lied. >> ainsley: he says what they're doing is just criminalizing disinformation or political speech. he said when is the price just too high to bag trump? >> brian: other thing that is so crazy we get the second half of the mar-a-lago indictment the day after hunter revelations and his deal falls apart.

>> and then we find out more revelations on devon archer and boom, jack smith has to. >> ainsley: take attention away from hunter? >> brian: to me, i didn't real memorize the january 6th report by congress led by liz cheney this seems exactly like it. you could have done this a long time ago. what's new about it i'm not sure. why jack smith the guy spends his free time at the hague, comes back here at the another major indictment and acts like first time on camera. why was he so nervous in delivering. this it seems like he was unsure of what he was saying. we back law enforcement what they had to deal with that day we get that it's like going after 9/11. we understand how brave the firefighters were. what does this have to do with other things that are involved in this indictment? that was just astounded that he sounded so much like a politician and somebody who just dislikes the guy rather than the guy who is indicting a guy. >> steve: see, i watched and it i thought it was very somber and sober.

it's a crazy time in our american history where this guy was saying, look, i have got the proof that the president of the united states. >> brian: i wouldn't say he was smiling. i'm just saying that he was nervous about his delivery and he went into rhetoric like an msnbc host or cnn host that he belonged on his 12 person panel. >> steve: it was a moment of historical significance to charge the former president. >> brian: should be good at it by now. >> ainsley: full of political opinion. people said it was sloppy, it was a joke. this is why many people think our country is heading in the wrong direction. according to this "new york times" poll, that question was asked, only 23 percent said right direction. 65 percent said wrong direction and 13 percent said don't know. >> brian: because everything we just talked about, i don't care where you stand on it, doesn't make our country better. we got real issues that we're in a better position to address than any other time in our history. we keep getting caught up with suing and trying and impeaching and indicting each other. and as a country we are sitting there watching all this happen,

the people we put in power seem to consistently let us down and fight with the other people that are in power. and what has been addressed in this country over the last 8 years? and tell me where the light is at the end of the tunnel because now republicans are looking to impeach biden. they are going to continue indict trump. and as a country, how do we profit from that? >> steve: well, there's a lot going on. and, ainsley, i think you are going to talk to many solve the folks. >> ainsley: i am i want to tell you about that poll when you look across the board the majority of every single age group, gender, race, people with or without college, people northeast, south, wyeth. >> cities, suburbs, rural areas catholics and those without religion 60% and above for most categories say this is the wrong direction for our country. more than 70% of southerners, rural areas and protestants and white people without college said wrong direction. >> steve: good news is the fact coming up a little more than a year from now, people are going to have a choice and they can

>> ainsley: this is a fox news alert. will former president trump due in d.c. court tomorrow to face charges on third indictment. >> brian: special counsel jack smith announcing four charges relating to january 6th. it happened yesterday. >> steve: mike waller joining us live. good morning to you, congressman. >> good morning. >> steve: have you guys as a caucus figured out how you are going to proceed with this? >> no. you know, obviously a lot of my colleagues have endorsed the former president. i have not. and, you know, i have said previously i think it's time to move in a different direction. obviously three indictments is certainly a challenge. we'll see what comes out of georgia. but, look, i have said repe repeatedly the former president lost in 2020 whether he believes it or not. >> steve: do you think he believes it.

>> i don't know what he believes. >> brian: you weren't in congress. >> i wasn't in congress. actually on january 6th i was in the first day of the state assembly. first republican to speak out against what happened at the capitol. it was wrong. and it never should have happened, period. >> ainsley: it's very bizarre because jack smith focused not on january 6th and we all thought when we heard january 6th, could be an indictment he was going to focus on blaming trump for that but, this actually just says it was election interference because you trump, he said he believes that trump knows he lost the election and he was lying to the american people. >> yeah. i don't know how you necessarily can conclude whether he knew. >> ainsley: how do you prove that? >> a lot of these court cases are going to, you know, wind through -- make their way through the court. we will see if it even comes to court to trial before the elections. i think there really is a challenge in this country right now. a lot of people do feel there are two tiers of justice.

hunter biden on the one hand is, you know, getting a sweetheart plea deal that then blows up in court because, well, it was a sweetheart plea deal that didn't make much sense. and obviously the former president getting indicted multiple times. so people feel there are two tiers of justice that the justice department has been weaponized real ghal our country. >> brian: change opinion trump was wrong, trump is wrong. reveals amongst your party. other thing you are working on is blackrock mci facing probes to figure out if some of their investments are helping china's military. what can you tell us about this? >> china is our greatest geopolitical foe, economically, militarily. i visited japan, korea and taiwan earlier this year as a member of the foreign affairs committee. and so our focus has been china. we set up this select committee earlier this year, bipartisan committee investigating the

an opponent and that's what these indictments are about. >> i think that's probably the calculation on the democratic side. >> brian: are they right to want that? >> that they know that there is going to be a huge rallying effect because we have already seen around former president trump by the republican base but also by independent disaffected democrats who voted for him in 2016 and 2020. so i would say to our democratic friends be careful what you wish for. donald trump is not your run of the mill standard politician or leader. is he a completely unique figure in american politics that drives tremendous emotional response from people, both, you know, hatred and love. so democrats who are playing this game thinking we want him to be the nominee because is he more easily beatable, be careful what you wish for. you are pla playing with fire. >> brian: siena poll, "new york times" poll, whatever you think of polls they show a trend and it's a dead heat. maybe he is up one or up two the

other smaller polls it doesn't matter. still a dead heat. >> i wonder if part of if is to drown trump's campaign in distraction and debt so he can't focus on campaigning. reporterrier this week that trump's campaign has had to spend hundreds of thousands of dollars to fight these legal battles. that's a serious handicap for his campaign. the most alarming part of this indictment is that democrats and jack smith are trying to use the criminal code to punish political behavior. the constitution is very clear that congress through our elected representatives has the sole responsibility of holding the executive to account. they have multiple opportunities to do this through various impeachments, through the january 6th congressional committee which, by the way, did not turn up anything in the way of criminal conduct. and so now they are trying to make up for this by using the criminal code. but criminal conduct is very specific. and it has to be applied specifically to narrow statutes that prosecutors have to provey

violated beyond a reasonable doubt. and here the facts just don't match the statute. >> when you talk about numbers, his joint fundraising committee reported raising $53 million, almost all of it has been spent on legal fees doug. and i don't think people are that upset anymore because they think that he is being unfairly targeted. >> said earlier going to distract donald trump. have you ever sat five minutes with the man he? can do five or six things all at one time and that's who he is. that's who he has always been. distraction. i think there is a bigger sort of background noise here. and that is not just that you are trying to tie. >> more than current background noise? >> more than the cards. when they come out. notice that jack smith in these indictments are coming at the same next day typically after a hunter biden episode. and so i think it's not just that they don't like donald trump, it's also that they are trying to deflect from the fact that they are having to answer hard questions now because joe biden was in the meetings. joe biden heard it and i'm sorry, all these people say they were talking about the weather.

[applause] charles, what does this mean exactly they downgraded debt? >> high quality the easier it is to borrow money. it's sort of a report card on us. i will tell you what fitch said

because this is important. they point to a whole bunch of things at the top of the risk erosion of governance. erosion of governance. okay. seconds rising general government deficits. how often, how long have we talked about this? you know, for years we have talked about, you know, going off the fiscal cliff and all these sort of things and because it hadn't happened people started to assume it wouldn't happen. we printed up a whole lot of money. a lot of money that the economy did not need. so, this is a major, major problem. general government debt to continue to rise. we know that. we're up there now at levels we are past world war ii. we had an emergency world war ii. we raised a lot of money. we saved the world. right now, all we are doing buy votes or change our economic system from capitalism to something not capitalism. you know, so these are the main things that they are concerned about. the economy, they say, will slip into recession over the next sixth months. so he they're looking at really dire things here. here's the thing, steve, they warned -- they made a warning

that this was going to happen. and it did happen. >> steve: yeah, it did, indeed. meanwhile, you know, it seems like the government is cracking down on us, regarding green house gases and fuel economy and stuff like that. down in georgia. they have opened for the first time in something like seven years, a new atomic power plant. and the thing about atomic power is there is no environmental damage. of course you have to figure out what to do with the rods after they are spent. >> right. >> but that's it. >> just like you got to figure out with electric battery. have you ever seen them catch fire? another ship just sank because a couple electric cars caught fire. the hottest fires a ship on the ocean. second one. too many electric cars on it. they caught on fire. traditional fire fighting methods didn't work. as far as this nuclear power plant, no, it's not the first in seven years. it took seven years. it was 17 billion over budget because of all the red tape. all of the bureaucracy to try to stop from doing. this this is the dumbest thing in the world not to go after

in new york it's been even worse these past couple years. i wanted to ask your opinion. what can small businesses do, especially in new york, to survive especially amid this current inflation? >> it is so hard, man. what part of the bronx. >> alecton. >> i used to live right off fordham road. >> right on the other side of the park. >> charles: this is tough. there is a war against small businesses and profits. new york city is perhaps one of the worst. certainly in the top ten. most important thing is you have to make sure that you have funding. if you are a small business, you know you are taking a risk anyway. you are not going to have the certain amount. always seeking or looking. don't ever feel comfortable. other than that, you just got to kind of go for it. be ready to sacrifice and know there is a high level of large degree of failure particularly in a place like new york. but america loves small businesses because that's the backbone of our country. so i applaud you. thank you. >> steve: gene, very good question. right next to you al-has a
