wetting myself but again, this is now something aft raid and after you find about joe biden and you looked at alvin bragg indictment and everybody was scratching their head but this doesn't even make legal sense. so that what's happens and then by the january 6 indictment, we're kind of tired of it and all of them on the media, they say oh my god, this is the biggest -- this is airtight. and then you look at it and everybody says h ho hum but the drama on the screen benefiting in guy and follow him around like the bronco chase and cameras in the -- pursuing him and reporters are tripping over themselves on wet tarmacs. and biden is on vacation and pass out of the beach. i'm not sure they're winning the media war. i guess we'll have to see what happens in the courtroom.

>> dana: greg gutfeld, you've been watching all day? >> greg: noted really. i've been playing with the dog. the value of something getting smaller with each iteration. and that's what you're seeing with the -- with these indictments as well as impeachments and they get smaller and cheryl and smaller and the value becomes less and they're more mundane and obviously here, they go too far. they go too far and they'll do it again and again and he's right. jesse's right, there's a pattern of indictment and always follows something else. if i was truck p's lawyer, it's so -- trump's lawyer it's so easy to say if it's a crime to say i've been cheated outloud than we better start building a whole bunch of super max prisons with an exclusive wing for obama, hillary, john carey, stacey abrams and throw in professional baseball players, high school coaches, high stake poker players. throw me there, okay. i sold, i sold the most books this week in america and the

times put me at no. 6. they cheated. they cheated. lock me up. go for it. i dare you. but the point is, is it irrational that an election can be unfair and it's rich for things that have been happening for the last four years and russian collusion and how hay hid the laptop and 52 experts, there's a lot of weird stuff going on, and i think real world experience teaches you that everything, every institution can be corrupted, can be exploited and the biden family has showed us that clearly that politickeds, everything, finance, i think what botteghine is the media spent decades saying he can be is rigged. the justice system, housing, finance, the defense industry, the cops, everything is broken, everything is broken. except the elections when wearing win.

then it's pristine and impervious to cheating and we don't know if the election by in large with 50 states was corrupted or whatnot. it's unprovable. but it's -- it can't be proven either way. i don't understand how you can actually prove this or read his mind when it comes to something like that. it's wishful thinking. >> dana: haroldford jr., people missed your voice and you're back around the table. good it to have you. what are the democrats thinking today? harold: i don't know. i listened to president trump and he has an amazing calmness and experience in some of these things in facing a lot of turmoil and a lot of difficulty as presidents are. he's innocent till proven guilty. one of the more refreshing things to hear jack smith say in his presentation and the rest of what he's doing a day or twoing a was that the president is innocent and they have to prove the case. two, i lost the race for the u.s. senate about 17 yearsing a, and it was a close race. there was those people, some of

my state and some of my campaign that thought we won. i could have gone around saying we won and i was robbed of the race. that would be fine and it would be protected speech. but if i picked up the phone and called three democratic election officials in counties saying find me 25,000 voteds. that's what's at stake here and i don't know all the facts. i was learned today as i listened to andy mccarthy, who i think is as good as anybody on any network, i only watch fox, but as good as anybody on any network analyzing that shannon's great and our whole team is great, but his experience in the justice department is fantastic. he has even indicate that had it may be that jack smith has more than we know at the moment. greg, i'd say one thing about the elections, i agree with you on so many things but on election integrity, remember 60 judges -- or 60 courts rejected president trump's -- your point is we cannot know if everything is done correctly and i would agree with it. >> greg: they didn't even look at it.

none of those guys looked at it. harold: that's not true. some of the courts d. it's so unfortunate and i think tragic that we oftentimes preface when talking about a court and a judge appointed by this person or that person. judges like anybody in elected office take an oath of office and fundamental to the oath is upholding the constitution and i believe any judge be they appointed by george w, hw, trump whomever they are and they're going to try and uphold the law. whether we like and agree with attorney general barr, he believes that president trump knew ease things. vice president pence believes when i say these things he believes that president trump knew that he had lost this race .x he was acting with some intentionality. these are things that they're saying and i would imagine that these people likely will be called by jack smith during the course of this case. one thing i do agree with whole heartedly as president trump said getting on the plane there

is this a tough day and terrible day with the country and i hope they're able to get to a trial as soon as it's suitable for both sides for the president to be prepared and seems if the government is prepared and i hope they're able to go through this in a way that delivers justice for the country and for those involved. >> greg: yeah, harold just attacked me like i've never seen in my life and i'd like to respond to him. >> dana: okay. >> greg: geopolitical the judges and jury and this is not normal. this case isn't normal and not like a fender bender between paparazzi and wayne newton and the president ovthe united states portrayed as hitler in the immediate .y the entire jury pool and judges are posenned and if you're a judge or jury you've begun for five years and i said this on the five, i think two yearsing a, i said if everybody's saying in guy is hitler, there's got to be something wrong if you don't rig the election and something wrong

if you're not biased and if you're on a jury and hitler is there, you don't care if he's innocent. that dude's hitler and that's for five years this guy has been hitler. there's no way that you can get around that and i think to your other point you can know that you lost an election and still think it was crooked. harold: but if i call people and say find more votes and i know we want it and that's the only point i was make. >> dana: ask legal eagle. she's here. shannon: there were a lot of cases not heard on the merits and motions and technicalities and a lot didn't get to merits and some did. i think the president's legal team, meaning president trump, felt like a lot of things were unresolved and efforts to get things down at supreme court. got to get at least four justice with this case and they didn't do it. they feel like there were a lot of angles and lanes that were left to them. but i think it's interesting that it seems that deputies are getting more and more concerned about what they've pushed for, when i think is to make trump

the nominee and think he'll be the easiest one to beat and see him judgerring and joking on social media and need that fourth indictment and they're getting nervous in play book today and there was a private lunch with president obama and presidents biden that was leaked where he warned him you've got to take trump seriously. why was that leaked and private lunchtime and have who leaked to play book and the left is getting worried about they've created this monster and want multiple indictments and tied up. >> dana: i imagine the leaker is somebody from obama's team that wants to make it clear he's warning him. one question -- harold: i agree tram subpoena a more serious candidate. >> dana: jack smith, wouldn't he have put all he had in the daytime of the court of public opinion being this unprecedented. would he hold back all these other nuggets.

>> democracy itself is really at issue in this trial. if trump could get away with what he's done, what he's charged with here, then we don't have the democracy we believe we had. >> to me, this is really going to be about whether people in this country care about the facts and the law. >> it would be if the end of our democracy and donald trump was able to get back into office. >> dana: that was a sampling of the reaction. >> jesse: said off the midterms democracy was supposed to be over in republicans won the house and we don't have one technically right now if you listen. the view does not seem confident that jack smith will bring this home if they're fantasizing about a ridiculous plea and he goes and lives in greece. seems like tram's traveled more to arraignments than bindis traveled to swing states. he's been zigzagging all over the east coast and biden has been asleep or at least like in delaware reading a book it doesn't look good for joe biden

right now. i'm starting to agree with greg, i hate to say that. signs are pointing that he might not be the nominee and i want to bring up what you said about barr. some really smart lawyer earlier on fox said if they're going to bring in barr as a witness, they get to crossbar and say, okay, you told trump there was no election fraud. what did you do to investigate it? how many man hours did you spend and how much money did you spend in where did you go and what did the lieutenants tell you? you can't say everything is find and two weeks you checked for fraud. everybody has the right to be suspicious and a covid reelection blowing out signature and blow out all the deadlines and blast out all these unsolicited ballots into the ecosystem with no chain of custody, you're in the suspicious and a right to be suspicious and all the state legislators know there's no power to do anything about it. it was just done via judicial

it's not illegal. the worry i would have if i were in the white house is that the investigation on hunter biden is underway and con going at the justice department. the one concern and only concern if you're president biden is were you -- did you do something on behalf of your son in your official position as vice president? and secondarily, are there records showing you may have been compensated for it? that's an offense that would cause, i think, a lot of alarm for democrats, republicans, indianapolis dependents and get the high -- independents and the eye of the justice department. >> we've seen this from hunter get nothing money from any businesses in china to there's no for pinocchio entry and the president didn't talk to hunt earn about the business to the president was in business with hunter. >> dana: when the goal posts are moving you know something is wrong and i think the deputies and white house try to continue and make this really complicated for the american people to figure out but america wasn't
