cheers of u.s.a., u.s.a. his next hearing is set for august 28th. guys, back to you. >> steve: all right, brooke, thank you very much. at the end ever the legal proceedings yesterday, the judge, the magistrate judge, who will not be the judge in the case, said to mr. trump, okay, these are going to be the conditions of your release. i'm going to release you. you will have plenty of time to campaign. you can do that. but she said, mr. trump, you can be arrested if you break any of the conditions of your release. so, you have got to show up in court. she said don't commit a crime. and she said it is a crime to intimidate a witness or obstruct justice. do you understand? and he said i do. you know, until that moment, i don't think anybody ever realized that donald trump could actually wind up going to jail before the trial if he breaks the rules. >> carley: can't break the rules. he is facing just so many charges right now. 78 felony charges across three criminal cases. if he were to be convicted on all counts and given the maximum

penalty, he would be facing a whopping 641 years in prison. people who commit violent crimes are given like no jail time now and he is facing almost 650 years. and that doesn't even include the additional charges that he could be facing in georgia. he did seem in good spirits. there he is after the arraignment speaking to reporters and he talked about how disgusting d.c. has become since he has left office and this is a political witch-hunt. he posted on truth social "i need one more indictment to ensure my election." he also said "considering the fact that i had to fly to a filthy, dirty, falling apart and d.c. today. >> brian: politico wrote this in terms of providing color for inside the courtroom. said donald trump, jack smith and historic smith said nothing audible during his hour in the

room but rebeated willly shot glances at trump until occasionally shot back until their eyes briefly met. trump was very polite, he was very clear in saying he was not guilty. jack smith did have a smile when the fbi investigators came in. so then he went back out. and jack smith says okay, i got my indictments out there. now it's time to make the case. and they want to pick up the pace. why do they want to pick up the pace? because they are trying to get this done before an election. which brings us to the bigger question. should they be getting this done before an election? bringing theme from other networks flip around to find out what everybody is saying. don't you think the american people need to know if he is innocent or guilty before they vote and the theme for most people is do you think someone should be able to rub for president and not be under indictment and be going up for trial. the question is as the "wall street journal" writes today the january 6th was disgraceful. but was it criminal? and if you look at what the

evidence has been charged, there is really nobody here has looked at this and said there's anything new from the january 6th trial. so there is nothing new. there is no conspiracy. there is no ah ha. here is the meeting with the oath keepers. here is the meeting with the proud boys. his or her is the game plan that steve bannon drew up and here is the president of the united states who likes to record things on tape. so nothing is really in there. so you wonder, 45 page indictment. 78 charges overall. add to that georgia, which we know the pattern, it's going to be coming up in two weeks and they are going to make him come down again and he expects that but, in the big picture, the one thing that is going to happen, innocent or guilty, is joe biden will get his wish. he won't have to campaign again because his opponent right now, if it seems to be trump, will be in trial. why should he have a rally if this guy is going to be in the courtroom? >> steve: well, we have got a pretty good idea because trump's defense attorneys have already starting floating around three

different lines of defense for the former president. one, he has the first amendment right to say whatever he wants. two, he got a bunch of bad advice from his lawyers. he was doing what his lawyers who mike pence referred to a couple days ago his crackpot lawyers. or, three, he believed he actually had won. now, here's the problem with that. ty cobb who actually was employed by donald trump during the mueller investigation, he was one of trump's lawyers, said that he tweeted this or he put this on facebook. he said there will be evidence from several witnesses in this case that donald trump knew he lost. he said i lost. and then ty cobb goes on to say it's going to be a d.c. jury. and this is the last line of ty cobb he said donald trump, he's toast. >> brian: see, that's the way he has been. i will say this who cares what ty cobb says?

>> steve: he was his lawyer. >> brian: around him for the last year and a half. >> steve: i'm just reporting the facts. >> brian: think about this, everyone around trump, in casual conversation and serious conversation on tour and beyond, goes -- will not go five seconds without him saying he won the election. he was down sean hannity's throat for not defending him for january 6th. >> steve: what i said was ty cobb real people told by trump "i know i lost." >> brian: that's fine he says he knows he lost. wait a second, they believe there going to be a traction in a courtroom because ty cobb and a few her people said he lost when almost everybody else said he won? why is that even part of this legal case? because he sincerely believed that he lost the election. i didn't even think that was going to be brought up. a lot of people said to him drop it. i know how you feel. change the subject. >> carley: attorney general bill barr says jack smith has more on trump than he has released in

this indictment. but, right now, there is absolutely no smoking gun, which would be trump saying i know i lost, but we are still going to go ahead and do this anyway. when you think about the language of some of those saying i lost. it's a matter of participation, too. in terms of what he saying. election results right now even though he believes that there were votes that were not counted. something play out in the court system over the course of 2024 or if trump's lawyers get their way after the election. >> brian: carley, getting inside his head is impossible. >> carley: absolutely. >> brian: anybody who says he thinks he lost there is 20 million people convinced he won. >> steve: luckily we have the course of three hours to continue to talking talk about this. there was this one story we were telling you about this yesterday. coast to coast. there will will be 300 libraries across america see you at the library. friends at brave books and kirk

cameron are part of this. and in fact there was a big fest planned tomorrow at the madison library in huntsville and kirk was going to be there along with riley gaines. at the last minute, it was canceled by the library because they said the organizers told us it was going to be 20 people. then the day before they said, you know what? we are going to have 300, 350 people. the library said you know what? we can't do that. >> ainsley: huntsville madison public library released a statement said the moms for liberty organization had planned to feature brave books meeting room this coming saturday which is tomorrow. due to the event's anticipating attendance increasing beyond the library's capacity the library will be unable to host the event. initially the organizers of the event reported 20 attendees to library officials. on tuesday the library learned that event organizers are now expecting over 300 people. a number that far exceeds any meeting room capacity within the

huntsville madison system. alternative recommendations have been recommend to the organization to ensure a safe and well-attended event. >> brian: this is ridiculous. if there are people in huntsville that are retired military or a cop looking to maybe volunteer some time for security, anybody that believes in the cause or they believe the books belong in the library with any type of security background, i'm sure they would show up and handle a crazy crowd of ethical, moral people who want to show up and show support for an ethical, moral book. i think that this is a copout. >> steve: the problem is they booked a room for 20 and 300 people are going to show up and that's it. >> brian: don't you have a tent? >> steve: well, you know, they have got to find a tent then. first liberty is representing cammeron and brave books. they said canceling is unlawful and unconstitutional. they are giving them until noon to respond otherwise they say they are going to take them to court. cammeron, as of yesterday, was tweeting he is still --

things and good morning to all of you, i think first thing, you know, it reminds us that china is already after military personnel. most consistent espionage act on the world stage it. reminds us that readiness is critical. this went on apparently for in one case a year and in the other case two years. and that tells you that we are more focused on things like wokeness than we are on readiness. and you don't win wars with wokeness. you win it with readiness. the last thing i just add i look at this and wonder what was going on in these guys' minds i have a president that has accepted tens of millions of dollars from china in what looks like a pretty clandestine kind of way and lo and behold, maybe i should have a shot at this. that's the sad part is that when readiness goes down and we end up prosecuting political language and we get distracted over here in wokeness and we have a president who is facing what looks to me like a really extraordinary set of future

you know, if donald trump does not show up for the fox debate coming up in a couple of weeks, we're going to see ron desantis in the center square. and then you see him on with sean vs. newsom a lot of people are okay i have never heard so much from the governor of florida then at the same time, and i know you are a democratic strategist, i think a lot of democrats are going to go that gavin newsom is so young. he has many new ideas. >> that's right. >> steve: why do we have joe at the front of the ticket? >> i think newsom is just way too smart of a politician to challenge president biden. president biden is on a bullet train to reelection to the white house. and gavin newsom knows it would be political suicide to run against biden. but i believe newsom is running for president, just not this year or next year going to be in 2028. this is great forum for newsom. i think it puts desantis at risk. desantis is actually running for president. gavin newsom is not. it gives them that opportunity to really poke holes or show

desantis' lack of platform instead of just attacking joe biden. you're going to have someone be able to push back against desantis. i'm looking forward to that debate. i hope it actually happens the problem for joe biden we have seen the polls, 60% to 70% of democrats wanted somebody else. they suddenly see this new shiny object from california. is he young and got new ideas. it's like why do we -- why are we sticking with joe biden whose economy not great according to the numbers of people who don't feel like they are getting ahead? >> gavin newsom appears to be very cocky. he has ruined california. he leads the country in out my grasmghts he needs to worry about running his state than chiming in on the presidential election. desantis also needs to focus on his lack of campaign. i mean, he has had a re-set in the last coming weeks. he needs focus on worrying about

the issues real quickly. about, we showed that poll that siena, "new york times" poll that donald trump certainly is way ahead in the republican side. but. >> absolutely. >> steve: half of the republicans are considering somebody else. what does that say to you? >> i think donald trump has done a masterful job of securing his base. but i think that half of the g.o.p. voters is more concerned that is donald trump running for president or to avoid prison. and it seems like is he putting himself before the party before policy and is he talking about himself and that's the problem. i think g.o.p. voters are starting to get concerned about that and i wouldn't be surprised if you started to see some other candidates. >> steve: thee is shaking her head she gave you a. >> no if you put all the other republican candidates together combined donald trump still has more. is he leading the pack right now by over 50%. >> steve: by a lot. >> he is the nominee. i think he is going to be the candidate to beat. i think he can beat joe biden
