"the faulkner focus" is next. >> harris: president biden said he did not attend a dinner with a son's business associates but a witness we heard this week says the commander in chief was definitely there. new trouble for biden at this hour. on the heels of former president trump's latest arraignment, the voices shouting down, two tiered justice system for biden's political enemies are growing even louder. i'm harris faulkner. you're in "the faulkner focus." shining a huge spotlight on this issue, former baltimore police

commissioner daryl deseussa. >> i went through that storm in my life. this is the way the criminal justice system is supposed to be, again, i have to say that, you know, i wanted to own up and take accountability for what i did. this is the way the justice system is supposed to be designed, then it should be -- everyone should be held accountable across the board. they should be held at the same standard as me or someone else that, unfortunately, had to go through this. >> harris: he was sentenced to 10 months in prison on tax fraud charges. very similar to hunter biden's, and he faced the exact same prosecutor who cut hunter biden that sweetheart plea deal. leo terrell on "focus" yesterday. >> the weaponization of the department of justice and the f.b.i. basically is taking place right now under the biden administration. we have the transcript release of archer.

and guess what happened? president trump is going to be indicted today on the same day. they are trying to deflect the attention away from biden in order to focus on trump. strictly politically, strictly to stop him for running for office. >> harris: a new op ed drills down on the different standards of justice. here's a quote. out of the fear of donald trump, the left has crafted one set of laws for themselves and another for all other americans. they smuggly believe their own moral superiority grants them a right to apply laws unequally or to ignore them all together." republicans are making plans now to take on the two tiered justice system. senior congressional correspondent is live on capitol hill for us. chad? >> harris, good morning. republicans are going to try to get their message out by turning the tables on democrats after the latest indictment of former president trump. now, that could include calling special counsel jack smith to

testify. republicans believe the indictment of former president trump is pre-emptive ahead of 2024. the g.o.p. is focused on the transcript of the interview from former hunter biden business partner devon archer. >> the biden name and the biden position was up for sale. money changed hands coming from different governments including the chinese communist government, romania and ukraine. >> the chairman of the judiciary committee, jim jordan says everything is now on the table. delaware u.s. attorney david weiss handled the prosecution of hunter biden. weiss is willing to appear before jordan's committee later this fall. some republicans are now pushing a step which is more serious. >> i have articles of impeachment out there against joe biden. and when we get back in september, if there's not a clear path and a clear timeline for impeachment, my articles are written in such a way it can be offered as a privileged motion. i'll pull the trigger on that

and we're going to move forward. >> but republicans are also talking about impeachment for attorney general merrick garland and the secretary of homeland security alejandro mayorkas. it's possible that they could overplay its hand. >> the more you normalize this process, the more the next generation is going to use it as a normalized process. and that's not good, right? that's an escalation of an oversight effort. it dampens the effects of good faith oversight investigations which should happen continuously in a separated government system. >> the other option for republicans, the power of the purse. some g.o.p. members want to clip the funding for special counsel jack smith. harris? >> harris: chad, thank you very much and you were just mentioning devon archer. we'll pick it up from there. archer tore down that big denial by team biden. archer told lawmakers this week that then vice president joe biden, in fact, was at that

infamous dinner in 2015 with hunter biden's foreign business associates. as first reported by "the new york post." in 2020, biden's campaign spokesman told politico "we have reviewed joe biden's official schedules from the time and no meeting as alleged by "the new york post" ever took place." well, it did. even after some apparent vindication, "the new york post" editorial board with a new headline now. just the number of joe biden's sitdowns with hunter clients is damning. ari fletcher, former white house press secretary. it's always troubling when a witness fact checks a president. >> yeah, and "the new york post" keeps being right, isn't that the case, too? much to the dismay of the mainstream media. look, joe biden is getting caught in a web of lies on this. and the only reason i think he lied and lied from the start and lied so vehemently about having no discussions period with his

son is because he knew he was up deep in so many of his son's business matters. he knew, he put himself on the phone more than 20 times to help his son get business. as the sitting vice president, that itself, harris, is an act of corruption. whether or not he received money from it doesn't matter. it was an act of corruption for the sitting vice president to get on the phone call to help his son get business particularly from foreign countries. >> harris: well, you know, when you look at all of this and the fact that around the world, america preaches about how democracy is supposed to look and you don't punish the people for speaking in opposition of what your politics are. but that seems to be what we're looking at right now as they go after trump and as they ignore a lot of what went on with hunter biden's, well, really mysterious foreign business dealings because we don't know the details of all of them. >> you know, and don't forget

the obama state department said it publicly on the record that it was a conflict of interest for joe biden to have his son serve on the board when joe biden was in charge of fighting corruption in ukraine. and then joe biden intervened on behalf of his son's business interest to support what his son and they wanted to accomplish. this is as unethical as it gets. and i really do think joe biden may have financially benefited from all of this. there are e-mails showing that joe biden received payments as a result of what the money flow to his son. and then his son shared it with joe biden or paid his expenses at his homes. this is exceedingly worrisome. a vice president who appears to have been on the take to help his son make more money. and i have another question -- what about joe biden's brother frank? is there any evidence, was joe biden on any phone calls with his brother frank's potential

business partners to help frank get business deals? >> harris: we aren't talking about all those other family members being looked at in this investigation. there are nine total bidens in that loop. you bring up an excellent point. in fact, for that matter, can we get a list of all the phone calls with any business that was being done that we don't understand that might be tied to this 170 suspicious activity reports with the federal government that were filed. all right, "the wall street journal" editorial board lays out damaging evidence that then vice president biden mixed family business with his ukraine diplomacy. they write "biden famously bragged on his role in using $1 billion in u.s. aid to get ukrainian prosecutor fired during his 2015 visit to kiev. what do you make of what we know now in thinking about -- that's on tape, by the way. you can watch that happening with the president. i'm going to hold back the aid. i'm paraphrasing a little bit here. he jokes about it.

that he can get that done and get that prosecutor fired! >> yeah, and devon archer testified that hunter biden's business partner, devon archer testified that devon -- that hunter biden's actions basically saved barisma that they needed this to survive and that joe biden delivered. you know, this is the definition of corruption. and that's why i find this whole thing so worrisome. you know, i think every congressman, democratic congressman who is defending this and saying they just talked about the weather. they need to be asked would you ever allow your child to put you or a family member to put you on a phone call as they seek to do business with the implication clearly that i've got a relative in congress who has influence. and i'm sure all of them will say no because it's unethical. kamala harris, the sitting vice president do for her family what then vice president joe biden did? and understand something. hunter biden never put his father on the phone.

joe biden put himself on the phone. it was voluntary. he did it as a busy vice president to enhance his son's ability to make money. with foreign governments. he wasn't put there. joe biden did it. that's why the issue is joe biden's corruption, nothing do with hunter. >> harris: yeah, that's the furthering of what i was going to say. and, you know, these democratic lawmakers had better be careful they don't get pulled into this case because, as you were talking, i made this note. the question that i would ask goldman and maybe others defending the president on this issue. do you know that they only talked about the weather? because you talked with president biden and he assured you that that's what they were talking about. get them on the record about how they claim to know this even more -- what they're doing is they're reading between the lines of a document that came out of an interview. it does matter because it pulls them into the case and they might be quiet if they thought, well maybe i don't know the truth. maybe i should, you know, pipe down until i do or ask the

president. >> yeah, but there's another issue here,, too and it doesn't matter if he only talked about the weather. he was on the line. the point is that he was showing that he's -- that his son has influence and can reach him. that's why. it was perfectly right if he just talked about the weather for hunter's appearances. it showed i can get my father. i have influence. i can use that influence for you. that is the corruption. and that is what joe biden exposed himself to by putting himself on the line even if he only talked about the weather. he never should have been on the line. it was unethical to begin with for a sitting vice president to be on that line. no matter what the topic was. no matter whether he did or did not receive money. the act of being on the line was the corruption. and the mainstream media needs to dig deep into this. it's inconceivable to me. >> harris: you know they don't. >> newspapers like "the new york times" that prides itself on ethics is looking the other way on this. >> harris: they need to lean in.

these democratic lawmakers, though, if you're going to defend somebody and it looks the way it does now, don't you want to go to the source and say look, mr. president, can i just get your thought on what was really going on on those calls? i'm sticking my neck out for you. here's a little bit of what i'm talking about. a washington examiner op ed called biden's family man image was always a fraudulent political narrative. and it points out biden has exploited his family for political gain for his entire career. his family focused image was carefully cultivated as a political tool and this despicable story has exposed it for even many in the media who for years bought the charade hook, line and sinker and maybe some of those other democrats buying it, too. last word? >> the charitable side of me says that his son was troubled. he was doing what a father tries to do for his son. but instead of steering his son straight and said no, you've got to make your own living and pull yourself up by the bootstraps,

>> harris: a third arraignment, a third not guilty plea. what is next for former president donald trump? how will it shape the 2024 race as we get deeper into campaign season? first, his team and maybe trump are set to be back in court on august 28th. and we don't know yet about a

trial date on charges including conspiracy to defraud the united states. the prosecution wants a trial smack in the middle of the election year. well, no shocker there! trump's defense attorneys want to delay proceedings until after americans vote. they cite the multiple prosecutions saying all of it is not really about justice under the law. >> this is not a coincidence. this is election interference at its finest against the leading candidate right now for president. for either party. >> harris: president biden taking a beach vacation as it all plays out. well, he does that anyway. he was asked during a bike ride if he was following yesterday's arraignment. he called back, no! he gave reporters pretty much his typical treatment. >> mr. president, any reaction to trump's indictment? >> any reaction to trump's arraignment in d.c. today, mr. president?

>> probably not. >> harris: in washington, d.c., grif? >> good morning, harris. from the courtroom to the campaign trail, that's now the reality for the former president heading to alabama tonight to keynote a g.o.p. dinner after making history yesterday for the third time pleading not guilty to those four criminal charges. we can show them to you. it's stemming from the alleged push to overturn the 2020 election results. three of the charges are conspiracy charges. one is for obstruction. now, trump wasted no time, harris, getting out of washington after the arraignment stopping briefly on the tarmac before boarding his plane to rail against the prosecution. >> this is a very sad day for america. this is the persecution of the person that's leading by very, very substantial numbers in the republican primary and leading biden by a lot. we can't let this happen in america.

>> now, as his campaign calendar competes with his court dates, more charges could come any day. a grand jury in georgia soon to decide whether to indict trump there. but as trump's numbers seem to climb with each case, he's embracing it writing this yesterday on truth social. saying i need one more indictment to ensure my election. meanwhile, democrats are calling for trump's trial to be televised live which currently is not policy but congressman adam schiff writing to the judicial conference "given the historic nature of the charges brought forth in these cases, it is hard to imagine a more powerful circumstance for televised proceedings. that would be something to be able to watch the d.c. trial live on television and the next court date in that d.c. case, as you mentioned, august 28th. it will be just five days after the first g.o.p. debate here on fox. in that case, by the way, we expect the judge to set a trial date at that time.

harris? >> harris: thank you very much. it's been a busy week. this editorial in the washington examiner gets to the nitty-gritty. "let's be honest. trump probably won't get a fair trial in d.c. piling on from the legacy media, a "new york times" columnists says special counsel jack smith's case stands on shaky legal ground. "shocking as it was, trump's behavior on january 6th did not violate any laws in obvious ways. as for his broader effort to overturn the election result, no federal law specifically bars politicians from attempting to do so." phil holloway, former assistant district attorney. phil, great to see you. so when i read that in "the new york times," i started to think if all that is the case, why are we even where we are? why don't these charges just get dropped? >> well, great to be with you, harris. listen, whether someone loves donald trump or hates donald trump, i think all americans should be, frankly, very alarmed by this latest indictment because, in my view, the entire

thing violates the first amendment. not only was trump's political speech constitutionally protected as free speech, his efforts that he made to challenge the election such as reaching out to the secretary of state here in georgia and even talking to mike pence, those were efforts by citizen taking their grievance to a government official. and that is specifically covered under the first amendment. americans have the right to petition the government for address of grievances. all of this, i think, is covered by the first amendment. listen, the entire premise of this indictment is trump knew in his mind subjectively that he had lost the election and that there was not any kind of election meddling or interference or frauds that would have changed the results. it's going to be very hard, if not impossible, to get inside his head and prove beyond a reasonable doubt that trump actually knew what he was saying

was false. they're going through a lot, harris, on people like bill barr or maybe even mike pence who shortly after the election said to trump, look, you lost and it was fair and square. but that's just their opinion. trump is being criminally charged for failing to accept the opinions of certain of his advisors. >> harris: if we know all of this, again, i come back to it. how does jack smith even have ground to stand on? what is perching him to the point where he can so captivate an entire american electorate basically inserting all of this into the middle of a political season? how does he have the power to do that if the charges can be easily refuted as you just did? >> well, somehow, donald trump has to get not only that issue but the first amendment issue i think before an appeals court, if he can, before any trials and before the election. the problem is that normally, these things are litigated with the trial judge and if you get

an adverse ruling, you have the trial and if you're convicted, then the whole thing goes up on appeal. but that could take too long. donald trump's legal team has to figure some way to get this to the d.c. court of appeals and then potentially to the u.s. supreme court if they can find a legal mechanism to do it because i think there's a novel legal argument here that all of this, when you put it all together, you know, somehow rises to the level of a constitutional violation with respect to the election and the presidential election. this is something that is brand new. we've never been through this before. this is all fresh, legal ground. and donald trump has some smart lawyers working on his team. hopefully, they can figure out a way to get this to the court of appeals before he has to be tried on any of these charges. >> harris: that's so brilliant. what you're talking about is pre-emptive offense. kind of like what my husband and i do with our teenagers. we meet in the kitchen as co-judges first. and then we try to, you know, push against whatever the case is. i'm making light of that a little bit.

but in all, what you're saying is there are things that they could be and should be doing right now that could really make august 28th the next time we potentially see everybody in court very interesting. your last quick thought. >> well, they're going to make these legal arguments to the trial judge. and the trial judge is probably going to say no, you're wrong. we're going to proceed to trial. they have to figure out some way to get this -- that ruling that i expect, they have to figure out a way to get it up before the trial because after a trial, it could be too late. speaking of trials, by the way, jack smith apparently wants the entire american public to live through all of the things that we went through following the 2020 election because donald trump gets to present evidence in court if he has it that there was election fraud going on. so he's giving donald trump the stage to make this case, again, two or three years later. >> harris: yeah, i think he's also doing it to be able to show that video outside of the capitol over and over and over and over as people go to vote.

>> very well could be. this is -- this entire thing looks and reads like political talking points. it doesn't, to me, read like a criminal indictment. certainly not one brought by an experienced federal prosecutor. it seems to be an overreach. >> harris: if all of that is the case, we are becoming a different country. much like the ones we preach how democracy should look to. that's the second time this hour i've said it. hard to get away from it. phil holloway, always good to see you. thank you. >> thank you. >> harris: three indictments within a few months would usually be considered pretty bad for anybody. yet, some political players are warning democrats that former president donald trump has never been more politically fuelled. they say he can use his legal troubles to help him win back the white house. plus president biden and his team keep bragging and bragging about the economy. oh, it's just amazing! for everybody. voters don't think so.

over his latest indictment. here's niki haley. >> like most americans, i'm tired of commenting on every trump drama. i've lost track of whether this indictment is the third, fourth or the fifth. >> harris: a new editorial warns donald trump has never been more dangerous to democrats. while another argues this indictment spectacle is exactly what democrats want. the more the press is preoccupied by trump's courtroom dramas, the less public attention there will be on president biden's declining capacities or the facts emerging about biden's promotion of the family business. it also means his competitors for the g.o.p. presidential nomination can barely get enough media attention. all of this has democrats elated because they want trump to be the republican nominee. doug collins, former republican congressman of georgia and former ranking member on house judiciary. patrick murphy, former democrat congressman of pennsylvania and former undersecretary of the

army under president obama. great to see you both. what do you make of the idea that this is the arrest playbook and democrats are going to love it? >> well, i mean, look, it's august. think do -- they don't have a l to do in d.c. the former president has a security detail and secret service. this is going to be planned. if you're donald trump, this is something he's been saying for many years. how the d.o.j. and how they're attacking him and persecuting him, in his words. this is becoming more and more evident to the american people. again, why not just deal with it? why not just promote it and deal with what is actually happening. he's not going to run from it. he's going to fight it. and i think by putting this out there for people, they see what's happening and for everything that you just shown on some of these other editorials, the democrats are very happy because the mainstream media especially the other networks don't follow the biden situation at all and the republicans can't seem to get any air. i'm going to warn them. be careful what you ask for on this. donald trump is getting stronger. and joe biden is not.

>> harris: you know, i thought about what doug is saying after former president obama got involved in a race like this like no other president i have really ever read about. in june, there was reportedly a meeting between him and president biden and he warned biden about how much stronger this process will make donald trump politically. pat? >> i agree. and the playbook that you're referring to is really former president trump's playbook. he's raising money off this. you heard a few minutes ago, president trump asked for a fourth indictment to guarantee his presidential win. at the end of the day, like your father, doug and i took an oath to defend and support the constitution of the united states against all enemies foreign and domestic. one of the blueprints of our democracy is the rule of law that no one is above the law. president nixon in a criminal case wasn't above the law. president clinton in a civil case wasn't above the law.

donald trump is not above the law. nobody is. >> harris: given the fact that you said that. i don't know if you saw, yeah, what phil holloway said earlier as an expert in the field of federal prosecution, he said first of all, he points to the timing of this. right smack in the middle of when the american public is going to be electing a brand new president. and this likely could be, could be, we don't know yet, on the right the nominee. he also broke down the case and really jack smith, according to phil holloway has quicksand that he's standing on. doug, what do you think? >> yeah, patrick, look, what patrick said, i don't think nobody is fighting the fact that everybody should be against the law but you have a d.o.j. that actually applies it equally. i mean, this is the problem that we're seeing here. i mean, again, there's no -- you can't debate. i mean, liberals and conservatives all across the spectrum said hunter biden has been treated differently. you look at the way the president has been treated and look at the way the republicans have been treated under the d.o.j., this is becoming the bigger issue. i don't disagree that everybody

should be treated the same under the law. let's treat them the same. when you get into the case as phil holloway actually said, let's look at the case. there's no greater principle than the rule of law. i think patrick would agree with that. there's also no greater principle that the government should not interfere with free speech rights either. and i think these are the kinds of things that are being looked at in this indictment. looked at it in these other areas. and look, it's going to be up to jack smith to prove this. this is going to be his case. but when you're having folks already come out on this issue and they're trying to tie it to another event, this is becoming a problem. apply the law equally. patrick and i will agree with that. problem is most people feel like it's not being applied equally. >> harris: patrick, quick. >> harris, real quick. i was a federal prosecutor and then i joined the faculty at west point teaching constitutional law. this is a red herring. first amendment, yes. first amendment guarantees freedom of speech except for four things. fighting words, inciting riot, defamation of character or obscenities. he incited a riot on january 6th and three police officers died from that. three police officers.

>> did you hear what doug just said? i'm going to interject here. i want to make sure you're on fact with each other. doug said, yeah, he hasn't been charged with any of what you said. which brings about the question. what is jack smith trying to do? he wants to make history here by trying something that has no precedent. we know that. is that really how you want to go about it? because this president is tied right now at 43% with the president that's been in office already. joe biden. he's still in office. i think it's panic mode time if you're looking at that stat alone. and he's soaking up all the oxygen for everybody right now. all right. he being trump. president biden and his team going hard with what they call their economic successes. new polling shows people aren't feeling it. a majority of them say the pessimistic on bidenomics is how they feel. most people, 44% say, the economy is the top issue facing the country. 3 out of 4 call economic

conditions poor. more than half say we're still on a downturn. the president's approval still deeply underwater on the topics of the economy and inflation. none of it stopping team biden from beating the drum. it's working! >> we're very proud of, i must tell you, because bidenomics is working! it's working! >> it's historical. bidenomics in action. bidenomics is restoring the american dream. >> starting to call it bidenomics and our plan is working bidenomics. >> bidenomics is about making sure that we build an economy that doesn't leave anybody behind. >> harris: patrick, with respect, that's calling the american people liars. why are they doing that? >> listen, there's no doubt that there are people still hurting across america and we have to do a lot more. i am not spiking the football. nobody should be spiking any footballs. these are the facts. there's 12 million new jobs.
