alexandria hoff is here with the latest. >> let's get to the protective order first. not unusual in criminal cases. in fact, one was granted in the classified documents case down in florida. but trump's attorneys argue that no new order should block nonsensitive facts about the january 6th case from being released publicly. this weekend the judge denied their request for more time to respond to the 5:00 p.m. deadline stands. in a post yesterday the former president wrote, quote: there is no way i can get a fair trial to the judge signed to the ridiculous freedom of speech fair elections case everybody knows this and so does she. she will be immediately asking for recusal of this judge on very powerful grounds and likewise for change of venue out of d.c. got in a war of words with his former bottom and former g.o.p. competitor this weekend. he also spoke about possibly being called to testify at trial. listen. >> i testified before the grand

jury under a subpoena after we got clarification from the court about protections that i have under the constitution as the president of the senate. but i had no plans to testify, but, look, we will -- we'll always comply with the law. >> well, right now trump faces a total of 78 charges in three separate criminal cases in new york, florida and d.c. his attorneys say they soon expect a fourth election-related indictment to come out of georgia. >> it's been highly spoken about. i think if you look at the barricades, the fact that she has got her pr team doing fresh pictures for her is a good indicator that fanny wants her moment. and she will get on the bandwagon with the rest of the corrupt d.a.'s and ags we have seen out of this country. >> speaking about fulton county, georgia d.a. fanny willis. we will have more from ha lien that habba coming up a at 8:00.

>> steve: it's called a protective order, that they have got to rule on today at 5:00. it's not really about protecting anybody. i think people think it's a security thing it. just protects the evidence, right? >> yeah. it's the discovery that the prosecution is going to come up with. they say that they have this whole round of new evidence that they are going to be presenting to the defense. they don't want that that come out there. they say it's highly sensitive it. seems that the trump team thinks this is going to be too overreaching this protective order. it's not a gag order. a gag order means you can't talk about the case at all. you will be able to discuss it but not parts of it. >> ainsley: materials grand jury transcripts provided by the doj through discovery. >> brian: one thing is pretty clear, trump, like many experts would agree, even people on the prosecution side would say hey, wait a second, this judge couldn't be worse for trump. even though they said it came random on a. we had and the venue in washington, d.c., where the president got 5% support, there's no way he should feel

secure with that judge and with this jury. but it's up to the judge to decide if she should recuse herself, which makes it not likely. i thought john lauro was really strong. i think he did five or six interviews. really understood the case inside and out. >> ainsley: he made great arguments. he was on with dana loesch. >> brian: listen, if mike pence goes true to his book, which is his biography, he will be strong for us, meaning the defense. >> steve: right. one of the things -- cope in mind, what mike pence said is the former president and then president, pressured the vice president, when they were still in office to reject the votes for joe biden in favor of false electors. but john lauro said yesterday, donald trump didn't direct pence to do anything. he asked him in what he referred to as an aspirational way, which is the new argument, and then when asked about georgia, when he -- when the former president had the phone call with the former -- rather the current

secretary of state, mr. raffensperger there saying can you find 11,000 votes and you could face criminal repercussions if you did not. lauro said once again that was aspirational app. that's a new word. he didn't ask him to do anything in particular. he just kind of hoped that he would when i watched him on different networks and. so anchors on other networks were really challenging him, it does make you think wow that might be a good argument. >> steve: what does that mean? >> ainsley: here is trump's attorney john lauro. >> the biden administration wants the judge to put in place an order that will prevent the press from obtaining exculpatory and material information that might be relevant to these proceedings. even though mr. trump, president trump has argued from the very beginning, as i have, that this is an attack, this indictment is an attack on his family rights. now with the biden administration wants to do is

deny all americans the opportunity to learn nonsensitive information about what the case involves in a political season. >> would you be okay with the president's support, televised trial? >> i personally would love to see that. i'm convinced the biden administration does not want the american people to see the truth. and they acted on it by filing this protective order, which is an effort to keep important information about this case from the press. >> a point, brian, about the judge, them wanting a different judge. they want a change of venue. trump's team was told you have until 5:00 today, as you know, to respond to the latest news. >> and he is saying no, let's extend it until thursday. >> we need more time to discuss. this our attorneys need more time. and he is trying to slow down the case. we have been told that but prosecutors are pledging a speedy trial and it appears that the judge is agreeing with them and says, no. we need to you respond today.

we're not changing the deadline 5:00 p.m. today so we can move this along quickly. >> brian: john lauro says in a case like this you have two to three years to prepare. you did. >> me to get this done in a matter of weeks we have all the other cases? >> i think the timeline, if you are a prosecutor, you want justice. so what's the big deal about the election? why do you have to get it done before the election? why is that even in your mind about the election? you just go about -- go out for the truth, jack smith. >> ainsley: trump expects a fourth indictment to come down within weeks of the fulton county one. he even said he is welcoming another indictment. >> he says he only needs one more indictment to win the 2024 presidential election. >> steve: that was a good joke that he did there in iowa. the thing about mr. lauro saying he would love if it were televised. he knows for a fact that since 1946, federal proceedings cannot be photographed or televised; however, the state court in georgia, they could televise that. and he's right.

coordination. here to react fox news contributor dan hoffman and u.s. institute of peace senior adviser dean cheng. dean, to you. what is the message that russia and china hope for america to take away from unprovoked actions over the weekend? >> i think they are sending multiple messages one of them is look at the capabilities that the two countries have that they are willing to coordinate together. the other is if you, the u.p.s., are going to operate in the black sea near russia, if you are going to operate in the south china sea near china, hey, we can do the same thing. we can operate the bearing straits. i would expect them to see them in the future operating off of california washington state. >> brian: dan, i didn't have to tell you. this didn't happen in a vacuum. they are buzzing -- russia and china are buzzing our planes and our drones, sometimes taking them down. they are cutting off our destroyers as we go in through international waters. and we basically have had no response. again, what is our response?

president of the united states starts meeting with the armed services committee's chairs and say listen, we are going to need a major boost in our military budget. we're going to start to get equal again or be on route to get equal again with the sides of the chinese navy and start flexing muscles a little bit. showing we are ready for this fight. we seem to be sending the exact opposite message. >> well, when you consider that at this point our shipyards cannot produce a new warship in less than six years. when you consider that the chinese have literally hot up and running shipyards, churning out the kind of ships that appeared off of our coast and we don't have the budget or the industrial capacity. i certainly hope the president does that sort of meeting. but i hope he doesn't just say hey build me some more ships. let's talk about building in the industrial base necessary to sustain such an effort. >> brian: dan? >> dean is right. it's about our deference industrial base. and that's one of the things

right. we go two out of three, doug does not. doug, why not? >> i just don't see either of these two have a clear vision for our future. in one sense if you are going to be a part of our future, you need to be alive, that speaks to the democrat. and with president trump, when you have so many indictments, you have had more indictments in the last not indictments but more charges in the last six months than tom brady scored touchdowns in his last two seasons combined, you have got a big obstacle to overcome. >> well, there you go. sammy, doug just mentioned you have got to be alive. you have got to be concerned about joe biden's age. what else concerns you about joe biden. >> well, the war in ukraine concerns me. i am a veteran, but i am antiwar. and i believe this ill conceived war in ukraine cannot make us stronger. it made us weaker.

i'm curious to see if joe biden is going to survive the primary. i mean, i'm taking a very hard look at robert kennedy right now because i don't think joe biden, our president is no longer in charge. >> steve: noreen, you are a republican, what's your main concern about donald trump if he were the nominee again? >> well, first of all, i just think you can actually be president while in jail not that we expect that on the trump side of things. look at that indictments 400 or something charges. most of them are erroneous and i don't think that will be the case. we have to remember this is a man who saved us once and i believe he is divlg to do it again. do we have a run of a lookout of candidates to choose from on both sides? i you would suggest no. it takes someone really powerful and successful to turn this country around. and in our case, that is donald

trump. >> >> i asked you though, what is your concern about him as the candidate? >> my concern is about donald trump are zero. there are no concerns. all of this that he is going through right now is once again the democrats being terrified of him and distracting away from their corruption and all of their issues that we just continue to put under the rug. >> doug, one of the things you told one of our producers who talked to you yesterday on the phone was that when you look at trump and you look at biden, neither one of these guys could be hired at any other job. what were you talking about? >> i stand behind that if you look at the age of president biden, and some of the baggage that he is carrying right now, i don't see any major corporation saying hey, let's hire this guy. with president trump again, the baggage he is carrying, the fact when he was in private business,

he lost over a billion dollars that he just walk away from. the fact that he is having to pay off a porn star. the fact that he has got all these different items that just everything listing up from his past, i just really question whether or not he would be employable outside of running for a general election for the president of the united states, which is, by the way, the most important job in the world and we have so many great candidates out there that also understand economics. they also understand the military. they also understand social services. i just don't see president trump being our best option right now. >> and, sammy, you mentioned a moment ago, you are thinking about supporting r.f.k. jr. is he along shot. do you think there is a chance he could win the democratic nomination? >> no. and that's why first question i thought was going to be a biden-trump re rematch i raised my hands, the democratic party is not giving him any traction.
