"america's newsroom." i'm dana perino. bill hemmer off today. >> bret: i'm bret baier. the governor calling it the worst national disaster his state has ever seen. it will take years and billions of dollars to recover from the damage. survivors are reporting horrific scenes as they escaped through the flames and burning embers raining down around them. strong winds from hurricane dora are fanning the flames. the fast moving wildfires destroyed thousands of homes and buildings in a matter of hours. we have photos showing a scene on the island before and after the flames came through. a small peaceful town ungavelled in an infern on. let's go to max gordon reporting for fox weather live on maui. hi, max. >> just a tragic situation here on the island of maui. 13 miles away from the town of

lahaina, one of the hardest areas hit by the fires. we have a roadblock where police aren't very many people in. just residents and restricted to only a few areas. it is an active scene on a lot of parts of the island. there are still many hot spots and firefighters are trying to put out the flames in areas and search and rescues crews are searching for survivors and finding victims. 55 people confirmed dead at this hour as fires continue to burn throughout the island. it is unclear why these fires started. none of these fires are currently contained. the most destructive fire, the one on maui's west side which ripped through the community of lahaina fed by dry conditions and fierce winds because of hurricane dora. the fire destroyed more than 1,000 homes and damaged the

voters here are used to seeing the presidential hopefuls move through the grounds and expect candidates to work for every vote. they want to see how they visit with vendors and flip the pork chops and if they take questions. doug burgum. mike pence and suarez. along with johnson and elder will take the turn this afternoon which does get some pretty big crowds at the fairgrounds. florida governor ron desantis will go one-on-one with governor reynolds. a chance to learn about what the candidates all stand for. >> it really helps them be a better candidate when they have to test their message and hear what's on the minds of everyday iowans. >> so who will not be at the fairside chats? donald trump. his team says he wants to go into the fairgrounds and talk with people one-on-one with iowa voters than sit with the current

hampshire. charlie hurt is an opinion editor and jessica tarlov. great to have you. put up the polls. iowa republicans trump at 44, desantis 20, tim scott at nine and then others down there in the low single digits. do you remember what president trump went in and took the helicopter and gave kids rides? one of the most iconic modern political experiences of our time. i don't know if he can replicate that. instead of taking iowa endorseers he is taking nine florida congressmen who supported him. >> he broke the caucuses with the helicopter rides and he was a bad boy back then because they shut him down and said he didn't have the permits. they didn't have the right place to land. he just found a football field across the street and started

over there and took people up and everybody left the fair to go over to the helicopter rides. it is interesting. it is still early. things are going to change somewhat in some direction. but you know, the problem here is a lot of times when you have the caucus, the iowa caucuses, you have -- you have a bunch of people in the field. a bunch of people not particularly well-known. big difference this time is you have one guy who is very, very -- >> dana: 100% name i.d. ron desantis has higher name i.d. than some others but visited 99 of the counties. for democrats when they watch this, if they watch at all, are they still anticipating that trump will be the one that they go against or do they think something could happen here? >> well, i think there are big questions surrounding what is going on with the indictments. we have three indictments thus far and another one from georgia

in the next week or two. jack smith's team released their target or their proposed date for the january 6th trial, january 2nd. >> dana: even with all of those things. >> that's the main factor. how could you assume it won't have an effect. something that will tie him up timewise. that trial would come days before the iowa caucuses. >> dana: they want them january 2nd. >> how could you not think it is donald trump barring the fact he drops out. >> dana: can you imagine the people at justice department saying great, jack smith just ruined christmas getting ready for a trial on january 2nd. >> jack smith is democrat's hail mary in this election. >> dana: i know what that means. do you remember on "the five" when we talked about how ridiculous it was to call the climate bill the inflation reduction act.

that hearing is underway. we have this from the court. the judge basically said the safety of witnesses is important that the defendant has the right to free speech but that right is not absolute. without a protective order a party could taint a jury pool. that's over the scope of the materials and information released in the case and whether or not he will be able to talk about that. this is not about a gag order but protective order. this is happening right now right there at that courthouse in washington, d.c. halfway between the white house and capitol hill. so we'll keep you updated as we get more information. they're in the courtroom right now. >> you need to come out with your hands up.

what do you know, bill? >> good morning to you. here in the rio grande valley sector the drug cartels have an iron grip on deciding who crosses the border illegally. the video reflects that. we'll get into it. this is texas dps drone video from brownsville that appears to show migrants scattering after that he are approached by several suspected cartel members armed with machetes waving them around telling the migrants you pay or you won't be allowed to cross this river into the united states. texas dps tells us they ended up talking to some migrants after they crossed illegally into the u.s. and told these guys came at us with match et east and weren't letting us cross unless we paid. once we paid they will let us cross. they wear the cartel brace lets saying they've been paid.

border patrol caught a backpack full of live endanger spider monkeys. they catch people smuggling exotic animals with the intent to sell them. they were rescued and turned over to authorities. human smuggling. take a look at these photos out of the laredo area. border patrol stopping a track for trailer. inside of it they find 28 illegal immigrants being smuggled crammed into the cab. just that front cab area. hard to believe 28 people crammed in there. lastly we'll take you out to arizona where border patrol agents opened up an rv and 16 migrants were smuggled and hidden in different areas of that rv. back live this migrant surge continues. multiple sources telling me yesterday alone border patrol apprehended just over 6,000 migrants who crossed the border

indictment it said they were producing 16 metric tons a month at that time in china. so we sent a contingent to china, prosecuted the zang's for his murder and after three days of prosecution, they deliberated for 15 minutes and set the zang's free. they are purportedly in mexico mass producing fentanyl along with the cartels. bob anderson from 60 minutes confirmed them in the marketplace in china and expelled from china and visa revoked. since that time hundreds of thousands of americans have been killed by this horrible scourge that has been launched against the united states. the well-known mechanism of compulsion, disease and death. this is a well-planned attack that has been going on for some time while we've turned a blind eye to what we consider the blight of the junkies. this is totally misrepresented as to what's going on.

is talking about would not go to maui. that's separate. >> bret: we're one fiscal cliff away. >> that's the theme on capitol hill. >> bret: thanks. >> dana: while that's happening a new poll finds president biden is losing support among key voting blocks. for the first time the president now failing to win a majority of support from non-white voters who have not graduated from college. here to break it down is a scholar at the american enterprise institute and great person to have on the show. you've done research. the margin of non-white working class voters in with theall elections for president obama was 67%. biden 48%. you think this is actually having an even stop for the democrats. >> at least on current evidence it is. the poll is the "new york times" poll found non-white working class voters giving biden only a

16-point margin over trump which is quite small relative to those previous margins you mentioned. if that holds through the election it would create big problems for the democrats. i expect it will improve somewhat over what we see in that poll. it has to improve a lot to get back to the level biden had just in 2020. there has been all kinds of indicators over time of softening of non-white, non-college support for the democrats and for biden. this is just another sign that that's a real thing, a real trend and something for democrats to be very concerned about. >> bret: i want to read from your op-ed "new york post" in which you say out of touch progressives are driving non-white voters out of the democratic party. the beginning of wisdom is understanding the non-white working class is not progressive while the democratic party became more so. the voters say they are moderate to conservative with less than a quarter identifying as liberal. for republicans, is it possible to look at this election and say

if you take let's say 1, 2 points out of a black vote that was traditionally democratic you can change the dynamic of this entire race. >> yeah, that's correct. that's a very important fact for people to keep in mind about so-called people of color or non-whites. overwhelmingly these are moderate to conservative, not liberal. they have a lot of views on a lot of issues that make them somewhat accessible to the republicans. as you say, if you just take a few points off the black vote or while we've seen bigger than that off the hispanic vote it creates problems for the democrats. so i think republicans, you know, i'm not a campaign consultant but if you want to concentrate on something that will give the democrats trouble you would be well advised to really work the non-white vote,

especially the non-white working class vote and not assume it's automatically all for the democrats. >> dana: do you think the biden campaign recognizes this as an issue and do you think they'll do anything about it? >> they recognize that. they can read a poll as well as i can and they're worried about it and i think they'll try to work these people pretty hard. they are not willing to compromise on some of the issues, some of the moderate to conservative not only working class voters are concerned about but certainly will be trying to remind them about how great bidenomics is, certainly try to highlight what they argue are excesses and outright racism on the part of the republican party. this is going to be a no quarter given culture war going into 2024. >> dana: it is underway today as all the republican candidates get to iowa to debate there. good to have you. >> bret: thanks. it's one of the reasons they're

>> bret: i like that one. a federal judge in the trump 2020 election case coming down with some rulings saying the former president has the right to free speech but that right is not absolute. courtroom reporter jake gibson saying the judge was not persuaded by the prosecutor's argument. that seems reading this to be something for the defense. shannon bream, anchor of "fox news sunday" and reading through the tea leaves it seems like a pretty good ruling for the former president. >> she is open to this idea he has to be able to talk about what's going on in the case. so what his attorneys have argued is if there is sensitive material let's parse it out and say that can't be used publicly. they didn't want a blanket

order. it sounds like the judge is siding with him saying yes, sensitive information is one thing. there is a lot of other information he should be able to talk about. >> bret: she also said earlier she is not going to factor in that he is running for office. that's not going to factor into how she thinks of things. clearly this is looking like it is heading his way. >> she has also noted his social media post and very aware of him giving speeches, stump speeches where he goes after the prosecutors and the judge and everybody else. she is aware of that. she said for neither side am i going to consider the issue you are running for president which begs of the question of the trial date. prosecutors want january 2nd. all the big caucuses and primaries he will miss. she is not deciding on that today but telegraphing here she can't help the fact the defendant happens to be running for president. >> bret: that factors in so much. 13 days before the iowa caucuses.

the average trial is what 4, 6, 8 weeks? >> think about in the florida case, the mar-a-lago case is set for may of next year. the parties discussed there and this discussion of the fact he is running for president was brought up and the judge said important people with big jobs get invited by federal courts all the time and they have to show up for their trial. she didn't let it factor in to setting hers for may and see what the judge says about january. it falls in the middle of everything that is going to be pulling him in ten different directions. >> bret: is there a sense this judge, looking at how she has ruled before on january 6th defendants, she has been pretty tough on the sentences. there were a lot of republicans who looked at this, including the former president, who said this is going to be an uphill battle. judging by this initial look at this protective order, it seems like she is cutting it down the middle. >> she is. she is no nonsense. over the weekend the case got

filed late friday night. she said everybody has to respond to monday. the trump team said give us more time and she said no, i'll see you on monday. she doesn't want any foot dragging or any delays. but also interestingly enough today what they are arguing about. one of the things coming out of the courtroom is the trump team has argued they want volunteer attorneys to be able to have access to this discovery information that will come in. >> bret: they aren't paying them. >> justice department has more than 60 lawyers. we have a small group. we want volunteer lawyers to see this stuff. doesn't sound like she is going for that. she says this issue is the same group that aided trump in the january 6th plot. volunteer attorneys at the time might seem to help in this case. i can't accept a definition that might let anyone including indictment co-conspirators to assist in the process. some wins for the trump team but this judge not playing around. >> bret: good to have you to digest realtime getting the
