judge, your reaction to the place, the prosecutor, the same guy david weiss who has looked into this for years? >> jeanine: you know, it is kind of hard to convey my feelings because i am furious. number one, stop laughing, lawrence. number one, this guy, weiss, is compromised. he is untruthful. he is not capable of being a special counsel. number one, a special counsel should be from outside the government, not someone inside the government because this is a conflict of interest case. okay, but more importantly is this. david weiss is the one who put together the plea deal that was rejected by a federal judge. that plea deal was not only a sweetheart deal, it was corrupt. what it is was it gave hunter biden legal immunity in perpetuity. that means for the rest of his life he could never be charged with a crime. now, the amazing part of it is

then why slide and he said but the case is still under investigation. why? because he didn't want the republican house to investigate. so then merrick garland comes out and he says tuesday, weiss said he wants to be special counsel. why? weiss finishes no mike finished his investigation, weiss said he had all the power he needed. he told jim jordan that in june. why today does he need a special counsel? plus he wanted to bathe him in legal immunity, and it gets even better than this. the fact is, this plea deal not only prevented anyone from going forward, but the same guy who tries to pull the wool over the american people's eyes and the federal judges eyes, it's a contradiction. because now he is stopping the congressional investigation by saying this case is still underway, preventing congress again from interviewing all the players. and let me just say one more thing. this is a good news, bad news cycle. we hear about the money from

case to continue to unravel. not because weiss is some ethical man, it is because weiss' deal got blown up before the court but democrats can save themselves here because ths unraveling before the american people. there is one way to do this. either joe biden can resign right now, give kamala harris the presidency, and then they can have gavin newsom run for office, but the idea that this is over now, this is just beginning now. they could have just conceded. they have talked about unfair justice under the law for years. and all of a sudden, when their guy is elected and as it starts to unravel, they don't want equal justice under the law. i think it is shameful. >> brian: these issues were all in play but ignored in 2020. real quick, this news, joe biden, close to the press, no shocker, i didn't ask for any questions or hear any questions. katie? >> katie: the appointed david weiss a special counsel is a total joke when it comes to credibility.

this is a guy come as the judge laid out, who decided they were going to do this unprecedented plea deal, whether the misdemeanor charges, five years of investigation, the lack of charges, or the diversion program for a gun charge, which would be a felony, in many years in prison for any regular person, especially the illegally possessed gone into a trash can next to school as joe biden and his girlfriend at the time did. how this is going to look moving forward. hunter biden, bad news for him, pretrial release because today the depa justice department saiy cannot come up with an agreement to get him a second plea deal after the first fell apart. we has to be drug tested, get a job, inform the court when he is going to travel. the issue is -- >> brian: case will not resolve short of trial. >> katie: correct vehicle the issue now is now problem. he was getting immunity from the plea deal and the biden defense team in court said no, no, no we

need immunity. now the justice department and special counsel is in this position where this is what they have to investigate. on its face, especially the documentation this week with james comer oversight committee chairman, millions of dollars in foreign money, hunter biden facilitating the money, there is a lot of people politically who have gone to prison for fara violations on a much smaller scale and big questions about whether that is going to happen in because they couldn't come up with a second plea agreement, including the fara charges indicates to me that hunter biden is actually kind of worried about that and for weiss to get his credibility based on the law he is going to have to look at that at some point. >> brian: quick answer. we know comber was going to ask the bidens to come before him like don jr. was asked, we know weiss was supposed to come before the committee. is all of that stop? >> jeanine: yes. that's the whole point. that is how corrupt this is. there is none of this on the level. >> brian: going to fight that

president trump talking about new evidence. she is instead imposing a more limited order that bars publicly discussing material deemed sensitive by the government. trump railing against the case earlier this week, saying it infringes on his first amendment rights. >> the case is -- is a ridiculous case. is a first amendment case vehicle but we don't want trump to sp speak! so they take away your right to a first amendment. now they sue -- so now i have one of these lunatic reporters back there saying, sir, we would like to talk to you about your case. i'm sorry, i'm not allowed to talk about it. somehow that is not good for votes, do you agree? we say i can't talk. i will talk about it. i will. they are not taking away my first amendment right. >> katie: judge, to you on the first amendment question, and the judge here citing mostly with the president but i think it says a lot the prosecution was trying to get essentially a gag order. >> jeanine: never underestimate the feds. they are notorious for this.

this is a trial about free speech. it is off and running with a prohibition against free speech. and that is the irony of all of this. i understand that what the judge is doing, i do. and in the article eight of the protective order, paragraph eight, it basically says there is certain information, like personally identifying witnesses or actresses, that makes sense. that needs to be prohibited. rules, material, and grand jury material, grand jury testimony, i don't have a problem with that. than what they do is order by the governments filter team come i'm not going to get in the weeds here. but they say there are certain evidence that will be produced at trial is sensitive and donald trump cannot talk about it. well wait a minute. you are going to produce as evidence in a public trial in front of a jury, why can't he talk about it? what are you worried about? you are worried about your case? you are worried about the public hearing the other side? in other than a courtroom setting? with the best part of it is

where the judge is putting an obligation on the part of defense counsel to not allow donald trump to take notes. from the information that he gets from the government. and counsel must inspect any other notes he takes to make sure the defendant, a.k.a. donald trump, hasn't copied down personal information. i mean, this is ridiculous. >> katie: lawrence, not underestimating the fed, not just donald trump talking, they also didn't want twitter talking when they got into president trump's twitter account, saying, subpoenaing this information in anybody at twitter should not tell the target that this is happening, which seems to be problematic. >> lawrence: they also thought he was a flight risk, as well, even though he has 24-hour secret service. i hope the court understands that donald trump is almost fading them to arrest him. he wants to get locked up. he wants that to be the rallying cry for his supporters to say,

get put in jail. the man doesn't even like sleeping in a hotel, let alone in a jail cell, so i think that he is genuinely and obviously, you know, we are not pals, we don't chat about it, but i think when you look at what he is facing with the four indictments, and putting aside the new york indictment, which i think is not a different kind of level than the other ones, there is real concern, this many counts that you are facing, that you are going to get convicted of something, and i think that is scary for anyone, let alone someone who has had a tremendously privileged and lovely life in terms of how they live, this idea that you are going to be going to prison. i think it was a good thing that this judge mostly sided with the trump counsel just to put it out there that she is not in anyone's bag here, that she can read the order and say this is going too far but i do feel this way, she was very clear again that it is not about a first amendment, that donald trump is not a normal citizen anymore, he is a defendant, there are restrictions.

he has rights, but he is out on bail. he can't do any witness tampering, and she did also say that the trial will be sped up if he goes out and talks about it because the jury pool will be contaminated. >> katie: january 2nd, 2024, right before the primary really starts. >> brian: i just love, the experts, like the judge says, in normal instances, takes two years to get ready, he wants to get ready in six months. what does jack smith care? why do you care, jack smith? just do a good job trying to prosecute and get justice. are you concerned about the election? the justices cannot and will not factor into my campaign on either side. you are not going to factor it in but jack smith is certainly going to factor it in and you really think she is going to wait two to three years to let this happen? i do think he is daring them to put him in jail, but i don't think there's any way he does. chris christie, will hurd, ron desantis can call out the

but that is not going to work. once these squatters have the clear residency and it is in the court, if he goes in there to do that, he will be cited for trespassing. he will be taken to jail. i have been covering this for a while, i covered it in florida and pennsylvania, recently in my new york apartment, we have squatters there. there was a vacant apartment, they leave, sometimes in new york they leave the doors open to all of the realtors can go show the apartment. one of the squatters moved in. now they are having to wait until the court system -- and sometimes it can take 6-7 months to get them out. i mean, i like how he has this innovation, but if you think this is going to work in your state come in most cases, it's not. >> jeanine: well, it depends on how bright the squatter is. the squatter might just say, you know, this isn't working, not go to court, not everyone knows what the law is. likely for homeowners in those situations. he says he likes to install the ring cameras in every room. what do you think of that? >> brian: a couple of things. he has a gofundme page come help

[laughter] >> lawrence: i appreciate that. >> brian: it shines a light, wait a second, how are people allowed to do this? how is this happening? this is a problem, it happens a lot during the pandemic where people say, you have to pay your rent, landlords are screwed, start paying your rent, good luck with that. i hope they find a way to solve this and get it through the court quickly because it is anti-american. >> jeanine: unfortunately it is not moving through the courts quickly. is being the worst roommate possible answer to get a squatter out of a home? >> jessica: its initiative, i guess. [laughter] you are trying to wait these people out, it is a method i guess you could employ. i don't know how this is the law, at this point, when you think about how it has been corrupted from what it was originally supposed to be.

and this huge wave of fake leases, i don't know how that is not more of an outrage to the rental -- >> jeanine: squatter. >> jessica: the squatter likes it when they can have a fake lease. the realtors, selling homes, renting homes, et cetera, just the legal system overall, obviously, takes a big hit from it. >> jeanine: it seems like everything is upside down these days. but jessica, why would squatters go into these trashy places when they could go into a $10 million home? >> katie: out-squatting the squader -- the word "squatter" is such a weird word. there something wrong with the local ordinances and the people to go into these places and say you are trespassing. you are not here, this is not your home, you are going to jail. if i were someone who had a piece of property, i would never become a landlord in cities where they don't have any protections for the homeowner because you are screwed.
