announcement that he appointed a special counsel to investigate hunter biden was like a really bad practical joke. >> here today to announce the appointment of david weiss as a special counsel consistent with the department of justice regulations governs such matters. in keeping with those regulations, i have today notified the designated members of each house of congress of the appointment. >> laura: yes, that's the same david weiss who tried to give hunter that sweetheart plea deal before a smart judge stepped in to say not so fast. now, droned weiss isn't even eligible to be named special counsel under the regulation governing his appointment according to section 600.3, he has to have a reputation for integrity and impartial decision making. now, that's obviously in question, the impartial decision making part after how he handled the initial phases of this investigation. and the special counsel shall be selected, it says, from outside

the government. okay. garland is not a stupid man, so i'm asking this tonight in all candor. is he blinded by a desire to muddy the waters here during the election psych? i don't know what could have motivated him here. andy mccarthy in national review pit bluntly. there could not be a more serious blatant conflict of interest in a situation in which the president's justice department is conducting an investigation of the president's son that implicates the president and in potentially impeachable conduct. the conflicts of course don't end there. remember what one of the irs whistleblowers testified to. >> the justice department allowed the president's political appointees to weigh in on whether to charge the president's son. i watched the united states attorney weiss tell a room full of senior fbi and irs senior leaders on october 27, 2022, that he was not the deciding person on whether charges were filed.

that was my red line. >>. >> laura: and garland as appointment is even more devious than that. for weeks members of the house and numerous ingraham angle guests have been calling on weiss to testify before congress. his appointment to this role means that he's potentially now protected against having to testify until he releases his report. >> this insulates weiss and the department of justice more than it necessarily moves the investigation forward. and he's going to be able to say now there's an ongoing investigation, i'd love to answer these questions but pound sand. >> the appointment of a special counsel would have the effect of delaying a resolution on the hunter biden matter, and it would certainly delay any anticipated testimony from the u.s. attorney in delaware to republicans on capitol hill. >> laura: good for catherine herridge while jack smith wants to move expeditiously so donald

trump can be hobbled during an election year, do we expect weiss will have the same sense of urge? don't bet on it. >> i've never seen a criminal case follow this strange path, five years, a u.s. attorney from a prior administration, a plea agreement seemed like it was about to wrap everything up and now fallen apart in dramatic fashion and from here it's very unclear where we go next. >> laura: what is clear, i think, though, is that this move was meant to protect joe biden, which his allies in congress and the media wanted to be sure to point out. >> not a sin tell a of evidence that he did anything wrong and mr. weiss has not surfaced any such evidence because there is none. you know, my constituents aren't asking about it. >> it is top of mind for a lot of constituents. >> laura: when cnn is calling out their lame defenses, you know that the bidens are in trouble which is what obama's

old architect david action rod alluded to. >> i'm sure this didn't land all that well over at the white house because i think they would love to have this hunter biden case behind them. anything that extends the hunter biden case into the election year is not welcomed news for joe biden. >> laura: and those concerns spilled out in a piece published by politico today about the biden team resign to a campaign shadowed by hunter drama. garland's friday night bait and switch i think follows yesterday's news that his other special prosecutor jack smith had asked the court to begin trump's january 6th trial on january 2nd, 2024. obvious what he's up to there. taking trump off the trail just as the gop primary season kicks off. nice going. these people are shameless. nothing but bad faith as far as the eye can see. but as we've been saying from the start, the hunter drama, while it's important, is its own

distraction. and republicans who think they're going to defeat the bidens with investigations, i think they're likely to be disappointed. the angle does not think you're going to get the justice you're looking for, not with garland in charge. you need to defeat biden and the democrats by going after them at the ballot box. winning, after all, would be the best justice of all. joining us now is sol weisenberg former deputy counsel and assistant us attorney and mike davis founder and president of the article three project. sol, how does gore land, an experienced lawyer and judge, not know about the special counsel's requirements? >> oh, he knows about it and it was just the height of hypocrisy for him to say, in his press conference, pursuant to the regulations, i'm appointing david weiss as special counsel because it's laid out right

there. you have to be, not just outside the department of justice, you have to be outside the united states government. i think the answer to your question is whether or not he's blind or corrupt. the answer is, he really doesn't seem to be in charge of the justice department. i think the number two person there is in charge. >> laura: and she is? >> lisa monaco, the deputy attorney general, who i think is the one who got on the phone with david weiss and said, no, you're not going to have authority to bring this case in any districts you want to bring it in and, of course, i agree with everyone else who has commented that it is ridiculous. you have a tainted investigation that clearly has been tainted and compromised, and david weiss has been the person in charge of it. now, he might not be responsible for all of the mistakes and the slow-walking that have been made but he is ultimately responsible because he's the person in

charge. and his integrity has been compromised by testimony letters he wrote saying he was in complete authority, totally inconsistent with what we know he told his investigators. so it is a continuation of the coverup to have him as special counsel. >> laura: now, mike, on msnbc today, not surprisingly perhaps, they were praising this decision to appoint weiss. >> this decision to make weiss a special counsel is another marker that doj is renewing its independence during the biden administration. this insulates decision-making about the president's son from political appointees. >> laura: mike, that msnbc, that they're happy kind of tells you all you need to know here. >> why did attorney general merrick garland wait 30 months to make a special counsel appointment here? and why did he pick david weiss?

and the answer is that he picked david weiss because david weiss is proven to be a loyal biden foot soldier within the justice department and they did it now because they ran into a roadblock in delaware called judge noraka who called into question the sweetheart deal for hunter biden that they put together so they're using this special counsel appointment as cover to make garland look tough when actually what they're doing is they're going to move this case to dc or california to protect biden. >> laura: well, at this point, sol, is there any way to challenge or any point in challenging weiss's ability to be special counsel given the regulations? >> no, in fact you can't do that. that's a part of the regulations that they're not enforceable in court. but here's a very key thing that nobody is talking about, laura. that plea deal that mike was talking about that blew up had two parts. the plea agreement, and what's

called a pretrial diversion agreement. that diversion agreement is for the felony gun charge that, after two years, was going to be completely dismissed and would be re-eraseed from hunter's record. but in the diversion agreement was the behind paragraph that they didn't even show to the judge until the last minute that arguably gave him broad immunity. here's what no one's talking about. the biden defense team might very well move to enforce that pretrial diversion agreement. david schoen, who was on your show with me a few weeks ago, suggested that they do that. and, boy, if they do that, and they win, it doesn't matter who the special counsel is. >> laura: sol, mike, thanks so much >> now, one of the assumed by-products of this announcement is that it could derail or somehow short circuit the house investigations that are ongoing, and then complicate any possible

impeachment inquiries. but today the house oversight committee released a statement reading in part, the biden justice department is trying to stonewall congressional oversight t committee will continue to follow the biden family's money trail and interview witnesses. here now is the chairman of that committee james comer. congressman, david weiss, i know you wanted to bring him up for questioning at some point in the near future. how is that going to work now and don't you foresee his saying not now, not until the investigation is complete? >> right. well, this is another example of the department of justice stone walling and obstructing our investigation. i've been complaining about it for months yet we continue to deliver evidence that shows a massive biden wrong doing and more evidence that shows joe was right front and center in this from day one. what this does is, a, it protects david weiss from coming in front of the committee, which

is fine. this is an investigation about joe biden. i don't think we need anymore evidence to show that the department of justice is trying to obstruct our investigation. i think merrick garland made that argument for us today. we're going to continue to follow the money, we're going to continue to interview witnesses that we know have firsthand knowledge of what exactly the bidens were doing to receive the millions and millions of dollars from bad actors in bad countries around the world and what role joe played in this scheme. and that's what's important to every american, what role joe played in this scheme because we believe that we have a president of the united states that's compromised because of the millions and millions of dollars his family's taken in. >> laura: now, congressman, dana bash over at cnn mentioned you today when discussing the hunter biden probe and the connections to joe biden himself. watch. >> so far, there is no evidence, james comer, the head of this committee just told my colleague jake tapper, pretty much

admitted, that they don't have evidence to show that joe biden did anything wrong. >> laura: congressman, your response to that. >> i pretty much didn't admit that. i pretty much admitted the evidence shows joe biden lied to the american people when he said he had never spoken to any of these people about anything, where joe biden was meeting with these people. we have e-mails, we have text messages, we have pictures, we have travel logs, we have travel records. we have sworn testimony from devon archer, who was front and center in a couple of these shell companies, that joe biden communicated with these people. in fact communicated with every single person who wired the bidens millions and millions of dollars. he even had dinner on more than one occasion with these individuals, which we didn't know. so joe biden lied when he said his family never got money while he was vice-president. he lied when he said his family never got money from china. and he lied when he said he

never communicated with any of these crooks who were sending his family the millions and millions of dollars. so we've proven over and over again that joe biden lied. what i think the evidence shows is joe biden was front and center in this from day one. devon archer said what they were doing. because we want to know what did they do to receive the millions and millions of dollars. devon devon archer said it was the brand, and the brand was joe biden. >> laura: congressman, will you commit tonight to calling david weiss to testify before congress despite this appointment. >> absolutely. of course we will. we're not going to stop. this is just another day in the office for us leading this investigation of biden corruption. they have obstructed every step of the way. they've intimidated our witnesses. when devon archer was set to come in on monday morning the doj sent him a letter saturday and a letter again sunday. that's never happened before. never has the department of justice sent a letter on a

weekend and they sent two on two separate days for the seoul purpose of intimidating them. they intimidated every one of our witnesses, the biden legal team, abby lowell and company have more than crossed the line of witness intimidation. you saw what the legal team did in the delaware court, trying to intimidate another person to take something off of the web site. there's example after example of obstruction but laura we're going to continue to move forward with this investigation. >> laura: yeah. the question is, what are they trying to hide and, you know, trying to -- i think everyone knows what this is, even if there's not a check that went to joe biden, whether expenses were covered for his home or he's just happy his son is getting all this money. i mean, we all kind of know what this is. but, congressman, we look forward to that testimony and i's going to give you the heisman not going to do it but we look forward to it anyway. congressman thank you >> joe biden's true priorities, what are they? are they on the home front or somewhere else? my angle discusses that.

ukraine in the fight against putin, raise your hand. nobody. >> you don't have to be that smart to put the -- connect the dots, right? and so is the war to cover up sins committed, so you can cover your tracks? there's too much money that's been thrown over there. >> laura: 55% of americans say congress should not authorize additional funding to support ukraine. now compare that to back in february 2022 when 62% said they felt like we should have been doing more. but our brilliant administration believes americans get why ukraine matters. >> i think the american people understand what's at steak here. they know it's not just about ukrainian sovereignty or ukrainian lives. it's about mr. putin and stopping him in his tracks before he can go any further. i think we can all understand that if he just gets ukraine, if he gets what he wants and he

pulls ukraine back into russia, where does it stop? and the cost of blood and treasure to the american people, to our financial health obviously would be much greater at risk. >> laura: oh, my god, i wouldn't buy a gallon of milk from that guy. that's the old nonsense we heard during iraq and afghanistan. if we don't fight them over there we'll have to fight them over here. the real problem is, as reagan understood, we can't have peace if we don't have economic strength. peace through strength. and the longer this drags on, the weaker the u.s. will become. we hate what's happened to the ukrainian people, but the spring turned summer offensive is not going too well. the generals once again seemed to have botched another assessment as ukraine appears stalled out right now. now, vox did a sober assessment of where things stand in the war and here are some highlights. kyiv is facing logistical and supply challenges, the country's

struggling to conduct combined arms operations, 20% of western equipment was destroyed or damaged in the early weeks of the offensive. and they're burning through a lot of ammo. and they're running out of time to wear russia down. the unofficial deadline quickly approaching of this fall. and, of course, russia has major advantages of its own in artillery and aviation, specifically attack helicopters. of course, zelenskyy's answer to all this is to demand more money from you, the united states. europe is providing a pittance compared to what the united states is giving in ukraine. but i thought the war was critical for europe's defense right. >> laura: remember we're still carrying the lion's share of the burden for europe's security and it's obscene considering the war ended 78 years ago and as we continue to shovel billions to ukraine, nearly four in ten americans report that they don't

have the funds saved to cover even a $400 emergency expense they might incur. that's disturbing. and joe biden doesn't care. no wonder his approval rating on the economy is stuck in the mid 30s right now. and it's not just ukraine that's flush with our cash, by the way. iran will be too, as well, now that biden is making a $6 billion deal with iran on the promise that jailed americans will get to come home some day. but what's $6 billion really between enemies? that brings us to another infuriating story and yet another rat hole. afghanistan. now, how many of you know that the special inspector general on afghanistan reconstruction says that he cannot guarantee that the bulk of u.s. humanitarian aid there is not going to the taliban. but don't worry, it's only $8 billion. and how is it at that the

democrats and pro-war republicans are so emotionally pumped about protecting ukraine's border that they're blissfully unconcerned about our own? biden's allowed more than 5.5 million illegals to cross our open border, and that doesn't count the got-aways. remember back in 2018 trump requested a mere $5 billion to fund a wall along our southern border? that's about a fifth of biden's latest aid request to ukraine. one fifth of one request. and think of what the return on investment americans would have seen on that wall. but, again, america is not the biden focus. the global order is the biden focus. and the biden team does not care if you're worse off than you were in 2019 before the pandemic. biden let the truth slip out yesterday, didn't he, when discussing his signature legislation saying that, i wish i hadn't called it the inflation reduction act because it has

less to do with inflation than it does with providing alternatives to economic growth. okay. to the extent that biden is ventriloquist focused on americans at all, it's in devicing new ways to control and limit our behavior and speech, certainly not our economic prosperity. when they say they're here to help, that doesn't mean making us richer, more prosperous, safer, our cities better, our border secure. stuff like that would actually make our lives better. they're not interested in it. they reserve their emotion and their efforts to really help people for their globalist goals. nation building. climate commitments, and foreign entanglements with no real end points. if voters want to change this dynamic, and i know you do, you're going to have to set aside your frustrations and vote for candidates who put america first. it's about time. after all, there's no "you" in

getting the college back to basics, back to the classic liberal arts and i'm certainly not going to apologize for that. >> laura: apparently some of the board members had an issue with that chris. one of them said, i do believe trustee rufo, if you looked at the curriculum of most colleges and universities across the country, i think he meant curricula, you will find there are robust programs in gender studies. i don't know how he defines robust. >> yeah. well, they may be robust, they may be ubiquitous but we know it's a pseudo scientific fake ideological discipline that doesn't contribute towards the production of knowledge. my rule is very simple. people who believe that men can get pregnant and women can become men do not deserve to run academic departments in public universities. in the state of florida we've put an end to it at new college and i don't think we're going to stop there. >> laura: i think that what's going to happen, chris, is that

originally, when law enforcement told me they had a squatter, they would be treated like squatters and they could not enter or do anything for me that i just dug deep into the lot and figure out when do they actually have squatter rights? typically when a homeowner goes to the law and goes to civil court and judge gives them rights. so i thought if they are squatters and they have all the rights then if i become a squatter i should have the right if they can take a home i can take a home so my whole idea was to switch places with them and become the squatter and lock them out in force them to break it on camera if that's what they chose to do and then file charges. >> laura: that gets very uncomfortable i can imagine if you move in with them? >> yes. it can be, although having a way
