will: we begin this hour with a fox weather alert. wildfires in maui have confirmed that 80 # people have kick comed to those terrible fires -- succumbed. rachel: officials say more than 1,000 people are unaccounted for as rescue and recovery efforts continue. joey: max gorden is hi in gnaw by with the -- is live in maui with the latest. >> reporter: we're parked a little ways down from a roadblock, you can see at lot of people are parked on the highway

here sleeping in their cars, waiting for a curfew to lift at 6 a.m. a lot of folks anxious to see what's left of their homes, and for those who have already made it into lahaina, a lot of heartbreak and shock at what they've seen. here's some folks we talked to yesterday. >> somewhere that i once knew is completely gone, it's unrecognizable. >> it's devastating. i mean, we lost our houses, our jobs. some of us grew up here. we don't even know whether half our friends are alive or gone. >> reporter: home after home in lahaina, gone. one estimate from the property data aggregator core logic puts the estimate of destroyed homes at more than 3,000. the rising death toll, now at 800 people, as rescue crews search for more victims. thousands of people have left the island, around 1400 staying in emergency shelters here. it's unclear how these fires started, but when they did ignite, the island was ripe for an inferno.

80 mile-per-hour winds caused in part by passing hush dora fueled the flames -- hurricane dora. residents of lahaina say they were given little warning and that the island's emergency sirens didn't go out with texts being sent out instead. many escaping with just their live, some in lahaina jumping into the water to save themselves as the town was raze by fire. >> it's -- razedded by fire. >> it's hard to conceive of when you look at the catastrophe that they have gone through, frankly, are continuing to go through. this crisis is far from over. there's so much frustration, there's so much suffering, you know? the real mourning has not even been able to begin, to start because of people really looking to how do i just get me and my family to tomorrow. >> reporter: power and cell service is starting to be restored on maui's west side, but now another challenge for folks who live here, officials say that the water is now unsafe to drink in some parts of the

island because it's been contaminated by the fires. back to to you. will: thank you, max. great job throughout the last couple of days reporting there from maui. by the way, if to you want to help, the red cross is already on scene. they can help those who have been directly impacted, and you can help by scanning the qr code here or head over to red cross.org/fox forward. meanwhile, we move to this, president biden has jetted off to delaware. he's ignoring multiple questions including those from peter doocy about a special counsel appointed to investigate his own son. the president said he's done nothing wrong, hunter's done nothing wrong, and they've not talked about his business. that's the words of joe biden. now he has, seemingly for some political cover, special counsel appointed by merrick garland, u.s. attorney david can weiss. weiss is the prosecutor who already had offered a sweetheart deal who said at one point he didn't have the power to do more, and now weirdly -- said he didn't need the power after that, that that he had plenty of

power, and now weirdly he's got the power. so none of it meshes up with the story the he's told throughout time, and it count make sense as to why he would be the appointee of merrick garland. rachel: yeah, particularly when the whistleblowers accused him of being the one who thwarted investigations leading, you know, into -- you know, that could lead in to joe biden. this is somebody who has a basically years of loyalty, of having proven his loyalty to the to the biden family. so, again, really odd choice for special counsel, and joe biden, by the way, wassed asked about this as he was leaving for delaware on yet another vacation. [inaudible conversations] >> reporter: mr. president, are you under investigation? [inaudible conversations] [background sounds] joey: you know, we have a special counsel now because the

plea deal was blown up which means that there's enough evidence to the convict, there's enough evidence leading toward conviction of hunter biden that his own defense team said, whoa, wait just a minute, if the judge won't allow this plea deal, we're not going to sign off on something different. they wanted immunity, basically, for potential charges related to these crimes and other crimes not related to these charges, and they weren't going to get that not from the judge, i believe, in delaware. and so -- [laughter] what do they do? i guess they make him a special counsel and, will, weigh in here, they make him a special counsel it's easier for him to take the it to another jurisdiction? is that part of the decision making process there? will: that would be one of his new powers as with the power under a special counsel. yeah, i mean, more investigative powers, more oversight, more independence -- joey: potentially get away if this judge that was strict on the plea deal. will: correct. he could do that as well.

rachel: one of the things that james comer and his investigation which i think has been a lot more fruitful, you know, so many people looking to get to the bottom of corruption in washington, d.c. get trues -- frustrated, and in the case of james comer, we have to give him and his team a lot of credit. they have been methodical, they have been slowly gathering evidence which i believe the special counsel appointment is meant to thwart some of the investigation because they had indicated they wanted to bring david weiss in. nonetheless, you know, one of the things representative comer kept saying is that our investigation proves that joe biden has been lying all along, because he has made little statements about it. not in depth, but basically saying i know nothing is here, hunter's done nothing wrong. here's an example of then-candidate joe biden back in december of 2020 denying that his son was doing anything corrupt. listen. >> i'm confident. will: he's confident there was nothing that was wrong done by hunter. vivek ramaswamy had this to say about joe biden. >> this is the same individual, the same person who actually negotiated that plea deal that the judge rejected handily. this is also just a designation of a title for an administration that in the case of hunter biden has been repeatedly creating one deflection after another. i think the timing in comparison to the donald trump indictments are not an accident for how long that investigation had been ongoing. and so, or unfortunately, i just do see this as another maneuver to distract the public from the fact that we have two standards of justice. start telling the truth again. the government today treats the people of this country as a though the people can't handle the truth. it's like jack nicholson in "a few good men," you can't handle the truth. we, the people, we can handle the truth. rachel: the most egregious

example, i think, or the most famous example of joe biden denying that his son was involved in corruption was on the debate stage with donald trump. i mean, you remember he, his own now-secretary of the tate department -- state department had put together a letter requesting, you know, 51 intelligence officers to say that all of this information about his dirty deals were russian disinformation. and they released it just before the debate when they knew that donald trump was going to ask hunter biden and joe biden -- was going to ask joe biden. and joe biden was able to use russian disinformation and 51 intelligence officers as his excuse for this. and as a defense. and that again is election interference. step by step we see this. joey: one thing we have to keep in mind and we need to remind people to understand not because you should e accept it, jonathan turley did a fantastic job

explaining this is not a new mandate, and it's not a wider scope of investigation. according to the doj, the only thing they are investigating is hunter biden didn't pay his taxes, and hunter biden has a federal gun charge. tear not necessarily -- they're not necessarily investigating to find out why, and that might be the linchpin. why did he not pay his taxes, what was he covering up, does it lead to the president and does something like the gaffe or the admission sitting there years ago as vp sitting there, i told them to get rid of that prosecutor or you're not getting your money, that's not what the doj or david weiss are investigating. rachel: how about we figure out who the big guy is? will: all right, we turn now to your headlines, a federal judge overseeing the case against former president trumps has delivered a mixed ruling on a protective order. she handed prosecutors a win by

broadening which materials are considered sensitive saying mr. trump, like every american, has a first amendment right to free peach, but that right is not absolute. in a criminal case such as this one, the defendant's free speech is subject to the rules. a disgraced ftx founder sam bankman-fried is now in jail after prosecutors claimed he was tampering with witnesses in his fraud case. a judge revoking his quarter billion dollar bail after prosecutors said he leak letters from his ex-girlfriend to the new york times. his lawyers claim he wasn't tampering, just responding to a press request. he is due back in court in october when his fraud trial begins. rachel: did his girlfriend turn on him? is that what happened? joey: i think he blamed it all on her. will: a virginia factory worker is going viral for his blue collar song. take a listen.

hand. we grilled that off and topped it with a little bit of yogurt sauce. we're using jersey and heirloom tomatoes so, again, local ingredients, local corn from long island. bharat that, fresh basil and hot honey. just in there you're talking about ethnic and regional dishes. you've got on-trend items like mike's hot honey and two local ingredients. but in the end it's still a pizza-style dish that is completely at home in a bowling alley. moving up here, we're going to step a little bit farther outside of the box. this is a rib duet. we're looking at corn ribs. these can either be done by hand just quartering down, this is a prepared product that's been banneredded, and we braised off what's called the denver are rib. to this is domestic lamb. again, try to take that, yes, domestic lamb rack. so we are trying to take the standard of ribs and just upscale them just a little bit, topped with a little bit of

chimichurri. will: beautiful. >> moving forward, we're looking at a, the savory plantain. will: yeah. >> crisp fry up. a pork belly that we grilled up. avocado mousse, a little twist on caesar. we went brock linney if instead of kale, and and then this is going to be a you have stuffed sausaging bread that we're grilling -- joey: that pork belly is where it's at. will: this sausage bread is amazing. >> the sausage bread is the thing we're most excited and that's why we're featureturing it. i think there's a bit of a resurgence in the pork world. liz: i agree up -- rachel: i grew up going to bowling alleys, and this was really, really good. >> pleasure working for an upscale bowling alley x they had already gotten to the burgers and and loaded tots, so we wanted to take it and find that

joey: welcome back. squatters taking over and trashing multimillion dollar mansioning in the hollywood hills. our next guests has dealt with squatters on his own, turning the tables on the people occupying his mother's california home. flash shelton joins us now. flash, you know, i want to say i like this story, but i don't. i don't hike the premise if at which it originates, but with you're taking some power back. first of all, tell us what happened with your mom's home. >> >> well, first of all, i'd like to say that, you know, it's unfortunate that we have to deal with squatters in the first

place, and i did start a petition hopefully to move squatting into criminal court out of civil court. but in my situation, my dad passed a away, squatters took over my mom's home, and we were trying to sell it so she could move on with her life. and and law enforcement would not enter once they saw that there was furniture in the houses and people living there, so i basically just broke down the laws and figured out how i could switch places with them, become the squatter myself and give them an ultimatum on camera, can and they took it and got 'em out in less than a day. joey: so they had potentially something that show they had a lease that would have been unlawful. so what you did, you went and goes a lease and made it legal, essentially, to lease your mother's home and then moved in, is that correct? >> well, if they -- can i did in preparation have a heat drawn up

and notarized prior only if they had presented a pick lease. joey: yeah. >> since they never did have a lease or a fake lease, i never had to use that lease are. i simply was able to just get in there, lock them out when they left in the morning, put cameras up, security system, therefore, they would have had to break back into the house. but, yes, i always prepare with a lease just in case to even the ground if they do come up with a fake lease. joey: you know, a lot of us get confused by this probably because we live in states that are less likely to having something like this upheld by law enforcement. how are they not criminally trespassing the moment they step foot there the? >> well, i know in my case if i would have had cameras and an alarm set up previously, and and i talk about that in my prevention videos, then law enforcement would have had an actual incident to, you know, to be reported on and carried out. i would have caught them in the act of moving in.

♪ will: fox weather wildfire alert. 80 people are confirmed dead on maui, and officials say that number will hike arely go up. more than 1,000 people are considered missing as the search and rescue effort continues. let's turn to chief meteorologist rick reichmuth for our fox weather forecast. rick: one piece of good news, weather pattern that is changed, certainly are winds is have calmed very much down. all of this kind of primarily due to two pieces. we had an area of high pressure to the north of hawaii and then hurricane dora, now-typhoon dora, off towards the east. you can even still see the winds very strong in between those two, it's just now both of those systems have moved off towards the west, so the winds in hawaii

dying down. interestingly, that's the international dateline. when it get to the east of it, it's called a typhoon. same storm, just a different naming convention. this fire now at this point 80 fatalities x that is the second deadliest fire we've had anywhere in the u.s. five years ago, 2018, in paradise, california, we've talked a lot about that storm -- that fire. burned most of the town and caused 88 payalties, but that's -- fatalities, and that's where we are right now. we'll see the that number changes. fires in two different areas in maui. green on the north and east side of these storms, that's the windward island, that's where all the moisture comes in, generally that's where most of the rain is, and the other side of it is kind of a rain shadow, drier conditions. up country, that's this spot right there, most of the fires are there, about 85% containment on those fires in the lahaina area. so not completely done with those fires.

winds lower now for about the next week, maybe a week are from now beginning to tick back up -- will: one cropped up last night, it's been 100% contained there. great report, thank you so much, or rick. turning to another fox news alert, republican lawmakers are sounding off on david weiss' special counsel appointment to the hunter biden probe. >> mr. weiss is the single architect over that sweetheart plea agreement deal. i am very fearful that appointing this special counsel just an attempt to stonewall congress' investigation of the biden family. >> this was a political decision, not a legal decision. they're trying to put out a fire, and they just poured gasoline on it. will: another one of those lawmakers is senator ron johnson, and he joins us now. senator, great to see you this morning. how do you explain the appointment of david weiss? >> good morning. i'd explain it as a corrupt act. there's no doubt about the fact that merrick e garland has done nothing to restore integrity and

confidence in the department of justice just like christopher -- the fbi director, christopher wray, has not restored confidence in the fbi. and and it's tragic. these are institutions that the american people need to have confidence in. as my colleagues stated, david weiss, he is the architect of the sweetheart deal. he's the u.s. attorney that allowed the statute of limitations to expire on the more serious tax charges. you know, this is just a travesty. this is not going to retore confidence at all in the justice department -- will: is there any reason to believe -- >> or give people faith that hunter biden's going to be treated equally under the law. will: david weiss' title has changed, why should we think the treatment of hunter biden will change? >> we have no expectation that it would change. you know, the sweetheart deal, the plea agreement was really a grotesque miscarriage of justice. i mean, this is something that

the u.s. attorney, weiss, and his prosecutors, they tried to pull the wool over the the eyes of the court, the judge. fortunately, the judge saw through it and asked some pretty embarrassing questions, and they had to retreat from the deal. and now that's been all to blown up, but is it really blown up in obviously, these prosecutors, obviously u.s. attorney weiss has no intention of holding hunter biden or any of his family members including president biden who is corrupt, who has lied repeatedly to the american public, that is a fact, we know it. he has no intention of holding them accountable. we need an independent prosecutor here in some way, happy or form. well, the regulations state the special counsel has to come from the outside of government. he's obviously in government. but i think the more serious offense is that he has no independence whatsoever. he's probably the least independent individual that merrick garland could have appointed, and that's who merrick garland appointed.

go figure. will: yeah. the law requires, as you point out, them to appoint a special counsel outside the government. it's seemingly a brazen act of corruption by merrick garland. there is one group though that's interested in holding this potential crime in the biden family account accountable who's looking to investigate, and that is house republicans. i recognize that you're in the senate, i know that you have relationships with people over in the house, but you also understand the law. will this affect that investigation in any way? this put david weiss beyond the reach of the house and their subpoenas and james comer? will it put other pieces of evidence in general. ty? >> it was certainly senator grassley's and my experience, we were denied access the all kinds of documents that we were = always under the the excuse, well, we have an active investigation. we can't turn that investigation over to you. so the d. of justice, the fbi is insulate aring themselves from congressional oversight and public scrutiny, and they do it by having an active investigation. i expect this is going to

dramatically frustrate the house's ability to actually get to the truth of the matter here. will: senator ron johnson, thank you so much for being with us this morning. >> have a good day. will: okay. rachel, over to you. rachel: all right. thank you so much, will. we're going to turn now to some of your headlines. overnight, minneapolis police officer discharged from the hospital to applause after he was shot in the line of duty last night. police say he was ambushed while following robbery suspects. he was taken to the hospital while his fellow officers chased the suspects, taking two men, a woman and a boy into custody. far-left congresswoman cori bush cashing in on a side hustle, teaching a graduate-level reparations course. [laughter] okay. her financial disclosure report reveals george mason university paid her $15,000. that reparations enough? for co-teaching a summer course last year. the squad member has long

advocated for reparations to be paid to black people. back in may she unveiled a $4 trillion proposal to -- $14 trillion proposal to close the wealth gap. larry you would or famously called reparations payments to people who never were slaves to -- from people who never own slaves. yesterday the arizona republican, kari lake, got the chance to milk a cow. she told reporters specifically from "the new york times"es and the washington post, hey, you guys, you know there's only two genders, right? and then lake challenged the media, "the new york times" specifically, to the try and mil a bull. carly, i'm going to -- first of all, welcome to all three of you, really appreciate you joining us. i'm going to start with you, carly. tell me, what are the top issues facing gen-z. >> great. well, thanks for having me. gen-z is really concerned about a couple issues, and namely, i think, energy and the environment are going to be really key for the gop to engage on to win over those young voters who, frankly, haven't decided whether they're republican, democrat or independent. if the gop can really kind of chart a path forward that's optimistic and actionable and make makes sense, frankly, on the environment and energy, they're going to be able to win over those young voters who are still undecided as to where their loyalties lie. rachel: that's such an interesting combination of topics, because a lot of people think you have to have one or the other, and there's a way that they can live together, right? we can have oil and and gas and lower prices and yet still ache care of our environment. vincent, what's your, specifically in your life, what's your toppenning? -- top

concern in. >> i would say crime and the economy. for crime, i work in our nation's capital, i work retail, and i've witnessed people stealing every single day, and it's affecting poem's livelihoods of -- people's livelihoods of where they could work. rachel: excellent point. you said it was crime and what was the other one? >> economy. i think inflation has raised prices on essential goods for everyday americans, and i think lowering those prices could really sway young voters as gen-z voters are usually in college to vote republican. rachel: tanner, what are the things impacting you specifically and that you're going to be looking at the candidate to resolve next election? >> yes, of course, thank you for the question and to be here. i believe my greatest concern is where we are as a people, who we are as a people both generationally speaking and as a nation. we are unaware of what it means to be american. we don't know who we are as a country or where we want to go. we are currently a lost people

who are many desperate need of retrieve thing our emergency identity -- american identity, and we've become a nation that is equivalent to a leaf that is unaware it's attached to a tree. rachel: so you're looking, tanner, for a leader who can articulate what it means to be american and maybe our constitutional rights that so many were lost are, by the way, during covid which brings me to my next question. there was no place more than the college campus that people's rights were abused because of covid. i mean, i have two adult children who were in college during the pandemic lockdown who literally felt like it was the city ran call on campus. tyrannical on campus. do you think relitigating any of the things that happened to young people during covid -- forcing them to take vaccines,

closing down their schools, etc. -- will be an issue that will resonate? >> i do believe so. i think that the gop has been given a tremendous opportunity to truly seize the youth vote of my generation, and by just providing clarity over what it means to be a conservative. my generation is exhausted as a people. we have been -- we know nothing but unprecedented politics can and chaos, and we truly just are craving, are yearning for a sense of normality. we are looking for the values exactly represent by the conservative party that is embodied by the gop, and i believe that's precisely what we need. rachel: karly, when my kids are on campus, especially public universities, they often see the democratic party canvassing and active and recruiting, and they never see republicans. outside of actually just showing up on campus, what exactly should republican activists be doing on campus to reach out to young people like you? >> absolutely. it's a great question, and i think whether it be college

campuses or to urban city centers where i live in washington, d.c., republicans have a tendency to say, you know, that's a lost cause, we're not going to win there. but the fact is our values can really make an impact in those areas. and like i was mentioning before, specifically on energy and environment, we saw with covid top-down regulation didn't work, right? and i think that that can also be applied to our climate and energy strategy. we need, you know, to harness the market, to use market forces to make our energy cleaner, to make our environment healthier and to keep our people safer. and i think that's what will really resonate with young people either on college campuses or in communities. rachel: yeah. maybe reminding young people that nobody, you know, produces energy more cleanly land the americans -- than the americans. >> exactly. rachel: vincent, i'm going to end with you, what can republicans do do to reach voters like you and your friends? >> i would say coming to college campuses is a start. i think canvassing on college
