♪ >> reporter: out of time thanks charles payne, charly arnolt, michael loftus, kat timpf, fox news at night is next with dreamy trace gallagher. thank you, i love you america [cheers and applause]. >> trace: good evening i'm trace gallagher it's 11:00 p.m. on the east coast 8:00 here in los angeles and this is america's late news, fox news at night. and breaking tonight, the court cases against donald trump are stacking up, but the former president now says he has quote, irrefutable evidence that will exonerate him in the georgia case. smash and grab robberies, plus no cash bail equals zero consequences as california's crime crisis escalates yet again. but we begin with a major legal decision about to come down for several new jersey school districts who will learn whether

schools are allowed to keep a child's sexuality a secret from their parents. the senior national correspondent kevin corke is live in dc with the breaking information on this. kevin good evening. >> reporter: evening trace. three monmouth county new jersey districts are being sued by the state of new jersey for passing versions of policy requiring teachers to inform parents if a student is seeking a transgender accommodation, such as using a new pronoun or bathroom. today was the first time the state publicly argued its case against the middletown, marlboro and manalapan englishtown school districts, districts whose leaders agree that the aim here, trace, is to strike a balance between care for the children and the rights of parents. >> i don't think that our policy is discriminatory in any way. i think we carefully crafted it to be compassionate and to actually attend to the needs of our district. >> reporter: meanwhile a spokesperson for the office of

the attorney general in new jersey said in a statement tonight, the state has always respected the rights of parents and agrees that parents should be involved in important decisions regarding their children and any characterizations to the contrary are flatly incorrect. to be clear, the state has never sought and never will seek a ban on parental notification. now, the battle, as you can imagine, also centers around the idea of children, we're talking about kids, attempting to change names and bathrooms and gender identification as well as sports team participation. by the way the superior court judge in this case david baumann says he will release his decision on this issue shortly. we don't know how soon that is. shortly could mean as far as a week we'll keep you posted but for now back to you. >> trace: we that you see it would be today but not the case. kevin corke we'll goat back to you as the news breaks. thank you. ♪ . >> trace: well, the fox news at

night common sense department had to go back and reread a statement released by the los angeles superintendent of schools. the statement needed a double take because it was astonishing in its hypocrisy. los angeles is now urging students to come to school sick, sneezing, coughing, sniffles, no problem. the superintendent says quoting, we cannot continue an environment where 40% of our kids are chronically absent. common sense would like to offer this reminder. during covid, los angeles unified had the strictest safety protocols in the country, keeping schools closed well beyond when the vast majority of students had already gone back. and even after the los angeles covid infection rate said it was safe to go back, instead, la unified bowed to the teachers union and locked kids out for years. which, according to the surgeon general, leads to, quote, anxiety, depression, social, emotional stressors and suicidal ideation not to mentaling tragic test scores now the la unified

chief medical officer says quote, schools are some of the safest places for children to be the. maybe some honesty is in order, like acknowledging schools lose hundreds of millions in state funding when kids don't show up. common sense thinks it's sad and hypocritical when the road to a healthy budget relies on sick kids. let's bring in the director of the education freedom center at the independent women's forum ginny gentles and american federation senior fellow corey deangelis, welcome to you both. corey, we'll talk about common sense in a minute but i want to hit the breaking news kevin was talking about, the new jersey school districts with you, the whole concept of these three school districts having to go to court to fight this battle over whether parents can be notified about a child changing genders. i mean, it's happening across the country but it's a very big deal. >> i can't believe this is the hill that they're willing to die on. they're fighting so hard to keep sexuality secrets about children

from their own parents. you have these far leftist communists, essentially, indicating that they believe kids belong to the government and not their parents. so hopefully the judge rules in favor of parents, but, you know what? judges can be taken over by judicial activism just as much as politicians. >> trace: that's exactly true. ginny i'm wondering this and you have to ask because the whole concept of this is when you do these polls, these parent polls, the vast majority of parents are in if favor of, yes, we need to know everything about our kids and yet you have these schools fighting seaing, well, that could be dangerous in some cases. >> right, and they're absolutely wrong. parents love their kids, they know what's best for them. it's unprecedented that schools would be hiding information from parents, especially information like social transitions, which are not a neutral act. this is a psycho social intervention that pushes children into these new identities hides that information from parents and then leads them down a path to

medical transitions which we know have lifelong consequences and serious health risks. so over a thousand school districts have these policies in place. we know that through the parents defending education analysis, and this has to stop. >> trace: i want to pivot back now if i can corey to common sense because the whole concept of the la unified superintendent telling sick kids to come on back to school after forcing them to stay home for as long as anybody in the country. >> yeah. wait, hold up, wasn't this the same district that had the teachers unions calling for medicare for all, a wealth tax and police free schools in order to stay open. they see kids as dollar signs and now they're realizing so many fled the district that they get 21,000 or so dollars per student per year, they're losing money and they want the kids back. their plan to keep schools closed with tax pay money and now they're begging families to sends kids back. >> trace: i want your thoughts

ginny because it shocked even the la times and the la times was on board with keeping the schools closed for a very long time. >> we knew as parents that our kids needed to be in classrooms. virginia, leak california, kept schools closed. and i watched my children struggle. thankfully schools are open again, but la is facing 40% chronic absenteeism and keep in mind these students are absent 10% of the school year or more. they're not learning to read. they are at high risk of failing, and dropping out. obviously, the superintendent has a big budget hole that he needs to fill with federal emergency supplemental funding drying up. la received 2.6 billion in funding and he's nervous. >> trace: he is nervous. i want to put this on the screen because corey you tweeted this and it is a fairly fascinating. the national center for education statistics, school funding, 18,000 per student, average class size, 24 students,

436-plus thousand per classrooms, 66,745 the average teacher's salary. i've got about 20 seconds for each of you. where is the money going? corey. >> well, you know what trace? i think we've got to hire a thousand administrators to get to the bottom of this ca number drum and figure it out. obviously the blow of staffing shortages in the schools and maybe they're sending some of the money to ukraine as well, i don't know where it's going but not to the classroom because the government school system is a monopoly that has no incentive to spend the dollars wisely. >> reporter: $436,000 per classroom and the test scores haven't been this low in decades. your final thoughts? >> tests have plummeted in every state, and funding has doubled after inflation per pupil since i was in school back in the 1980s, districts have plenty of funding they need to be targeting it to teachers and figuring out creative ways.

like let teachers teach 12 months out of the year, and let them have more than 190 day contract if they want to teach more and make more. >> trace: yeah, ginny gentles, corey deangelis, thank you both. >> thank you. >> trace: meantime former president trump in defiance over the latest charges brought against him in georgia, and he says he will present proof of presidential election fraud at a news conference next week. jeff paul is live with the very latest news on this. jeff good evening. >> well, trace, buckle up. if you thought yesterday's fourth indictment of the former president was dizzying, this is only the beginning. as it stands, follow me, trump has an october court date regarding a business fraud case. then his trial involving the january 6th riots is set to begin january of 2024. roughly two months later trump is back in court regarding the stormy daniels hush money case. another two months later, the mar-a-lago classified documents case is supposed to start in may. while we don't know when his

judge case is supposed to have started, the da said last night she would like to start within six months of last night. so we spoke with a former federal prosecutor, kendall coffee, he said the idea of preparing for several trials while also running a presidential campaign seems almost impossible. >> the frustration that i think is legitimate is the effort to push this to trial at what amounts to a velocity that is not consistent with usual cases of this magnitude. >> reporter: now coffee also says normally state and federal prosecutors communicate more to either condense a schedule but that doesn't seem to be happening and it might come counsel to each prosecuting office can't give up the idea of making history, taking on a former president. trump said he will be exonerated and has scheduled a news conference for monday. >> and cameras will be there

waiting. let's bring in nelson perez, i want to play this sound bite from mccarthy and get your thoughts on the other side. watch. >> it is not easy to get 19 defendants to trial. i don't know how on earth they can do that in six months and i would remind people a number of people who are indicted here are in themselves lawyers. there are going to be voluminous pretrial litigation in this case. >> i mean, they want this thing by february, right? what do you think? any possibility of this thing falling in line. >> i don't see this going to try by february. i absolutely do not see that. like you said, there are 19 defendants named in this indictment. there will be voluminous discovery. it takes time, this is a complex investigation, a complex case. trace i wanted to bring something to your attention, about a year ago, august 8th of 2022 when we first heard about the raid at mar-a-lago and americans were absolutely shocked. i was shocked. a special agent in the miami division, i was not present but i was absolutely shockedment a year later look where we're at, if you heard there was a raid at

mar-a-lago now you wouldn't flinch. there's one indictment after another after another and i think americans have become accustomed to this happening. half americans say is this justice? half of america says thinks malice and that's no. gay place when half the country doesn't trust our criminal justice system any longer, it's that bad. >> i hate to interrupt but i think part of the plan is had you alvin bragg come out first and it was just so weak on its face that everybody beyond that stopped listening. senator john kennedy said this and it kind of segues a comment by trump into the biden administration. watch. >> all we get out of washington is more indictments on president trump and all the sleaze surrounding hunter biden and david weiss. no wonder the american people have started to hate government. i mean, nobody is trusting -- you see these polls, nicole, and nobody has trust in these

institutions that are so value in our country. >> and that is quite a shame and that is when there is a threat to our democracy. we need to have an unbias criminal justice system. we have not seen that. i have spoken to former colleagues -- they're treating president trump as if he's on the fbi top 10 most wanted list. you know what? he's not. the vigor in which they're investing, one indictment after another, is not reasonable at this point. it seems extremely excessive. i'm one who believes hold people accountable no matter where you stand on the political spectrum. look at hunter biden and his family, they skate on by and that's not far. >> trace: hunter biden text message april 12, 2018, quoting, my dad has been using most lines on this account which i, through the great offers of eric sha waring, seth to go before the house oversight committee, have paid for the last 11 years. the another damning piece of evidence the media is largely

merchandise from a nordstrom's store. >> what has occurred is unacceptable, and those that are committing these crimes will be held accountable. >> reporter: but a union representing lapd officers says that accountability rarely ever comes and blames the city's controversial zero cash bail no the surge in smash and grash robberies. a spokesperson for the union tells fox digital the elimination of cash bill for these kind of offenses those that break the law so brazenly pushes them over to say hey if i'm going to be caught i'll be right out again. they tell fox 1500 people have been affected since the court rule to reinstate cash bill and of those 226 have been released and rearrested for committing crimes. and that has rapper $0.50 posting to his instagram, quote, i told you la was finished.

across the u.s. organized retail crime has cost businesses over $100 billion. trace. >> trace: crazy maryanne. let's bring in wendy patrick and sheriff's deputy meagan mccarthy. welcome to you both. i look at this video and we put it up on the screen again because i was kind of astonished when i first saw this went i didn't have. you know it's a retail game and exactly what they're going after but a fun fact when you look at this and think, okay, this is not just retail gangs and robert luna the sheriff in la county said the following, quoting, there's individuals here that have been released, not these nordstrom, that have been released talking about zero bail across the thing, released on zero bail and turned around and committed murder in the last several weeks. so it's not just gangs or shoplifters, there are serious deadly people getting out and doing nefarious thing. >> you know, for a lot of criminals, zero bail means zero

consequence. you know, second chances are for first offenders not repeat criminals. i hear these things being referred to as flash mob mentality. these are orchestrated pre-planned sophisticated events. they are targeted, targeted for the resale value of what they steal, in public areas, high-end stores, luxury items. so this is anything but spontaneous it's sophisticated and preplanned. >> i know meghan is a former deputy and also victim of crime. the former sheriff of la county alex villanueva and i want to show you this video from hacienda heights yesterday. this is a woman who had perfect purse stolen and she was dragged across the street by this person who got away and that's the whole concept here meghan is these people are not being put in jail. >> exactly. i mean, when you have such low numbers for the police, i mean, lapd has seen under nine you this thousand cops the low nest two decades. you're asking them to do the

work of a hundred cops so how can they be proactive against crimes when they have to react to situations and the criminal justice system isn't even having their backs to prosecute the crimes. >> it's amazing because the warnings are going out, the san francisco chronicle headline is crime is so bad near san francisco federal buildings that employees are told to work from home wendy. i want to put more video up. these are garages that were smashed and the new tactic is the they're going through these businesses and just smashing through the door and going in and getting it and it's happening on both sides of the bay, oklahoma and san francisco. >> josh. >> trace: what's different about this kind of crime is it's bold and brazen and almost without consequence meaning they're not trying to cover their faces or license plates. you know, long gone are the stocking over the head robberies that used to get caught on video. now you see video people waltzing in and out comfortable calm and collected, that's a problem. that's one of the reasons that

some of our best cities and most beloved cities have become dangerous. >> trace: yeah, and congressman kevin kiley of california posted this on x, formally exert. he says if california offers a preview of where our country is head, san francisco offers an even starker warning. this is where failed policies radical politics and public corruption are in their most advanced stage and where residents are most rapidly fleeing. they are, people are fleeing san francisco, they're fleeing oaklyn, you had the naacp come out and say we can't take this crime anymore and yet very little done about it. >> i think it's time to hold the elected officials accountable. where are the people to live in these sees and see the reactions from the policy they enacted, they're long gone leaving it for the communities to defend for themselves when they don't even have the backing for their own people. you're causing this huge pendulum swing in the wrong direction and we have to fix it.

william really still a lot of questions unanswered. >> reporter: yeah, and the governor did give us a briefing a few moments ago and i want to go over the top lines with you trace. number one 27%, that's not a lot, of the burn area has been searched by those recovery teams. they found 101 fatalities, they've identified four individuals, are in the process of notifying the families. the feds have brought in a mobile morgue along with coroners and pathologists because of the size of the operation. governor said he would assign state and private attorneys to lahaina land owners to protect them from, quote, predatory developers and would not allow any of that land to be sold to outsiders. >> you can be sure i will not be allowing anyone to build or rezone or do anything of that sort if they've taken advantage of anyone here. >> reporter: so the most immediate challenges accounting for the 1,000 individuals who are still considered missing, 20 dogs, 90 recovery workers are in the disaster zone sifting

through the rob and ashes looking for soft tissue teeth and bones they can recover dna and urging anyone who lost relatives to get a dna swab to help build a database. so far they've obtained dna from 14 victims and 43 individuals have submitted samples. >> it's from a relative. it's pretty straightforward. we know the level of the relationship. so from this swab, the dna is extracted, then we quantify it, then we profile it. >> so we're going to get everybody that's unaccounted for, to the best of our ability, accounted for but i can't promise that we're going to get them all. >> reporter: another challenge, housing, temporary and long-term, so far they've secured about 500 hotel rooms and a thousand vacation rentals that be paid for by fema 3,200 people applied for assistance meaning everything from cash to housing. today president biden promised to visit when he would not disrupt the recovery operation. >> i immediately approve the

kevin. >> reporter: indied trace. the rnc actually wants qualifying candidates to, you probably heard this, sign a pledge backing the eventual gop presidential nominee and they want it to be signed before the first debate which, of course, is coming up on august the 23rd. and while it's true, the request has rubbed several of those running the wrong way, many of the top contenders aren't taking any chances. they're putting pen to paper for a guarantied slot in the spotlight. and while the remain for president, donald trump, has rejected the idea of signing the pledge, he says, as if, plenty of others either have or say they're willing to do so. among them ron desantis rvivek ramaswamy tim scott nikki haley mike pence even chris christie. okay. meanwhile on the trail today for most gop hopefuls it was frankly time to make up a bit of ground holding court with iowa voters and of course to prepare to crisscross the hawkeyes 99

counties. the hawkeye state's 19 counties, that's something isn't it? in the search for votes, a marathon that just about every one of them says, yeah, i'm ready for. trace, as you know, when it comes to retail politics, the real challenge, especially in a place like iowa, is finding the right balance between earnestly connecting with people and selling them on the idea that, yes, you and only you can beat joe biden in 2024. it's a tough sell to be sure especially given the former president's popularity there. which means for most candidates, this really could end up being a defactor veep stakes, and that is something none of them want to hear right now. trace. >> trace: we're not going to bring it up right now. kevin back to you on news breaks, bring in 2024 republican presidential candidate and mayor of miami, francis suarez. i want to clear this up because your packet says you do have the qualifications, you met the threshold in funding and in polling to make the debate next week, but there seems to be a

little bit of a shortage here? what do we know? >> so first of all, thank you so much trace for having me. we have met the fund raising threshold of 40,000 unique donors. we have also met the 200 donors in 20 states, and we met most of the polling threshold. we are either one national poll or one state poll away from qualifying from the debate stage something we feel very confident we're going to reach over the next few days, we are preparing already for the debate. i'm in new hampshire today, i'll be in new hampshire over the next couple of days talking about my vision for the country. it's just an exciting time as i'll have an opportunity, god willing, a week from tomorrow, to introduce myself to the american people in a way that puts me on an equal footing with the other candidates who are going to be on that stage. >> trace: yeah, and there was a lot of news coverage about the fact that what if you did not make it and you said or at least you're quoted of saying i would just drop out of the presidential race, fair assment.

>> yeah, fair assment because i feel if you don't meet a minimum threshold it's not fair taking time away from other qualified candidates but we feel confident we will. it's like being in the fourth quarter with two minutes to go and you're in the 2:00 warning and you go over the sideline for the 2:00 timeout and a reporter asks you, what happens if you lose the game. wait a second i still have to try for the end zone. that's what we're focused on, it's going to be great when we're there because america will get to know me, get to know my personality, my policies and my profile and why i'm uniquely positioned to give the gop the best chance to win in 2024 and beyond. >> trace: and you are very powerful and popular in south florida. you talked about the other candidates i want to put this emerson college new hampshire school because it surprised a lot of people. the middle name at 9% ahead of ron desantis, i'm not sure if a lot of people are buying that. do you buy it? >> well, like i said, to get a electriced president, you have

to have the right personality. i think what's happening here, it's not just a policy test, it's a personality test and it's a profile test. in my case, what i've done on a profile level is i changed miami dade county from a plus 20 to democrats to a plus ten for republicans in the five years i've been mayor which means i can get votes from cities. i've also had a track record of getting young voters, people that we lost to joe biden by 26 points. it's unforgivable to lose young voters a 80-year-old president by 26 votes, who does not project youth and vitality in any sense of the word. and then of course, hispanics. hispanics are a voting group that's 60 million americans, 20% of which are undecided. i think if you have a candidate that can speak with them and connect with them, we cannot only win the 2024 election but i think we can take back the senate and win elections for a generation. >> trace: i have to go but i have ten seconds, your quick thoughts on the former president being indicted for a fourth
