possibly bringing a years worth of rainfall to areas no relate bone dry this time of year. millions of people are preparing for what is expected to be the first tropical storm to it southern california and 84 years. >> a batten down the hatches for a quick check and went up to 14. hitting los angeles county. it is a once-in-a-lifetime event. >> we can get waves as big as 2. >> we are praying for the best it can be pretty bad. steve at "fox weather" meteorologist adam klotz is live in the weather center with a lace on hurricane hilary's path. it looks like the storm is moving faster than expected? what can you tell us about this? >> is moving pretty quickly allow the heaviest rain is out in front of this. folks are going to start tennis impact here pretty early. as you said the first ever tropical storm warning across southern california. a big area with some wins but really it's going to be rain

that makes it such a powerful system. we got the 2:00 p.m. update winds at one or 50 miles an hour. it's lifting in a slightly colder water. which is going to slow down the winds. it's currently category three hurricane is going to continue to weaken that's not going to slow down the amount of moisture it's bringing up in a flooding is a major concern. this is how that times out as you get into sunday but really throughout the day on send that you are going to be dealing with these conditions across all of southern california before ultimately lifting up into nevada as you get more so sunday night into monday morning. we can type this out with the fox model. this is taking you from today at 5:00 p.m. that is a pacific time you are looking at tons of rain out in front of this. this is not the center of the storm but again a lot of the moisture is heavy showers across the areas don't typically see hardly any rain this time of year. getting into the heart of it.

harrigan is live with more, steve. >> that is right there was a five hour hearing on friday brian accused of murdering for college students back in november did attend much of the fight was over dna evidence. investigators say they have his dna on a sheet of eight knife that was found next to one of those bodies the dna actually matched dna taken from cheek the defense is pushing for a delay that something the judge has denied the defense says they want now the entire dna family tree. they want to know how investigators and narrow this down using dna to just one suspect. >> they want all of the names used in that genetic genealogy. think about it. this could include people that gave their dna for let's pretend 23 and me but they never agreed for law enforcement to use it.

>> is a bona fide legitimate defense request for under seminole case of the supreme court's brady versus maryland the defense is entitled to information that potentially could exculpate them or could benefit them. the prosecution should err on the side of caution and elected turn over this information because this is a probable cause that led to bryan kohberger being at suspect in this case and placing him in custody when taken that confirmatory it was known as a buccal swab it's a cotton swab of the mouth they used to get the more specific scr dna that s used normally criminal cases. this is genealogy and genetic genealogy information is definitely discoverable the defense is doing the right thing. and again unless the prosecution wants to lose this case on an appeal down the road it seems that they have a strong case here. i would air on the side of caution when i was prosecutors always turn the stuff over. this is what causes great cases to be overturned a higher court. arthel: the prosecutor said they

do have one more test to present that test is still at the lab. so they are going to provide it but they can only get it from the lab as quickly as the lab can process that. does that seemed like a reasonable position from the prosecution? lex yes absolutely. these types of test take a long time there is a lot of paper that gets generated for this a lot of individuals pure review and review these types of cases before they are published. so the prosecution in the lab absolutely is allowed to take their time is not a delay or stall tactic where they will try to say gotcha enforce the defense into a quick trial. the judge would be definitely incorrect and not granting a continuance of the d.a. lab is taking longer than normal. arthel: the defense called doctor lee at larson she's one of four genetic genealogist that testified on law enforcement searches are failing dna sites i want to listen and talk about

after. >> if you add a kit to family tree dna they opt-out in. there is a way to opt yourself out but you have to know where to find it is not obvious. it family tree today. read the fine print so to speak. whether or not a coat court is going to allow blanket discovery of that information. which protective orders would potentially have to be filed the people were scared, rightfully so considering the facts of this case. it's going to be groundbreaking on many levels. what is left of the trial. arthel: what do you think, how do you think the jurors see this? do they see the move by the defense part of the process they are thinking or could they see this as some sort of sle sleight-of-hand trick. >> you are going to have battle of the experts in this case. obviously the information as we have seen and it has been disclosed to the press and the court proceedings are that this is going to be a dna case the sheets of the knife on the nightstand directly tied to the defendant is going to be the biggest piece of evidence they have combined with the cell phone information in the tracking data that they do have potentially placing him at that location.

stay clear of the beaches. a possible dangerous waves during the storm. back to you. >> christina coleman live in southern california thank you. arthel. >> rich thank you for more of preparations for hurricane hit hilary. santa barbara county office of emergency management. thank you for joining us. i want to ask you, you are asking residents to be prepared, how should they be preparing a what should they be doing? >> absolutely. first and foremost they need to make sure they are registered for notification so they can receive current information from the county or city that they live in. for santa barbara county they can go and register it make sure we have their e-mail, phone number and such. we also want them to prepare their homes put out sandbags for the typically have water coolin. bring out anything that could become debris in the strong

winds we are expecting bring in your umbrellas, your lawn furniture, all those concepts that does not become additional damages your property. and then be aware. where is our the low-lying areas where it is usually floods who do not drive to those areas. >> what would prompt you to call for mandatory evacuation? >> and mandatory evacuations typically would be associated with the risk to the homes or at lives and property. iwe ended up with landslides, debris flow. at the flooding was significant enough to impact directly to homes, not just roadways. when roadways are fledged we typically would call for shelter in place rather than evacuation. go to high ground. then it might be to try to leave. arthel: going to show flooding in montecito eight months ago.

it looks really, really bad. i want to ask a santa barbara county been able to fully recover from that event? and also how is that flash flooding that happened in january helping you prepare for the flooding of hurricane hilary is expected to produce? >> yes absolutely. that flash flooding was unprecedented. really throughout our county not just in montecito. we had over 2 billion in damages to public infrastructure from the storms between january and march. our city and county and special districts all of our agencies have been working really hard for instance our flight control channels are cleared of the debris that came down and through in january and march. those are all clear. our watershed is dry. we are hoping there is a little bit of a difference here with the storm. that our watershed is dry and hopefully the rain will flow through much easier. not get built up right not drag the debris down. we still need to monitor, we

will watch we have our cameras and crews out working 24/7 monitoring. and then just making sure our residents are single where as well. arthel: listen, these unfortunate devastating weather events are occurring far too often. so, not to prepare and react to each event what kind of sustainable solutions can implement to circumvent the damage before it even happens? >> yes absolutely. but is a bigger ongoing questin we keep asking ourselves what kind of mitigation can we do? can we increase our flood control capacity? can we increase -- encouraged homeowners to put in more permanent measures not just sandbags but may be more drainage on their property but those are costs that not all of our homeowners can afford but hopefully those who can have had an opportunity to put some of this measures in place. in fact just today it's hard to get contractors who i am only today having contractors in my own yard to repairs and the

damages i had and to prepare for the storms this coming weekend. it is difficult. but putting into more permanent measures and not just those sandbags, drainage, increasing the infrastructure, our flood control channels, increasing how we monitor, more cameras more water level measures those kind of things help us to respond better in the next event. arthel: okay i want to end by just asking what are you expecting this 24 -- 48 hours question mike i understand you have to remain calm. you are the office of emergency management. but i am a little more nervous than you seem to be nervous about these impending floodwaters and storms coming. seriously? shouldn't residents be a little more on alert? >> yes most definitely. i think i am a little calm that
