reporter: my frepgd the rain is starting to come down and light an picking up this afternoon. as we go into the afternoon i think we're going see that rain really pick up now the category hurricane center winds are at 80 american so it is just a category 1. once it drops below 73 then we're talking tropical storm. but it is about 285 meals south of san diego. now, the concern here is remember about when you're talking about hurricanes and tropical storms, hurricanes are given their category based on wind speed. so while the wind speeds may not be quite as strong here like we're used to maybe say the atlantic or gulf coast side the rain is a major concern. there you can see as it continues to barrel up to baja, mrks now we're seeing rain in san diego, los angeles, riverside county, inland empire, right through palm springs more rain than we get in one year in a matter of 24 hours so we're talking easily as you see the track up to the north rainfall

totals one to three inches of rain webcast of the san diego mountains clear the koation. once you go east of the mcts in san diego and east of the san ha sen toe mountains through palm springs three to five inches of ran and terrain there as you know is desert like and you have major boulders out there. not the type of tour rein to absorb this much moisture in this amount time. up to san bernardino and riverside county you have heavy rain through the inland empire. then once this goes into the afternoon we're seeing that bank up against the san bernardino or santa barbra into ventura county and san what mountains th a steep grade and go up 4500 feet drop to about 50 feet in a matter of couple of miles so flooding concerns there. that's the big story here is all of the flooding concerns. and we've also got the flooding concerns extending from the u.s.-mexico border clear up to the u.s. canada board that's how far this moisture is going to go. so rachel, pete and will it is one for the record books we

glaifl welcome back to "fox & friends" idaho murder suspect brian co burger defense team grilling dna experts in court as they aim to challenge evidence used to indict him in the murder of four college students. families of the victims attending friday's hearing, including a relative of caylee who reportedly wore a profiring squad t-shirt to taunt co burger nancy grace has been covering the case and she joins us nancy great to have you here especially on this and second topic what are your thoughts on how this trial is going and what do you make of that t-shirt? >> a lot. i can tell you how this trial is going the judge i'm quoting him his words not mine saying reality check we're going

forward in october with this trial. and i can tells you why he's saying that and such a stern and aggressive manner is because the defense has filed a demanding for speedy trial. under that this case must go to trial within six months of indictment with no exception. if the state did you want go forward, there's an automatic acquittal that's what we're looking at. and he will go through hell and high water to make sure this case does go to trial. so what the defense is doing right now is gumming up the works. trying to outlast that speedy trial demand by one request after the next. that's all right now about dna found on the sheet at the murder scene where the victims are stabbed dead. it is incredibly important and it is crucial. but you asked about the t-shirt -- okay. i understand -- i understand how the victims

feel. although i've never lost a child i lost my piece i can say to murder just before our wedding i know how they want justice. but wearing t-shirts that support the firing squad for the death penalty they should keep those thoughts inside -- and not wear a t-shirt baring that insignia to court number one it will help the defense argue for a change of venue because pre-trial publicity number one it could actually be a grounds of appeal if there's a conviction. now, do i think it will work? no. but it is just another problem for the state to deal with. >> yeah. you know, i had never thought about that. i'm personally not for capital punishment but not thought there could be implications for the case so that i'm surprised that the attorneys didn't tell them to take that off when that happened. let's -- go ahead --

>> and hold own one more thing don't start defense team with claiming that is your -- that somehow there's a right to free speech and what you wear or don't wear to court. because the right to free speech is not unfettered you can't go into court wearing something that will inflame jury like yelling fire and a crowded theater. the right to free speech and wearing whatever t-shirt that has a message does not pend to tainting a jury and getting a mistrial. do i think that will happen, no. but it is an argument yes it is. rachel: okay let's move to this other situation so the ex-wife of slain microsoft executive is fighting extradition from the state of washington to florida after, of course, she's been charged with murder. what are your thoughts on this? >> let me tell you about shawna garner bitter angry ex according to court documents and to people within the family, he has an

we know that competition is good for america. part of why we succeeded as a country is we focus on innovation, not regulation, that's what we're doing in north dakota and we innovated our way through this one. will: i know about your personal story you started a business that sold to microsoft highly successful enterprise for you as entrepreneur and i've heard complimenting you. did you have a unique story about approach to goarches it is going to be a competition as you mentioned to get your story out. what is it that you can say what is unique about governor doug burgum? >> there's plenty of things i think i'm going to be only one on the stage that grew up working on a farm, ranch like you've done will i worked as a chimney sweep and took a shower at the end of the day not at the beginning of the day and a lot of americans you know with hey we can use small town values we can use someone who understands

what a working man is going through and like you will you lost your dad at a young age i did when i was a freshman in high school my mom went back to work and if you're a single mom i know what it is like putting food on the table and paying mortgage. and so we bring that perspective but then i've also you know from a technology we've never had anybody with a software background ever anywhere near the white house. and right now technology is changing every job every company, every industry, it needs to change our government it needs to change our military. and having somebody that understands that and those impacts and where we can go and what that can do to improve the life of every american and bring out the best of america i think that would be great. >> that experience governor is interesting on one hand we can see what went down in maui and see the inability of government to sort of evolve with necessities of the time when is it comes to technology on the other hand, there are a lot of people very skeptical about the growing role of big technology

in our lives, seemingly in concert with government. how do you approach that or thread that needle? >> well, i think we have to do what innovation has done for this country always which is invasion is helped increase and lift productivity for this country and raise standards of living. it brings people out of poverty we have to do that but you know collusion between the government and big tech that suppresses free speech just can't happen. we have to be able to separate the innovation itself from bad policy and urntiondburgen administration we'll make sure that you know, first amendment, second amendment, and especially the town state rights these are things that states created federal government not the other way around i've seen as a small business owner and large business seen it as a governor, federal government always overstepping -- will: seen you say invoke 10th amendment and not going to approach abortion and pro-life policies in the united states of america but here we go wednesday you've got just a couple seen
