the justice department agreed to that plea deal for hunter is because his attorneys threatened to put joe on the stand i guess putting the squeeze on chinese business execs isn't the only thing. warned the doj president biden now unquestionably would be a fact witness for any defense in any criminal trial. putting him on the stand against his own justice department could cause, he said, a constitutional crisis. now, does anyone think that joe biden somehow wasn't kept abreast of any of this? come on. if the threats hunter made in his what happ whatsapp message . this is the kind of intimidation tactic that joe biden would completely agree to. and as andy mccarthy pointed out today, it's just another example of the biden family corruption.

>> you have these big, bad justice department prosecutors who aren't supposed to be afraid of anything. they got this guy dead to rights on a 10-year gun felony and tax evasion charges and they are afraid to charge him. they don't want to charge joe biden's son. this is exactly what access to joe biden is. this is why people were willing to pay millions of dollars to get it. that's what the scheme was. >> laura: everyone gets it. including hunter's attorneys. use the biden name, just make sure you are either protecting or enriching the family. they would have gotten away with all of this, this entire sweetheart plea deal if it wasn't for those pesky whistleblowers. the "new york times" reporting over the weekend that weiss wasn't originally even going to require a guilty plea from hunter on any of the charges. mind boggling. but his position changed around the time a pair of irs officials

on the case accused the doj of hamstringing the investigation. what happens when you get in the way of protecting the biden family like those whistleblowers told the doj by disclosing details of the investigation to congress, the irs agents broke the law and that they should be prosecuted. joining me now is the attorney for whistleblower gary shapley, kristin leavitt. he is the president of empower oversight. tristan, your reaction to that reporting, specifically this allegation that your line was the one breaking the law? >> it's clearly utterly ridiculous on its face. we have seen this throughout the threats the hunter biden legal team made. last summer chris clark told the prosecutors even before this threat to put joe biden on the stand that charging joe biden would be a career killer for them. and he is trying what he can to make it be a career killer for our clients as well.

so it's unfortunate but not a surprise at all the pleadings had asked chairman amik cass brief giving details be removed from the docket. they claimed there was grand jury or other information there that shouldn't have been and george nor eke can a really smacked that down saying making such broad allegations was irresponsible of . what is your client saying that they wouldn't have asked him for the guilty plea at all if they didn't come forward. imagine if they hadn't come forward? what's his reaction been. >> several key points stuck out to gary. first off is that knowing now what was happening between the prosecutors and the defense counsel really adds a whole new dimension for the investigators.

they were cut out from the meetings that the prosecutors had with defense counsel now we know about the interactions. the threat to have joe biden testify came at important time. important for your viewers to understand. that letter was sent on halloween in 2022. that letter came at a time when u.s. assistant david weiss bass to have the 2014, 2015 tax charges, including a felony for 2014 for making false reports burisma income. about to expire. statute of limitations. weiss had a decision to make. i don't think it's a coincidence at all that chris clark is writing to weiss and saying hey, we would put the president on the stand at a time when he is making a decision about whether to let these burisma charges go. so i think that's very significant. the other thing that i think really stands out to the investigators is that this march

than anything points out there should have been a special counsel earlier in the investigation. at that point they should have immediately appointed him one. >> laura: also you, the idea that we discovered the president is using these pseudonyms to communicate the jrb, whether it's acronyms or pseudonyms to disguise his identity. why do you that if it was just a friendly conversation between father and son? that also gives more credence to what your client and the whistleblowers said all along. this needed to be delved into seriously by objective prosecutor were no political ties, none. >> absolutely. what you see, instead, looking at the information that senator chuck grassley has put out there from unrelated whistleblowers is that when this information, for instance, about the fd 1023 from

the fbi alleging the -- that burisma bribe not only hunter biden but joe biden, that being presented to the delaware u.s. attorney's office, the irs agents were cut out just five weeks later, the same as the attorney who received those allegations was telling investigators you can't ask anything about the dad. this investigation was hobbled and hamstrung from the very beginning because people refused to see what was right in front of their faces. >> laura: remember tristan garland was saying early on that authority. a wide berth in which to operate. and that clearly is not the case. >> no question. and what these articles also revealed was something that's very, very significant. which is that less than five weeks after merrick garland swore to congress, in fact, senator grassley specifically, that there would be -- that weiss would not have any interference by the justice department. you see that an official from

the deputy attorney general's office responded to an inquiry from chris clark trying to get anyone at doj say where to go if weiss charged him. for a deputy attorney general official to set up a meeting and join the meeting with chris clark and david weiss clearly shows that merrick garland's testimony to congress was just not accurate. >> laura: christian great to see you. thank you very much. while the doj tries to slow walk the hunter biden investigation whatever form of it exists today. the house g.o.p. is not stopping. late today, four new subpoenas were issued for irs and fbi officials who were present or had direct knowledge of a meeting in which the now special counsel david weiss allegedly claimed he was prevented from bringing charges against hunter biden for tax crimes. joining me now sol wisenburg former deputy independent counsel and fox news contributor. sol, we will get to that in a moment. i first want to address this

other issue and your reaction, again, to hunter's attorneys saying that putting president biden on the stand would cause a, quote, constitutional drivers. what of that? >> it's an absolute joke and would be considered an absolute joke by any responsible prosecutor. i would have kicked somebody out of my office who said that to begin with have they forgotten that william jefferson clinton testified for the defense in the white water trial? he was a defense witness. there was no constitutional crisis. they made accommodations because he was president. no constitutional crisis here. that's number one. number two, that assumes that the joe biden would ever want to testify or whether or not a district judge would allow him to testify, allow the defense to put him on because there would have to be a threshold showing of some relevancy. so it's a joke is an argument

and it's a bigger joke if any prosecutor in the department of justice took it seriously. >> laura: well, at this point, when we see the -- this evidence that they would not have even asked hunter biden for a plea in this case were it not for these whistleblowers coming forward, again, what does this tell you about the -- just the objective -- by any objective measure what this investigation was really like? >> it was -- i was astounded to hear that it's the it's like the prosecutors had stockholm syndrome. and there are so many things about this case. this is the thing i want to stress to your viewers, there is some things about this case within the department of justice that are just simply not how it's done. they are not by the book. they are not kosher. and this is just one of them. i could give you several

examples. and just the statements alone. the inconsistent statements alone by weiss, since this story broke are just appalling. first saying that he did have the authority, then limiting that here's the key thing that he has never refuted. he has never in any way refuted or denied that at that meeting on may 22nd, sorry, may 7th, 2022 meeting, he told a room full of fbi and irs criminal agents that he did not have the authority to prosecute hunter biden and that authority had been denied by the d.c. us attorney's office. that is completely inconsistent with him saying that he had ultimate authority and completely inconsistent with everything merrick garland said about the case. >> laura: well, cnn's evan perez made a comment about the "new york times" reporting on this. watch. police cars i think, without a doubt, have been injected in this investigation, and it's been very clear for a long time.

the stories that emerged this weekend, clearly show that there are at least some people involved in this investigation who were ready to end this. >> laura: sol, your reaction? >> well, of course that's true. and the amazing thing if by ready to end it, kill it i think that's true. the amazing thing the decision had been made by weiss in 2022 ultimately and by the department, the doj tax, there is enough to indict here and you can indict here and then the defense -- hunter's defense attorneys hear about it and go in and start lobbying and it's all over. he just rolls them. >> really quite stunning. >> bakari sellers is a former congressman from south carolina. he was talking about the comparison between what is being alleged against the biden family

and donald trump. and all the indictments coming forward. check this out. there is a whole lot of what aboutism when it comes to hunter biden. there is a great deal of difference between the multiple felony accounts the president of the united states is looking at versus some activities or actions by this president's son. >> laura: yeah. trying to say well, these rumblings about biden's son and meanwhile we have indictments piling up against trump, that actually allege credible wrongdoing. so, neither -- i mean, the other one suspect here and the other one is down there. >> well, the question is why isn't there an indictment against hunter biden? the reason there isn't is because of this political interference. and i have never been impressed by what about -- to me, he is engaging in what aboutism. every case should be judged on its own merits. and let me just tell you, the hunter biden investigation is a

octogenarian who cannot find his way off the stage. that is a very con ventricle yens yent way of approaching things. is it not? now, they are obviously freaking out and they are resorting to strained legal arguments even fringe theories turn constitution into silly putty to stretch into any way you want. scholars are trying to argue that trump should be barred, constitutionally barred from running for office. now, this is patently absurd, especially coming from judges who once called themselves originalist like our own friend mike luttig. i want you to remember that they strenuously argued that trump's team was guilty of wildly distorting the constitution regarding challenges to the state counts and the establishing of alternate slate of electors, watch. >> the people that that wrote

the 14th amendment were not fools. they realized if those people who try to overturn the country, who try to get rid of our peaceful transitions of power are, again, put in power, that would be the end of the nation. the end of democracy. >> all officials, federal and state, who have a responsibility to put on the ballot candidates for the presidency of the united states for instance, they, himself or herself are obligated under the constitution to determine whether donald trump qualifies to be put on the ballot. >> laura: what? try to follow that. now, again, they accused trump of pulling apart the constitution after the election. and you can argue about what trump did. but what are they doing? and to think by the way he was
