brian. former donald trump's motorcade entered and exited the fulton county jail behind me in just 22 minutes he was arrested and released on $200,000 bond for 13 felony charges, including racketeering. but, as you mentioned, ainsley, it is the mulling shot that everyone is talking about. mr. trump seen scowling at the camera. listed at 6'3", 2215 pounds. some aren't buying that given in 2020 as president the white house physician listed him at 244 pounds. reportedly these numbers were prereported to the sheriff's office to speed up the booking process yesterday. nonetheless, mr. trump spoke exclusively to fox news digital about his experience saying, quote: they insisted on a mugshot, and i agreed to do that. it is not a comfortable feeling, especially when you have done nothing wrong. as uncomfortable as the mugshot may have been for the former president, that has not stopped him from already profiting from

it. his 2024 presidential campaign is selling merchandise online plastered with his mugshot, including $34 t-shirts. $25 mugs. and even a pair of $12 mugshot bumper stickers. the former president posted his mugshot and fundraising on x. marking the first time he was tweeted after he was banned from twitter january 6th riot three years ago. as part of the former president's bail conditions he is prohibited from intimidating any witnesses, co-defendants, or victims in this case on social media. but, after his historic arrest. mr. trump was defiant before taking off from atlanta. >> you challenge an election, you should be able to challenge an election. i thought the election was a rigged election, a stolen election. and i should have every right to do that. what has taken place here is a travesty of justice. we did nothing wrong. i did nothing wrong. >> as for what's next, seven of the 19 defendants have yet to turn themselves in.

the deadline to do so is noon today. and d.a. fani willis, she wants to have all 19 arraignments the week of september 5th. guys? >> brian: what do you think the significance of chesebrough splitting out in october and going on trial by himself he has the right to ask for a speedy trial. from a logistical point of view, you know, this could actually benefit him because it allows, perhaps, the prosecution less time to prepare this case. remember, this is a ricco racketeering case. it is complicated. also, also is not great. we have been told for the prosecutor, we have been told by experts that this is a sign that, perhaps, this judge is willing to try these cases separately, which makes prosecuting a ricco racketeering case much more difficult. so, look, the october 23rd, 2023

'. >> brian: underhanded, i got a problem with this. going to watch these cases go back and forth. it doesn't end here. >> that shouldn't happen. two wrongs don't make a right. it doesn't give you a right to abuse the system of justice for partisan reasons, which is exactly what this is. a hyper partisan local district attorney who wants to elevate

her career is fundraising off of it. which is an egregious abuse of power and a violation of the canons of ethics that govern prosecutors. it's shameless. >> ainsley: do you think this is a federal case that shouldn't be tried locally? >> yeah. i think one of the motions that will be made meadows have already made it. i think trump will make it a lot of the alleged criminal acts t.j. makes. pennsylvania. arizona. they will move it until they make a motion to move it under subject matter and diversity jurisdiction to federal court and i think they have a good shot at that that's the where it belongs. but, frankly, it doesn't belong in any court of law. >> steve: you were talking about how fani willis' fundraising changed her website. donald trump is actually fundraising with the same picture. yeah. >> yeah. >> steve: i was just talking to one of the producers, the picture essentially has become a rorschach test because according

to how do you felt before this booking, you either love donald trump and you look at a guy who is being persecuted while is he being prude or look at a guy who is really guilty and getting caught. so it's like both sides of the political spectrum are embracing this picture for their own uses. >> yeah. i think it's an interesting point. look, he knew in advance he was going to have a mugshot. he made a determination as to how he was going to appear in it. >> steve: absolutely. >> and, you know, he is conveying a message. if they can do this to me, they can do this to you. >> ainsley: yeah. he didn't smile. that was probably intentional. >> yeah. >> ainsley: he said he was 6'3" and what did he weigh 215 pounds? >> he says he has blond strawberry. >> brian: he did not swear in before giving his weight. >> i don't think fani willis will convict him for lying about his stats. apes ain't we all do that we all make that number a little lower.

>> brian: guilty as charged. >> ainsley: i'm not accusing him of that what happens next, gregg, where does it governmental in addition to an attempt to move it to federal court, i think there will be a variety of other motions one of which will be a motion to dismiss based on absolute immunity. look, the 39 of the united states is sworn to enforce all laws. if he has reason to believe that a federal election is the victim of fraudulent voting. he has absolute immunity as president of the united states. commander-in-chief to pursue that and so he will claim, i was acting consistent with my oath of office, even though there's a dual benefit for him personally. but that doesn't shed his duty as comeefer. >> brian: let's talk about what is happening with hunter biden. >> steve: gregg, can i ask one more question about this case? what do you make at the 11th hour donald trump changed his

criminal defense attorney, hired a new guy. >> i don't think it's terribly unusual in a high profile case in the o.j. simpson case. they changed attorneys just before trial. >> steve: they just kept adding. >> other thing about o.j. was he was very smart. look, i cover the trial every day in los angeles. i thought i was absolutely guilty. but, he was shrewd. he invoked the speedy trial right, which is not a prosecutorial right, it's the defendant's right. and i think i watched this unfold. i think he caught chris dar done and marcia clark unprepared. and as a consequence, that extended his benefit. >> ainsley: trump won't do a speedy trial he wants these all to be. >> he wants to watch the chesebro trial if it occurs october 23rd. you can learn everything about the prosecution's case. >> brian: 9 minutes after the hour. the other story the white house wants to go away with the hunter biden story because it leads

right to joe and is picking up warped speed. now we find out it wasn't just a china visit where the vice president's son joined the president, it was about 15 separate visits. in a freedom of information request, they are up to 15 times, which hunter biden be on air force 2 traveling with his dad to these countries. lead from a different exit off the plane, and then meet up and do various things. in fact, there's a quote from a hunter biden email, mexican business partner. listen to this. february 24, 2016, right before the vice president was out the door. we are arriving late tonight on air force 2. in mexico city. we will be there for thursday. i'm attending a meeting with dad in with dad. really? remember, he had a deal going in mexico city with i think it was carlos slim. >> yeah. this just underscores that they were acting in concert and that joe biden was an active participant. he was an accessory, aiding and

abetting. you know, we have got all of the telephone calls. he would get on the phone with the foreign business partners america's adversaries. they weren't talking about weather. in the burisma call on december 4th, you know, the ceo, who is under siege, is he having his assets seized by viktor shokin who you interviewed. he said get your dad on the phone. three days later, joe biden flies to kyiv and under an extortion attempt, he gets shokin fired. and all of a sudden overnight, the investigation into hunter biden wants company that's paying him a million dollars a year. vanishes overnight. you know, will the ceo got what he paid for. influence. >> steve: the hunter biden case would have completely gone away had the hunter biden team and the prosecutor, david weiss, up in delaware, had they signed off on that thing. but the judge said, you know. >> brian: whistleblowers are the heroes.

>> steve: that's what i'm getting to. those two irs whistleblowers, obviously, and according to everybody who looked at this. given the david weiss suddenly asking for special counsel status. those whistleblowers spilling the beans on hunter biden and how he got special treatment. that changed the entire case. >> david weiss wasn't going to charge anything. the fix walls. in it was a protection react by merrick garland at the doj and david weiss, the u.s. attorney in delaware. the calculation completely changed, but then, you know, weiss said well, let's get him to cop a plea to a couple of minor misdemeanors, which is ludicrous under the circumstances. favorable treatment. political interference. this is a classic case. >> brian: the question is when we see the vice president of the united states bragging to the council on foreign relations bragging i'm leaving in six hours. you don't get the billion dollars unless you fire that

prosecutor. what is going on here? does that relate to anything to do with this hunter biden and these deals? and the answer seems to be yes. one week ago it took a while with the translation to get the white house's response. i talked to viktor shokin who is living a humble life right now basically living off their version of social security who was fired by joe biden. so he sat there through an interpreter never do it live. i asked him the questions i think everybody wants to know. what were you doing? how did you get fired? how do you feel? i asked him, too. why do you think you were fired? after all, he was asked by prix showing kin president at the time to come out of retirement to clean things up. here is what he said destroyed his life and why he was fired. >> i did not want to diehl in unproven facts by my firm personal conviction is that, yes. this was the case. they were being bribed. the fact that joe biden gave away $1 billion in u.s. money in

super impressed with the shokin group. we had a two hour conversation about the challenges they faced. then, when word came up that the u.s.a. was going to be fired shokin ouster. the cia guy says yikes, i don't remember him coming up in our meeting on tuesday. archer and his testimony said his chief objective was firing victor shokin. so this is -- who is the one who wanted him snyder greg. >> gregg: the state department, treasury and justice department had all agreed that choken was doing great things in his anticorruption crusade, deserved the billion dollars. the inner agency policy committee advised that this is our stance, joe biden. when you go to kyiv, you are to give him the promise of a billion dollars. what did joe biden do? just the opposite. why? because his son is sitting on the board. he is demanding that shokin be fired because shokin is going to shut down burisma and end the,

he says the wagner leader made serious mistakes in his life as the pentagon calls the death his assassination. does anyone doubt it? fox news senior strategic analyst retired four star general jack keane. they taped it. they blew up this plane. they seem to want to send a message with this what looks to be an assassination. what's that message? >> well, certainly no surprise here. i think prigozhin's fate was sealed as of june the 23rd when he conducted a mutiny against vladimir putin regime. and despite the fact that, you know, they worked out some kind of an agreement, i think everyone looking at this knowing putin's history of dealing with his opponents, the fate was sealed. i think the message clearly, you know, putin was severely criticized at the time. one for tolerating prition's criticism, which began last year, based on the conduct of the operation by the way prigozhin was nota public figur.

the reason he became public was because he was criticizing putin and the ministry of defense's prosecution of the war. and he also said the war was unfounded in terms of the reason for conducting it. so, the reality is that putin gets criticized for tolerating that criticism for almost a year of his regime and he did it, i think, to put pressure on the ministry of defense to do better. and, secondly, that he brokered a deal with a guy that was committing a coupe against his regime. that stunned people in moscow and the kremlin as well send a message it opposition behavior and certainly the most threatening opposition he has ever had for the 23 years in power is what prigozhin's march in moscow was all about. >> brian: amazing he lasted this

long and the wagner leader felt comfortable living outside of moscow going back and forth and starting operations in africa again. the world is a better place without some of the higher ups in wagner. we will see where it goes from here. they also demoted one of the most effective generals because he was allied, allegedly, with him. i want to bring you to something else think is important. we all read in the "new york times" an unnamed pentagon source said they advised ukrainian forces to not spread out across the 400 miles of the ukraine border with russia and the land they have taken to consolidate and try to probe certain areas. but as if they know this war better than we know. what should we know about that story that came out in the "new york times"? >> well, first of all, i mean, i find the arrogance implied in this story is really quite stunning. we haven't given the ukrainians a 31 tanks yet until the fall of the year, likely after the court

offensive. we have hundreds of armored vehicles in germany in storage, for what pursuance? in the event there is a war with russia. for the life of me, i have never understood why we did not accept the risk the war was already on and give them the equipment. the ukrainians know. this they have 60 of the 250 tanks they were supposed to get and only 15% of the engineer breaching equipment. despite all of those shortcomings the ukrainians have been able to take tactical advantage and breakthrough for the first time this week the main defenses of the russians. and they deserve a huge amount of credit. they got secondary defenses to move through yet. and then they have to see if they can exploit it. but, here, the armchair leaders in the pentagon -- and, by the way, no one in the pentagon or in a military uniform in the united states military today has ffought in combat against prepared defenses that have been

optic kat call with mine freeldz in trenches in combat. that's the reality of it. go back to the battle of methods in world war ii that followed the normandy. they are criticizing ukrainians because they are not concentrating forces in one place those forces are limited to take advantage of it and breakthrough. in every battle that we have fought of any consequence, to include what the germans and the soviets did in world war ii, to include united states military operations in iraq in 2003, and to include desert storm back in 1991, they were all fought on multiple axes. why is that? because you don't want to put all your resources on one axis. it sounds pretty obvious to give the enemy the opportunity to consolidate their reserves and block your penetration. the ukrainians have been pinning down multiple divisions bakhmut.

they conducted another offensive north of the one that's been successful, hoping that that is maybe successful as well and maybe the one to the south is not. they wanted that's o. what has happened is the russians are not able to concentrate all of their reserves in one place because the ukrainians are fixing them. the arms chair generals have got to stop carping and be silent here and support the ukrainians with the equipment they need and, my god, let's morally support them also and showing them and giving them the credited that they do in terms of what they're up to. they are outgunned and outmanned and doing a terrific job and they need our moral and physical support. >> brian: and sweden and norway are giving the f-15s and 16s we are not. we are not starting training until october which is insane. general jack keane, thanks for staying on institute study of war is a great resource and you head that up. appreciate it. meanwhile, we move ahead. a fox news alert. it's the mugshot that's captivating the nation. donald trump booked in georgia

turning himself in georgia county jail on election interference charges. >> steve: our next guest says if the president is convicted she would pardon if she is elected president. republican presidential candidate nikki haley joins us now live from chicago. nikki, good morning to you. >> good morning. >> steve: what do you make of the mugshot? >> i mean, to me, i think it's a sad day in america. i think it's disgraceful. i mean, the idea that we're seeing a mugshot of a 77-year-old former president, i mean, how did we get to this point? and i don't know that anyone in america should look at that and feel good about it. he think the reality is we need to focus on what i hear everybody talking about. that is inflation is keeping being able to afford necessities. parents worried about transparency in schools. we have open border. and national security threats. so we have got some work to do. you know, i think the main thing when it comes to trump we need

to know that first of all we shouldn't assume that he is going to be convicted. and the second thing is we shouldn't assume that he is going to be the nominee. >> ainsley: a lot of people after the debate were talking about the abortion issue and your response to the abortion question. many republicans are saying we need to adopt this, too. because you were saying look, i am unapologetically pro-life. my husband was adopted. i had trouble getting pregnant with my two children. but, we need to stop demonizing this issue. we need to not try to throw women behind bars. >> steve: and be realistic. can't pass it. >> ainsley: we don't have enough votes in the house or in the senate to abolish this. how did you come up with this answer and what are you hearing from the voters after that debate? >> i mean, ainsley, that's the answer from my heart. you know, i am surrounded by blessings. and god has blessed me with an amazing husband and two wonderful children. but, having said that, i think it's really important that all

of us remember everybody has a personal story. so, while i'm unapologetically pro-life i don't judge anyone for being pro-choice. i think we have to humanize this issue. we are got to stop demonizing this issue. i think the division in this country has gone too far. we have to start looking at the vision going forward my vision is how do we save as many babies as possible and support as many moms as possible. if that's the case, be honest with the american people. tell them what is possible and what's not possible and let's bring people together based on humanity, not based on making people hate each other. and i think it's happened too long and i'm just not going to be a part of that i refuse to be a part of that. >> ainsley: very similar to your stance i remember when you took down the confederate flag in south carolina and a lot of people were against it. you said this is unamerican, it is offending a lot of people. and then you got so much support after that from the folks in south carolina. sorry, brian, i know you wanted to ask a question. >> you have to remember leadership is about bringing out the best in people, right?

leadership is about telling people the truth. and letting them make decisions. but, leadership is also about tone. and you have to make sure that you are giving people the knowledge they need but the ability for them to find the best way forward. and hating each other is not the way to do it. and i don't think we have to compromise our beliefs to do it. but i do think we have to be responsible in how we communicate. >> brian: by the way, shows the american people care about this election. you have 13 million people watching that debate which is pretty amazing in today's fractured television environment and probably going to grow there when we take in all the streaming numbers. meanwhile, looking at first blush at the impact of the debate, desantis looked like he picked up five points. trump seems to have lost five points. you have almost doubled your support from 29% to 46% and you man you diametrically opposed foreign policy wise vivek ramaswamy seems to have picked up six points. you mentioned abortion one area in which you sparred with mike

pence. you spard with vivek ramaswamy on taiwan but especially on ukraine. and a lot of republicans say yeah, i believe nikki haley might be right but what drives them crazy is how under financed and under supplied joe biden is to the ukrainian forces. not giving them what they need in a timely fashion. making this thing drag on longer than it has to. what's your reaction to that? >> first of all, i hadn't seen those poll numbers so i'm super excited and i love that. >> steve: you should be. >> second thing i will tell you is we didn't have to be at this point. if biden had done his job, had we not had the debacle in afghanistan, he had not shown weakness, we wouldn't even have a war with russia and ukraine. we wouldn't have chinese aggression on taiwan. so understand that was the leadership that was missing and that's the situation that put us in this point. and so when you talk about ukraine, i understand that americans are divided on what we should be doing with ukraine.
