review the evidence provided by the prosecutors asking for a start date in 2026. plus trump has three other trials looking for space on his calendar. >> these trial dates are going to move. it is unrealistic, it's the attics and no judge is going to say that you can be on two trials at once in two different states. a lot of these overlap. they look at the start date of the trial but these are 4 to 6 week trials at the least. so there is no way they aren't going to overlap. they will have to go into october, november of next year. again, by design. >> dana: a court hearing about to get underway in georgia. lots of focus on this because former white house chief of staff mark meadows and fulton county district attorney will lay out her case against trump and 18 other co-defendants. david spunt is live outside the federal court in washington. >> good morning to you both. a busy day in two courthouses,

one in atlanta and one here in the district of columbia. the federal judge taking a bench a couple of minutes ago behind me getting underway now. in a few hours we may find out when this thing will actually go to trial. we are talking about former president's trumps alleged efforts to overturn the results of the 2020 election. the government as you just said in the intro wants this to happen in january, meaning january of 2024 in a few months. trump's team wants it to happen in april of 2026. we'll see what the judge does. that's 2 1/2 years from now. the decision ultimately rests with the judge. we're told she will likely set the trial date today. unlikely she will allow the trial to take place 2 1/2 years from now in april 2026 but may also make the government wait a few more months and push it back into the spring or possibly the summer. you have to remember donald trump's schedule as you heard his attorney say is getting full when it comes to court appearances. also we learned in this case

that the government has some 11 million pages of discovery to share with trump's attorneys. discovery just means evidence that they are using and the defendant's right is to see that discovery. donald trump could not post or make public comments about the evidence. also today as you mentioned former trump chief of staff mark meadows will be in atlanta with the goal of moving his trial to federal court. his legal team argues he was the chief of staff to the president of the united states and this should be a federal case because it's a federal job. dana and sandra. if it is moved to federal court it will expand the jury pool and keep the trial off cameras. in the state court where donald trump's case currently it, it is lights, camera, action. in federal court and all federal courts in the united states no cameras in the courtroom. we'll follow all the developments today. back to you. >> sandra: david spunt, thank you. >> dana: the other republican candidates campaigns are continuing across the country. florida governor ron desantis is

we have to make sure we win this because the thought of kamala harris being president should send a chill up every american's spine. >> dana: what do you think about that strategy? >> it's a really smart message. think about this. i looked at the social security administration tables. the average american has a 42% chance of making it to the age of 85. average american male. joe biden would be 86 at the end of his second term. the odds are something like 60% that kamala harris will be president of the united states if he gets a second term. you are running against kamala harris as much as you are running against joe biden. joe biden is the least popular president in the history of polling going all the way back to world war ii except for jimmy carter. she is less popular than he is. they need a plan b. it is not kamala. >> sandra: there are questions about gavin newsom's attempted move into the spotlight as one headline reads in nbc biden

advisors are bristling at his plan to debate desantis. apparently harris allies are taking particular umbrage of what they see as newsom's -- at the expense of the vice president. it's disrespectful said one outside advisor to harris. joe biden is running with kamala harris. that's the democratic ticket. what's going on here, marc? >> first of all gavin newsom sees the same decline of joe biden the rest of the country does. second of all he knows even the democratic party doesn't want her to be the presidential nominee. he is positioning himself to be there to pick up the pieces if something happens between now and election day 2024. quite frankly debating ron desantis is smart both for desantis and him because seven in ten americans don't want a trump/biden rematch. so putting the two of them on

the stage together to debate shows people what the alternative universe, what could be if they didn't -- if they weren't forced into that choice and had a choice they liked more. >> dana: one alternative universe is the no labels group saying they won't be a spoiler in the election but they think americans want another choice and looking to next april, perhaps a convention in dallas to try to get somebody on the ballot. >> it's too early to talk about the third party yet. we had the first debate in the republican party for people who don't want trump to be the nominee this is a safety valve issue. a unique situation where a third party could win. i will tell you why. as i said seven in ten people -- americans don't want a trump-biden rematch but forced to have that choice they don't have a safe harbor. a democrat who doesn't want biden isn't going to vote for trump and some people are not

millions of tax records at one of their storage facilities saying this. our physical inspection found empty boxes including micro film, backup cartridges with no explanation as to the location of the missing cartridges. i.r.s. cannot account for thousands of micro film cartridges containing business and individual tax account records. millions of missing records just one problem in this report that was detailed. the i.r.s. commissioner responding saying the safekeeping of these records was not the top priority for them as they face under staffing saying the report highlights the impact of challenges the i.r.s. has experienced over the course of the last decade from the attrition of experienced staff due to reduced funding and the effects of the recent pandemic as the ranks of experience staff are reduced, redirection of those employees to higher ranking priorities affected our ability to maintain desired standards of control for lower-risk programs. republicans are not only

>> dana: behind the glamour lies a darker reality in hollywood. the homeless crisis is escalating. tens of thousands of people are living on the streets in tinsel town and the city of los angeles. kelly o'grady with the very grim numbers this morning. hi, kelly. >> hi, dana. that's right. about a third of the u.s. homeless population lives here in los angeles. before i show you where i'm at today i want to jump into those numbers. at the last count that was released this summer 46,000 people were homeless in the city, 76,000 in the county on any given night. that's close to a 10% increase versus last year. admittedly the count was in february. residents are dealing with something like this for years. you can see the camp i'm at behind me. you don't see things like this just in bad areas.

a trampoline like this video. if a bear is breaking into a home or business the new law could kick in. this bear is breaking into a bakery. last year bears broke into a record 67 homes in connecticut. state wildlife officials say the bear population has skyrocketed since the 1990s. right now it is estimated at 1200 throughout the state. >> for a lot of our neighboring states, they have had legislation that relates to their bear population, how they manage their black bears and how people interact with them on their books for a long time. we haven't. >> state wildfire officials say the new law doesn't go far enough because it doesn't include a bear hunt. they argue that a hunt would make bears more fearful of humans which would change their behavior. bear advocates promote other options like bear resistant trash cranes and criticize the new law.
