florida governor ron desantis is giving an update on hurricane idalia. bill is off. good morning. >> bret: i'm bret baier in washington. "america's newsroom." the governor is beginning down there in florida and we can listen in to governor desantis. >> forecast to make landfall along florida's big bend tomorrow morning as a major hurricane. the national hurricane center issued a hurricane warning for the gulf coast from sarasota county through franklin county in the panhandle and storm surge watches are also in effect in those areas. national hurricane center advisory includes if this storm hits at high tide storm surge could reach 8 to 12 feet in some areas. that would be life threatening storm surge. i know all those areas are under evacuation notices in the low lying and coastal areas.

you run from the water and you hide from the wind. if you are there in that storm surge you are putting your life in jeopardy when it gets to be that high. so if you're giving those orders please heed those orders. you don't have to leave the state. you don't have to drive hundreds of miles. get to higher ground and safe structure. ride out the storm and go back to your home once the storm passes. there are evacuation orders for coastal low lying areas in 22 different counties along the gulf coast as well as throughout north florida. to make these evacuations easier on families, we have directed f.to wave tolls in several counties and that started at 0:400 this morning. florida has activated with -- if you want to find a hotel go to

expedia.com slash florida. we continue to coordinate with the power companies across the state. we had as of this morning over 25,000 linemen stationed. more on the way. you will have most likely between 30 and 40,000 linemen when the storm hits will be in the state of florida and immediately move to commence power restoration efforts. we've also been working with counties to make sure that they know that we have resources ready to deploy and want to be helpful to support their efforts. we have received more than 450 active missions that we are coordinating. every resource request we received has been filled or will be filled by the end of this morning. we do have 420,000 gallons of fuel staged and ready to deploy and additional assets are expected over the next few days and the gas stations that will be prioritized will be the ones along the heavy evacuation

routes. we have eight urban search and rescue teams activated and 580 search and rescue personnel ready. right now we delivered 431 pallets of water, 303 pallets of mris and tarps to communities and many more gallons of water and things deployed as needed. over 20 shelters open and additional 20 special needs shelters are mobile liesing and on standby throughout the state of florida. 500 national guardsmen activated and have deployed 247 links and they will be deployed to impacted areas as the needs arise. 42 school districts have announced school closures over the next two days and 16 state colleges and seven florida universities. florida department of transportation has more than 600

personnel including over 220 cut and toss crew members with more than 400 pieces of heavy equipment and trucks strategically placed across the state to prepare for cut and toss operations post storm. if you look at that track of where it is going now, you are going to see a lot of debris. there is a lot of trees along take track and it will knock down trees and knock down power lines and there will be a need to be able to clear a lot of the right of ways. florida department of transportation has about 1100 generators en route to impacted areas and they will use that to get the traffic signals up and running as soon as possible when the storm passes. as wind becomes stronger later today and tonight f-dot is coordinating with local law enforcement to close bridges once the speeds reach in excess of 40 miles-per-hour. road rangers will be concentrated along evacuation routes to help motorists.

we have also called up 33 ambulance strike teams with over 200 ambulances that are ready to surge into any impacted area. also requested an additional six strike teams through our emergency management assistance compact with other states. this storm is going to hit tomorrow morning. you will start certainly seeing effects of this in different parts of the state later on today. you still have time this morning to be able to make your final preparations. if you are in one of those areas that's in line for some of the major storm surge and you are told to evacuate, you have time to do that. you have to do that now. you don't have to go hundreds of miles. you can go to a shelter in a different part of your county. go to a friend's house in an area that is not going to be susceptible to the storm surge. hotel. all these things are good to do and you should do that and heed. this is going to be a major

hurricane, likely a category 3 and where it is scheduled to hit along this big bend. we have not really had a hurricane strike this area for a long, long time. i think you have to go back to the 1800s before you would see a path like this. and so those coastal areas there have not necessarily been through this before and i think that being safe is the appropriate thing and erring on the side of caution is the appropriate thing. we will, of course, be mindful of any changes in the path of this storm. i think everybody on the gulf coast from tampa bay until northwest florida must remain vigilant. they have nudged the track a little bit further west over the last 24 hours. we were looking at potentially leavey county. yesterday and today. now we're looking for at taylor county. there are some models that say

it may go further west. so places like tallahassee where we are today certainly you could end up having it hit tallahassee directly and some of the surrounding areas. everyone remain vigilant, continue to watch and listen to the local orders that you receive from your local emergency management personnel. i want to thank everybody. we've been in contact with people from most of these counties over the last few days. everybody is working hard and everybody understands that this is a significant event and they are remaining calm, cool and collected but they are executing and that's what we need to continue to do. i want to thank everybody in the state of florida for working hard. they've been working round the clock and getting the resources where they need to be as those requests come in. of course, once the storm passes -- >> dana: there you have the update from governor ron desantis is florida. they are seemingly very well

overseeing president trump's election interfere answer case setting a trial date for march 4th. the timing puts the trial directly in the middle of the republican presidential primaries with super tuesday slated for the next day. mark levin is with us. when we first heard the date of march 4th yesterday i think people politically minded thought isn't that around super tuesday? it's the day before it turns out. >> so your federal judge sitting there and saying to yourself what date can i set that would not interfere with the election, that would allow the defendant to actually defend himself? you pick march 4th? six months from now? in a case that involves 12 million documents, scores of witnesses, where he can't possibly have effective representation and i'm sure there will be an appeal based on that. a couple of things. this judge not only set

march 4th, the judge who by the way whose father -- excuse me, grandfather in jamaica was a marxist in the "new york post" today. and was imprisoned by the jamaican government for a period of time. chip off the old shoulder there. there is something called the anti-suit injunction. the department desighted they would bring two federal cases so close to each other donald trump wouldn't have the ability to defend himself. they moved for early trials in both cases. moved for january trial in d.c. they moved for a january, february trial or maybe march in florida. you are talking about tens of millions of pages of documents. so they are piling on trying to smother him. i would file a motion under the anti-suit injunction. the anti-suit injunction is for a case like this. when you have the department of

justice, the biden administration, piling on cases, piling on charges against a single defendant and it is supposed to be tried within months of each other, the judge in florida set the date for may. now this judge in d.c. blowing off the judge in florida. she should have waited in d.c. until the first trial was done and the first case was done. if she had any desire to show due process rights for the defendant but she jumped the other judge, the second case. that's how important this issue is. it is bigger than march 4th. the motion should be filed with the first judge in florida. that motion should say look, we can't have two trials at the same time overlapping each other with tens of millions of pages of documents. with a presidential candidate. the department of justice scheduled it this way

intentionally. the judge in d.c. jumped the line, she is the second case not the first in order to get her case before your case, and for whatever reason, that's what she did. the anti-injunction act would be judge cannon issuing an order against jack smith and the department of justice telling them to cease the prosecution of the case in d.c. until the case in florida is completed. that's the way it should be. because it is hard enough to defend against one case as opposed to two case essential or in trump's case four cases. i want to mention also grand juries. nobody has talked about this to my amazement. the grand jury process is set up in the fifth amendment. it is in the bill of rights. you are to be indicted by a grand jury, not a prosecutor. but what happened when jack smith moved his charges from washington, d.c. to florida? he was in the wrong venue in

violation of the department of justice rules. but he gets his indictments and moves them to the grand jury in florida. now the grand jury in florida inditties. okay. but a grand jury's indictment is not supposed to be a rubber stamp of another grand jury in another jurisdiction. what exactly did that jury vote on? did they ask for witnesses or any documents? this investigation in washington is going on 2 1/2 years and there are piles of information. in one week's time they indict the president in florida on top of the indictment in d.c.? i think that's fast and loose. i think mr. smith actually violated the grand jury rules in florida. again, i would file a motion of grand jury abuses and i would want to know exactly what they told that grand jury because they are supposed to be truthful and present facts and explain the law, supposed to ask if they want to talk to any witnesses,

scrutinize any documents. i doubt that happened for the most part. and in georgia. -- i was going to say georgia is a huge problem. >> bret: tough to get grand jury, isn't it tough to get what they heard and saw? >> it is tough to be a defendant in any case when you are up against the government. all your motions are difficult to pursue. this is unique. the circumstances are quite unbelievable. why did he bring the indictments in washington, d.c.? that's not supposed to happen when the material activities and events being charged occurred in florida. so there is more basis for getting behind what took place in this case with grand jury abuses than there would be normally. the government opened itself up and doesn't have a good explanation for why it did that. none. in georgia -- >> bret: let me ask you this. this sets up for, it seems like a lot of issues on appeal. but because these are happening

realtime during an election, is there a fast track process that somehow the appellate or supreme court gets involved earlier? >> the motion for the anti-suit injunction can be appealed if it's ruled against the president and the other co-defendants immediately because it is an issue about the trial itself. you can't go through the whole trial and then go back and say by the way, you should have issued an order to stop the other trial. the judge in d.c. has pushed up the date to march 4th. so this is the immediate issue. it is a pre-trial issue and it is an issue -- we don't call it an interlock tore appealed but immediately appealed to the circuit. grand jury abuses supreme court has ruled you need to lay it out before the trial. if you lay it out during or after the trial you have no

basis. you have to raise it now. that provides a basis for an interlock tory order. both of these cases would go to appeal, if necessary, before the commencement of a full trial. to answer that question. real quickly, i know we're out of time. in georgia when they posted the grand jury indictment before the grand jury came to the courthouse, before they met, before they voted, and in georgia you don't have to use a grand jury. when you do you have to use it properly. that's a perfect case for grand jury abuse and since in georgia there are no secrecy rules as we know, it would be easy for defense counsel to find out what the hell took place in that grand jury. so these are things that can be done because there is no question that the department of justice has abused the law. they are piling on the charges. there is no question that the

judge in d.c. is a partisan, one of the most radical judges in the federal bench of all the thousand district court judges and there are ways to at least seek relief even if they're tough. you don't roll over and play dead because what the american people are seeing here is an abuse of the justice system and judges, at least the judge in d.c., the judge in manhattan and we'll see about georgia, are going along with it. in other words, they are allowing their courtrooms to be used to interfere with an election and to deny trump and other defendants their due process rights. this is very, very important. >> dana: we'll see what the trump attorneys do. i'm sure they are meeting. they have a lot on their plate and a pleasure to have you on "america's newsroom." thank you. >> bret: thanks, mark. >> thank you, god bless. >> dana: be sure to catch a fascinating interview tonight. former trump attorney john eastman when he sits down with laura ingraham tonight at

police have yet to say publicly what they think may have motivated the alleged gunman to show up at the lab building. open fire killing a unc faculty member. the suspect being charged with first degree murder. for students on campus yesterday there was a lot of chaos, confusion and fear. it happened around 1:00 yesterday afternoon when 911 calls reported gunfire at the campus. students were seen running with hands up and polices courts like we've seen in other school shootings. we heard overnight from the chancellor. >> this loss is devastating and the shooting damages the trust and safety that we so often take for granted in our campus community. we'll work to rebuild that sense of trust and safety within our community. >> the search for the suspect

police posted pictures publicly while looking for him and lasted 90 minutes. people who live near the campus took video of the suspect being taken into custody. we believe the suspect is a ph.d. student at unc with ties to louisiana and china. the charge is first degree murder and investigators stress they don't have all the answers yet. >> to actually have the suspect in custody gives us an opportunity to figure out the why and even the how. and also helps us to uncover a motive and really just why this happened today. why today, why at all? >> already investigators have shown up to this building. you can see police cars behind me. gone in within the last 20 minutes continuing their investigation. all the classes at unc are canceled for today and the university is also offering resources to students who may be impacted. i've seen a few students

bringing flowers this morning. the campus coming to terms with what happened. >> dana: thank you so much. in florida authorities releasing video of the jacksonville gunman's movements before opening fire inside a dollar general store. it shows him briefly stopping at a family dollar store where he bought some items and later putting on a tactical vest. three people were killed in the shooting on saturday in what investigators are calling a racially-motivated attack. the suspect did take his own life.
