there is a change in the political front line in the u.s. after next year's presidential elections. aishah. >> aishah: greg palkot live in london, thanks. >> dana: an attorney is calling out the justice department over the hunter biden case. the lawyer for garry shapley now alleges a top doj official promised his client protection that never materialized. welcome to another hour of "america's newsroom." i'm dana perino. the hour flew by with you. >> aishah: happy to be here for bill hemmer. shapley's attorney said he spokes with assistant attorney general back in april and he says that winesheimer expressed interest in hearing about claims of a cover-up in the hunter biden probe and assured him of the d.o.j.'s commitment to protect whistleblowers from retaliation. shapley's attorney says

winesheimer changed his tune after that conversation and shortly afterwards his client was removed from the case. >> he says he will look into it and get back to me. we don't hear. we had a call on may 16th, the next day and during that call he said we're an open book and he just said mr. weiss is in charge of the investigation. >> aishah: david spunt is live at the justice department to look into this. >> this entire hunter biden legal saga was supposed to be in the rearview mirror per d.o.j. officials. however, things changed after that plea deal fell through last month in a very public way in a federal court in delaware. this lawyer, you will hear from him in a second, the lawyer for gary shapley. he was encouraged in april when

he spoke to a career official working for both political parties whoever is in charge of d.o.j. who told him his client shapley would be protected as a whistleblower. he was the first to come forward on the record, hold up the red flag and say the hunter biden investigation was quote slow walked multiple times. mark says a day after he originally talked to u.s. attorney. david weiss, the special counsel met with hunter biden's defense attorney and him at d.o.j. headquarters where i join you now. he said the promises about whistleblower protection suddenly disappeared. >> in just about two short weeks, my interactions with mr. wine chimeer went from the office the deputy attorney general would like to hear about any wrongdoing or allegations of improper conduct to two weeks later go talk to mr. weiss. >> d.o.j. and weiss's office

declined to comment. garland will be testifying before congress. the district court in delaware, the judge originally overseeing the plea deal is giving both sides until september 6th to provide an update on this fight over this gun diversion agreement. basically hunter was hoping to avoid jail time for lying on a federal gun form. hunter's attorneys say it was valid because both sides signed the agreement. but special counsel david weiss says not only is it not valid, they are starting from scratch because the entire plea deal fell through. while the tax case against hunter was dismissed in delaware and maybe brought in other jurisdictions the judge wants an update on the gun deal by september 6th. >> dana: new york city mayor eric adams is hosting a labor rally for asylum seekers

flooding the big apple. labor unions, elected officials joining his call for work authorizations after repeated requests to the federal government have been ignored. new york congressman mike lawlor is standing by. bryan llenas is live in new york city with much more. >> good morning. this rally was supposed to start about 20 minutes ago. so far there is about 100 people here. many of them seem to be from labor unions. this is a very unique type of rally sponsored by new york city government. mayor eric adams calling on new yorkers and business leaders to come out this morning to pressure the biden administration to give work permits to thousands of migrants in an expedited way. they want to really alleviate the overcrowding at city shelters. the city says the faster they can get migrants working legally the quicker the 60,000 migrants in the overcrowded shelter system can get out. yesterday governor hochul visited the white house.

she did not meet with president biden. instead she spoke with his chief of staff and homeland security secretary mayokas about the migrant crisis here in new york. the white house saying they would help the city identify migrants who are eligible for work permits and each out to them with texts and emails. >> i walked out of there with a sense they are committed. i have pressed the white house to find a path so we can get more people working. they are starting tomorrow with an app notification for people who have applied to come into this country under the cbp app. >> this as the blame game continues. mayor eric adams blames governor hochul for not forcing suburban communities to take in migrants. hochul says the city has been slow to respond. both are blaming mayokas and the biden administration, which says congress is at fault for not having a better border plan. all of this as the city is losing patience.

more and more protests including a violent clash that was on sunday. critics say ultimately, dana, that look, if you expedite these work permits you could be doing nothing but incentivizing more migrants to come to the city that's seeing 10,000 migrants a month at a cost of $12 billion over the next few years. >> dana: isn't this going to cause more people to come? right. thank you, bryan. >> aishah: new york's governor kathy hochul visited the white house yesterday to ask for help from the government for the big apple spiraling migrant crisis. let's bring in new york congressman mike lawlor who sits on the house foreign affairs committees and represents some of these suburbs around new york city. welcome to the show. i want to quickly read a part of this letter that you wrote to governor hochul and mayor adams. you say while new york city officials have chosen to embrace

sanctuary city policies suburban officials like the ones in our districts have not. as such sub urn an counties like the ones we represent must not be forced to incur the financial and public service burden by the policy choices of new york city officials. you broke it, you pay for it. that's pretty direct. tell me how this is impacting and as you say burdening is suburban areas. >> well, governor hochul and mayor adams have been an absolute disaster in dealing with this crisis. and not only have they been behind the eight ball from the beginning, but the very policies that they embraced for years have created this crisis. the new york city shelter system was down to about 50,000 people in it. it's now up over 85,000. they have taken in over 100,000 migrants in just over a year. since joe biden has become

president, we've had 5.5 million migrants cross our border illegally. the challenge here is not the work authorization wait period of 150 days. the challenge here is the fact that it's taking 2 to 3 years for these asylum cases to be heard. when they are finally heard, 70% of them are being rejected as not valid asylum claims. and so in the interim, our municipalities in areas like new york are bearing the burden and having to provide housing, education, food and this is a real challenge. on municipalities like the ones i represent, they don't have anywhere near the social services support system that new york city does. the state legislature gave new york city a billion dollars in this year's budget to deal with this. new york city is now claiming it will be upwards of $10 billion to handle this migrant crisis. this is funds -- taxpayer funds

that we don't have. we have veterans who are struggling. we have seniors who can't afford to pay their bills. we have people who are unemployed because our economy is still struggling. the cost of groceries, the cost of living, the cost of gasoline have gone up. and this biden administration coupled with the incompetence of governor hochul and mayor adams has created an absolute mess with our immigration system. >> dana: congressman, new york city's deputy mayor she basically said a lot of what you are saying. also coming from inside the house. watch here. >> i think with 2900 people coming through the front door every week, even if we get people out in the shelter, even if we do get kids into school and do resettlement it seems like we're hamsters on a wheel if we don't do something about the front door. >> dana: so hochul goes to the white house, gets told she will only get to meet with the chief of staff. she walked away basically with

nothing. >> again, incompetence. the deputy mayor is 100% right. if you don't deal with our southern border you could give all the work authorization you want. you are still going to be dealing with the fact that you are having tens of thousands of migrants cross the border every week. we're talking about roughly 43,000 migrants a week crossing the border. i live in a town of about 49,000 people. so it is almost the size of my town crossing the border every week. it is absolutely ludicrous. this is why house republicans passed hr2 to secure our border act. chuck schumer, the senator from new york, has done nothing to pass that. >> aishah: respectfully, that house bill -- i understand the republicans in the house passed it. it is not going to make it through the senate. you have this never-ending loop that we hear of blame being passed between the white house, to congress, secretary mayokas

wants you guys to do something. you guys want the white house to do something. the white house throws it back to you. it is never-ending. can republicans and democrats -- do you think this year come together to put something together that both of you can vote on? >> respectfully, i will disagree with you here. the senate democrats have done absolutely nothing on border security. they have done nothing on immigration. house republicans passed hr2 months ago. when president biden came to my district westchester county in april, i specifically said to him mr. president, please work with speaker mccarthy to pass a border security bill. i am someone whose wife is an immigrant. i've been through the system. it is a fundamentally broken system and needs to be fixed. i signed onto the dignity act. the first bipartisan piece of legislation in over a decade to secure our border and reform our

broken immigration system. but if we don't deal with the border first, we're never going to get anywhere. you are seeing cities like new york have been overwhelmed after years of having a sanctuary city policy, they didn't give one concern about what was happening at the southern border. now that it's on their doorstep they are melting down because they can't handle the influx. so the deputy mayor was spot on. we need to deal with the border first. and chuck schumer, who is the senate majority leader who represents new york, needs to keith off his butt and pass a bill through the senate and all pass and the president can sign into law to actually solve the border crisis once and for all. >> dana: the pressure on schumer might get ratcheted up quite a bit and you are doing that. democrats are doing it, too. mike lawlor, thank you so much for your time today and i know senator cortez was ask about

facing questions about his age and health once again because of this. senator mcconnell appearing to freeze for about 30 seconds yesterday during a press conference. the 81-year-old had a similar incident when speaking to the press last month. rich edson is live from d.c. with the latest on what his camp is saying. >> good morning. this is growing scroti knee in washington over politicians serving into their 80s and 90s. mitch mcconnell froze up yesterday after addressing the northern kentucky chamber of commerce for 20 minutes. he took questions from reporters after the event. that 30-second pause happened after a reporter asked whether he would run for re-election. just before august recess mcconnell froze before reporters. in march he fell during a fundraiser and went absent from the senate for several weeks. president biden born the same year as mcconnell and the subject of republican attacks said he would reach out to the

minority leader. >> president biden: he is a good friend and i will try to get in touch with him later this afternoon. i don't know enough to know. >> mcconnell spokesperson said while he feels fine, the leader will consult a physician prior to his next event. congressman jim banks is running for senate in indiana and tweeted out the photo. wide ranging discussion with leader mcconnell about the future of our country. i look forward to working with him on issues confronting our bordering states. representative marjorie taylor green said severe aging health issues and mental health im competence in our nation's leaders. they are all examples of people not fit for office and it's time to be serious about it. just heard by the way from a spokesperson for senate minority whip john thune. he spoke with mcconnell last night and sounded like his usual self and was in good spirits.

>> aishah: he has a lot of supporters on the hill. >> dana: nevada tribal ranger who used his truck to plow through a climate protest is now under review. video also shows the ranger pulling a weapon on unarmed climate activists. it is not clear whether the weapon is a taser or gun. response coming after the protestors block the entrance to burning man festival. outkit host and fox news contributor. this is chairman james phoenix of the rangers. he said it is not like you are out in the middle of nowhere and no one else to be there. there are miles of cars. they have assist the police department because we're so small. protestors were preventing people from getting to work, to the festival and maybe the hospital, home to their children and meanwhile all the cars are idling all those emissions.

i think law enforcement handled it appropriately. law enforcement aren't able to do their jobs because there are so many procedures now in place. things that are appropriate. here is where i come in. they call them non-violent. if i'm trapped inside my car for a prolonged period of time in a scorching hot desert that to me is a threat and i expect law enforcement to step in and do their jobs. we know this is the same type of group and same type lgtbt community kick and scream when they don't get their way. someone has to do their jobs. pulling out a taser or weapon to get them to move it's what needs to be done. >> dana: consequences like this maybe these protests wouldn't happen all the time. i always remember that one guy who drove a truck during a climate protest. he couldn't get through. i'm on parole. if i don't show up to my job i go to jail. he ended up having to go back to

about kohberger's alleged alcohol and drug use. >> he could get drunk and aggressive and rowdy. he was trying to drive somewhere and we had to take his keys and had them. when i say aggressive. physically move in front of the keys and prevent him from getting the keys and started branching out to hang out with a different group. that group they did some sketchy drugs. >> aishah: none of this makes this guy look good, nancy. >> no, it doesn't. i doubt very seriously the defense is going to raise any type of drug or alcohol defense at trial because the law is very clear that voluntary use of drugs or alcohol is never a defense except in rare occasions. what i also find interesting about this friend. it goes all the way back to middle school. he apparently was frustrated and

angry with women and three of the murder victims are women. right now in the courtroom we are going to hear a big argument regarding cameras in the courtroom. the defense doesn't want them, although the constitution calls for a public trial and public now in 2023 means cameras. and they are complaining that various outlets focus on kohberger's face. the state and other parties to the hearing have shown reams and reams of video where it is not just about kohberger. other people are shown, lawyers, the judge. so i think they've got an uphill battle trying to get cameras out of the courtroom. >> aishah: can i be honest with you. when i heard you got this interview with the friend allegedly, i was just surprised this guy had friends. it seems like he is such an introvert and isolated and keeps to himself.

did he have a lot of friends with his social circle leading up to the murders? >> no, he did not have a lot of friends. and from what we know about this friend, they were friends early on in middle school and then somewhat after that and i think if you look at profiles of killers, including serial killers, you see as they go into puberty and become young men their anger grows and animosity toward women grows and festers until it boils over. he did not have a lot of friends. the first time he got in trouble is when he stole this i-phone from his own sister and stole it. >> aishah: you can catch so much more from this interview with this friend on your brand-new fox nation special brian kohberger i am blank. check it out, everybody.

thank you, nancy. >> thank you so much for inviting me. >> dana: always the best. supreme court justice clarence thomas releasing his financial disclosure report following criticism over the justice's travel and finances. lucas tomlinson has the details for us. >> this report is a prerequisite for all federal judges detailing their information about finances, investments, gifts and what nots. it comes past criticism and complaints over his travel and finances. the nonprofit news organization earlier reported the supreme court member has failed to disclose vacations, private jet flights and passes to sporting events over the years. they also reported that conservative texas billionaire crowe had funded some of thomas's vacations, the purchase of his mother's home and a nephew's tuition payments. the new report from thomas includes several updates and revisions to past reports including details on the 2014

purchase of a savannah georgia home of thomas's mother and real estate deals with members of the thomas family so she can live their rent free. after reviewing the records i'm confident there has been no willful ethics transgression and any prior reporting errors were strictly inadvertent. critics say -- he has never accepted a gift from anyone with business before the court. the lawyer also went on to say some of these reports were slack reporting and erroneous. not just justice thomas under scrutiny but sotomayor, her staff reportedly often prodded schools to buy her memoir and children's books that earned her a total of $3.7 million. earlier this week 112 of justice thomass former law clerks say

horrible. i see it on new york streets. people whose flesh is rotting away. listen to somebody in austin, texas officials on the tranq overdoses there. tranq is not reversed by narcan, for example. >> that's exactly right. >> in fact, there is not any available agent to reverse the effects of tranq. >> we know drugs in our community are mixed with fentanyl and mixed with tranq and we need to warn people now to save lives. >> dana: is there any hope of being able to find something that would reverse the effects of xylazine? >> yes, there is. we're working on that. the important message people need to use narcan because it does reverse the fentanyl part of the tranq/fentanyl mixture. i declared xylazine or tranq as a threat early this year for this purpose to get ahead of it rather than chasing drugs that we've been doing for so many
