government officials were communicating with hunter biden's financial firm. welcome to a new hour of "america's newsroom," i'm gillian turner. good to be with you, john. >> john: i'm john roberts. dana and bill both have the day off. we have the joystick in washington and not giving it back. >> gillian: not until 4:00 when we're both off the air. >> john: the lawsuit comes after the national archives responded admitted to having more than 5,000 emails potentially associated with joe biden's office. fox news cannot independently confirm hunter biden was copied on any of the emails. but there is a group suing to get the actual records. critics are asking why vice president biden would even use pseudonym email accounts in the first place. >> not only is that nefarious in its intent, it shows that they really truly want to hide

something. we went from joe biden saying that he never had a discussion to now joe biden having full and complete access of the white house and the vice president's office to hunter biden and all of his business associates. that's what they were selling was the access. >> john: david spunt is live at the d.o.j. with the latest on all of this. >> good morning to you both. listen, it is not unusual for public figures, especially politicians on both sides of the aisle, republican and democrat, to sometimes use aliases in emails to communicate. however, this group the southeastern legal foundation says what makes this different is because hunter biden was copied on several emails and there was business discussed and that's what they want out to the public and why they are suing the national archives. fox news, as you mentioned, has not independently confirmed

these emails. the southwestern legal foundation is waiting for them to be made public. they filed a last suit last month. the national archive have thousands of messages from joe biden's office. jrb ware. the national archives responded we have performed a search of the collection for vice presidential records related to your request and identified approximately 5,138 email messages, 25 electronic files and 200 pages of potentially responsive records that must be processed in order to respond to your request. however, a source for the national archives tells fox news there was a multi-year backlog for records and requests of this volume and told there are certain restrictions and the freedom of information act process for national security and law enforcement. beyond that hurdle emails from

the biden vice presidency fall under the presidential records act needing to go to representatives for the former vice president joe biden, the current president, joe biden again, and the former president barack obama, meaning likely it will be difficult to get these emails. i will note that the group the southeastern legal foundation asked for these emails more than a year ago. that's why they are suing saying they haven't gotten any substantial response as far as those emails and we'll continue to follow this, john. >> john: hopefully whoever is sitting on the emails at the archives will stand up and somebody can come along and grab them. we'll see. david spunt, thank you. >> gillian: let's bring in shannon bream now, the host of "fox news sunday." shannon, what do you make about the lawsuit? do you think -- i asked house oversight committee member nancy mace yesterday if there is still a chance the archives may turn the content of the emails over.

she said as far as she knows, nobody over there has said we are not going to do this. they could be dragging their feet? >> as often happens in washington sometimes the non-answer is the answer. everybody watches and waits. that private group that has the foia request unanswered since june of last year is one prong. when congress gets involved it is something different because this is now going to fuel only more of the gop talk about impeachment. they say if we can't get answers from these agencies and can't get things turned over that will push us towards more support for an impeachment inquiry. that's what this invites, this delay. we don't know it's stonewalling but no answer feels like that. >> john: in terms of an impeachment inquiry james comer said the other day looks like they are getting closer. listen to what he said. >> i think there is consensus in the conference now we'll have to go to impeachment inquiry. that will be speaker mccarthy's calls. but i feel like we're there now,

sean. i feel like it's imminent. >> john: impeachment inquiry is different from impeachment proceeding. >> you will start gathering information. these committees have subpoena power, a lot of them. the ones controlled by republicans in the house. so they are going to say don't force us down this path. if you give us the information and forthcoming and answer our letters, so many of those outstanding from jim jordan and others saying we need this information related to hunter and the president. they'll use the impeachment argument if we don't have to go there don't force us to go there. they will have different power when they start to move forward with that process. >> gillian: want to make sure we ask you about this supreme court development which is that justice clarence thomas filed his financial forms yesterday. reading into those, what do you make of the disclosures? >> well, there was an attorney elliott burke who was hired, a

private attorney by justice thomas to go through things and hired a cpa firm and wants to be abundance of transparency. we did learn some new things. the rules did change in spring of this year as to what you have to release. justice thomas's defenders say listen, many of these things were vetted before by the judicial conference and others and they said he never did anything improper. it's out there and explain why he took some private flights. that is not illegal or unethical. he says we're also going to continue these conversations with supreme court counsel's office and others to look at whether we may amend other years. he says they are trying to be abundantly transparent. the left says it proves that he is as corrupt as they claim he is. >> john: you mentioned elliott burke. he made a statement about all of this insisting that there was no wrongdoing on justice thomas's part and went on to say the

attacks on justice thomas are nothing less than ridiculous and dangerous and set a terrible precedent for blood sport through federal ethics reporting. listen to this. >> clarence thomas has wealthy friends that have been generous to him over the years. the narrative has been relentless against clarence thomas. there is only one fact that matters if you cut through the noise. harlan crow and these friends had no business before the supreme court. full stop. >> john: is that the line that you could accept gifts from people but if they have business before the court that puts it into a whole different -- >> you have all kinds of things you have to report based on where they are coming from. that had been what justice thomas said there were things that may not have been reported but didn't think they had to be. again that's one of the things

that came out of burke's statement yesterday. he never did accept a gift with anybody that had business before the court. crowe is conservative and have certain interests even if he is not the name on the case before the court. remember, there are justices on the other side of the ideological been much here who also had questionable issues have had to alter their financial disclosures, too. so pro publy ca is interested in specific justices but maybe not all of them. >> gillian: we look forward to seeing you sunday morning. >> john: she is laboring on a labor day weekend. student loans begin accrue interest today following a three year pause on payments. the biden administrations is looking for more ways to give costly hand-outs to borrowers. hillary vaughn is live on capitol hill. anything so far that passes legal muster the president can do? >> that's the big question here.

they are working to try to downsize people's monthly payments. that's something that a lot of people are able to participate in but while they are trying to figure out these other ways to work around the supreme court ruling, a lot of people surprised that president biden did not issue another hail mary extension delaying people having to make the payments after president biden spent the majority of his presidency promising he would forgive student loan debt entirely. here is president biden one year ago. >> president biden: my campaign for president i made a commitment that we provide student debt relief. i'm honoring that commitment today. using the authority congress granted the department of education we'll forgive $10,000 in outstanding federal student loans. >> that turned out not to be true. today uncle sam is coming to collect. interest starts accruing for millions of people who owe

student loans. payments start in october. the white house not giving up on sweeping forgiveness yesterday. the department of education says the they are recruiting people to a special committee tasked with figuring out other ways to pay off student loan debt that are legal. >> joe biden violating federal law. the same guy who ignored the fact you cannot pass through a student loan bail out. did it anyway. supreme court slapped him down. now they try to find a new way to do the same proposal. >> the biden administration making moves to help people downsize monthly payments that pegs your payment to your income and family size. that's going to save people some money but it will cost everybody else. penn wharton says it will cost $475 billion over the next ten years. >> john: that's adding up to real money, i think you could say. hillary vaughn on capitol hill. thank you. >> when you see him do not approach him.

>> gillian: a manhunt is going on in pennsylvania. convicted murderer got past guards at the chester county prison yesterday morning. he was sentenced the life in prison last week for the 2021 murder of his former girlfriend. nate foye is tracking the story live from new york city. hi, nate, what can you tell us? >> not only is this man convicted of murdering his former girlfriend in front of her two kids. prosecutors say he did that because she found out about another murder that he was wanted for in brazil back in 2017. authorities warn anyone who sees this 34-year-old to stay away and call police. he is five feet tall, 120 pounds. but authorities say he is as dangerous as they come. >> they had deployed canine units, drones and helicopters in the manhunt. if you see him, do not approach

gillian. >> gillian: nate foye in the new york newsroom. >> john: if you are driving this labor day weekend you'll face more pain at the pump. the national average for a gallon of regular gasoline is $3.82, just shy of a record $3.84 set back in 2012. phil flynn is a senior analyst and fox business contributor. we're down just a little bit. $3.82 today, $3.83 yesterday but close to that all-time labor day record high of $3.84 set back 11 years ago. everything old is new again, phil. >> it sure is. sadly so. i would have to say if it weren't for the fact we had a hurricane in florida, we probably would have broken that record. now it will depend over the weekend how strong the holiday is.

if we have any refinery outages we could still break that record. mainly because look at what is happening to the cost of crude oil. the major input into gasoline is crude oil. we hit the highest level today since november of 2022, over $85 a barrel. >> john: do you think pricing are peaking because the peak driving season comes to a close over the labor day or do you think they could still go higher? >> normally the summertime we burn more expensive gallons of gasoline. they call it is summertime blends like the starbucks of gasoline, more expensive. it becomes cheaper in the winter but the problem is normally we get a 10 to $0.15 a gallon drop when winter sets in. i don't think that will happen. we see a significant squeeze on global crude oil inventory supplies. they are falling dramatically and look like they'll continue to fall dramatically because opec is doing everything they

can to squeeze the united states and make sure our prices are higher and inventories are low. i'm afraid we still have significant period of time where gasoline prices will remain elevated. >> john: he was looking at where it was regular $3.88. >> it might be worth a vacation to see that. >> john: i have no idea. this really is hitting people in the pocketbook, though. fox news poll found 85% of people say gas prices are a problem for their family. and i don't think there is really any end in sight. one forecast said gas prices may stay high until after the election next year. >> they sure could. the biden administration has run out of bullets to try to fix this thing. last time gasoline prices went up they decided to use a strategic petroleum reserve to

lower prices. that worked for a while. but the problem is you can't keep doing that. when they did that, they actually discouraged investment in refiners and discouraged investment in oil production because they artificially lowered prices and now we'll pay the price for that. now demand for gasoline is high because prices were artificially low. we don't have the supply to replace it right now and why we'll see the new era of higher prices for some time to come. >> john: i feel like sit a stock market in reverse. the stock market will find any reason to go down. gas prices find any reason to go up. good to get that your take on things. have a good labor day particularly if you are traveling. hang onto your wallet, though. >> i will try to borrow somebody's electric car to save a few bucks, right? >> john: just don't drive it into saltwater. >> gillian: president biden set to observe storm damage in

congress to standardize the regulations since 2020. aishah hosni live on capitol hill with more. good to see you back in d.c. >> good morning to you, john. look, this is a pretty bipartisan issue. democrats and republicans see a national standard when it comes to how college athletes use their name, likeness or image to make money. whether congress will actually step up and do something is a completely different story. as we know from past experiences, they like to talk a lot about things like this and move very slowly on it. right now more than 30 states are forcing universities to comply by their rules which at times are at odds with the ncaa's rules. so far lawmakers have introduced more than a dozen bills, held eight hearings on this topic but we haven't seen a single peels of legislation get through a committee. we're tracking a big bipartisan efforts that aims to preempt most state nil laws, create a transparent nil database and

concerning behavior from our president of the united states and several members of congress and talking about the second oldest u.s. congress that american has seen since 1789. for goodness sakes the oldest member of the house of representatives was born before the invention of the ball point pen, the microwave off oven. we live in a constantly evolving world that demands a new generation of leadership and in your previous segment one of your guests said congress can't agree on anything. i might take fault to that argument knowing that congress can agree on the same small group of people holding onto power rather than giving a new generation a platform to lead. it is high time to consider not just term limits because of the risk of the consolidation of power in certain individuals and party leadership, but certainly age limits and encouraging young people to make their voices heard. our founding fathers weren't 80 or 90 years old on july 4, 1776, when they had a future of this country, 18, 19, 22, 25 years

old and get back to the roots of our great american story by plat forming the next generation. >> gillian: is it time for generational change, victor, as vivek ramaswamy is calling for? >> look, i think there are definitely reasons to be concerned about the age of many members of congress. what you saw from mitch mcconnell and dianne feinstein is concerning and wish them all the best. what you see from them is a fundamental difference what you see from president biden. president biden might be 80 but really sharp and active. you look at his record. you have republicans saying he outmaneuvered them during the debt limit deal and his record really speaking for itself. he have is 80 years old but so many things passed. things that president trump wished he could have gotten passed. like the infrastructure bill, inflation reduction act, lowering the price of farm suit call drugs. these are things that matter and young people see. a young voter cohort is more pragmatic than other generations. the type of action he is taking.

real aid into these communities like cedar key rather than standing up trying to make a political statement about chime at change. >> gillian: to the president's credit and gov for desantis's credit they are putting politics aside for the moment and communicating regularly and both said that they are working hand in glove to do what they can. that's sort of positive, right? >> certainly. i don't care if you are republican or democrat or independent, we have to come together as americans and help communities that are in need. you see that happening right behind me. as you can tell. to start making points about how to get this funding whether it's tied to ukraine funding or not, which as i have said previously is totally unacceptable. that's something that is going to have to happen, that conversation. putting americans first, people who lost their homes, their livelihoods. so many of these coastal communities are forest areas

where we have multi-generational families that have established their presence here. we need to put politics aside. come together as work as americans to get people back on their feet. this is going to take months and possibly years of recovery. >> john: as we saw with hurricane ian last year on the topic of ron desantis the country got to see close up how he handles crises and how he demonstrates leadership during that crisis. he has been knocked on the campaign trail for not being particularly warm and fuzzy. here is how the "wall street journal" saw it. they said hurricane ron desantis. if he can do the executive job maybe his skill at small talk is im material. can you give us your thoughts on that? maybe you are a little prickly from time to time but if you can get the job done that's really what people are looking for. >> absolutely. i feel like we have been living

through the reality tv era of politics. i call it -- where on both sides people continually stomp their feet trying to get attention. what we have seen through governor desantis is a no nonsense approach of helping people in their darkest hours. that's really what i feel. we need someone who is battle tested and i know both president trump and governor desantis equally well and friends with both. i have a feeling that no matter what the next president of the united states will hail from the sunshine state but at this point in time our country is in crisis. so we need to start looking to the helpers and really start focusing on doing what's best for americans and putting america first. >> gillian: before we let you go you are on the ground in cedar key, which is an area that was hit really hard by the hurricane. how are folks doing? >> i'll tell you, this is one of the most resilient communities all up and down and called -- the forgotten coast.
