hunter's business account, the business that joe had no involvement in whatsoever. so shouldn't come as a surprise the white house is now ramping up a war room to respond to an impeachment inquiry. they have dozens of lawyers on call. that inquiry is now all but certain. here now with reaction, fox news legal analyst greg jarrett and matt whitaker, attorney general. axios was reporting that kevin mccarthy said an impeachment inquiry would require a house vote. nancy pelosi didn't hold a house vote either time in the first impeachment or the second which was a snap. what do you make of mccarthy's insistence on a vote and does it change the process? >> well, it does change the process in a meaningful way. i mean, mccarthy it seems is going to be fair. there will either be a house inquiry committee or

select committee. it will have both sides on it. you recall in the first impeachment of donald trump, secretive hearings in the basement of the house. republicans were allowed to attend but that's about it. they weren't given subpoena power, couldn't call their own witnesses, they were limited and restricted in cross examination, so it was essentially a sham. then they didn't vote out of the committee but simply went to the floor where democrats had the vote. the second impeachment was even worse. they didn't even bother to hold any hearings. it was a snap impeachment. here i think mccarthy is determined to be fair. >> matt, you have been at the highest levels of the justice department, the highest level of the justice department. how common are government officials using one of the, a dot gov account, a couple g mail accounts, pseudonyms to pass information in government

to others, including hunter biden. >> well, good to be with you, pete. regular order is always the most important thing. i know when i took over at the department of justice that was my main mantra, regular order and i'm glad to see kevin is doing that in the house, unlike nancy pelosi who exercised sheer politics as gregg mentioned. the pseudonym thing is very interesting. typically, you know, it is known that the principal has one of the accounts so that they can conduct business without all of the pam that will come in. it is g mail accounts and multiple accounts that's concerning in this case. obviously we're just scratching the surface now, pete, on multiple thousands of emails that the vice president was sending to hunter, his son, including infor information, not classified but sensitive information about ukraine and other topics that hunter was certainly very

interested in for business purposes. >> for sure. gregg, the regular order as matt points out, it gives the power to whether it is a select committee or impeachment inquiry to subpoena records. are they going to see unredacted emails? would they see unredacted bank accounts? would they have a chance to get to the bottom of it, hence a war room being assembled in the white house at this point? >> yeah. i mean, look, yes, they would, if they use a select committee. they would have absolute authority to obtain unredacted alias emails, 5,400 joe biden was using over eight years as vice president. that's more than two a day. i think in there you're going to find some pretty astonishing information about how joe biden was working with his son in these influence pedalling schemes. you played a clip of it. he laughs it off.

bribery is an impeachable offense. the recent scandal contains evidence of influence pedalling which the criminal code describes as bribery, using public office to benefit exchange of money. bar is ma got a courtesy because of joe. and an investigation that vanished when he demanded the ukrainian prosecutor be fired. meantime, his son gets millions of dollars in return. that's the definition of bribery in the criminal codes. >> right there in the code, right there in the constitution. matt, if you turn to other channels now, it is wall to wall 18 month shots, atlanta, indictments, hearings, cameras in the courtroom, donald trump, donald trump, as it often is. how much legal jeopardy, though, are the bidens actually in? should there be an inquiry that connects the dots

that so far cable news and a few house committees had to connect? to what gregg said, this strikes to the heart of what it means to be the president, what it means to hold classified information, to use your influence. how far would this go? >> well, it can go a long way, and it is going to be the deliberate drip, drip, drip of an impeachment inquiry that's ultimately going to do the significant damage to joe biden and his presidency because if you remember in watergate, it took a long time for that case to build, a lot of shoes had to drop. i think in this case in particular, you know, as gregg points out, there's a prima facie case for bribery. as they build the impeachment inquiry brick by brick, the american people are going to learn a lot more about what joe biden was doing as vice president and how involved his son hunter was as the bag man and as the person

field considering where joe's poll numbers are, considering what he has got looming, considering what his opponent has looming, considering his capabilities, would you advice him to run or is it time to look to the bench? >> well, i would say this, pete. he has serious, serious negatives, both in terms of performance, ethics, and age. but that being said, he is tied with or slightly ahead of donald trump and as long as that's the case, the democrats will keep him as their neiman not turn to anyone else. part of the reason for that judgment is because most likely alternative is vice president kamala harris who if the numbers people believe, and i do, is weaker both in terms of her ratings and against trump than joe biden. >> doug, those numbers have tightened though, in

some battleground states trump has shown now ahead. is there a moment the political step in and say enough of this, we can't win this in '24? >> we're a long way away from that, pete. it could happen, but with donald trump facing four indictments and numbers that are almost as bad if not in some instances worse than joe biden, we're a long way away from it for pure political reasons. >> purely political reasons. nothing to do with competence and ethics, all political. tudor, you're familiar with one of the players. >> it is poll numbers. >> you're right. that's how washington works on so many levels. what do you make of her name being floated and others, michelle obama being another one. >> i think it is interesting. i do think the point of polls is good because joe biden is considered a moderate. he can still run on a moderate even though we know the truth about him, grich enwhitmer can't run as moderate, gavin newsom

can't, i don't think michelle obama wants to jump in. she's the threat they use, it makes the republicans scared. they don't like the idea of an obama running. they're already running things behind the scenario. she doesn't want to give up her life-style and run into the race. gretchen whitmer does. she has had a bad second term. state of michigan is falling apart right now. you're seeing this news as we speak about the unions suing the automakers because they're suing for unfair labor practices because they've come back and said we'll give you a 9% raise and unions want a 46% raise, and they're using her language saying we'll fight like hell to get equitable money for our workers. this is not a good look for gretchen whitmer when we don't have business in the state of michigan. gavin newsom has a similar situation with theft in california, the businesses that are leaving. this is not a good look for them.

i think democrats will say we would rather stay with someone we can pretend is moderate. >> gretchen whitmer has the same problem as newsom, a record to defend, quality of life to defend in that particular state. doug, say the poll numbers went there. who would it be? michelle obama showed no interest or very little in this, but if desperation struck and can't be kamala harris, where do they turn? >> i think first it would be kamala harris. she is the sitting vice president. and in polling my firm has done, she's well ahead of the field. if it wasn't, my money is on gavin newsom who has the interest, the money, and the energy. he would be my bet, notwithstanding the very real problems in california that i don't minimize at all. >> tudor, how much do these, what happened in

hawaii, he is going to florida tomorrow, we'll see how the president performs there, but these big emergencies where joe biden seems absent, and when he is there, he is flippant. you described him as a moderate. he hasn't governed as a moderate, i know that's how people view him. when it comes to emergencies and the governor of florida, ron desantis, stepping up, being all over it, over time does that add to his challenges? >> absolutely. i think as republicans get smarter how to talk to voters, how to educate, advertise these messages, i think this really hurts him. doesn't hurt him as much now, people that are hearing the news are hearing very little about hawaii sadly, because he is not there, it doesn't stay in the news. if we are able to get the message out, continue to talk about the vacationing over people's lives, people will recognize that he is not able to do the job. but it is not just that he's not there, it is when he is there, he says things like i had a kitchen fire, too, it was terrible. we're looking at people

that lost their lives. when you start to pull together what he does say when he is there, that's when people go wait, this guy is not capable of running the united states of america. >> doug, real quick on the other side, what's polling showing as pertains to former president trump as indictments have loaded on, as trial dates are being set. has it solidified republican support in your numbers, how has it changed him in a general matchup? >> it has solidified him vis-a-vis the rest of the republican field as the public polling is showing, and we've done a great deal of polling both nationally and in states, pete. in the general election, we are showing trump this week with a one point lead. clearly he has not eroded at all. the democratic case is based on the fact that they believe swing voters and suburbanites will turn against him as they did in 2022, 2020, and 2018, but that remains an open

plan, crime wave, and they're like the three stooges, what a disaster. so people are vacating new york. as illegals come in on the greyhound, there's another group of new yorkers heading to florida, even with the hurricane raging, georgia, north carolina, south carolina, virginia, texas, they're out of here. one day the empire state will be the illegal alien state at this rate. >> moving that direction. there's absolutely no doubt. sarah, what's the data point at the top of the show, august, highest number of family units ever crossing the border. why is that number going up higher than ever? >> because there's incentive. the government is incentivizing people to come across the border. it is extraordinarily dangerous. i spoke to folks in panama, going through the

darian gap, they told me there are a number of children disappeared into this dangerous jungle. not only is he incentivizing people to come into the country but we saw that was the same with numbers in july, around 245,000 i think nationwide, nationwide encounters, and about 200,000 just at the border. this isn't going to slow down, pete, this is going to get far worse. i think when we look at a serious note, it is in a way laughable. on the serious side of this, it is the american people paying the price. we know this border is being used by terrorists. we know that terrorists like isis, islamic state, al qaeda and others are looking at the border as an open siv into the united states. we don't know if we have sleeper cells ready to target us. who is going to pay the price for it if they do. the american people, our children, people going to the mall, people at soft targets. you know this well from

thank you for being here. brian, we are both from forest lake, minnesota, small town, you know. how are our neighbors of old, how are they feeling the biden economy, are they loving it? >> they hate it when they go to the grocery store and gas station, a lot of them drive trucks, pete, you know that. this is not ev territory. you don't have an ev charging station at every corner. you need gas stations to afford the gas. that's the problem. if you try to buy a house or car, trying to buy anything, watching interest rates go up, saying oh, my gosh, i can't afford this. my mortgage is now 7, 7.5%. car loan is 9.5%. my average car payment to buy a new car is $750 a month, pete. those numbers don't equate in parts of america where you need a strong economy to afford a family's life.

leaders of the city and state believe those things. i believe you're out of los angeles, you're living this scenario. what's it like? >> it's going about as you think it would, and as a matter of fact, here in the state of california unbelievably to address the rash of smash and grab and robberies and violent crimes that has been plaguing the state, our state assembly has suggested a bill to help store owners, particularly small convenience store owners, guard themselves against crime. guess what the bill does, does it stop the criminals? does it punish criminals more harshly? no, it makes it an offense for a store owner to defend their property while being robbed. not to mention it now creates a new bureaucracy where store owners have to fill out reports, fill out paperwork to send to the state so the state has all the proper statistics.

bad in seattle, really be that bad in san francisco? could it get worse, too, if bills like this take hold? >> absolutely. i think it can get worse. you're looking at specific scenarios in certain cities. it seems like we are watching san francisco, for example, die in real time. i think it is getting to the point where i don't think it can turn things around. we have certain scenarios going on here in seattle, in portland, chicago, atlanta, d.c., the list goes on and on. as i was doing research for my book, i kept hearing from people telling me i was making everything up, especially here in seattle. like oh, what you were reporting on, despite chilling video, i was told it wasn't really happening. and i am surrounded like kira and so many others, people who pretend what we're saying is just figments of our imagination. you have local leaders that refuse to acknowledge a problem, you have activists that say all is well, if you don't like

it, go somewhere else. sorry, i am not going to be kicked out of the city i live because you're too lazy, ideologically bigoted to say no to any circumstance, any solution to what's been going on out on the streets. >> kira, what communities does this end up disproportionately effecting most? >> that's easy. the minority communities are disproportionately effected. los angeles has a huge latino population, even in areas where the black population is suffering, they're always the ones to suffer first. now, it is not a secret that the black community in the united states acted like a canary in a coal mine for many years for the rest of america. some of us saying for years, republicans, democrats, if you don't address various serious issues in our own communities, it is going to spill out into the larger america, into larger america, and it has. so it was so predictable.
