i certainly enjoyed it. but i guess the sequel is playing out now in real time, right? people who know the story do not know what to believe would you say it's the truth in the middle somewhere? >> i definitely would. i enjoyed the movie as well. i was under the impression the tuohy did adopt michael after hearing about this controversy going on now there's a lot of questions in my head. someone is granted conservatorship over someone usually the person who is bound to be incapacitated would know that because they have to be evaluated by two different doctors for the doctor has to find this person is unable or lacks the mental capacity to make decisions about their health and finances. then they also have a court appointed attorney to make sure who's seeking the conservatorship is doing what is in this person's best interest. i find it kind of shocking michael had no idea and the seas that incapacitated he would not have a member those things.

itsuper that's a good point anda good question we have the state statute on that if we could bring that up right now. it talks about what is necessary for a conservatorship. i think we may have that, there you go to the court must find by clear and convincing evidence the respondent is fully or partially disabled and respond is in need of assistance from the court before a fiduciary can be appointed to exactly what you just said. is there any evidence that anyone knows of that he was in need of medical assistance? >> no. i've done my own research i cannot find anything. i do a lot of conservatorship cases in my practice normally the person they have autism are have dementia, or some type of serious mental illness where they definitely it is clear they cannot make these decisions. so the fact i cannot find anything about michael's condition, it does give to a lack of credibility on how they

even obtained it i would love to see the judgment because it has to have all those details and it to indicate what judge found it, what the appointed attorney stated and the opinions of the two physicians did the evaluations. anita: a lot of unanswered question there also the question whether he was told by the family that he was too old to adopt at the age of 18. but tennessee is one of many states that allows older adoptions let's put the list up on the screen through see the mass and the list and tennessee is on that they allow adoptions over the age of 18. now i want to be fair to the tuohy family and give them a chance to respond their lawyer responded to this question of adoption versus conservative. when his lawyers said was that the family said they did not care whether it was an adoption or conservatorship they just wanted to bring michael into their family to do you have any
1:51 pm
thoughts on that? >> i find that to be very suspicious. number one if you have taken the person into your household come into your family most people do adult adoptions and want to finalize it and make it legal so they can forever say this person is our son. also it is so much easier to do the adoption and once he becomes of age or when he's willing to be independent that is that they are done they cannot control anything with a conservatorship it is so strict it is intrusive it does not give him the ability to make any decisions indefinitely until it is overturned which is what he's doing right now are trying to do right now. >> is also asking for a number asking for number ofdocuments he records showing how that money was spent, who got the minute with you got the same amount of money as the family, so many questions but we are running out of time rate thank you so much for coming on with us we would back with you on this topic
