tsa says more than 14 million americans are expected to get on plane. that is 11% more than last year, and higher than back in 2019. aaa says that shows there is still a huge pent-up demand for travel after the pandemic, especially when you consider that inflation continues to be a major factor for most families. >> choose not to travel for a holiday, and it can be because of inflation, gas prices, could have been covid. but we are not seeing anything that is setting anyone aside and not getting on the roads or a plane. >> the roads are expected to be bugs i today, since more than 85% of aaa members in one survey said they planned to drive to their destination, airports are seeing a lot of foot traffic, there have not been the widespread delays or cancellations many passengers were bracing for. >> no, i expected more. more than what there is. >> so far so good.

nevada. hi, max. >> we are in gurlock, nevada, the closest significant town close to black rock city, and a steady line of muddy vehicles and people coming out, as officials with burning man open up escape routes for tens of thousands to get out. over the weekend we saw a lot of rainfall here in the nevada desert. this closed down roads and officials with the sheriff's office say one person is confirm today have died during this rain event. they are still investigating that death, but they have not provided many details about it, and they said the victim's family had been notified but really nothing else, whether it was weather-related we don't know. organizers say mobile cell trailers have been placed around the event to boost cell signal, and ensuring that portable toilets are clean and firefighters and ems workers

gate after the event unexpectedly reached capacity. wow, the mess happened after organizers said that ticket holders would be turned away but that was not the only issue. day one of the festival was canceled right before it was set to begin and day two started several hours late. some outraged fans calling it the worst concert experience of their lives. oh, my goodness. yeah. that's got to be disappointing. >> new details shedding light on new york city migrant crisis. 41 migrants reported arrested outside the roosevelt hotel since may when it was turned into asylum seekers. and the mayor is asking for federal help to manage the overload. mike lawler joins me now. congressman, thank you so much

for talking to me today. you know, eric adams, as well as the governor here in new york, have both been asking the biden administration to help with these work permits, to get things processed, waper work filled out. biden administration says they are sending teams here this month. do you think that's a good idea? >> look, we could speed up the work authorization but it's not going to solve the problem here. since joe biden became president, you've had over five and a half million migrants cross the border illegally. many asylum cases are taking 2 to 3 years to be heard and when they are heard they are rejected. 70% of them. in new york city, a sanctuary city, they have taken in over 100,000 migrants since last year, and so they can't handle the overload. and so just, you know, expediting the work authorization here is not going to solve the problem, even the deputy mayor of new york city

admitted unless we deal with the crisis at the border, the problem is going to persist in new york city, and so the governor, governor kathy hochul and mayor adams have been woefully inept in dealing with this. senator schumer, the senate majority leader has done nothing as the leader, house republicans passed secure our border act, hr2 in april. this is an absolute disgrace what has happened and the failure is on the part of the white house and the governor and the mayor as well as the senate majority leader who refuses to do anything about this at all. >> congressman, you don't just have a crowding problem here in the city. you also have a growing crime problem with the migrants who are coming here. one example here, a man from venezuela, he's been here two months. in the past two months, he has

been accused of assaulting three strangers and two police officers. he has been arrested and released six times. now, your district is just outside of the city so you have constituents coming in here and commuting to go to work. what are they telling you about the crisis? >> well, this is a failure of democratic policies. open borders, sanctuary cities, cashless bail, and a refusal to cooperate with immigrations and custom enforcement. it's an absolute joke and voters across america are seeing the result. this is what happens when you have really bad policy coupled with really inept leadership. as far as i'm concerned, not only do we need to end the sanctuary city policies, we need to end cashless bail but need to enforce our laws. we are a nation of laws and yes,

a nation of immigrants, too. my wife is an immigrant, i've been through this process, it is a fundamentally broken system that needs to be reformed and i signed on to the dignity act. unless we get control of the border, having a legal process that works, we are going to continue to deal with the chaos and when you see the fact that people are being arrested and released as illegal immigrants coming to this country and put back on the streets to cause more harm, that is an absolute dereliction of duty, but also exposes the failure of these laws that have been enacted, especially in cities like new york, and now the chickens have come home to roost and they are ranting and raving, screaming about the crisis that is of their own making. >> congressman, switching gears here, you and your colleagues will be heading back to d.c. at the beginning of next week, on

friday house speaker kevin mccarthy said impeachment against president biden would only move forward -- you live in a district that biden won the last go around. what does it do for you, how do you think you would vote if that happens? >> to me this is something that needs to be based on the facts, and the evidence. impeachment in and of itself is a political act, but it should not be political, it should be based on the facts and the evidence and if it is warranted. obviously there are multiple investigations that are underway with the house oversight committee and the house judiciary committee. those investigations have produced a lot of evidence of wrongdoing. certainly with respect to hunter biden and some members of the biden family. the question so me ultimately is whether or not the then vice president was involved in any

capacity, and certainty if he somehow benefitted from those deals with russian and ukrainian oligarchs and the chinese, certainly that would be grounds for further investigation and an inquiry. as i have said, we are not there yet and i think it's incumbent on everyone to make sure that we dot the is, cross the ts, and the facts and evidence are there. i am not looking to go down a poli political issue here. the democrats made everything political in the prior administration. it does not serve the american people well so we need to make sure the facts and the evidence would warrant further action. obviously when we get back on september 12th i'm sure there will be a lot of discussion internally about this. but i think it's imperative we make is your that it's warranted

could larry hogan say i'm a stronger candidate? >> if you look at polls of support for trump right now, it just seems like this is inevitable that he will win the nomination. 70% said they would back trump for the primary. and the support does not go away even if larry hogan were to mount a bid for a third party. trump is not necessarily weak to a third party challenge. it's joe biden particularly weak from someone like larry hogan or joe manchin, potential option for the no labels group. >> what about that, david. concern mostly for democrat, same question to you on the democratic side. this group no labels says it will only put forward a candidate if both sides look weak. how does president biden look? >> yeah, well, i don't see how no labels could be anything but

a spoiler. and will it be a spoiler for the republicans or the democrats? and i think that's yet to be seen. it will be who is the candidate that they put up. they keep mentioning these polls where they have a generic candidate doing well. well, you can poll a generic candidate but you can't vote for a generic candidate. once you put a face on the name, you have a name, you have someone that has a record, that's -- they have their pros and their cons. in this political environment those cons will really be weighed heavily. so, i think it's a kay who that candidate is. larry hogan is not an exciting candidate. joe manchin is not really an exciting candidate. i don't see them getting more than 1 or 2% of the vote, but that could be enough to swing the election. polls are showing biden and trump neck and neck. any deviation from the election could mean the spoiler goes in

that direction. >> anita: put up a poll here, head to head match-up between president trump and president biden. it's a dead heat. so, if you have a third party candidate in there and president biden starts to struggle in the polls, i mean, a lot of people point to the fact he forgets people's names, sometimes he looks confused on stage. is that enough to make someone like larry hogan or joe manchin look a little more attractive and kaylee, go to you first on that. >> no label sees a path to victory because so many polls show the american voters are fed up with both joe biden and donald trump. basically everyone polled said they don't want to support either candidate and one recent poll found 47% of americans said they would consider supporting a third party bid and this one recent a.p. follow, when voters were asked describe of the leading candidates, they called

biden old and donald trump corrupt. is this the best we can do? are these really the only options we give voters? many swing voters say we may take a look at a different candidate. >> anita: david, another poll and then you first. this is the poll showing the enormous lead that the former president has against the other primary candidates. there doesn't seem to be any weakness there. when you look at that poll, is there any doubt in your mind that he's going to be the republican nominee? >> no, i think polling tells us, look, trump is far, far ahead. now this is a generic, nationwide poll, does not show how he's doing in iowa or new hampshire. but unless there is something that happens, it looks like trump is going forward, looks like biden is going forward. but of course, we are a few months out from iowa, from new hampshire, so anything can happen. but, i think -- i was going to

say, these candidates have been through the ringer. donald trump, we know his pros and cons, joe biden, we know his pros and cons and yet the american people is still split between the two of them. i don't know how much more you are going to poll away, i think the base support is strong. and any deviation, 1% here or the other side, could mean a spoiler effect and that could dictate in terms of who the candidate is. biden is strong in his base and trump is strong in his base. the fight is for the middle but i don't know who left is independent any more. >> anita: we'll have to see what happens with this no labels and if they are serious, if they put a candidate forward we'll be watching it. thank you for both for coming. alicia. and remember, the next gop debate, don't want to forget

to the white house this evening. anita. >> anita: i know you are going to ask about it next week. we look forward to that. thank you, peter. >> alicia: we are seeing a late summer surge in covid infections and hospitalizations and some health officials are once again pushing for a return to masks. despite recent studies that suggest masking made no difference in transmission rates. dr. anthony fauci was pressed on this over the weekend. >> what about the studies that persuaded policy makers to impose mask mandates, convinced by studies flawed observational studies. how do we get beyond that finding of that pick review? >> yeah, but there are other studies, michael, that show at an individual level, for individual. when you are talking about the effect on the epidemic or the pandemic as a whole the data are less strong.

>> dr. marty makary, thank you for being here. see folks listening and watching at home hearing it's possible that mask mandates or recommendations could come back, there are studies that say it really wasn't that effective. fauci has gone back and forth. >> the study the interviewer is asking dr. fauci about is something called the cochrane review. it's a summary, 150 studies on mask, found they had no impact on community transmission. it does not mean if you put two people in the room and tight fitting n95 masks for 20 minutes that you are not going to reduce the risk of transmission, it's believed it does. but on a community level, when we tell the population, tell kids in schools, including toddlers to wear masks it had absolutely no impact on transmission. so, dr. fauci did not refute the

study, did not try to poke holes in it. he created this arbitrary delineation there is individual masking and community masking and individual may work and community may not, but we have spent energy and time arguing over masking. it has an intervention essentially no benefit whatsoever but we live in a blind allegiance to certain public health officials and that's the tragedy of it. >> over the course of the last few years, folks have decided they have to make their minds up for themselves. but dr. fauci did say he hopes people follow recommendations. those are not requirements but can you imagine a scenario in which a mayor, the head of any kind of other municipality, a governor getting up and saying it's time to put masks back on? >> generally they read the tea leaves of public support. i don't see it coming from government officials except in certain states where masks are

popular and rewriting their own history on covid. dr. fauci so making some space between him and the cdc. he's been doing this a lot in the last 6 to 8 months, arguing the cdc has their recommendations and he's supporting them, or that's them, and not me. my concern is you have so-called experts that are citing conclusions and studies when they like those conclusions even though these studies are flawed and completely ignore the studies like the cochrane review that gives them results they don't want to hear even though they have very strong research methodology. >> you make that point, folks i think are just so doubtful these days and it's really hard to decide what to do. and on that, can we just talk a little about the new variant, and put up a map, and see where it's been detected. a handful of states in the

united states, it is increasing in number, when it comes to the number of patients. can you tell us what it looks like, how it's different, what people should be doing and what they should be concerned about? >> i think they should consider this to be one of the many common respiratory viruses that circulates and is circle. b8286 is incredibly different from the prior covid variant, it may not care if you have antibodies to one of the previous variants. but the laboratory data is suggesting it's not more dangerous, it's not more pathogenic or more transmissible. the biden administration is about to push a newly designed booster in about eight days from now. they are going to recommend it for everybody age 12 and older, with no human outcome data in a

another shooting. birmingham police have not said whether the two are connected but what one witness had to say. >> i seen the tahoe go up in the emergency exit at a high rate of speed and the dodge blue car pulled up behind it and before they could get out, the guys in the blue car jumped out with long rifles and just sprayed the tahoe up and shot it up, totally shot it up. hit the police car, just -- they weren't trying to hide, it's scary. >> it's unclear why the shooter or shooters targeted the chevrolet tahoe that was heading to the university of alabama birmingham hospital. believed to have carried victims who were hurt after shots were fired outside of a lounge. at least five people were hit in the initial incident which happened around 2:00 a.m. jefferson county coroner's office released ages but not the

it up to people who make under $55,000 as opposed to those who are making $35,000, that's quite a jump. retail and hospitality groups are saying it's going to break them, way above the rate of inflation. what do you think about this? >> i think they are right. this is an enormous increase, it's a huge additional cost that small businesses are going to have to shoulder at a time we have seen record small business bankruptcies, so many struggling to keep their heads above water. we are going to add to their burden. why? because those in washington with very little experience running a business are telling businessmen and women how to run their operations. it's ridiculous, and will hurt workers, not help them, it's going to put more small businesses under and make it

harder for them to employ low wage workers. >> anita: many are still getting back on their feet from covid, and a large group of people want to work from home, and they are demanding higher salaries, some employers are forced to pay. how are they going to survive? >> they are going to have a tough time. we see large businesses react to higher labor costs by investing in technology, automation. they can find a way around the high labor costs because they have more capital to bring to the equation. the small businesses, they just have to fend for themselves. very little recognition of the additional hardships where we have seen labor costs go through the roof, that's good for workers, it's tough on small businesses, and we have to be a lot more in tune with the needs of small businesses as a government, unfortunately the biden administration has absolutely not followed that lead. they have made it harder, not

easier, for small businesses to succeed in what's been a tough economy. >> anita: my understanding is this is a proposal rolled out by the labor department, does not need congressional approval so likely to go forward. i understand president obama had a similar proposal and it was struck down by the federal courts in texas. is this going to end up in the courts? >> it will end up in the courts and obama rule was successfully struck down. we don't know what's going to happen in the judicial system, it's unpredictable, house republicans can stop the proposal through a spending bill, through the appropriations process. insert language to say that the department of labor should not move forward with this proposal. unfortunately, republicans have had a tough time getting out of their own way, a difficult time
