educated voters are now looking more and more similar to democrat numbers among white working class noncollege voters that's something very dangerous for them. the reason it hurts them for particular areas in our political map and ways impossible to recover from. if your coalition becomes a bunch of white elites and college kids, then you're not going to be able to have the kind of coalition that joe biden was able to form in the past usual not going to be able to see the down ballot results need to hold things like the senate. they are losing working class, hispanic, black and working class voters in a way it should be stunning to the party elites and the "new york times" admitting that tells you how far gone this is. >> laura: that was wild. mollie, i think this owns the door in such a wide way for the republicans to walk right through and said this is what they have done to your cities, your schools your country. is this the horse you want to

immigrants now housed here at the roosevelt hotel by the city of new york courtesy of the taxpayers have been arrested here. the violence has broken out. a lot of domestic violence here. but there have been other offenses. officers hit over the head with parking signs. employees struck. this is apparently a reoccurring theme they roosevelt. you will notice these scooters, mope heads, they have strewn the streets on all sides of the roosevelt but they have no licenses. if you look at the back, there is no licenses on these vehicles. they are all unregistered. now, what are they here for?

numbers the party elites do not trust their own voters. >> under the 14th amendment he is not even allowed to run even though he hasn't been convicted yet. >> instead of concentrating so much on the indictments, i mean i'm very excited about them myself, i definitely think 14th amendment all the way just prevent him from running. >> okay. >> laura: she is a renowned constitutional scholar. joining me now jonathan turley professor of law george washington university and fox news contributor. professor, does getting left leaning state attorneys general as adam schiff was referring to, getting them involved here, does that give this wacky 14th amendment strategy any more heft or credibility? >> i don't think it does. you know, there are academics that have thought about this seriously and have supported this theory. i think it's the most dangerous theory that has emerged in decades. i think it's entirely

unsupported by the text and the history of the 14th amendment. this provision was written after the civil war of an actual rebellion where hundreds of thousands of people died. there was an army on the other side. they had their own foreign policy. that's a rebellion. now, that doesn't necessarily mean that it can't be used for anything that isn't of that magnitude, but it is notable that trump has not been charged even with incitement, let alone rebellion or insurrection. yet, they say that this doesn't even require an act of congress that any judge can simply announce that he was supporting an insurrection and that he, therefore, disqualified and voters will not get the choice of whether to vote for him or not. that's what makes this so dangerous. i don't think this will withstand review. they could end up getting a couple of judges to go with them. but, in the long run, i think it will be rejected. that's why i'm eager for them to take it to court so we could

finally put this on the road and see if they can take -- you know, get this off the ground. i don't think it will. >> laura: i can imagine what justice alito and a few of the others would say about this. i mean, talk about anti-democratic. this is the ultimate anti-democratic move that you could think about. like it doesn't matter what the people want. whoever the nominee is, if they want trump, if it wasn't trump, you know, desantis would be, you know, they try to charge him with kidnapping the migrants and sending them to, you know, massachusetts or, you know, california. i mean, you can see that this would -- could go in a lot of different directions, none of them good. >> no, i mean, this is comforting tale to tell liberal children at night so they can sleep restfully, you know, donald trump will not be on the ballot. but he will be on the ballot. the thing is this thing was written after the vice president of the confederacy showed up in congress to retake his oath. and people were just a bit

peeved about that. because he had taken that oath before we have all have disagreement what january 6th was. it was a horrible day. a desis he scration of our constitutional system. in my view. and in the view of a majority of people polled, it was a protest that became riot. i don't believe it was technically a insurrection. should we have a system where any judge can just takes a riot like that and say well, in my view it was an insurrection you aided and abetted it by not responding fast enough using rhetoric that was inflammatory. that is a very dangerous theory and it would be replicated over and over again if we allow it to be accepted. >> laura: to that point, jonathan, arizona's secretary of state let slip what an important detail about the broader

implications of this 1st amendment strategy. watch this. >> section 36 the 14th amendment is a radical and sweeping proposition. this isn't just about one person and one office. >> um-huh. >> this is about everyone who is running for any office in the united states of america. >> laura: so, look, if they can use this against trump, what stops them from finding that someone else supported, you know, refresh your recollection -- insurrection that wasn't an insurrection? so you can see where this would continue to leapfrog against other potential races. >> that's right. and the ambiguity within this theory is quite maddening. if trump had asked people to come back an hour earlier, would that have been not an insurrection? if he had mentioned go there peacefully three more times, would that have made the difference? we need a bright line rule. raskin and democrats tried to

16-3-0010, cdr code 0116, verdict, guilty. >> laura: now the nation was rivetted by the story for all the reasons you would expect. the prominent southern family, two murders, big money, drugs, and, of course, mystery. alex murdaugh placed at the scene of his wife and son's killing by an audio recording from his dead son's phone. but now murdaugh's attorneys say that he deserves a new trial because of jury tampering allegedly by the clerk that you just heard reading the verdict. >> that the clerk of court would go in to the sanctity of the jury room before he testified and tell the jurors don't be fooled by his testimony, watch out for his body language, and if that is true, which we have every reason to believe that it is, and no reason to believe that it's not, there is no choice but the courts to grant a new trial. >> laura: joining me now martha mccallum editor and executive

editor of "the story." she just spoke with murdaugh's surviving son buster for new fox nation series "the fall of the house of murdaugh" available now on fox nation. all right, martha, this is wild. what else did murdaugh's attorneys claim that this clerk did? i know there was a facebook reference and juror 630. i'm devouring all this information but tell us. >> martha: yeah, we always knew that dick hoorpt and jim griffin were going to appeal this case, laura, they said that as soon as it was over. we thought it would be along the lines of the judge allowing all these financial improprieties to be part of this murder case. but what we got today was something completely different. it was based on becky hill's book. she released a book of her inside story of this case. she really became kind of a character in this whole case and the narrative of it. so she released this book and it talked a lot about what happened behind the scenes. and that gave harpootlian and

griffin an open door so they started going through that door based on things that she said, like this, for example. we all remember, laura, when they went to the scene of the crime right before they started deliberating. she says when all of us at the -- from the courthouse, law enforcement or the jury went to moselle, we had an epiphany and we shared our thoughts with our eyes. at that moment, any of us standing there knew, i knew and they knew that alex was guilty. okay. so she is talking about communication between the jurors. there is two jurors who say that -- who told harpootlian and griffin they knocked on every jurors' doors two of them indicated that she indicated to them don't be fooled by alec murdaugh, she also indicated to them according to their sworn testimony, look, this isn't going to take long. and then they also say that she wouldn't allow them to take smoke breaks during deliberations that they couldn't smoke until they were done. now, this is their side of the

story. we'll see what about when we hear the other side of the story. it could be very, very different. this is what we got today from the defense attorneys, laura. >> laura: isn't there is a claim, also, that a juror was dismissed for of incorrect grounds? that's another claim that they are making? >> martha: yeah. this is a wild story. this juror, the story is from the defense that becky hill moved to have a juror removed because she saw something on facebook that said that the juror's ex-husband was indicating how this juror felt about the case. she went to judge newman, they hard it out. they ended up removing this person from the case but griffin claims that the post was not from her ex-husband at all. she hadn't communicated with him in 14 years, and that she was removed improperly from this case. but, you know, as you know better than anyone, laura, we're still going to wait to hear, and there is absolutely crickets coming from the prosecution so
