mayorkas, james comer gave the details to brooke singman, who join us. >> brooke: chairman comer reached out to dhs and secret service? june as part of investigation of the hunter biden investigation. comer is subpoenaing documents from homeland security alejandro mayorkas and two secret service officials and three officials from dhs. comer says department of justice initiated the cover-up and dhs is complicit in it. investigators were never able to interview hunter biden during the criminal investigation because secret service headquarters were tipped off about the plan interview. this alleged tipoff happened in december of 2020. hunter was being investigated for two misdemeanors, failure to

joe biden on the stand. there was a clear threat delivered to the doj around the same time. again, better question is who was not involved in this? hope we will get to the bottom of that with the subpoenas. >> todd: that is the question, you wonder how far the cover-up goes, doj, fbi. what i'm confused about, what does alejandro mayorkas have to do with hunter biden? why was he subpoenaed? obviously comer knows something, care to hazard a guess at why alejandro mayorkas? >> he could be directing the secret service to inform the biden team. there are a lot of layers and alejandro mayorkas has been biden's point man on the border crisis, is it shocking to believe he is the point man on other allegations? the real question for james comer, are we going to enforce

the subpoenas? if these people fail to comply to give a deposition, that is a misdemeanor, they could be charged with contempt of congress. do republicans have the spine to enforce subpoenas and make it happen? >> carley: there is this push to launch impeachment inquiry into joe biden and that could play well at home for congressional republicans. others say that would only juice joe biden's campaign. what do you think about that? >> it is a difficult balance. impeachment inquiry never go down well in the public. this scandal may be so important republicans need to bite the bullet and accept swing voters aren't going to like it, but the public deserve transparency. >> todd: we cannot have a president when he was vice president exchanging policy for money thachl cannot happen.

a criminal defense attorney joins me now. if these allegations are true, how catastrophic is this for the prosecution, which i should add, did nothing wrong here. >> right. good morning. it is a gut punch to the prosecution, if true. i heard here is post-judgement motion sake which criminal defendants do all the time, they have nothing, but time. these allegations are stub stanative and damning, i can only believe the lead prosecutor is not happy. they did nothing wrong. this elected public official was leaning on the jury heavily during the trial, at time murdaugh was testifying, during the view of the property and during the deliberation. >> todd: hill, court clerk, allegedly told jurors not to be

fooled by alex murdaugh's testimony. regardless of whether you think he did this or not, it is nobody's job but the lars in the courtroom to convince jurors one way or the other through opening and closing statements. it is not the court clerk's duty, it is exactly the opposite of that, it is unconscionable that she did it. have you ever seen anything like this? >> i have never seen anything like it, i would venture to guess the prosecutors have never seen anything like it. the prosecution is going to try to uphold this verdict. the process matters and the process has to be fair. no matter how overwhelming the evidence was, no matter how overwhelming the judge says the
