is he supposed to get into the 747 and fly to germany and then on to india. whether a if he tests positive this morning? >> steve, carley and brian, good morning to all three of you. the white house is not engaging in hypotheticals about what would happen if i he were to tet positive today. not answering a lot of questions what would happen if he was overseas. they say they are following cdc guidelines. but the president certainly knows people are watching how both he and his staff are handling all of this after his wife tested positive for covid earlier in the week. he was at an event yesterday here at the white house. and he appeared to poke fun at the large amount of questions his staff is getting about covid protocols. listen. >> explain to the press i have been tested again today. i'm clear across the board. but they keep telling me because this has to be 10 days or something, i got to keep wearing it. but don't tell them i didn't have it on when i walked in. generally though, don't they give the press a heads up hey, by the way, after the president presents the medal of honor to this 81-year-old man he is going to leave early because of covid usually what will happen in events, ladies and gentlemen, please stay standing or stay where you are until the president leaves the room. that's what i have seen at least at a number of different events; however, as you can imagine, just like with live tv, anything can happen at events. we have seen, just all sorts of things happen. you can have the best laid plans and everything can fall by the wayside pretty quickly with this event, the president left. there was no hubbub or chaos that followed. there are still questions about why he chose. >> carley: can you see one of the recover froms in the video looking at him why are you leaving right now? and he gave his speech, he hung the medal of honor around captain larry taylor's neck and then everybody was applauding so it seems pretty clear to me that

the federal government says no, that no longer is in effect going to be charged sproshed development in this case only such small part of what hunter biden was facing what we look at in these case what is is the most readily chargeable offense. what is the most seriously chargeable offense prosecutor's standard. now we are left with a few random charges a couple misdemeanor taxes which weren't talked about in this hearing and then this gun charge the government already offered diversion. i can't imagine if i'm defending hunter biden they are not screaming up and down and asking

for that deal again. >> carley: other things david weiss special counsel when he wasn't before and he was willing to enter into a plea deal with hunter biden now he has to be special counsel some people are speculating that it's because of that would give him authority to send these charges to another more favorable jurisdiction and hunter biden could possibly walk away with just probation. do you think that's a possibility? >> >> in this case like no other case ever seen. as you know i was u.s. attorney like mr. weiss. and have a lot of experience in these types of cases. what i know is that no one, that we prosecuted in my district ever got this kind of a sweetheart deal. but, you know, we'll see, you know, allegedly, special counsel weiss complained about not being able to take his cases where they should have been prosecuted. now that he has that power, there is no indication that he is actually using those powers to go prove these cases up where he needs to take them.

>> carley: california, d.c., no jail time for sure. >> brian: and we want to see how many more millions of dollars he was dealt with james comer is pursuing on that end. cnn poll came out this morning they said do you think that joe biden had any involvement in hunter's business dealingsing in ukraine and china while serving as vp? 61% in the cnn poll said had some involvement. # #% not. you know what? it gives me a good feeling, matt, that there is a logical -- there is a logical american public who understand no one -- we have -- we have put scrutiny to this. there is circumstantial evidence to this. there is a guy hunter biden saying my dad is sitting next to me and is not happy and we're not going to forget to a chinese official. we know about the long dinners with the burisma officials. we know about the interaction from devon archer from the dubai -- the dubai meeting with burisma where he got d.c. on the phone. it seems like the american public is beginning to figure it out.

>> yeah. it does. but, 40% still believe that joe biden wasn't involved, even when hunter biden tells, you know, his most closest family members that he gets half of his income to his -- gives half of his income to his father. there is obviously a long way to go here. there is a lot of circumstantial evidence that shows that joe biden was benefiting from hunter's deals. and i think the house and their work is very important. but, 40% is still the base of the democrat party that don't believe there is anything wrong here. >> brian: the independents and undecideds that make up more than what donald trump got in his vote. >> steve: hey, matt, let me ask you an exit question that is it was last year the supreme court gave people the broad right to carry guns outside the house. they struck down a new york city law as you remember. hunter biden's team says, essentially, that that could derail the prosecution of that gun charge. is that a possibility? >> it's not. and, steve, what we have here is

obviously the second amendment, you know, gives lawful citizens a right to carry firearms. and, you know, the supreme court has been, you know, defining where that line is. but, typically, they have also said that congress has an ability to regulate certain things, including drug users and possession in possession of a firearm or lying on a federal form. these -- i don't think that will give him an out on this case. >> steve: all right. let's see what happens. matthew whitaker, sir, thank you for joining us on this thursday. >> good morning, good see you guys. >> carley: good morning, great to see you, too. >> carley: he said good morning in the exit. i like that. there is an op-ed that is in the cut which is magazine affiliated with new york magazine. and it caught our attention and it's about women who genuinely want to have children right now but they decide not to because of climate change. >> steve: right. >> carley: the title of the article is having a kid dot dot

dot at the end of the world. and it's written by a woman who has three children but she is genuinely concerned about having the third, i believe she is pregnant right now. because of the state of the world. >> steve: that's right. so part of the op-ed says so, should i have a baby even though the world is burning? my knee jerk response to the question has always been defensive. i know the perception is that it's selfish to even think about that but, like the whales and the ozone layer, how did something somebody else broke become my problem to fix? when i put this question out to people on twitter and instagram, the response was overwhelming i got long email from 50 strangers, men, women who are scared, hopeful, anxious, optimistic who have kids and fear for their future who won't have kids so they don't have to and who don't know how they can possibly make a decision like this at this time.

>> steve: i have actually heard people say that i'm sure you have heard it as well. young people in their late 20's, early 30's and you'll ask them about sir, are you going to have kids? i can't bring a baby into this world right now. they are not citing climate change. they are just how this is a scary time. >> brian: there is always scary times in this world. that's what the conclusion of this op-ed. by niel nazi is. wildfires, hawaii. we know what happened there. and burning forests in canada. and should we bring a kid into this world? there is always challenges. no matter where you go, no matter where you are, that's part of life and that's the challenge of life it doesn't mean you should decide the world is coming to an end. of i don't want my children to be there to witness it or my future children. and i think she came up with that decision. >> carley: she did at the end. >> brian: far greater hardships and shape your futures than i could ever imagine in the past. climate impacts and those

traumatized feelings direct impact on the number of children they plan to have you should basically. >> carley: then she highlights other people like this woman who lives in buffalo who said that when she thinks of the state of the world, she shuts down. i cry uncontrollably thinking about the future that my 1-year-old son belongs to. and, you know, part of me feels sympathetic towards people who, you know, as a new mom, you worry about absolutely everything. it could make you irrational. but then, the other part of me thinks about other parents and these climate activists are exactly why. this is another headline that came out yesterday, why the biden administration decided to ban drilling on millions of acres of land in alaska. those types of decisions impact other families because, you know what? gas prices are going to go up. >> steve: they are. >> brian: that's unbelievable not refilling our oil reserves while the saudis in russia cut. we cut off of the ability in a law passed by congress to drill

message resonate and with that let's bring in our panel of swing state voters from nevada, lydia dominguez from pennsylvania mark goldberg and from arizona rom saleen. good morning to all of you, lydia, i will start with you, what do you think about that ad? do you think it will resonate with people in your community? >> that ad was so boring i almost fell asleep while watching it. it doesn't resonate with people. i can tell you out here in the swing state i don't see any biden stickers, i don't see any biden flags. i don't see anyone wearing a biden t-shirt. biden is boring. and i cannot -- i don't understand how people can get off the couch and vote for him. >> carley: rom, about a month ago the president got off his couch and visited your home state of arizona and he brought his bidenomics message with him. and his message at the time and still is that the economy still needs a little work but what he is doing is working. do you agree with that? >> not at all.

>> nope not at all. >> arizona, his message is falling flat. arizona has a higher inflation rate than the national average. gas prices are some of the highest in the nation in this state. and, of course, we have got the border right next to us. and everybody knows that's a total disaster. so i think biden's message is going to fall flat completely in this state. >> mark, i know you are a numbers guy you are the co-owner of matt name of. cnn poll 39% approval rating. and when it comes to inspiring confidence the number was 28%. does that surprise you? >> i think it -- it doesn't surprise me too much. i would be curious to see -- you said that's not specific to the swing states. you said that's national? >> carley: yeah. that's a national poll. >> yeah. that does surprise me a little

bit. i would think maybe more in the red states and some of the swing states that does surprise me a bit. just to clarify, too. well, just because i think that there are enough people out there that aren't really paying attention a lot of mainstream media is telling them biden is doing a good job. i think if you talk to a lot of people in general public that aren't paying close attention they don't complain. about it. some of the swing states like i am you do hear about it more. >> carley: a fox news poll came out has biden made the economy better or worse. 25% say better. 52% say worse. there is also other polling that shows he is underperforming with

divorce in the black and hispanic community. you have to wonder if that's why. >> i'm not surprised at all. this is awful. this economy is trash. it shows what the biden economics is. it's garbage. and the latino community, the minority -- this whole entire community here in vegas it's a melting pot down here. everyone is struggling. every single person in my community is struggling my neighborhood and family and friends we are all constantly talking about money and make more money in different ways and different revenue incomes because everyone is struggling. electric bills and grocery bills going up. people can't afford to live here anymore. and that's insane. this isn't okay anymore. and the bidenomics it's garbage. >> carley: rom, last question to you. you say you know people who voted for president biden democrats but now have buyer's remorse. what are they saying? just that i think a lot of people voted for biden.

steve 7:33 here in the east. back with a fox news alert. a kentucky police officer is at this hour in critical condition after a traffic stop shooting in louisville, kentucky in that neighborhood right there. residents are being told to stay in their homes. the suspect apparently is on the loose. the louisville metropolitan police department says the officer is in critical but stable condition. we're going to monitor this situation and bring you any updates. all right. speaking of law enforcement. high end retailers in l.a. rocked by skyrocketing thefts and violent shoplifters leaving them helpless and it sure is taking its toll. take a look at this. this viral video showing better beverly hills the sad state of beverly hills. iconic luxury stores about a dozen of them being completely shuttered not being replaced by any new businesses as retailers flee the high crime, high tax city. next guest is from that area. and this is why he left

california actor dean cain is also a reserve police officer in poke tell la, idaho and a deputy sheriff in virginia. he joins us now from georgia. dean, good morning to you good morning how are you, sir? >> steve: i'm okay. it has to break your heart. he grew up not far from beverly hills and rodeo drive is kind of a ghost town. >> nonel you told me 10 years ago this would happen i would have thought you were insane. what is going on is insanity. nike town i have been to that nike town dozens of times. top of the line. nicest place to shop. all of beverly hills hills is incredible. when you have horrible politicians in office making ridiculously terrible policies policies you end up with situations like this. the idea none of these shop owners could defend themselves or their merchandise and their shops. these policies have literally invited crime to take place and for some reason california

voters keep putting these politicians in u-haul salesperson of the year every year for several years running because people like me are getting out because it's unsustainable the businesses that survived covid. that was a very challenging time for retail. people weren't going shopping. anything that did survive now, with this smash and grab business if i'm a tourist and guy from let's say the new york area and i go out to the rodeo drive, beverly hills area, i have seen the videos of smash and grab on tv. i am not going to go into a high end retailer i don't want to be in that store when somebody comes in with a sledge hammer. >> no. i mean myself and my fellow law enforcement officers would love to be people in the store and clean that out. they don't want you to do that. they are discouraging people from doing things. i will tell you and i hope this

doesn't happen. but at certain point it may. you know, vigilantism. people are going to protect their stores. it happened in stockton, california that everybody celebrated those guys, beat the guy with a stick. that sort of stuff might take place because people will have enough of it but the problem is like there is there is right now in the senate they are trying to push something where you will be penalized. criminally if you try to defend your store. so they're literally inviting these things to happen. unfortunately, i wouldn't want to go in there either to be honest, i wouldn't go inside. i know and we are looking at a lot of places in california. you are a deputy sheriff in pocatello, idaho how often does stuff like this happen in idaho? >> well, i'm a reserve police officer in idaho. it doesn't happen in idaho. because go to jason aldean's try that in a small town. but you know everybody. you're aware of what is going on. the community comes together. doesn't have anything to do with race. it's about the community

second. we know how effective the ads have been getting people south dakota as you put on blue jean shirt and told people the trades that were needed and the jobs that had to be filled. is it a success? >> incredibly successful. we have had thousands and thousands of people pick up and move to south dakota to fill our open jobs and they love it here. i have got testimonial after testimonial of lives of people who have been dramatically changed. they came to our state and get a professional license. we helped them with their training and education. they have a home in a safe community with neighbors who love them and they can't believe this is still america when they come from the places that they have been in bigger cities and new york, california, even from florida and texas, they said south dakota is so different people here still love each other. >> brian: former president trump is going to be headlines a rapid city tomorrow. first off, how is it selling and moving? how did you get the former president? >> well, we asked him. and he said yes. he would come. i think that's what is so remarkable. we have had asked several to

come visit us in south dakota who are running for president. he is the one who said i will be there for you, ch chris christi. within hours the event sold out. then we expanded the seating and that sold out, again, within the first day they were available. there will be over 7,000 people in attendance. i'm sure many more will -- would have wanted to come but that's all the capacity that we have available to us. and he should have and be surrounded by people that recognize how hard he fought to protect america and how he still wants to continue to do that in the future. >> brian: i'm pretty sure that you considered running for president. i assume the door is almost shut on that. many people, experts on the outside, will say that you would be the perfect running mate should president trump hold on to this lead and become the nominee. have you thought about it? have you discussed that with the former president? >> we have not discussed it at all. and i would say everybody, if asked to serve in any role

should consider it. especially right now when you watch what is happening across this country. all it takes for evil to succeed is for good men to do nothing. we have a lot of people who say politics is ugly. politics is divisive. i don't want to get involved in it. well, how will you feel in 10 years when this country is no longer the indoctrinatest example of freedom in the world. step up people. be better. go do what you can to be engaged because the reason that we see the violence that's going on in new york city and other communities is because good men did absolutely nothing and now those of us who really do care and want to protect this country, we have to be present, show up like president trump is tomorrow in south dakota and start talking about what is precious about this country that we need to save. >> brian: governor, have you endorsed him? >> i haven't, but i have talked openly that he is the candidate i'm supporting. so tomorrow we will have some conversations at the rally that i think everybody will be interested in. but, of course, he is absolutely the best choice for us. i don't know of any other

candidate that is running for president right now that fought when it mattered. thinking back to the big battles we have had when this country to protect our constitutional rights. set only one i know of that went out there and actually fought to make sure that those foundational beliefs were going to be protected. i'm looking for a fighter that knows when to dig in when it gets controversial and hard. because that's really when we have someone who will stand in the gap for all of us. >> brian: you think he would? >> yes. i do know that he would. he has proven it. you know, you look at everybody who standing on that stage and look at their record. you can't rewrite history. so many candidates are trying to rewrite history. people on that stage shut down their businesses their states and their beaches. they have bad foreign policy when they were in office when they had the chance to really do something to make america stronger. so, people don't let them just because they are giving a lot of speeches and debates to rewrite history. go back and see what they really did when it really mattered and then you will decide who is the best person to lead this country
