policy space to address these challenges. so we're monitoring the situation. i don't see it as having very significant direct impact on the united states. >> the motorcade snaking through the streets of new delhi will be at the same place but may not find themselves on the same page. for example, china may not sign on to reform the world bank. it would encourage developing companies to stop taking high interest loans from beijing. china and india will hesitate to emissions cut as they use coal-powered factories to grow their economies. russia isn't going to sign on to condemn russia's war in ukraine which could table a joint statement. >> the question is, will every country step up, be responsible

and constructive. the answer to that is yes, we'll get a joint statement. it is too soon to tell. >> as the biden team confronts growing concerns back home about his age, his schedule on this trip is grueling. the president has been in transit since 5:30 p.m. eastern last night. as soon as he lands he will have his first meeting with the indian prime minister. there will be limited press coverage of that and every other meeting. that's a preference of the host, not the white house. >> dana: keep pressing for it. the white house press corps will be doing that. >> bill: when the wheels hit down, poll after poll showing his approval is well underwaters. voters concerned about his age as well, especially democrats. jerry baker, the author of the new book american breakdown coming up here. good morning to you. 39% of a poll out of cnn.

democrats say he is not physically or mentally fit for the job in the years to come. >> not just democrats. huge numbers of independence and huge numbers of republicans. they are in the basement here. what must be worrying for the white house, nothing is really moving them up. economy is not in bad shape. inflation is a serious problem still but there is no indication that the president is able somehow to connect with people. these astonishing numbers that show 70% of americans think the president is too old or out of touch. word association and what they think about president biden, old, incompetent, incapable. we have never had a president who is held in such lowest steam by such a large majority of americans. >> dana: they aren't figuring out how to pivot. everybody can see what's

happening. the white house can say his accomplishments are amazing. wise, we can't keep up with him. when people see it day after day the white house press corps not being able to get a lot of media attention from president biden on this trip. i know that modi in india probably doesn't want press. it probably works in biden's favor as well. >> i think that's right. the white house -- you keep some of these ridiculous story that karine jean-pierre he has incredible energy. no one can keep up with him. nobody believes that. they ask us to believe a fiction. the president is 80 years old. if he did serve another term he would be 86 the ends of that term. everybody who has elderly relative knows what age does to people. when you are president of the united states it's magnified and they don't like people told --

opens her mouth you see why people are so actually democrats think they have no choice but to stick with joe biden because as weak as biden is, as old as he is, as incapable as he seems to demonstrate. as unpopular as he is, every number that we see tells us that kamala harris is held in lower esteem by the american people. even by the recognition of people around her, people in the biden team. she has been a very weak vice president and people see her and they can't imagine what the country would be like with her as president. so we talk about a heartbeat away from the presidency. people have to pray as long as joe biden is president, that something doesn't happen to produce president kamala harris. whatever one thinks of her capabilities american people don't have confidence in her. that's a scary thought. >> bill: certain

responsibilities and she has seen what she has done or not done. >> dana: the battleground states and college towns is where they are making up the votes. >> look, if it's about getting out the democratic vote she does that. she doesn't appeal to independents. >> bill: look forward to the book. great to see you. >> dana: david weiss plans to indict hunter biden no later then september 29th after the collapse of a sweetheart plea deal. unclear whether the charges against him will involve a gun purchase from 2018. lucas tomlinson is live in washington with more. >> according to the court filing the new indictment could come in three weeks at the earliest. capitol hill many republicans believe the gun charge is just one part of the hunter biden saga. >> i think it's the tip of the iceberg. we need to wait and see what the house investigation committees discover and see how deep this bribery accusations go.

i think that the gun issue is very, very small compared to what's really at stake. >> delaware's democratic senator says the focus should be on donald trump and says the current president has done nothing wrong. >> hunter biden is not on the ballot. former president trump is. he has been indicted dozens of times. there is no evidence suggesting that president biden is in any way implicated in what may be an indictment around either late tax payments or a gun charge. >> majority of americans disagree with the senator. new cnn poll shows 61% of americans say they think joe biden as vice president was involved with his son's business dealings. house republicans accuse special counsel david weiss of dragging his feet. >> this is a diversion. he has had plenty of opportunity to legitimately prosecute hunter biden. he failed to do so. this is about joe biden. we may be on the verge of the biggest political scandal in the history of the country where the

>> dana: news conference on stopping covid mandates getting heated as desantis fires back at a heckler who blamed him for a racist shooting in jacksonville last month. the candidate joins us now. thank you for being here. wonder what you thought about in that moment and what you would say about reducing gun violence in america. >> well first of all it was outrageous to take an incident that has been a gut punch to our state as well as to the jacksonville community and try to leverage that as a political thing to use against somebody you disagree with politically. i won't sit there and stand for that or let anyone impugn me in that way and we'll fight back. i think it shows part of the problem with our society that people would stoop to that level. we can have disagreements on issues. we can even be heated on issues. but to take some nut job and try to act like we were a part of that is absolutely absurd.

this guy was very mentally ill. he had actually been baker acted which in florida is one of the initial involuntary commitment several years ago. he have was not, though, done on a more permanent basis. had that happened and it probably should have he would have ended up being ineligible to purchase a firearm. people that don't have their wits about them need to be dealt with appropriately under our system. >> bill: the next topic, which is covid is coming back in some areas. mask debate is back as well. it was on the floor of the senate yesterday with j.d. vance the senator from ohio. at the fox debate you said you would have fired fauci. prior to that you said donald trump outsources government to anthony fauci during the pandemic. three days ago with huweish it he was asked about this and here is how the conversation was. >> why did you keep dr. fauci?

>> no, dr. fauci was there. first of all he is a civil service and you aren't allowed to fire him. >> bill: when ron desantis says you didn't fire fauci and you shut down the country and it was a mistake. >> he shut down the entire state. he has selective memory. >> bill: what did you think of that, governor? >> well look, at the end of the day the leader has to take responsibility. i think it was pretty clear that fauci was misfiring and elevated to his pronouncements were viewed as gospel around the country and we rejected thought and when we reopened the state he criticized us. when we had kids to school. he criticized us. when we said no vacs mandates they criticized us. the results speak for themselves. i would note, donald trump --

>> bill: he is making claims that florida had the third highest death rate in america. he says you shut down -- >> that's total nonsense. >> tight as a drum in vax lines. april 1, 2020, just to be clear you did allow local authorities to determine who goes on the beach and who doesn't. the rule you made that day was to limit it to ten people or less. do you disagree with any of that? >> so right, that was a local decision. but you know those first few weeks we followed some of the federal guidelines. i have always said that. but then i was looking at the data myself and i made the decision that we were going to chart a separate course and we did that. clearly florida boomed as a result. i would note this. this is important. donald trump's re-election campaign in october of 2020 was running ads bragging with fauci saying trump did everything i told him to do. they were putting that out and

bragging about it. then on january 19th, 2021, donald trump's last day as president, he gave fauci a presidential commendation. so those were wrong to do that. clearly i think the important thing is this looking forward, we need accountability for what went wrong because those people in positions of authority at the cdc, fauci, they lied about lockdowns, school closures, mask mandates. they were wrong. it did a lot of damage around this country. i know that because the people that were harmed, a lot of them came to florida and would tell us about it. we need a reckoning so this never happens to our country again. we instituted permanent protections in florida against max mandates and all this stuff. people said you are talking about old issues. you see they are trying to bring it back. montgomery county, maryland school districts forcing students to wear k-n95 masks during the school day. it doesn't work. we have to clear house and need

evidence-based medicine not narrative-based policies. >> dana: want to ask you about this. a former member of the house in congress and you want to be president. right now they are debating whether to shut down the government if the impeachment vote for joe biden doesn't go forward. would you favor tying impeachment and government funding? >> well, i don't know necessarily -- i think they should do the inquiry. i think some of the corruption that's been uncovered is significant. i think they are right to be investigating that. on the government funding, the way i look at it this government is spending way too much money. they've locked in the covid-era levels of spendsing that are totally unsustainable and absolutely have a big fight over righting that ship. you also have the issue of they are funding really bad policies. biden's border policies are causing a massive influx of

illegal aliens, causing a massive influx of fentanyl, human trafficking, sex trafficking, the department of justice and the f.b.i. with the weaponization. when there are memos circulating targeting catholics as potential terrorists and parents going to school board meetings, the power of the purse is really the way that you hold those agencies accountable. some of the guys in the house like chip roy, who are raising the alarm about this, i think are right and part of the reason our bureaucracy is so out of control in this deep state developed is congress has not been willing to use the power of the purse to discipline these agencies. >> bill: let's talk about disney. a month ago you said disney will lose that lawsuit. just yesterday that lawsuit has been trimmed down and some would argue significantly now only applying to free speech and you and what you said about the company. can you win it? >> they are going to lose that claim. it is a bogus claim.

these were acts of the florida legislature. they had every right to make sure disney is going under the same laws. we have great laws for new business and here is the thing. we are going to stand up for our children in the state of florida and it is wrong to try to get things like transgender ideology into the elementary schools. as a dad of a 6, 5 and 3-year-old my wife and i are very sensitive about what parents are going through. that fight ultimately was about the appropriate role of education, parents being involved, and making sure we don't have indoctrine nation in the schools and we've delivered for parents in florida on that. that's not a partisan issue. that's an issue that independent and democrat parents agree with and what the schools focused on the basics. they don't want a second grader told that she can change her

grow and feel safe and something so important to young women. having someone come and try to take that away is not all right. >> bill: you say some things made you uncomfortable. what specifically? >> there was a lot of behavior that you shouldn't have to deal with when you are living inside your own home. walking to the shower, we just wear a towel. communal bathrooms and common areas in the south. sometimes the individual would be waiting there as we walked past. which is something you shouldn't have to deal with. >> bill: you lost in front of this judge. what happens now? >> we keep fighting. we aren't done. >> are there other sororities on that campus who have transgender members? >> not to my knowledge, no. >> bill: you are the only one. >> yep. >> bill: to your attorney now, thank you for your time. part of what the judge said is that plaintiffs request the court to insert itself into this constitutional political debate

and declare that a private organization can only interpret the term woman using plaintiff's definition of biologically born female. want to get your comment on that. i caught what you said the other day. this is not about defining women anymore. it is about erasing women. quite a statement. what do you mean by that? >> well, thank you. this isn't a political debate but a biological reality. unfortunately these young women have been forced to experience the lie. they've been inserted in this debate. the vote conducted to bring this individual in was illegal. they waited until many of the girls were absent from the house and didn't have a secret vote and refused to do a revote. without any recourse we sought a determination in a court of law to look at the bylaws from a contractual standpoint. the judge converted it into a political issue. it is unfortunate because it has

been skewed into a conversation about inclusion. this isn't about transgender inclusion. this is about erasing women. are we not entitled to any safe spaces? title ix specifically excerpts men from joining women's sororities. we just thought that challenge when the sorority at the high level had pushed through. >> bill: you said it's a lie. what's the lie? >> the lie is that being a woman is simply a game of semantics that one can play. by the admission of this individual, he is attracted to women. he is autistic. there are legitimate concerns where in another environment all of these young women would be willing to be friends with this individual. when you talk about a sorority, communal space, a shower in a communal area. a p.j. room that this individual invited himself into. there is danger there and uncertainty there.

there is no planning and there are teachers who don't know how many kids are coming to their classrooms. principals who don't know how many kids are coming into the schools the week before school starts. it is impossible to plan that way. in addition to being expensive it is chaotic and there is no excuse for it. >> dana: the new york city department of education says this is their policy. as a reminder we don't ask about or track student immigration status and any and all resources must be available to all students. that's a federal law, too. if you are a child in america you get to be educated. have you heard anything about the schools and how they are managing, especially because there are many different languages that are now sprinkled in throughout these schools. there is no way a teacher would know how to handle all of that on their own. >> i will say this. i have kids ranging from high school to elementary. it is easier for the younger kids. immersion helps kids. my son -- my first grader had two migrant students in his
