remain in texas policy for illegal immigrants. the la times is reporting that the white house is thinking about using gps monitoring to force some migrant families who cross the border illegally to stay near the border in texas effectively restricting them from traveling across the united states. the times reports the idea here would be to discourage migrant families from crossing illegally and to help deport them quickly if they fail initial asylum screenings. texas governor greg abbott though is slamming the idea tweeting in part, quote, biden considers forcing migrant families to remain in texas. this scam was tried years ago and was shot down by a judge. we will send biden the same swift justice and add even more buses of migrants to washington, dc. the president of the union representing front line border patrol agents also shot down the proposal on fox news today. >> as much as i hate the catch and release, i also recognize

thank you both for coming on. the gop congressman toney gonzalez said this. watch. >> it's almost as if biden is punishing texans for us trying to uphold the law and keep our community safe. remain in new mexico or remain in california? why is it texas? >> trace: he makes a good point, lee. why texas? >> well, i think it's a place where he knows he can't win. the bigger issue is, he clearly knows that he's got an issue on immigration. his job approval rating is only 42% overall but less than a third of americans approve of his rating on immigration. so this is a real challenge for him. so clearly he's trying to do something different, but this is not going to be the answer and this is not going to work. i think that a lot of people, whether you're on the right or the left, have very different concerns about immigration but they're on the top three of all voters. >> trace: lee talks about this being an issue, it's such an issue that in south dakota the

former president is actually kind of revving it up, right? he's campaigning on this. watch. >> i will immediately terminate every open border policy of the biden administration. we will seal up our borders like they were when they took office. >> trace: suddenly feels like 2015 a little bit james. >> absolutely. and i think, you know, it's really shocking when you look at president biden, his complete inability to address the human rights crisis on the southern border to the fact now you have democrats, democrat mayors of new york, chicago, calling him out for his inability to address it. so i think this is definitely going to be a talking point for any republican going -- competing for that position this next year and i think it's really just tragic and sad. i agree with governor abbott's tweet earlier. i think the legality of this is questionable, i highly doubt a court would let this stand and it's just sad at the end of the

somebody besides joe biden to be the candidate. and so i think that gavin newsom sits in a pretty good place and he's doing exactly what he should be doing, saying let's just see how it plays out. >> trace: james lastly i want to get your take on this. 9/11 is monday, foxnews.com writes the following, biden's plan for september 11th, represent the first time since the attacks that a president has opted against observing the occasion at either the white house or any of the three attack sites. your final thoughts on this james, what do you think. >> again it's just sad. again it's clear this president is not leading being led by people within his administration. so it begs the question, are the people leading him do not care about the tragedy of 9/11 or two were they too young or not born yet. either scenario it's a tragedy for this country and something that we should really look beyond and i really hope the president does change his mind on this because acknowledging the tragedy of 9/11, following

very cozy. it certainly appears sketchy. what do you think, john? >> trace, it's a good point. because what you want to do is establish a connection between the money that's going to hunter and then what did hunter do in return. was he actually doing real legal services? was he actually providing business advice. or was he actually trying to use his influence and his father's influence in the government. this should be of interest if we had real special prosecutors of interest, they should be following up because this is the point it becomes corruption where hunter's paid and uses contacts and influence in a way a normal person would not be able to because of his connections in the government because of his father. >> trace: yeah. you talk about investigating this, maybe it's not a smoking gun john but it's worth looking into and if you are a media outlet it is worth your time to investigate. meantime i want to get your take on this because i'm wondering,

the proud boy leader enrique gets 21 years. he was not there on january 6th, convicted of inciting the violence. montez lee gets ten years for burning and building killing a man. red state says the following, there's no way to square that circle except to assume that the doj makes sentencing judgment based purely on politics. why would someone who literally killed a man deserve less time in prison than someone who never laid a hand on anyone? >> makes you wonder whether there's consistent leadership at the justice department. we already have doubts because we had a terrible special counsel appointment and a terrible running of the hunter biden investigation. and now you're seeing these, i think, terrible sentencing disparities. i'm not going to defend the proud boys. i think 22 years is an appropriate sentence. he could have gotten longer for leading the most violent aspects of the january 6th attacks.

but what it points out is that justice isn't being done with people who did terrible things, violent crimes, killing people, destroying buildings. their sentences should be higher to match those that are being handed out to people who committed violence on january 6th. it's not a case for bringing everybody down lower. >> trace: yeah. i'm out of time as a matter of fact but i had to get your take on fulton county grand jury recommended charges against lindsey graham senators david perdue, kelly lost letter. what do you think of this. >> just shows how out of control the da in fulton county and the grand jury. she's indicted people in the executive branch of the federal government and thought about indicting members of congress. maybe she indicts chief justice is the next because she doesn't like the ruling abortion. it's going to make the federal government vulnerable to any state da or county da who doesn't like the federal government policies are. >> trace: john yoo good insight

so this is video in question, it's perfectly reasonable in terms of its content. hillary clinton, as you said, on dozens of occasions has called donald trump illegitimate as a candidate installed by the kremlin. she has said the 2016 election was stolen from her, quote, unquote. so this is clearly big tech once again playing the role of big brother on steroids all in an effort to protect the party in which it serves. and hillary's words by way in terms of it being stolen have had an impact. we've seen polls eight in ten democrats after the 2016 presidential election felt that that election saw the russians actually change vote totals by changing vote totals in voting machines. the good news, trace, is, that we're talking about this now, and every time big tech tries to get away with this stuff, it's right out of pyongyang it will be called out as we are right now. >> trace: yeah. meantime you talk about the

media that will not touch the hunter biden scandal but, boy, biden comes out on cnn with bad polls, joe, i mean, it's a blood bath. here's a few examples. >> the numbers, they're looking rough for president biden. we've been talking about it all morning and the fact it could be a troubling sign for democrats and the president's hope for reelection in 2024. >> there is no way to spin this. cnn reads the country's mood right now and finds that america is deeply unhappy with joe biden. >> 58% of americans say that joe biden's policies have worsened economic conditions. >> problematic new polling numbers out this morning for president biden. the cnn poll finds his approval rating sinking to just 39%. >> trace: when cnn says there's no way to spin this, joe, there's really no way to spin it. >> particularly when you peel the onions off here as far as this poll, trace. where you see that two-thirds of americans think that this president actually engaged in

criminal behavior as troors hunter biden and his business dealings over in ukraine and russia and china and kazakhstan. and then when you look at the fact that he's polling so low that we're now hearing whispers from cnn pundits that worked for the obama administration, like van jones like david axle rod that, whoa, maybe boy this maybe a time where joe biden needs to step aside and put somebody else forward. look, the by whom line is joe biden won in 2020 because he ran by running from his basement and pleading the fifth and saying that donald trump is bad and i will restore order and normalcy to the white house and to washington. and now he has a record he has to run on, right, and an age issue to run on as well. he's not going to get better as he gets older, and when you talk about crime and the economy and education and ukraine and you go on, suddenly he has to defend

heated hours long meeting last night, the orange school district became the sixth district in california to adopt a policy that essentially says parents have to be notified if their kids identify as trans and things, as you can imagine, got contentious. >> leave our kids alone! leave our kids alone! >> reporter: ultimately the orange school board voted to pass the resolution last night which triggers a parental notification when a student asks to be identified as a gender other than their biological sex or the gender listed on their birth certificate indicate and parents on both sides of this issue spoke out. >> kids are trying to figure their self out and sometimes they do not feel safe exploring talking to their family. >> this policy further the long-held belief we have in this country that parents have a fundamental right to direct the care, custody and control of

their children. >> has nothing to do with the communication towards the parents and everything to do with a witch hunt for the kids. >> this is not about outing anyone, it's about protecting parental rights and it's about protecting the relationship between children and parents. >> reporter: now the resolution came as california attorney general ron bonta is suing districts even getting an injunction against a similar one in the chino valley school district. a.j. bonta sent a message to the school district before last night's meeting warning them that he wouldn't hesitate to take legal action again to, quote, protect student civil rights. so, trace, we'll have to see if another lawsuit comes down the pike. >> trace: you talked about the border earlier, that's becoming a campaign issue, and parents rights becoming a big campaign issue. bill melugin, bill, thank you >> meantime the fox news at night common sense department is

intrigued by the story of stacy davis gate, the president of the chicago teachers union, for years davis gates has fought against school choice calling it racist and against the invest in schools act a scholarship program that allows students to attend private schools instead of public schools, again, racist. so common sense was surprised to learn that davis-gates is now sending her son to a private catholic school, 16,000 a year. apparently davis-gates needed to explain herself so sent a letter claiming black students on chicago's south and west sides have limited options and that her son was going to private school, quoting here, so he could live out his dream of being a soccer player while also having a curriculum that could meet his social and emotional needs. common sense wonders if that social and emotional curriculum includes the ability to read and do math. it's a valid concern considering

that in 53 chicago schools, not a single student can do math at grade level and at 30 schools not a single student can read at grade level. common sense thinks davis gates has every right to choose where to send her kid to school, but it's a shame that she doesn't believe other parents should have the very same choice. >> let's bring in carrie bowler former ms. california and founder of the battle cry and caroline moore vice-president at parents defending education. carrie to you first, i can't even imagine opposing school choice and scholarships for private schools and then putting your kid in a private school because you think it's the best remedy for that person. >> yeah, this is total hypocrisy once again from the left. and what they're doing is they are saying to parents, hey, we don't want you to have these rights, but we're going to have these receipts. we don't want you to have school choice but we're going to remove our kids from the public school system and send them to fancy

private schools, kat electric schools, that's where she sent her son and it's wrong and hypocritical of her and once again the left, all they do is spread lies. and they're hip criths. >> yeah, and caroline the form education secretary betsy devos made this point earlier. watch. >> stacy is doing exactly what millions of other parents want to do, and yet she and her boss, randi weingarten pretty much single handedly killed the tiny little school choice education freedom program in the state of illinois. it is the height of hypocrisy. >> trace: no different than the governor putting his kids in private school and all the other kids are home. i mean, it gets tiresome. >> it's exhausting. honestly as we see in illinois but also across the country, i mean, we have these elites who, you know, set the standards and pass laws and what not, and then their kids are held to a different standard. they can pull them on it, put them in private school, and it

creates a strange situation. you know, more than half of americans don't have -- can't do -- can't participate in school choice, like in the state of illinois. but really a lot of parents don't even know what school choice means and so they have to work through the public school struck as it is. and it's really disheartening that you would advocate on behalf of teachers or pretend to advocate on behalf of students like the unions do, when your kid doesn't even go to these schools. it's ridiculous. >> trace: yeah, and that's the whole thing now you have the orange unified school district becoming the sixth district in the state to require that parents be notified if your child's pronouns are changing, gender is changing, changing bathrooms. but the lawsuit carrie you know is coming, rod bonta is going to file a lawsuit and now you have to whole litigation in california, it's going to happen the next couple of years. >> yeah. and one thing that i want everybody listening to realize

is that this is a hill that parents are willing to die on, trace. this is the hill. and this is what government needs to understand. educators do not have super rights over parental rights. what we are saying in ill ill, i live in california. what we are saying is that our rights, our god-given rights as parents supercede the educator's rights. so what you teach our children in school, we have a right to know. all these secrecy clauses that we're seeing in these bills passed in california, it is not okay. we have never surrendered our rights, they cannot take those rights away. and so what we're seeing, just like you saw last night, trace, when parents rise up, when parents get organized and go on the offense, we win. and so i want everybody to take note across the country. copy what they did last night and take it to a school board near you. >> trace: yeah. your final thoughts on this caroline. i have about 15, 20 seconds. >> i completely agree and this is like a beacon of hope for
