president biden. so many republicans have wanted this for a while. they site mounting evidence of bribery and corruption. it appears speaker mccarthy is ready to pull the trigger. >> bill: then the question does he have the votes? republicans have a majority. slim majority of four votes. some republicans, said to be skeptical whether or not it rises to the level of impeachment. >> dana: andy mccarthy and bill mcgurn are here with analysis. let's begin with chad pergram on capitol hill. >> good morning. kevin mccarthy has long inched toward an impeachment inquiry for the president and tell members this is the next logical step. this is what he said earlier this summer. >> when more of this continues to unravel, it rises to the level of impeachment inquiry where you would have the congress to have the power to get to all these answers. >> house oversight committee chairman james comer and judiciary committee chairman jim

jordan are slated to update house republicans where they stand with their investigations thursday. it comes down to the math. mccarthy has pushed impeachment to mollify the right but lacks the votes to even begin a formal impeachment investigation. some gop members are skeptical. >> as republicans, we need to stay focused on the border, on crime, particular life in urban areas. focused on inflation. those are issues americans care about. if we start going down these paths that bear new fruit we won't get an impeachment through the senate. >> an inquire eye gives the house more power in its investigation. >> let's go to the inquiry next. the evidence is there. i don't know what vice president or what government official needs dozens of shell companies, needs to have foreign funds from adversarial nations flowing to

their relatives. this stinks to all get out. >> that said, questions remain about dinners and phone calls the president had with hunter biden's business partners and whether the d.o.j. sandbagged and i.r.s. investigation. dana. >> dana: can i ask you one quick question? one of the things that is also happening this month is that kevin mccarthy is facing republicans who have several demands to prevent a government shutdown. this is only one of the five. so kevin mccarthy's month is getting pretty squeezed. >> what does he do on that? they passed the debt ceiling bill with more democrats than republicans. republicans are watching that closely. it was thought that maybe kevin mccarthy could, as i say, mollify some republicans by talking about impeachment more. if they don't have the votes there and they don't have the votes to fund the government and you have some republicans saying well, maybe if he doesn't go in our direction we have that option sitting out there the motion to vacate the chair. this is a very dangerous period for the speaker.

it will be a rocky month in september. >> dana: chad pergram, thank you. >> bill: andy mccarthy joins us now. good morning to you. here we are again maybe. here is president biden talking about his business dealings with his son saying he had nothing to do about it. >> president biden: i don't know what he was doing. i did not know he was on the board of that company. i've never discussed my business or their business, my son's or daughter's. >> i never discussed a single thing with my son about having anything to do with ukraine. i have never discussed with my son or my brother or anyone else anything having to do with their businesses, period. >> bill: that covers a couple years period there republicans say he lied. what is the constitutional question, andy? >> this is really more about math than merit at this point. the constitution provides for

impeachment for treason, bribery, high crimes or misdemeanor. they have more evidence here of inappropriate behavior than trump was impeached for in connection with the ukraine transaction back in 2019. so it is not a question, i don't think, of whether there is a basis to open and inquiry. it is simply does mccarthy have enough votes to get that through because it's a pointless unforced error to try to get an impeachment inquiry and to lose, raise the profile of it and if he doesn't have the votes not get it. it undermines the investigation. meantime, comer is doing a fine job as it is. and you would be much better off letting him continue what he is doing rather than have a humiliating loss in terms of authorizing the inquiry. >> dana: the other thing is the white house is not sitting around waiting to see if it is going to happen.

september 1st this is on nbc news the headline. white house ramps up war room to battle impeachment inquiry saying president biden's aides studied the clinton to impeachment and making republicans pay a political price. i know we can reach back in our memories and think about that, how that happened. do you have think this white house has strong defenses that we've seen so far? pretty much they've said you don't have any of the information. the impeachment inquiry, the idea is that then you have the power to get the information because you believe that it is there. >> dana, i think they only have marginally more power with an impeachment inquiry than they have now. in ramps up the political urgency. when you defy the subpoenas of an impeachment committee politically it's more explosive than defying the subpoenas of

the oversight committee. the democrats are going to defy the subpoenas. the administration won't cooperate with this. the question to me about the clinton impeachment having lived through that time and remembering it well is there was very aggressive defense on the part of the administration and a lot of passivity on the part of the investigation, judge starr, a very great dignified man decided to put his head down and get his work done rather than respond to all the noise. it turns out you have to respond to the noise. obviously if they are going to go this route, the republicans have to be ready to mount the public battle, more important than anything else. >> bill: andy, thanks, leading our coverage today. bill mcgurn joins us "wall street journal" editorial board. you heard andy say it's more about the math than merit. thinks that republicans have a strong case but his point is

allow comer to continue to pursue because comer has seen a fair level of success. how do you see it? do republicans have the stomach to go there? >> yeah, i think the republicans have had a lot of success. look at all the stuff we know that we didn't know three months ago. we didn't know about the f.b.i. form and trusted informant saying he bribed the president and hunter. we had so little information, devin archer, emails saying biden had signed off talking points supplied by hunter business partner. so we have a lot. it is worth noting chairman comer supports an inquiry. i'm in favor of one. it is disingenuous. i think dane with a was alluding to this, to say we have no evidence when you are finding all the attempts to gather evidence and see what you are there. president biden, if he did

nothing wrong, could say look, take a look at all the records. here is the stuff. you'll see there is nothing wrong. but the more we learn, the smellier it gets. joe biden's public statements have been untrue. he told people in the debate his son took no money from china. well, hunter just admitted in court that he did. he said that the laptop was a russian disinformation. it wasn't. so i think an inquiry is a good idea also because i think a vote is crucial. it forces accountability. all these things have to be weighed and it is good to get members on the record. not just have it like nancy pelosi in the first impeachment declare one and having the vote a little later. >> dana: what would you say there are some republicans who have been out there. we showed you one in chad pergram's package, that are

saying we need to stay focused on bidenomics, on the fact that americans feel so much anxiety, china, the border, there are so many on the substance of the policies of the biden administration that the republicans run this risk of getting the media to just cover an impeachment inquiry and not focus on the things they think could help them win. >> there is a risk but republicans ought to be able to discharge a constitutional duty. i think the american people have the right to know whether, as vice president, joe biden was willfully enabling his son and possibly affecting u.s. policy as we saw in ukraine. i think people have the right to know that. i think doing it through an inquiry that is a set process with fair rules, that's a good way of restoring respect for

congressional powers, which were so abused in the pelosi years. >> bill: thank you, bill mcgurn and andy mccarthy. already an interesting morning. thank you for your quick analysis for the moment. in the house, republicans have 222 seats. simple majority is 218. it is that thin on a vote if you come to that for the inquiry. mccarthy will talk to republicans today. they have a meeting tomorrow and wednesday. they have another conference meeting thursday. we should have a good fix by the end of this week where they feel on this. >> dana: conservatives are saying on the merits there should be an inquiry. let's talk about politics. of the 222 there are 18 of those republicans who won their seats in districts that biden won, that biden won, not trump. if the republicans want to keep the majority in some of their opinions are saying why are you going to make it so much harder for us to win re-election in

we'll see what all of these court actions do. >> dana: let's bring in former new jersey governor and presidential candidate chris christie. a lot of questions about this and she has been pushed back on by democrats saying this right doesn't exist. but i have a feeling, governor, you will see many more governors perhaps on the left and right if she gets away with this declaring emergencies. so number one, what do you think on the merits of this and what she is trying to declare? two, if you were president and a governor tried this, what would you do? >> well first off, she is not going to succeed here, dana. this is so clearly and blatantly unconstitutional. i think it will be knocked down. it is nothing more than a public relations ploy by a governor who is having trouble in her own state. understands how politically unpopular her border policies are. how politically unpopular violent crime that's going on in new mexico and across the country is. and she is attempting to cater to the grandstand. it is not going to work. i think what you are going to

see are the federal courts will come in here and stop her from doing this stuff. you see pushback from people even in her own party in the state of new mexico saying you don't have the right to do this. i was a governor and i am for governors having real authority to be able to make sure the quality of the life in their state is excellent. the people are safe and law and order is enforced. but not by violating the constitution. this is clearly violating the constitution and she needs to be reprimanded for it. >> dana: if there is a desire, and there is, to reduce gun violence in the country, this is her approach. what would be yours? >> how about enforcing the laws that we already have, dana? you look at the major cities and now moving into some of the smaller cities in this country. we aren't doing our jobs as law enforcement officers on the prosecution side. police officers are being put in an awful position of revolving door justice system.

as president, what i would do is order my attorney general in all of the cities where there is runaway violent crime, we know which ones they are. san francisco, los angeles, chicago, philadelphia, new york are just some of them. to make the u.s. attorneys in those cities take over the enforcements of violent crime if the prosecutors won't. we have plenty of room in federal prison for people committing violent acts and ruining the quality of life in america's great cities. america can't be a great country if we don't have great cities. as president what i will do is make sure we enforce the law at the federal level if soros-backed prosecutors who won't do it in cities across this country. >> dana: there is another example second topic i wanted to get to of the federal government not performing its duties and that is on the southern border. because of that, there is -- your state to the north, new york, or is it to the east? new york, 18,000 migrant

students have joined the public schools this year. the teachers cannot handle it. the parents are upset, the students are going to suffer. yes, mayor adams has started to call out the biden administration. at this point what do you think should be done? these 18,000 kids are not leaving. their parents if they were giving any orders show up to court in 3 to 5 years. what should be done? >> right. look, there is plenty of blame to go around here, dana, starting initially with joe biden's rhetoric during the 2020 campaign. he made it clear to folks he would open the border and everybody could come across whether they were doing so legally or illegally. that's the first thrust we have had. he has taken away the border protections we had prior to that. secondly, we can't not place blame on folks like mayor adams and governors like my governor phil murphy who declared themselves to be sanctuary cities and states.

they did that when there was no cost to it because we were controlling the southern border much better than we're doing today. now when there are costs to it like what you just talked about, 18,000 new children in new york city public schools, now mayor adams is up in arms. look, you should have never made yourself a sanctuary city to begin with. what we need to do and what i'll do on first day as president is assign an executive order that sends the national guard to the border and interdict the fentanyl killing 110,000 of our citizens last year. now the leading killer between the ages of 18 and 34 and send a brand-new message on immigration. that the border is not open and we'll do everything we can including finishing the wall that donald trump never got done. only 52 miles of wall in four years. he would need 110 years as president to complete the ball at that pace. we have had failures in both administration. the biden failure has been significantly worse and these mayors and governors who are

pandering by calling themselves sanctuary cities and states, now they know what it means to be a sanctuary city in new york and it means the degradation of quality of life for every student in the new york city public school system. >> dana: let me ask you a foreign policy question. today we found out that kim jong unhas bordered his train on his way to meet with vladimir putin in russia. is there a new axis of evil being formed? >> of course there is. i've been talking about this. what's going on in ukraine right now is a proxy war being quarterbacked by china and funded by china. you don't think kim jong unis getting on that train without xi's permission. they're getting together with iran which joe biden just funded with an additional $6 billion incredibly he is releasing to

>> bill: live now southeast pennsylvania where the elusive capture of this escaped inmate. 14 days. another spot as of last night apparently. let's listen. >> information was received from another resident in that immediate area that a pair of work boots had been stolen from a parch at her residence.

the tracking of cavalcante continued in a northerly direction and at 10:10:00 p.m., a call was received from a resident on coventryville road indicating a short hispanic male with no shirt and no pants entered his garage while the homeowner was it and he grabbed a 22 rifle leaning in the corner of the garage. the homeowner drew a pistol and fired at cavalcante as he fled with the rifle. psp responded and secured that scene. at that time, a green sweatshirt and white t-shirt believed to belong to cavalcante were discovered near the edge of the driveway. the perimeter was expanded to include that area. overnight, searches of the area within the perimeter were conducted by teams from multiple agencies, teams from pennsylvania state police, border patrol, atf, f.b.i., us marshals and chester county have been active through the night.

teams are currently being rotated out and replaced with fresh teams. aviation assets, canines, mounted patrols and numerous other assets are mobilized and operating in the search areas. 500 law officers are conducting searches mobileizing additional resources and planning for an extended operating period if necessary. cavalcante is considered armed and extremely dangerous. he is now armed with a 22 caliber rifle with a scope and flashlight mounted on it. throughout the night we spent -- we sent several reverse 911 messages to residents within a three mile radius of this incident as well as posted information to social media in an effort to inform the public and keep them safe. we also notified the affected schools of this incident in the early morning hours and decision was made to close schools in the onj roberts school district for

today. the current perimeter includes pa23 to the north, pa100 to the east, fairview road to the south and iron bridge and county park roads to the west. we ask residents in and around this vicinity to please secure homes outbuildings and vehicles. it is imperative that anyone with information about cavalcante contact us immediately so we can act on it in a timely manner. they can call 911 or our tip line at 717-562-2987. we will take questions at this time. >> what was the response time, sir, from the moment the homeowner called the state police after the shot was fired? what was the response time. >> minutes. >> do you believe he is injured? >> we have no reason to believe he is injured as a result of that shooting. >> i think he is just trying to

survive and avoid being captured right now. >> how does it change your tactics when it comes to the fact -- >> we have considered him dangerous right from the start. it changes nothing. we have always considered him to be a risk. we just now absolutely know he has a weapon. >> do you know where he is? >> yes. >> do you know where -- >> yes, he has been in that area before. >> are homes evacuated? >> not evacuating homes. we ask residents to lock their doors, be vigilant and call us if they see anything. several shots, i don't have that number. >> [inaudible] >> not as a result of anything with the search. we have had a few minor incidents or issues with officers out on perimeter and things but nothing related

directly to the search. >> has he gotten help from anyone at any point? >> i won't comment on whatever assistance he may or may not have received. what i will tell you is that at this point i believe he is beyond assistance and he is in that perimeter and we will actively hunt until we find him. >> [inaudible question] >> yes. >> now that he has a firearm and you have a general location is it imperative to push given that he has a firearm? >> we have been pushing any time we had him contained from the very start. we've seen it as a high priority throughout. in this particular case the search area is close to three miles across east to west and 2 to 2 1/2 miles north to south. it is a large area, wooded, hilly terrain. not something that is a matter of sending a few people in and searching. we have had a number of tactical teams operating in there through

the night. we continue to have teams operating in there now. it will take a long time to clear that entire area. and we will continue until we do locate him. >> you say how difficult the area was to search in. [inaudible] >> similar challenges. the difference here is a larger area. any time you are in an area like this you can imagine if you went out and took several square mile area and had the try and find a single person who is trying to hide, it is a challenge. >> is he contained now in that area? >> no perimeter is ever 100% impenetrable. we are absolutely -- have absolutely stood up a very strong perimeter. we will do our very best to contain him in there and to capture him. >> [inaudible] >> there are some creeks in

there, yes. >> law enforcement now that he is armed and dangerous. are officer instructed to wear tactical gear? >> they have been wearing their gear throughout the search. we have always considered him dangerous. we now have confirmation he has a firearm. the tactics are the same. >> how did he get the ammunition? >> it was with the firearm. it was with the firearm. >> [inaudible] are you searching on the tunnels where he was last spotted last night? if he is in a tunnel -- >> we are focusing on that entire area. again, we have people, supervisors on the ground assessing any issues or risks of escape and we're trying to address any possibility out

there. >> these residents contacted officials quickly. the fact the tactical team was identify them as prison suits, what happened. why -- >> they have been searching for him. it was only minutes but in that amount of time, he traveled a significant distance. we have been utilizing dogs and utilizing tactical teams. so again just because we find a footprint doesn't mean we necessarily know which direction he traveled. in fact, he had traveled south and then went back north. so it is not a matter of just charging into the woods and knowing that it is that way. it's a matter of trying to track him. a matter of sweeping methodically through the woods checking buildings and so forth. we don't have the luxury of charging up the nearest trail and hoping it is the direction he went. >> do you believe he scoped out that house and he went to the garage and found the gun. had he been watching that house? >> i don't believe so, sir.

at that point he was being pushed by the teams pursuing him from the original sighting. i think it was in my opinion i believe it was a crime of opportunity. i think he went in there probably trying to hide. the garage door was open. he didn't -- i believe recognize that the owner was in there. and i think he was probably looking for a place to hide. ran for that garage, saw the firearm, grabbed that and encountered the homeowner and fled with the firearm. >> what square mile area, larger, do you have an estimate? >> what is that, 8 to 10 square miles probably? >> you have had two instances of cavalcante picking up supplies whether it was the van with the keys or the firearm somewhat unsecured. do you have any plans to change the messaging to contain the area so emphasize -- >> i don't know how much more i could emphasize. i have been very clear about

securing things. we have sent, as i said, several reverse 911 messages through the night emphasizing that point and telling residents what they can do, just advising of the situation. i can't be any clearer that they need to secure things. >> [inaudible] >> we're working with the variety of maps. we have county emergency management people on site and have had them on site in the command post so that we do have access to the available information. >> [inaudible] >> i don't. i was told it is not a life threatening situation. >> [inaudible] >> we're well past the 400. probably around 500 now. very fluid. we have people still coming in. we've been releasing people that were held overnight.

we have people that have been on duty for 20 hours, 24 hours or more and we're relieving them. we held people over because of the seriousness of the situation last night. we're working through replacing all of those. we have people coming in, i can speak for the state police from all over pennsylvania to support this effort and to be able to sustain it and our partner agencies are doing the same not only from pennsylvania but from out of state as well with various specialty teams. >> how did he get -- [inaudible] on foot or did he steal another vehicle? >> this is the area where he left the van. it was very close in proximity to where the van was abandoned and i talked about i believed he was in the woods likely hiding. >> the homeowner, do you have any more detail? had he gotten the reverse 911 call? >> i really can't provide any more detail now. i can tell you he encountered him. he called us very quickly.

he did what we asked him to do with regard to that. coventryville road. >> how many times did he fire at him? >> i don't have that number. several shots i was told. >> that he stole a pair of boots, is that accurate? >> yes. >> [inaudible] >> which homes are you referring to? [inaudible question] >> the ring door camera is not in this search area and the home with the garage that we talked about is within the search area and we're actively working that area. >> [inaudible] >> i don't know. i don't have reports of any other houses he has been in. doesn't mean he hasn't been but we don't have reports.

>> what has gone wrong? have you underestimated him? >> i don't know why you think something has gone wrong. law enforcement people have done an amazing job tracking and locating him. that needle in the hay stack. they have located that needle repeatedly. the questions yesterday is he out of state. somewhere around the country and we told you we were actively searching this area. i'm proud of the work our people have done and continue to do. there is nothing has gone wrong. our agencies are all working very well together and i believe we'll be successful in the long run. >> did it change the posture of how your troopers and law enforcement are pursuing him? >> we have always considered him to be dangerous and i have stressed that in every one of my press conferences and every briefing that i have given to our people that are out there searching. we considered him desperate and dangerous. all this does is confirm for us he has a weapon.

>> is he desperate enough to use that weapon to target law enforcement? >> he has killed two people previously. i would assume he is desperate enough to use the weapon. >> any other way to prevent a carjacking? >> we're working that area actively. i don't know what other efforts we could make to prevent a carjacking. we've asked people to secure everything. anything that occurs in there we'll be on top of. and we're making every effort to find him as rapidly as we possibly can. >> is there a shelter in place -- [inaudible]? >> people can leave their homes. that's up to them. we have not tried to direct anybody to shelter in place. we've asked them to secure their homes. it is up to them if they want to leave or need assistance they can let us know and we'll work with them to make sure they can get out of the area.

>> i know you have reiterated very important facts. >> i think again i stress please secure things and not just within the perimeter in the vicinity around it and please call us immediately if they see something suspicious, if they believe cavalcante might be in the area. we need that information. again it's a large search area. we will very thoroughly search it. their assistance is very much appreciated. >> worth repeating or can you explain why you can't just push through with the terrain and how it is challenging? >> we're pushing through with the terrain with tactical teams but it is not really practical to suggest that we could line up a line three miles long and push in one long line through there. we have to methodically search

longwood gardens where you heard the lieutenant. then things changed over the weekend and today overnight in the past 12 hours things have escalated more now we know he has the rifle bill was talking about and the new search perimeter. we're right on the edge of the search perimeter now. 300 yards down this street is where cavalcante dumped that stolen van that helped him breach that original perimeter near longwood gardens. another takeaway from the lieutenant that i heard, they have no reason to believe that cavalcante is injured. a woman driving saw him at 8:00 p.m. a couple hours later. he breaks into the garage. homeowner shoots at him with the pistol but again no reason to believe he is injured and he did make it out with that 22 caliber rifle that prompted a big police response. look at this video as we have state, local, federal authorities all scouring this

area right now. atf agents are searching the corn fields behind me. a very rural area. people don't awful lock their doors. you have heard frustration about that as cavalcante stole the van, keys were left inside. he was able to break into that garage where he stole that rifle. take a look at this update from pennsylvania state police. you just heard lieutenant say they have not issued a shelter in place. however, according to this tweet, they say quote he is armed, residents in the area are asked to lock all doors and windows, secure vehicles and remain indoors. do not approach. call 911 if seen. it comes after cavalcante unsuccessfully tried contacting two acquaintances after stealing the van on saturday night. he changed his appearance over the weekend. clean shaven. these pictures were taken at a former co-workers house. they learned cavalcante breached

biden. abby lowe has largely taken over the case. chris clark originally was the lead. since he may be a witness in a case involving the failed plea negotiations, he did take a step back. we've reached out to chris clark and abby lowe on screen right to see what they have to say about it. as part of the plea agreement between hunter biden and the government that fell apart in july in delaware hunter would have had a diversion agreement in return for his promise not to buy another gun and consent for entry into a background check system. biden's attorney said the diversion agreement was signed as it will be in effect and biden has and will continue to follow that agreement. the government says the agreement is null and void. back to attorney general merrick garland he will be feeling the fact that house republicans are back in action. he will appear before the house judiciary committee next week, a week from tomorrow. expect hunter to be a major
