biden. abby lowe has largely taken over the case. chris clark originally was the lead. since he may be a witness in a case involving the failed plea negotiations, he did take a step back. we've reached out to chris clark and abby lowe on screen right to see what they have to say about it. as part of the plea agreement between hunter biden and the government that fell apart in july in delaware hunter would have had a diversion agreement in return for his promise not to buy another gun and consent for entry into a background check system. biden's attorney said the diversion agreement was signed as it will be in effect and biden has and will continue to follow that agreement. the government says the agreement is null and void. back to attorney general merrick garland he will be feeling the fact that house republicans are back in action. he will appear before the house judiciary committee next week, a week from tomorrow. expect hunter to be a major

topic during hours of intense questioning. dana and bill. >> dana: thank you, david spunt. republicans have long enjoyed an advantage in the electoral college. believe me. because of past luck in key battleground states that decide the election. in 2016 he won the presidency even though he lost the popular vote. that edge is now fading. we want to talk about that, of course. let's start with that and we'll go to impeachment and everything else on our plate today. so democrats have been so frustrated how is it that we can win so much more in the popular vote and still lose the presidency? happened in 2000 and happened again if 2016. "new york times" in arguing the republicans, because they are growing in red areas but shrinking in blue areas, this is changing. do you see that? >> i agree. there is a migration of our party. we have red voters moving to red

states. florida and texas have added and blue and purple states are getting bluer and why i've made the case electorally we have to go through a blue or purple state to win the white house. i will say in 2022 we did win the popular vote and we would have won the electoral college. we were the top vote getter in new hampshire, georgia and arizona. republicans were the top vote getter in all three states. it bodes well for us heading to 2024. >> dana: which blue or purple state is the most gettable for republicans? >> wisconsin, pennsylvania. i would say michigan. we have a very competitive senate race there. this senate map. people aren't paying attention to the senate map. democrats have 23 seats up. we can flip the senate. we won't have a map like this for 12 years. this is our best chance to flip the senate. >> bill: would you put nevada and arizona. >> west virginia, ohio and montana. georgia won't have a senate race

but in the presidential georgia. >> bill: at the presidential level there are seven states that will likely determine. >> not just seven states but dial into key counties. this is where the ground game starts and why the rnc is in the states right now. we know it will come down presidency to 6 or 7 states. >> bill: "wall street journal" polling, who is too old to run for president was the question? the answer is this, joe biden at 73%, donald trump at 47%. another question. who is mentally up for the job, biden 36, trump 46. who has a vision for the future, joe biden 44, donald trump 52. what does that tell you in terms of strategy? >> i think biden has some real problems and we see it in the democrat party. there is a vacancy. i don't love the age. my mom is 80 and she could run the country. okay? my dad the same way. i just think you see biden go vacant. the lost stare.

it is concerning. anybody who has had family members who had the moments and he is the president of the united states is deeply concerning. i don't think people see that with donald trump or anybody on our side of the aisle. >> dana: do you see it with mitch mcconnell? >> he has had an illness. i talked to mitch the other day and he sounded as sharp as ever. i don't feel that way. >> bill: what about the future for the house. redistricting in certain states like alabama could reshape the future in the majority for control. what is your view? >> i agree. i don't think people pay attention to happening right now in the courts. you have north carolina that's potentially can pick up a couple seats. ohio. we just saw a ruling from the supreme court there and you look at wisconsin. you look at new york right now trying to redraw the maps. all this is happening now. the rnc is investing in all of this. but the house is key. and you have to hold california and new york. places where we had big gains in

2022. we need to not only keep the house but expand it. >> bill: go ahead. >> dana: before we lose her. they are trying to push us. the impeachment inquiry that house speaker mccarthy will push forward today. does it help republicans? >> i think kevin is right on. our voters are sick and tired of republicans getting attacked all the time through the courts or whatever and it's time to go after biden. when you see 22 llc funneling $20 million to 10 different biden family members while he is vice president. this is deeply concerning to our country and we need to get to the bottom of it. >> a certain percentage of republicans in america who don't like the vote the way that america now is voting and will vote in 2024. you have run the rnc. what are you doing actively to make sure that republicans understand the new rules in states where it applies? >> we have to vote early. why do i say this? we have launched back your vote

but i tell you why. if you vote every year, if i get your vote in the first voting day of the 45 day period it costs me a lot less money and frees up money so i can chase new and independent and swing voters. you have to bank your vote early. if there is a 45 day voting window vote the first day. you are a football fan. you don't wait until the fourth quarter to start scoring. if you have four quarters of a game you start scoring in the first quarter. the lions won. let's use them against kansas city. we have to play by the rules. >> dana: president trump last week even said your votes won't count necessarily when he was on in the town hall he said he was frustrated with what he saw in 2020 and if you look at georgia, in those runoffs, a lot of people didn't turn out to vote because they thought it wouldn't matter. >> trump has done a video for

the drive began ramming that vehicle that belonged to the city of l.a. at high speed. the suspect in custody with a lengthy criminal record. jonathan hunt is running it down live in l.a. jonathan. that was something. >> it really was. we've seen chases in l.a. this one was something else. the suspect had been on police radar earlier that day. stopped and cited for driving with a suspended license and detained for trespassing at a small airport. detained for traffic violations and after all that he stole a department of water and power truck and took off. when police finally cornered him, he did this. and that's when police first

>> dana: how do you think he defines success in his own mind? >> he has three great missions. as he said to me i read comic books. i was a lonely child. i would go to the corner of the bookstores and the super heroes saving humanity. one to have a space faring civilization. let's go to mars. two, get us into an era of sustainable energy with electric vehicles. single handedly he did the most to do that. let's make sure our robots, artificial intelligence is safe. those are the 3 missions that drive him. >> bill: you study your subjects before you write about them. you did that with steve jobs and maybe einstein. outside of the era. but when you study a man like him but then spend time with him, what surprised you? >> one of the things that

surprised me there is no one elon musk. sometimes you are with him he is giddy, happy, funny, sometimes focused on an engineering issue and can figure things out better than any of his engineers. how a valve should work. sometimes he gets into a dark brooding mode and something that happened to his father. it all goes back to the childhood. he has a father who was jekyll and hyde. go into dark modes and make elon stand in front of him and told him how stupid he was. you see that in elon musk. when he gets angry. but when that happens he gets things done. >> bill: what will he do next? >> i think he really -- he called me and it is the last part of the book about artificial intelligence. everybody is talking about the large language models chatbots fun. you have to integrate it with real world artificial intelligence. a robot or a car driving through the city street.

intertwined with the effort to get the finances figured out, the budget figured out. the fiscal cliff avoided by october 1st. today 3:00 p.m. the rules committee meets in the house to move the defense appropriation bill. there are people on the house freedom caucus who will hold a news conference at 3:00 p.m. at the same time looking add two trains on a track going toward each other about financing the house freedom caucus and others saying they need to cut the top line. need to cut out of the budget. the republicans some of them in the house but a lot of them in the senate say we have agreed to this. we need to move forward to avoid a shutdown. all of this is tied to the impeachment inquiry which politically may provide some cover for house speaker mccarthy but we'll see. >> dana: this is always a risk politically. i wonder if the white house thinks of this today as a lifeline perhaps, meaning that the numbers have been so bad do they think things will get worse because of this or will

democrats sort of figure out a way to get behind joe biden and hold him up even though so many of them in the polls are seeing are also saying we don't know if he is the best guy to run in 2024. >> that's true, dana. everybody is saying that, even democrats in their circles saying it does not seem like the president has the vitality, vigor to do four more years especially after what we saw in the vietnam news conference in hanoi. you have heard circles in democrats impeachment opens the door. you heard fetterman from pennsylvania who doesn't talk out much saying that go ahead, bring it on, because this is going to be something to see. and so it could fire up some democrats if this impeachment moves forward. the other problem is it could also find more things. >> bill: i mentioned mcgurn. roll this clip from last hour. some republicans think exactly what bill mcgurn is thinking on
