in "the faulkner focus." house republicans need 218 votes to proceed with an impeachment inquiry. there are 222 republicans in the house chamber. we know of at least five of them holding out. here is what has happened with the biden family to get us to this point. three separate gop-led committees are investigating allegations that hunter biden leveraged his father's government positions to secure big money foreign business deals. the key question, did president benefit? if so, by how much? here is former arkansas governor mike huckabee. >> they need to continue the methodical and ongoing investigation of these phony companies that the biden family created. the foreign money they got. but the inquiry is one thing. they should definitely conduct it. what they need to be careful about is going ahead with a full blown impeachment vote because once they do that, it goes to the senate and it dies in less

speaker of the house, there are five hold-outs in the house right now. where do you stand? >> harris, i don't know how much more evidence the american people need to see to warrant opening or frankly for my colleagues to see to open an impeachment inquiry. it is not a vote, it's inquiry that has greater standing in the courts. between whistleblowers, f.b.i. informants, allegations that both biden and hunter received millions of dollars in exchange for changing policy to fire a prosecutor, actual interview with the prosecutor saying he was fired in exchange for these monies, at a minimum i think we need to look at whether the taxes were paid on it, whether there was money laundering, whether there was illegal foreign lobbying and violation of farah. there is a lot of exposure here.

in addition to this emails and texts of oligarchs thanking hunter for time with his dad, of hunter saying my dad is sitting right here and you better pay up, look, there is so much smoke here that i certainly think it warrants a vote to get to the point to see if there is fire and to see if the person, vice president biden charged with policy over china, russia, and ukraine actually changed policy in exchange for this bribery scheme. >> harris: all of it really, if you just kind of narrow it down, comes to national security. was the former vice president via his son put in a capitulateing position where other countries, entities on the other side of the foreign business deals might be able to put pressure on him or expect to get something in return? that has to do with how safe we stay as a nation. depending who those people are. by the way you have ukraine,

china on that list. >> harris, i don't know -- i don't know a business person out there that doesn't expect something in exchange for millions of dollars. so what did they get for that money? and we know through these shell companies -- i don't know what government official or vice president of the united states needs dozens of dozens of shell companies registered in the name of their relatives. but we know the money went from these oligarchs and officials to these shell companies and out to biden family members. and we know that at least to some extent policy was affected, policy was changed and they happened to be from the same countries that biden was in charge of from a policy perspective. >> harris: there you go. that's a connection the american people really need to understand. since one of those countries on the list was ukraine and as i understand it also russia was on that list potentially as well.

with those two countries at war right now where does it put us and our president at the table to try to bring peace? have a lot of questions. i'm expecting the speaker to come out at any moment. they have been testing micks. we're getting close. the five republicans who don't agree there is enough evidence to move forward. representative don bacon, nebraska, ken buck, colorado, brian fitzpatrick, pennsylvania. french hill arkansas and mike lawlor in new york. what is it with the hold outs? >> the democrats and others will say there is nothing there. all about politics. if you look at the politics of it, president trump was at his highest approval rating during impeachment. clinton's was 60s. it is about getting to the bottom of whether we have the highest. >> harris: i understand why democrats don't want this. what about your party? >> this isn't nor should it be

about politics. history shows politics may if we don't do it the right way work against us. that's why biden is establishing an impeachment war room. this is about getting to the truth. about transparency. was there obstruction of justice and was at the highest levels of government an influence scheme that influenced american policies not just for new zealand or the unite ed kingdom or allied country but some of the most difficult and adversarial countries that the united states faces in the world. >> harris: i want to just take this a little broader now and recap if we can for our audience if you were just tuning in, representative mike waltz of florida has joined me as we are covering the breaking news now the house speaker, kevin mccarthy, is set to stand up and tell us exactly what he meant when he told fox news earlier today that they are at the point of the next logical step in the

movement toward an int inquiry into president joe biden. so with all of that said, what are the next logical steps and do you think at this point you can bring on board those five gop hold-outs? >> look, i think so. i would look forward to having the chairman jamie comer of oversight, jim jordan, chairman of judiciary, really lay out for the conference. there has been so much going on between i.r.s. whistleblowers, f.b.i. whistleblowers, the bank records. look, 160 suspicious activity reports from treasury. bank records we have of the llcs. once you lay it all out for folks we should go to the next step. what i want to get is the actual bank records of the bidens themselves, which they will fight in court.

he is putting together an impeachment war room. >> well i think he is sleeping literally. he just got back from a trip around the world and said he needed to go to bed. they are gearing up politically to fight this but it is an indication he knows that as vice president he likely engaged in behavior that was highly unethical. we know he lied to the american people about not having any knowledge of his son's business dealings and lied in a debate when he said his son didn't take millions from china. all of it has been contradicted by evidence. most of it coming from his son's business partners, not partisan republicans. but people within the biden family so to speak. so it's very serious. i have reservations about impeachment. i think impeachment is now turning into a vote of confidence in the president not a high crime or misdemeanor until we find further evidence

on joe biden. nancy pelosi is the one who created this situation. she is reaping what she sewed by impeaching donald trump twice and violating the rules of the south on one occasion. this is the revenge that nancy pelosi has set in motion and democrats should look to themselves why we have reached this point. >> harris: i don't use the word ironic very often but perhaps it fits here with nancy pelosi just, you know, days ago announcing that she at 83 will run for re-election. if the president is working on an impeachment war room. you have been in the white house and seen when things come together. walk me through the steps of the former twice house speaker then deciding at 83 years old with all the age conversation going on among voters and the leadership on the hill she decides to lean in i'll go for more. >> i think one of the hardest decisions in life is knowing when to walk away.

inquiry into president biden. and his actions via his son's business dealings when he was vice president. you see the two of them together on the bottom right of your screen. hunter beside his dead exiting down the steps of air force one. there are five hold-outs among republicans in the house who don't support an impeachment inquiry at this point. we're seeing movement on the bottom of the screen. i have with me congressman mike waltz, republican from florida. member of the intelligence committee, along with another committees. and now before i even go to you, gentlemen, the speaker of the house. >> we have a month where we were gone and in the weeks house republicans have uncovered serious and credible allegations into president biden's conduct. taken together, these allegations paint a picture of a culture of corruption. now here is what we know so far.

through our investigations we have found that president biden did lie to the american people about his own knowledge of his family's foreign business dealings. eyewitnesses have testified that the president joined on multiple phone calls and had multiple interactions, dinners, resulted in cars and millions of dollars into his son's and his son's business partners. we know that bank records show that nearly $20 million in payment were directed to the biden family members & associates through various shell companies. the treasury department alone has more than 150 transactions involving the biden family and other business associates that were flagged as suspicious activity by u.s. banks. even a trusted f.b.i. informant

has alleged a bribe to the biden family. biden used his official office to coordinate with hunter biden's business partners about hunter's role in burisma, the ukrainian energy company. finally, despite these serious allegations it appears the president's family has been offered special treatment by biden's own administration. treatment that not otherwise would have received if they were not related to the president. these are allegations of abuse of power, obstruction, corruption. they warrant further investigation by the house of representatives. that's why today i am directing our house committee to open a formal impeachment inquiry into

president joe biden. this logical next step will give our committees the full power to gather all the facts and answers for the american public. that's exactly what we want to know, the answers. i believe the president would want to answer these questions and allegations as well. this effort will be led by chairman james comer of the committee of oversight in coordination with chairman jim jordan and chairman jason smith on ways and means. i do not make this decision lightly. regardless of your party or who you voted for, these facts should concern all americans. the american people deserve to know that the public offices are not for sale. and that the federal government is not being used to cover up the actions of a politically associated family.

of our government. and the reason speaker mccarthy is putting chairman smith, who is the chairman of ways and means. he has oversight of i.r.s., jim jordan of judiciary oversight of d.o.j., and then jamie comer, which has oversight of basically everything else. it is not just president biden's involvement but was there a cover-up, which we're hearing from very credible whistleblowers from d.o.j. that was not allowing the i.r.s. to do the investigation that the american people deserved. so there are so many layers to this, i think ari is right. we'll move forward judiciously. responsibly and we will get to the truth. >> harris: just before mccarthy spoke, white house spokesman ian sams says this. opening impeachment despite 0 evidence is raw meat for the

extreme right wing so keep baselessly attacking him. ari, your reaction to that. >> the same advice i gave to the house i would give to the white house. that's a preposterous statement. we all know joe biden lied. why did he say he didn't have any knowledge of his son's businesses? why did he say his son did not take millions from china when we know he did? where is the white house press corps? it is on fire when i've been there and the press is on a feeding frenzy. will the press corps turn their guns on the white house and demand answers to why joe biden lied? or are they going to come to the aid of the white house and go against house republicans? the white house has some careful explaining to do, too. not about right wing meat. this is about the former vice president's behavior, now the president's behavior. >> harris: ari said previously congressman that this was powerful and strong. is this enough to bring along those five hold-outs among the

gop? they will take a vote after this trio of chairmen, comer, jordan and smith lay this all out, which is what you called for earlier this hour. is all of it enough to move those five? you will need them. >> look, i mean, i think the evidence already is overwhelming. i doubt that people have had the opportunity to actually read these suspicious activity reports. it's one thing -- i was a former business owner, to get one if you are doing overseas transactions, to get 160 when they see who all of these shell companies are registered to in the biden family, grandchildren that are receiving money? i think it is just common sense to say -- we're seeing this in polling now as well, not just republicans but independents and democrats saying it warrants taking the investigation to the next level.

>> harris: an illinois judge is now hearing arguments on whether disgraced actor jussie smollett should be ordered to go back behind bars. he was -- he never went to prison. he was let go after only six days be hand bars because he was going to appeal. he lost that. why didn't they put him back in jail? mike tobin is in chicago. that's the focus mike. >> the story that never happened but won't go ahead. his legal team is back in the illinois appeals court. this could be the difference between jussie smollett staying

out of jail or doing his sentence. they argue when kim foxx dropped the charges and then the special prosecutor dan webb was appointed essentially brought the charges back that jussie smollett is subject to double jeopardy. tough to remember all the twists and turns since 2019. kim foxx cook county state's attorney determined jussie smollett forfeited his $10,000 bond and did community service and dropped the indictment. then the special prosecutor was appointed in 2020. he brought back a six-count indictment against smollett. got convictions of disorderly conduct and lying to police. he was sentenced to 150 days in cook county jail. 30 months probation, $25,000 fine and had to pay back the city of chicago $120,106 restitution for money spent investigating the bogus hate crime. so far he has served a week of

that sentence. if you remember, he was led out of court fist in the air shouting he was innocent. not suicidal. if something happened to him it wasn't suicide. the defense said the conviction sets a dangerous precedent but giving prosecutors a second bite at the apple any time they are dissatisfied with the outcome. when kim foxx dropped the charges the special prosecutor left open the process for smollett to be charged again. the appeal is factually and legally unsupported. harris, back to you. >> harris: thank you very much. president biden's re-election campaign is dropping some big money on media ads. $25 million now to go to launching a spot in swing states. >> thanks to joe biden's inflation reduction act we double the number of good jobs in the next month or so. >> he is bringing manufacturing jobs back to america. >> harris: tell you this. the ad blitz is coming well ahead of the timetable his

as joe biden's numbers sink and as the questions about his age grow more serious, i think there is a greater opportunity that come the end of the year joe biden meets with the family over the christmas holidays and makes the decision not to run. that's by no means certain but it is absolutely possible and harris's numbers, as you suggest, are even weaker than joe biden's and they would give a great opportunity not only for the republicans at the presidential level but at the senatorial and congressional levels, too. >> harris: and they are even weak for kamala harris. she appears to be working on the black vote in the last few days. you've seen the dancing video celebrating 50 years of hip-hop. that's a lightness. not the heaviness for people of color but back drop video for her. they built her up this person will stand in at ground 0. i don't believe in coincidences.

and what happened to him? the whole team built around a possibility now of getting to the super bowl. well, really getting to the playoffs. new york jets fans expected it to happen. it started like this. aaron rodgers running onto the field with the american flag. and then this happened. >> time runs out. down goes rodgers in the sack. a loss of ten on the play and hopefully the jets are thinking that's the only loss on that play. >> harris: and a report now saying today an mri confirms aaron rodgers has torn his achilles tendon on that play. four plays into the game. had not even made one -- one completed pass. he went for one, he missed it. his season is over. rodgers 39 years old. serious questions whether his

hall of fame career really has come to an end. not just the season. >> he is 39 years old like you just mentioned. achilles injuries is not an easy one to bounce back from and there will be a lot of recovery that will be having to take place if he hopes to get back onto the field and play at the caliber that he was. here is the thing. he played the past 17 years in green bay. switched teams. come to new york. the hero the jets have been looking for. i feel for the jets. to be a jets fan, this is very appropriate this would happen. jet fans can't have nice things. but it is really sad. they are doomed for life. but rodgers came here hoping for a fresh start. he was bonding with his team. they had high hopes to where they could get the season. i just don't see him even if he does come back, having some incredible bounceback season and from there i don't see him resigning. to me it feels like it is over. >> harris: you know, a year, a season is a long time.
